041922 Megasite Easement
Special Meeting – April 19, 2022
The Randolph County Board of Commissioners met in special session at 5:00 p.m. in the 1909
Randolph County Historic Courthouse Meeting Room, 145 Worth Street, Asheboro, NC.
Chairman Darrell Frye, Vice-Chairman David Allen, Maxton McDowell, and Commissioner Hope
Haywood were present. Also present were County Manager Hal Johnson, Assistant County
Manager/Finance Officer Will Massie, Deputy Clerk to the Board Sarah Pack, and Clerk to the
Board Dana Crisco. The meeting was livestreamed on Facebook and YouTube. Commissioner
Kenny Kidd was absent.
Chairman Frye said the topic of the meeting needs to be addressed in a timely manner, which
is the reason for a special called meeting.
Consider Granting Easement
Kevin Franklin, Randolph County Economic Development Corporation (EDC) President, said
property at the Greensboro-Randolph Megasite has not been conveyed to Toyota yet. The new
site for the Duke Energy 525kv powerline has been identified. The Board will need to approve
the easement in order for Duke to relocate the powerline.
Chairman Frye noted that approximately fifteen parcels of land are affected by the relocation.
Vice-Chairman Allen asked when the construction of a new powerline will proceed once an
easement is approved. Mr. Franklin said construction of a new powerline would begin as soon as
possible.
On motion of Haywood, seconded by McDowell, the Board voted 4-0 to adopt a Resolution
Authorizing Randolph County to Grant an Easement to Duke Energy Carolinas, as follows:
A RESOLUTION AUTHORIZING RANDOLPH COUNTY TO
GRANT AN EASEMENT TO DUKE ENERGY CAROLINAS, LLC
WHEREAS, the Randolph County Board of Commissioners has received a
request from Duke Energy Carolinas, LLC (hereinafter “Duke Energy”) for the
easement attached hereto as Exhibit A and incorporated herein by reference, said
easement requested in order to facilitate the relocation of a 525 Kv line and
associated lines and equipment across property owned by Randolph County; and
WHEREAS, the relocation of said line is necessary for the use and development
of the property as part of a Megasite; and
WHEREAS, North Carolina General Statute §160A-273 gives the County the
authority to grant easements over, through, under or across any County property;
BE IT THEREFORE RESOLVED that the Randolph County Board of
Commissioners hereby grants the attached easement (Attachment A) to Duke
Energy Carolinas, LLC and authorizes the Chairman to sign the easement on behalf
of the County.
