779 July 13, 1993
1 . Chairman Phil Brower called to Order the Randolph
County Zoning Board of Adjustment meeting.
2 . Bill Dorsett made the motion, seconded by Lynden
Craven, to approve the Minutes of the June 8 , 1993
Randolph County Zoning Board of Adjustment meeting.
The motion passed unanimously.
3 . Swearing in of Witnesses:
Hal Johnson, Planning Director, requested that any
citizens present wishing to speak concerning this
Variance take an Oath of truthfulness . Johnson
administered the Oath.
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
There were approximately 8 people that took this Oath.

4 . VARIANCE:
GERALD BRASWELL, Asheboro, North Carolina, is
requesting a side setback variance from a public street
of 10 ft. in lieu of the required 35 ft. to construct a
site built home. Location: Poplar Lane (off
Sawyersville Road) , 1 acre lot size, Cedar Grove
Township, Zoning Map #7721 , Zoning District RR.
**Arguments for Granting Request
Braswell explained to the Board that this is corner lot
to a street in name only. The street has not been
developed but has a designated right-of-way. Braswell
stated that the proposed structure would be 100 ft.
from the existing street and 10-12 ft. from the
undeveloped street. Braswell said that the subdivision
was originally plat in the 60 ' s and the lot slopes down
to a creek in the rear. Braswell said that if his is
required to meet this setback, he will be unable to
install a gravity septic tank system (it would require
a pump septic tank system) .
**Arguments Against Granting Request
NOAH HATHAWAY, Adjoining Property Owner, stated that
there are 5 house beyond this lot and if the structure
is allowed to be close to the road it may hinder the
possibility of the State taking over road maintenance.
Hathaway presented the Board with a petition of
homeowners in opposition to this request.
RICHARD TROTTER, Adjoining Property Owner, questioned
the effect this would have on adjoining lots .
**Board Discussion: Conclusions based on Findings of
Fact
Bill Dorsett stated that there are several lots
(undeveloped) beyond this one and they would probably
require a Variance to develop them. Dorsett went on to
say that if this setback variance was approved it might
set a precedence.
Jim Routh expressed his opinion that since no houses
had been constructed on the undeveloped street he did
not see a problem with the house being in line with
other houses. Routh stated that being a builder he
understood the importance of trying to eliminate
mechanical septic tank systems when ever possible (due
to possibility of malfunctioning pumps and added
expense) and he felt that granting the Variance would
be in-keeping with the intent of the Ordinance.
1 . The Board found that a hardship was not a result
of the applicant' s own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found that the use will not
substantially injure the value of adjoining or
abutting property.
**Order of Board of Adjustment
Jim Routh made the motion, seconded by Lynden Craven,
to approve the request for a Variance based on the
Board' s Findings of Fact. The motion passed.
5. The meeting adjourned 7 : 15 p.m.
