COMMISSIONERS MINUTES
December 2, 1985
The Randolph County Board of Commissioners met in regular session December 2, 1985,
at 2:30 p.m. in Courtroom B, County Courthouse, Asheboro, NC. Commissioners Frye
(Chairman), Langley, Davidson and Comer were present. Commissioner Petty was
absent. Invocation was given by Rev. Leroy Hunt, Grace United Methodist Church.
Carolyn Laws and Dan Shelton of Archdale Cable TV came before the Board to request
a 10% rate increase in their monthly base rate, effective February 1, 1986. This
would be a $.75 increase, raising the rate from $7.50 to $8.25 per month. They
also requested a waiver of the franchise ordinance's stipulation that they notify
in writing all subscribers of the proposed rate increase 60 days prior to the
proposed effective date. They asked that the 60 days be changed to 45 days. On
legal advice of the County Attorney, the Commissioners, without formal vote, denied
the request to waive the 60 -day notification period, changed the February 1, 1986
effective date to March 1, 1986, and set a public hearing for the Commissioners'
January 6, 1986 meeting in order to receive comments from the Archdale Cable TV
subscribers concerning the proposed rate increase. By law, if the Commissioners
do not approve the requested 10% increase, Archdale Cable TV can still raise the
rate as much as 5% each calendar year.
Bill Ivey, Industrial Bond Authority attorney, came before the Board to request
final approval on industrial revenue bonds for Dansen Contemporary. Charles Alt
of Dansen Contemporary answered questions concerning the company. On motion of
Langley, seconded by Comer, the Board gave final approval for industrial bonds for
Dansen Contemporary. Copy of these proceedings is included by reference.
Health Director George Elliott requested the allocation of two positions to the
Health Department in order to make use of expansion funds received from the state
for the Maternal and Child Health Program. Mr. Elliott noted that employees hired
for these two positions (Physician's Extender II, Grade 73; Medical Lab Technician
I, Grade 60) would be informed that their positions would be terminated if the
state discontinues the funds. On motion of Comer, seconded by Langley, the Board
approved the allocation of these two positions to the Health Department, contingent
on state funds to support the positions.
Mr. Elliott reported that the County made $7282 from the recent timber sales at the
landfill. He requested permission to use a portion of those funds to begin a pilot
project to study the survival and growth rate of trees planted over completed areas
of the landfill. Something needs to be planted over these sloping areas, he said,
to prevent further erosion. The Agriculture Department, N.C. Forestry Department,
and the Soil and Water Conservation Office are currently involved in mapping the
area and testing soil samples. Mr. Elliott recommended the planting of loblollies
and autumn olives over the affected areas. On motion of Davidson, seconded by
Comer, the Board approved setting aside $4,500 from the timber sales to be used to
set out trees on 30 acres of the used landfill area.
On motion of Comer, seconded by Langley, the Board unanimously approved a procla-
mation in honor of the retirement of Jewell Morgan. Copy included by reference.
On motion of Davidson, seconded by Comer, the Board unanimously approved the
addition of five roads to the state system. Copies of resolutions included by
reference.
Chairman Frye reported that he and Commissioner Langley have been studying the
issue of where to house an ambulance currently located in Ramseur's old town hall
building. When Ramseur offered that building to the County for $1.00, the County
did not want to commit itself to that building. Since that time, J.B. Brown Real
Estate Company, owned by Bill Brown and Mike Richardson, have made an offer to the
County on two acres they own west of Ramseur on Highway 64. They will build a

building to house our Ramseur -based ambulance and lease it to us, with the condition
that the County puts in a septic tank large enough to share with their building next-
door. An alternative option is that they will donate enough acreage for the County
to build its own building if we share the septic tank with them. Mr. Frye recommended
that Neil Allen, Emergency Services Director, come up with a building plan and the
specifications and then the Commissioners will study the two options, based on the
costs involved.
Perry Brady, Ramseur interested citizen, recommended the County consider an aluminum
building because of the insulation factor and the short length of time for construc-
tion.
County Manager Frank Willis gave an update on the Fair Labor Standards Act. On
November 13, President Reagan signed into law the Fair Labor Standards Act As
Amended In 1985. This new law does not totally exempt counties and cities; however,
we can give compensatory time off at the rate of 1� hours off for each overtime hour
worked, rather than having to pay for overtime work. Employees may accumulate up
to 180 hours, with the exception of public safety employees, who may accumulate up
to 480 hours. The County has no obligation for overtime worked in the past, and
the new law does not go into effect until April 15, 1986.
Tax Supervisor Billy Chilton gave a report on the 1986 personal property assessment
and farm present -use value assessment. Commissioner Langley stated that he didn't
think the County should begin garnishing wages on February 1 since some people
depend on their income tax refunds to pay taxes with. After some discussion, the
Board of Commissioners agreed to begin garnishing wages March 1 instead of February
1 of 1986 to see if there is a significant decrease in the number of garnishments.
On motion of Comer, seconded by Langley, the Board unanimously approved the
appointment of Ralph Hardison to the Library Board of Trustees.
On motion of Langley, seconded by Comer, the Board unanimously approved the
reappointment of Don Hancock, Bud Osborne, Ray Farlow and Tal Harrison to the
County Planning Board. They agreed to vote on an alternate member, to be added
from Commissioner Langley's area, at the January meeting.
On motion of Langley, seconded by Davidson, the Board unanimously approved the
reappointment of Doris Spencer and the appointment of Linda Gales to the Board
of Health.
On motion of Davidson, seconded by Comer, the Board unanimously approved the
reappointment of Randall Bowman, James Lloyd Blair, and R. H. Lassiter to the
Guil-Rand Fire District Commission.
Having no further business, the Board adjourned.
