BOARD OF COMMISSION
November 4, 1985
The Randolph County Board of Commissioners met in regular session at 2:00 p.m. on
November 4, 1985 in Courtroom B, County Courthouse, Asheboro, NC. Commissioners
Frye (Chairman), Langley, Davidson and Comer were present. Commissioner Petty
was absent. Invocation was given by Rev. Tim Strider of Clearview Baptist Church
in Cedar Falls.
On motion of Davidson, seconded by Comer, the minutes of the October 7 meet-
ing were approved.
A group of citizens from the Trinity area came before the Commissioners to
discuss and request help on a neighborhood sewage system problem. Their spokes-
person, Betsy McFadden, had contacted Darrell Frye earlier and he met with a
small number of this group a couple of weeks ago. Rev. James Ricks of Gray Road
told Commissioners their sewer lines had been in trouble for 15 years. Their
area cannot tolerate any more growth because of inadequate sewage systems. He
was recently denied a building permit to add a room onto his house because of
this problem. Charles Allen of Trinity Road stated that he has a commercial
building which he would like to expand, but that he can't under the present
sewage conditions. He asked the Board to help his group get some grant money
to finance a new sewage system. Joyce Gibson of Johnson Road also requested help
from the Board in obtaining grant money. She said land in their area won't perk
and that existing homes have swamps, mosquitos and a bad odor. She suggested the
possibility of having an engineer do a study to see what a new system would cost.
Betsy McFadden presented a petition with 156 names of those who could not be
present today. Francis White spoke in support of the concerns already expressed.
Gurnie Peace expressed concern that this problem may extend to a nearby school.
He mentioned the possibility of Archdale extending their sewer lines and allowing
this community to hook up to their system although Archdlae has a cap on the
number of gallons per day they can pump.
Chairman Frye informed the group that the County has no system available
and if it did get into providing sewer service, it would be 8-10 years before
citizens could be served. He suggested that the best solution would be for them
to hook up to Archdale's sewer system. Another alternative would be to set up a
water and sewer district and have a private system, but that would be very
expensive. Mr. Frye advised the Trinity group that state grant money the County
receives goes to the cities that already have existing systems and those cities
will decide how to spend their portion. The County would have to put to a vote of
the citizens whether the County would have a water or sewer system. Mr. Frye
suggested that the group appoint a subcommittee of three to meet with the Archdale
City Manager and the County Manager to explore their options.
James Sibert of Trinity stated that a preliminary hearing with Archdale's
City Council had indicated there is not much chance of their extending lines to
Trinity. He said, however, they would be willing to meet with the managers to see
if something can be worked out.
Billy Chilton, Tax Supervisor, gave an update on the Sophia and Coleridge -
Erect Fire Districts, which were formed in June, 1985. After the billings went
out, the fire department personnel helped the Tax Department find those property
owners in the fringe areas who had be missed in the billing. Second billings will
be going out to those people. Tomorrow notices will be sent out explaining that
their property or part of it was missed and that a bill will be issued within 10
days just for the fire tax.
Bill Ivey, Industrial Bond Attorney, came before the Board to request final
approval on industrial bonds for United Brass. On motion of Comer, seconded by
Langley, the Board gave final approval for United Brass. A copy of these procedings

Chairman Frye advised the Board that there is state grant money available
to counties and cities for the next two years. Randolph's share is $935,089
per year. The money can be spent for water and/or sewer projects and will be
50/50 matching funds. $270,549 (2970) goes to the cities; $664,540 (71%) goes
to the County. Mr. Frye noted that since the County does not have a water or
sewer system, its portion cannot be utilized unless it is re -allocated to the
cities. He suggested that the Randolph County Planning Board, County Manager
and Joe Hardee of Black & Veatch come up with recommendations on how the money
should be spent. The cities can address the Planning Board about their indi-
vidual projects. The Planning Board's recommendations will be reported to the
Commissioners early next year.
On motion of Davidson, seconded by Comer, the Board approved two D.O.T.
additions. Copies of resolutions included by reference.
Mr. Frye informed the Board that the New Market School Road which they had
approved for addition last month has not been added to the State Road System
because D.O.T. has been unable to obtain right-of-way.
Manager Frank Willis advised the Board of a parcel of property which the
County obtained through foreclosure on October 8, 1984. A citizen desires to
buy this parcel, which is located in Liberty. On motion of Langley, seconded
by Davidson, the Board adopted a resolution to accept a bid of $360 for this
property. The bid will be advertised in a newspaper of general circulation
so that others may have the opportunity to offer an upset bid. A copy of the
resolution is included by reference.
On motion of Comer, seconded by Langley, the Board proclaimed November 17-
23 Education Week in Randolph County. Copy of proclamation is included by
reference.
County Attorney Ed Gavin explained a new state law aimed at resolving
titles to mineral rights which have been reserved in some deeds to the grantors.
The law gives mineral rights owners two years to declare to the Register of
Deeds office their mineral rights. They must also list their mineral rights for
ad valorem taxes. If they fail to declare their mineral rights within the two-
year period, the present landowners will also take over the mineral rights. Mr.
Gavin suggested that the Board publish the state law (G.S. 1-42.9) in its
entirety once a week for 4 consecutive weeks. On motion of Langley, seconded by
Comer, the Board unanimously approved this recommendation from Mr. Gavin.
The Board briefly discussed Ramseur's offer of their old town hall. Mr.
Frye stated that he and Mr. Langley would continue to work on this issue and
the matter was tabled until the December meeting.
On motion of Davidson, seconded by Comer, the Board reappointed Addison
Penfield, Billie Vuncannon and Floyd Langley to the panel of Electors for the
Piedmont Health Systems Agency.
On motion of Langley, seconded by Comer, the Board appointed Dewey Coggins
as an outside member of the Archdale Planning Board.
Having no further business, the Board adjourned.

RESOLUTION
WHEREAS, Randolph County has in its possession .37 acres of property
from foreclosure in the Liberty Township; and
WHEREAS, the Randolph County Board of Commissioners have received
an offer of three hundred and sixty dollars ($360.00) for said property;
NOW, THEREFORE, BE IT RESOLVED that the Randolph County Board of
Commissioners proposes to accept the offer and that a 590' bid deposit be made
in the form of cash, cashier's check, certified check, or bid bond; and
that the bid deposit is forfeited if the bid is withdrawn;
BE IT FURTHER RESOLVED that a notice of the offer must be published
in a newspaper of general circulation and that the notice must contain a
general and accurate description of the property, the amount and terms of
the offer (including the 5 percent deposit requirement), and a statement
that within 10 days any person may raise the bid by not less than 10 per
cent of the first $1,000.00 and 5 percent of the remainder.
BE IT FURTHER RESOLVED that the purchase price be paid in cash upon
acceptance of bid and that the Randolph County Board of Commissioners
reserve the right to reject any and all offers at any time.
BE IT FURTHER RESOLVED that Patty Sykes, Purchasing Agent, shall
be the person to whom all bids are submitted.
