Commissioners Frye, Langley, Davidson, Petty and Comer were present. Mr. Jay Hobbs, Rector of Good Shepherd Episcopal Church in Asheboro, offered invocation. On motion of Davidson, seconded by Comer, the minutes of the April 6, 1987 meeting were approved. The joint meeting with Department of Transportation was deleted from the agenda. They will be present at the June meeting to present their Secondary Road Construction Program. Citizens present were invited to return at 2:00 p.m. on June 1 for this item. Chairman Frye explained that there was a mix-up about the date D.O.T. representatives were to appear. Release of County Zoning Jurisdiction to City of Asheboro Hal Johnson, Planning Director, told the Board that the City of Asheboro has extended its extra -territorial zoning from one mile to two miles and has requested that the County relinquish its zoning jurisdiction in the area where this extra mile overlaps the County's Zoo Zoning District. Mr. Johnson noted that Asheboro's zoning designation is compatible with the County's and that he sees no problem with releasing the jurisdiction. (Re: Asheboro Zoning Map dated March 2, 1987) On motion of Davidson, seconded by Langley, the Board agreed to relinquish zoning jurisdiction to the City of Asheboro in the area where the City's extra- territorial zoning overlaps with the County's zoned area, effective May 5, 1987. Land Development Plan: Current Status Hal Johnson gave an update on land use planning. The Planning Board will meet May 6 to make final recommendations on the unified ordinance being prepared by PTCOG. PTCOG has completed the land development studv and will have the maps ready before the end of May. Mr. Johnson recommended additional community meetings for the areas of the county that PTCOG has just completed work on. He suggested the following schedule: May 28 - Joint Meeting of Planning Board and County Commissioners (Planning Board will present their final recommendations on the unified land development ordinance) June 9 - Community Meeting at Coleridge Fire Department (Receive input from area residents concerning countywide zoning and land use planning) June 11 - Community Meeting at Seagrove School (Receive input from area residents concerning countywide zoning and land use planning) July 6 - Final Public Hearing at County Commissioners' regular monthly meeting. The Board felt an additional community meeting for the Ramseur/Franklinville area was needed. Mr. Johnson suggested June 16 for that meeting, to be held at Ramseur School. On motion of Davidson, seconded by Langley, the Board adopted the above schedule, with the addition of the Ramseur community meeting. Commissioners Minutes May 4, 1987 Page 2 Planning and Zoning Staffing Needs Hal Johnson presented a request for additional personnel for his department. He explained that the County is expanding in the areas of planning and zoning, will be enforcing more ordinances and will be involved in such projects as naming the roads in the county. In order to carry out these expanded responsibilities, additional personnel will be required. Mr. Johnson requested two Property Development Technician -positions (Salary Grade 62) effective June 1, 1987. These technicians will, on a daily basis, review applications for zoning permits and ensure compliance with all land use regulations. A June 1 hiring date would allow a one-month training period before countywide zoning could be enacted in July. Mr. Johnson's other requests included upgrading the current Zoning Technician to Deputy Zoning Administrator and adding the positions of Secretary V and Planner July 1. On motion of Langley, seconded by Comer, the Board approved the addition of two Property Development Technicians (Salary Grade 62), to be effective June 1, 1987. Jimmy Ward, citizen present, spoke in support of adequate training and personnel for zoning enforcement. Mapping Program Plan and Staffing Needs Billy Chilton, Tax Supervisor, gave an update on the mapping project currently underway with Black & Veatch. It is estimated that it will take Black & Veatch four more years to complete the project. By using County personnel to enter data on the computer on 277 assembled map sheets and the data on the 393 drafted sheets, the project could be completed in two years. Three additional data entry operators and a reap editor and supervisor would be needed. The amount charged by Black & Veatch would be reduced in an amount that would be sufficient to pay County personnel for data entry. An additional digitizer at a cost of $6,950.00 would be needed. The positions would be as follows: Three Data Entry Operator IV's (Salary Grade 59) and one Map Editor and Supervisor (Salary Grade 60). Fringe benefits include health insurance, paid holidays (if they worked the day before and after the holiday), no vacation the first twelve months, but beginning with the thirteenth month, vacation would accrue at the rate of four hours per month. On motion of Comer, seconded by Davidson, the Board approved the addition of four temporary positions (3 Data Entry Operator IV's and 1 Map Editor & Super- visor) until the mapping program is completed, which is estimated to take two years, and approved fringe benefits as outlined above, effective May 4, 1987. Cable TV Ordinance Alice Dawson, Clerk to the Board, advised the Commissioners that she, County Attorney Ed Gavin, and County Manager Frank Willis, with input from representa- tives from ATC and Alert cable companies, had drafted a regulatory ordinance for cable television which is satisfactory to everyone with the exception of two statements in the draft. These two statements were Section 9(b), dealing with the sale and service of TV's and radios, and Section 13(h), requiring a county office to be maintained by any Cable TV franchisee. On motion of Langley, seconded by Petty, the Board voted to delete Section 9(b) from the proposed ordinance. On motion of Langley, seconded by Comer, the Board voted to delete Section 13(h) from the proposed ordinance. On motion of Petty, seconded by Comer, the Board repealed the existing regula- tory Cable TV ordinance. On motion of Langley, seconded by Davidson, the Board adopted the proposed Cable TV ordinance, with the deletions mentioned in above motions. A copy of the ordinance is included by reference. Commissioners Minutes May 4, 1987 Page 3 The Board gave Alert Cable TV and ATC opportunity to present their plans for serving the northern portions of the county. Frank Kivett, Greensboro manager for Alert Cable TV, stated that his company could serve the petitioned areas (3 mobile home parks in Randolph adjacent to the Guilford County line) within 90 days of receiving a franchise. The service includes 27 basic channels and at least one premium channel available. He distributed a schedule of channel selections and rates for service. He explained that his existing cable in Guilford County is only 400 feet away from areas requesting service in Randolph County. Alert has some 15,000 subscribers in Guilford County. Dan Shelton, Vice -President for Public Affairs for ATC, stated that ATC is in the process of planning 35 miles additional cable line into the Randleman -Level Cross area, passing some 1200 homes, including the three mobile home parks petitioning service. He could not provide a time framework within which this work could be done, but estimated 120 days. Mr. Shelton expressed concern over the deletion of Section 13(h) from the newly adopted Cable TV ordinance. He also said that ATC does not know if and when they will apply for a franchise under the new ordinance. Their current franchise allows them to operate in the areas in question. Mr. Kivett presented a franchise application to the Board and asked for a first reading on it then. Chairman Frye stated that it would be inappropriate to act on such an application until the attorney and administrative staff could study it. He directed this item to be placed on the June agenda. Re -zoning Public Hearing On motion of Langley, seconded by Petty, the Board adjourned to a public hearing on a re -zoning request, advertised for 4:00 p.m. Hal Johnson informed the Board that Richard Bruning, Pleasant Garden, NC, is requesting that approximately 10 acres located on the southwest corner of I-85 on Finch Farm Road (SR 1547), Trinity Township, Zoning Map 1-2, be rezoned from Residential Agricultural to Highway Commercial -Conditional Use. It is the desire of the applicant to locate a self-service gasoline station and convenience store. The Planning Board recommended the request be approved. Chairman Frye questioned Mr. Bruning extensively any possible extension of industrial or commercial activity on Finch Farm Road and Mr. Bruning's connection with it. Mr. Bruning assured the Board that at this point in time he is not connected with any industrial or commercial expansion on Finch Farm Road other than the tract he is requesting to be rezoned today. He did say, however, that at some point in the future he would like to be connected to a larger industrial or commercial development in the area. No one else spoke for or against the rezoning request. The public hearing was closed. On motion of Davidson, seconded by Comer, the Board approved this rezoning request. Flood Plain Ordinance On motion of Petty, seconded by Comer, the Board adjourned to a public hearing concerning a new flood plain ordinance, advertised for 4:00 p.m. Hal Johnson advised the Board that the proposed flood plain ordinance, which would replace an existing one, is a model ordinance recommended by the federal government. Adoption of this ordinance would allow Randolph County residents building in a flood plain to be eligible for flood insurance. No one spoke in favor of or against this ordinance. The public hearing was closed. Commissioners Minutes May 4, 1987 Page 4 On motion of Langley, seconded by Petty, the Board repealed the existing flood plain ordinance of 1981 and adopted the proposed flood plain ordinance as presented. Requests On motion of Petty, seconded by Davidson, the Board approved abandonment of 0.46 mile of old roadway on SR 2100 and approved the addition of a new section of SR 2100 created by realignment. A copy of the resolution is included by reference. On motion of Comer, seconded by Petty, the Board approved the addition of Sussex Trail in the Canterbury Trails Subdivision. A copy of the resolution is included by reference. Proclamation: Mental Health Month On motion of Davidson, seconded by Langley, the Board adopted a proclamation declaring May as Mental Health Month. A copy of the proclamation is included by reference. Proclamation: Salvation Army Week On motion of Davidson, seconded by Comer, the Board adopted a proclamation declaring May 11-17 Salvation Army Week. A copy of the proclamation is included by reference. Appointments: Climax Fire Protection District Commission On motion of Petty, seconded by Comer, the Board approved the reappointment of Frank Fields, Daniel Brown, and George Gregson to the Climax Fire Protection District Commission. Appointments: Julian Fire Protection District Commission On motion of Langley, seconded by Petty, the Board approved the reappointment of Glenn Gilmore, William Collier, and Pearl Shepard to the Julian Fire Protection District Commission. Appointments: Nursing and Rest Home Advisory Cc mittee On motion of Comer, seconded by Petty, the Board approved the appointment of Joane Peterson and Bea Cole to initial one-year terms on the Nursing and Rest Home Adivsory Committee. This leaves one vacancy. Commissioners are to present any nominees for this vacancy at the June 1 meeting. Appointments: Randolph County Plann-- ing Board On motion of Petty, seconded by Comer, the Board appponted Bill Dorsett of Randleman as an alternate member on the Randolph County Planning Board. Appontments: Social Services Board On motion of Langley, seconded by Comer, the Board reappointed Commissioner Kenyon Davidson as their representative on the Social Services Board. Budget Amendments On motion of Petty, seconded by Comer, the Board approved three budget amendments. A copy of the budget amendments is included by reference. Commissioners Minutes May 4, 1987 Page 5 Ordinance Regulating Private SwiIIming Pools Commissioner Davidson noted that he has received calls from citizens concerning an ordinance which would regulate private swimming pools by requiring fences around them. Hal Johnson was directed to check into this matter. Mobile Home Park Moratorium Jimmy Ward, mobile hone park developer, asked for clarification on the mobile home park moratorium relative to a plat he turned in to the Health Department last year. At that time he had not received soil evaluations on 9 lots. Chairman Frye told Mr. Ward that no septic tank permits could be approved during the moratorium. Adjournment The meeting adjourned until 7:00 p.m. Special Meeting, 7:00 p.m., May 4, 1987 County Manager Frank Willis reported where the County is in the areas of control, management and planning. He indicated that his emphasis in the next year will be involvement in a result -oriented management system, a countywide systems analysis, and a capital improvements program. He mentioned problems which must be addressed in the immediate future, including the need for a new jail, schools' capital needs, and county office space. He then answered questions posed by the Board.
