MINUTES
April 7, 1986
The Randolph County Board of Commissioners met in regular session at 2:00 p.m.
on April 7, 1986 in Courtroom B, County Courthouse, Asheboro, NC. Commissioners
Frye, Langley, Davidson, Petty and Comer were present. Invocation was given by
Rev. Lee Cockerill of Neighbors Grove Wesleyan Church.
On motion of Davidson, seconded by Langley, the minutes of the February 27,
February 28, March 3 and March 24 meetings were approved.
Reynolds Neely of the Asheboro Planning Department came before the Board to
explain a request his department has received. A parcel of land on Highway 64 E
is for sale. The parcel is partially within the City's jurisdiction and partially
within the County's jurisdiction. The buyer would like for the County to relin-
quish its control over its portion of the parcel so that he may deal with only
one planning board in his re -zoning request.
On motion of Davidson, seconded by Comer, the Board adopted a resolution
relinquishing control of the parcel to the City of Asheboro. Copy of resolution
included by reference.
Dr. George Fleetwood, Superintendent of Randolph County Schools, requested
that $45,000 be transferred from their Current Expense budget to their Capital
Outlay budget for the purpose of replacing a portion of the Building A roof at
Randleman Middle School. As required by law, the Asheboro City Board of Education
has been notified ofthis request and they have not objected to the request.
On motion of Langley, seconded by Petty, the Board approved the transfer of
$45,000 to the Capital Outlay budget.
On motion of Petty, seconded by Comer, the Board agreed they were not
interested in purchasing a Live Project House offered by the Randolph County
Board of Education (property located on Klopman Mill Road, Ramseur). By law, the
County has first refusal on property school boards declare surplus to their needs.
On motion of Petty, seconded by Langley, the Board agreed they were not
interested in purchasing a parcel of land offered by the Asheboro City Board of
Education (property located at Park St. & Albemarle Rd., Asheboro). By law, the
County has first refusal on property school boards declare surplus to their needs.
On motion of Comer, seconded by Petty, the Board approved two additions to
the State System of Roads. Copies of resolutions included by reference.
On motion of Comer, seconded by Petty, the Board declared April 6-12, 1986
as Telecommznicators Week in Randolph County. Copy of proclamation included by
reference.
On motion of Petty, seconded by Comer, the Board declared April 14-18 as
Countywide Youth Week in Randolph County. Copy of proclamation included by
reference.

On motion of Davidson, seconded by Langley, the Board adjourned regular
session at 2:30 p.m. for a public hearing concerning industrial revenue bonds for
Associated Materials, Inc. Bob Quick, attorney representing the company, stated
that they will provide 50 ,jobs initially and about 100 at the end of 3 years.
They plan to pay in excess of the required manufacturing wage. The company does
not ,yet know which bank will purchase their bonds.

at 2:45 p.m. for a public hearing concerning industrial revenue bonds for Black &
Decker. Bob Quick, attorney representing the company, stated that the company is
requesting $1 million for purchasing new machinery and equipment which will save
125 jobs. They will continue to pay in excess of the manufacturing wage average.

On motion of Comer, seconded by Petty, the Board adopted a resolution approving
in principal $1 million of industrial revenue bonds for Black & Decker.

On motion of Petty, seconded by Comer, the Board approved the Randolph County
Travel Policy presented by Manager Frank Willis.
On motion of Comer, seconded by Petty, the Board approved changes in the
Personnel Ordinance, as presented by Manager Frank Willis.
Marion Smith, Director of Social Services, discussed the state Workfare program
as it relates to Randolph County. Food stamp and AFDC recipients could be required
to work off cash receipts, with some exceptions. They must work for a public or
non-profit organization. There are penalties for refusal to cooperate: Under AFDC,
Social Services would delete that person's portion; under Food Stamps, the entire
household becomes ineligible. We would have to pay up to $25 per month for travel
allowance. Recipients can spend work time in the classroom. Implementing such a
program would require two full-time social workers. The costs for the first year
of the program would be $40,000 - $45,000. Funding would be 50% federal, 25%
state, and 25% county.
On motion of Petty, seconded by Comer, the Board adopted a proposal by PTCOG
for planning and zoning work for the northern and northwestern sections of Randolph
County, authorizing the land use study now with the time frame for the remainder of
the work to be determined by the Board at a later time. Funding will come from
contingency funds, the balance to be encumbered in the 86-87 budget.
Frank Willis reported that the City of Randleman plans to build an addition to
their fire department for housing one of the County's ambulances. The common area
and kitchen will be shared with the fire department personnel. They will not charge
the County any rent, but we will pay a portion of utilities.
Mr. Willis stated that the contractor and architect are still working on
figures for the Ramseur ambulance base.
Chairman Frye related that Guil-Rand has purchased a new unit and our ambulance
can no longer be parked in their base. The County will have to make other arrange-
ments.
The Board discussed a request brought to them at their March 3, 1986 meeting
from the Eastside Community Association. It was the feeling of the Board that
funding this request would open the door to a deluge of similar funding requests.
Mr. Frye called for a motion on this matter and there was none. Action on this
request was prevented from lack of a motion.

On motion of Davidson, seconded by Langley, the Board approved a resolution
endorsing the efforts of the Eastside Community Association to establish a pre-
school day care center. Copy of resolution included by reference.
The Commissioners discussed the mobile home park ordinance under consideration.
Chairman Frye said that as a result of the Board's van tour of 21 parks the previous
week, their 2 primary concerns were for lot sizes and road conditions.
Bob Nelson, Highway Division, Department of Transportation, addressed the
issue of roads in mobile home parks. He said proper drainage is more important
than having a road paved. Twenty percent of the lots must be individually owned
before the roads could be state maintained. The County could hire a consulting
engineering firm to make sure park roads meet our standards or we could require
certification from an engineer before permits are issued.
Health Director George Elliott noted that 20,000 square feet is not an
adequate lot size for a well and septic tank because state law says there must be
100% repair area on the lot.
Jim Martin of Environmental Health requested that sketch plats turned in to
the Health Department have some sort of standard scale. He also requested some
regulations for garbage disposal in mobile home parks.
There was lengthy discussion concerning a permanent lot number identification
and the placement of the number.
There was discussion on the minimum number of mobile homes required to
constitute a park.
There was discussion on a 25 -foot setback from all property lines.
Chairman Frye instructed Frank Willis and Hal Johnson to rewrite the mobile
home park ordinance based on the discussions in today's meeting.
On motion of Davidson, seconded by Petty, the Board approved a budget amendment,
copy of which is included by reference.

WHEREAS, a parcel of land owned by Glenn F. Glass (Deed Book 215,
page 394 and Deed Book 248, page 177) is for sale; and
WHEREAS, said parcel is partially in the City of Asheboro's
extraterritorial jurisdiction and partially in the County of Randolph's
zoning jurisdiction; and
WHEREAS, the buyer of said parcel has requested the City of Asheboro
to take extraterritorial jurisdiction of the entire parcel so that the
buyer can work with one planning board;
NOW, THEREFORE, The County of Randolph does hereby relinquish control
over its portion of said parcel to the City of Asheboro.

old Central Elementary School in Asheboro; and

raised an additional $34,000 for renovations to the school gymnasium; and
WHEREAS, the Eastside Community Association is now seeking grant funds
to convert the school building into a pre-school day care center; and
WHEREAS, the Randolph County Board of Commissioners feels that the
Eastside Comnunity Association has achieved a prodigious goal and performed
a meritorius service for their community;
NOW, THEREFORE, BE IT RESOLVED that the Randolph County Board of
Commissioners publicly applaud the remarkable accomplishments of the

response capabilities of our communications systems through their leadership
and participation in training programs and other activities provided by the
Associated Public -Safety Communications Officers, Inc., (APCO); and
WHEREAS, these teleccmmunicators often work long and hard hours without
the proper recognition by the citizens of the United States and provide a
critical service needed by all citizens; and
WHEREAS, these professionals need and deserve the informed support of
our community to continually maintain and improve the quality of Public
Safety dispatching services; and

honor and recognize our nation's teleconT=ictors and the vital contributions

a portion of the Randleman Middle School roof:
NOW, THEREFORE, BE IT RESOLVED, that the Randolph County
Board of Education be authorized by the Randolph County Commissioners
to transfer up to $45,000.00 from the Current Expense Budget
originally designated for fuel oil to the Capital Outlay Budget
for the purpose of replacing a portion of the Randleman Middle
School roof. This roof replacement is an unforeseen expenditure
that grew out of an energy retrofit project jointly sponsored
by the Board of Education and the Department of Energy, North
Carolina State Department of Commerce.

ARTICLE III. THE PAY PLAN
Sections 1 - 7 will. remain as currently written
Section 8. Payroll Deductions
Federal and State income taxes, social security tax, life and health insurance
premiums and retirement contributions shall be deducted at each pay period from
each employee's pay as authorized by law and the County Commissioners. Any other
payroll deduction must be approved by the Board of Commissioners.
Section 9. Overtime
Overtime work shall be that work performed by an employee which either exceeds
the number of hours constituting the established workweek for the employee's
position or which is accomplished on an unscheduled workday.
Overtime opportunities will be distributed as equally as practicable among
employees in the same job class, department and shift regardless of age, sex,
race, color, creed, religion, national origin or physical handicap.
Supervisors shall arrange the work schedule of their sections so as to accomplish
the required work within the standard work period. Employees shall be required
to work overtime only in emergencies.
Employees may receive compensatory time off, in lieu of immediate overtime pay,
in cash, at a rate of one and one-half hours for each hour of overtime worked.
Compensatory time off in lieu of overtime cash compensation shall be granted by
the department head within a reasonable period after it is requested if to do
so would not unduly disrupt the operation of the department.
Accumulated compensatory time will be paid upon termination of employment and
shall be calculated at the average regular rate of pay for the final three years
of employment, or the final regular rate received by the employee, whichever is
higher.
The maximum number of hours that can be accumulated for regular, 40 -hour employees
is 240 (not more than 160 hours of actual overtime hours worked). Eligible
employees who qualify for the 7(k) exemption in the sheriff's Department and
Emergency Services Department can accumulate up to 480 (not more than 320 hours
of actual overtime hours worked).
Department heads will be responsible for administering their compensatory policies
by allowing employees to take accrued compensatory time in a timely manner so that
compensatory hours will not accrue to excessive levels. In situations in which
compensatory time off is not practical, employees will be paid in cash for over-
time; however, overtime cash compensation must be approved by the county manager.
Section 10. Fair Labor Standards Act
On November 13, 1985, the Fair Labor Standards Amendments of 1985 (Public Law 99-150)
were enacted. The legislation was enacted by Congress to soften the impact of the
Supreme Court ruling in the Garcia v. San Antonio Metropolitan Transit Authority,
which held that the Fair Labor Standards Act was fully applicable to county government.
Randolph County shall comply with this legislation effective April 15, 1986.
This legislation is enforced by the U.S. Department of Labor. Certain policies,
as set forth in Appendix D, are hereby adopted to establish work periods and
other rules required for the implementation of this legislation.
