BOARD OF COMMISSIONERS
RANDOLPH COUNTY
September 6,1983
The Randolph County Board of Commissioners met in regular session on September
6, 1983, at 2:00 p.m. in Courtroom B of trhe Randolph County -Courthouse, Ashe-
boro, NC. Present for the -meeting were Chairman Bill Boyd, Richard Pugh,
Richard Petty, Darrell Frye, and Floyd Langley.
Invocation was given by Bill Boyd.
On motion of Darrell Frye, seconded by Richard Pugh, the Commissioners unani-
mously approved the minutes of the August 1, 1983 meeting.
On motion of Floyd Langley, seconded by Darrell Frye, -the Commissioners unani-
mously approved a -renewal -contract between Guilford County and Randolph County
for the Julian Fire Protection District.
On motion of Richard Pugh, -seconded by Darrell Frye, the Board of Commissioners
unanimously proclaimed September 18-24 Emergency Medical Services Week in
Randolph County. A copy of this resolution is included by reference.
Bill Black, Chief of the Westside Fire District, came before the Board to
request an annexation to the Westside Fire District. An acre of land -in the
proposed annexed area has been --donated to Westside for the purpose of putting -a
fire station on it. The proposed annexation does not touch the existing fire
district, and the- Commissioners voiced their concerns that the people -living
between the existing and proposed areas would be paying fire district tax, but
would -not receive an insurance rate reduction since they are living outside the
four -mile limit. On motion of Richard Pugh, seconded by Richard Petty, the
Commissioners unanimously -voted to connect the two extreme -western points and
the two extreme eastern- points of the proposed and existing districts so that
the two areas touch, to require 2/3 of -the property owners in the middle (out-
side the insurance reduction area) to sign a statement agreeing to the fire
district tax without an insurance reduction, and to require signatures of 2/3
of the property owners in the proposed annexed area agreeing to the annexation.
Approval of the annexation as amended will be withheld until representatives
from the Westside Fire Department obtain the necessary signatures and have them
verified by the Randolph County Tax Department.
On -motion of Darrell Frye, seconded by Richard Petty, the Commissioners unani-
mously -voted -to go into a scheduled public hearing for the renaming -of -a street
and for a rezoning request. Minutes for this hearing are recorded separately.
On motion of Richard Petty, seconded by Floyd Langley, the -Commissioners unani-
mously voted to change the name of Single Tree Lane to Cedar Trail.
On -motion --of Darrell Frye, -seconded by Richard -Petty, the Commissioners -unani-
mously approved the rezoning request of Mr. Russell Hoffman, subject to the
restrictions placed by the Randolph County Planning Board.
On motion of Richard Pugh, seconded by Floyd Langley, the -Commissioners unani-
mously athorized the County Manager to dispose of three scrap ambulance
chassis.
George Beck of Union Carbide came before the Board with an offer to purchase
five to six acres in the southwest corner of the Randolph County landfill for

the purpose of disposing of Union Carbide waste batteries. The offer was for
cash in the amount of -$325 per acre-. George Elliott, Health Director, informed
the Commissioners that the State has said the batteries must be disposed of at
the highest point and that a portion -of the -site in question -is down the slope
near the dike and -has been cleared already, which means the County has invested
money in this portion. Mr. Elliott felt that the plat needs -to be- revised to
eliminate -the low sites because of -possible battery leakage. On motion of
Richard Pugh, seconded by Richard Petty, -the Commissioners tentatively accepted
the proposal of Union Carbide to -purchase not less than 5 acres and up -to 6
acres -on the southwest section of the Randolph County landfill at the price of
$325 per acre, such to be advertised through negotiated offer -and advertised
bid.- As- required- by General Statutes, the purchase will include easement to
the property through the all-weather road at the landfill.
Bob Crumley reported on the Leonard vs. Mason, et -al case, in which Sheriff
Mason, Deputy John Chilton, the- County of Randolph, and Gene Bumgarner are
being sued by Jerry and Doris -Leonard-.- In 1980, the Sheriff was authorized to
serve an -eviction— notice to the Leonards, and Gene Bumgarner -provided the
storage trailer -in which the Leonards' household belongings were stored. Since
the County's liability insurance policy does not cover Mr-. Bumgarner, and since
he was acting at the request of the Sheriff's Department, he is asking the
County to assist -him -in paying legal fees for this lawsuit. On motion of
Richard Pugh, seconded by Richard Petty, the Commissioners unanimously voted to
provide local legal counsel to represent Mr. Bumgarner, fees to be discussed
with our County attorney.
Mr. R. L. Casey, -general contractor for the Willie M group home, asked the
Commissioners for a change order in the amount of $3,400 for -installing water
and sewer lines up to the house.- Mr. Casey stated that this job is ordinarily
under the plumbing contract and that -he -didn't realize he would be -responsible
for water and sewer -lines when he submitted his bid. Larry Austin, architect
for the Willie M project -,-stated that he had a mandate from the City of Ashe-
boro that the plumber not install these lines and that the contract clearly
stated that this job -would be the general contractor's responsibility. -On
motion of Floyd -Langley, -seconded by Darrell Frye, the Commissioners unanimous-
ly denied Mr. Casey's request.
Bob Crumley reported that the State has tested the air in the -McDowell Complex
for formaldehyde and has found formaldehyde levels from .044 to .224 -parts per
million. George -Elliott, Health Director, presented his recommendations for
dealing with the problem.
The Commissioners discussed an upcoming Chamber of Commerce seminar to be held
at Myrtle Beach November 11 -and 12. On motion of Richard Pugh, seconded by
Floyd Langley, the Commissioners approved the meeting.
On motion of Richard Pugh, seconded by Darrell Frye, the Commissioners -unani-
mously authorized the County Manager to dispose of -a car held -by -the Sheriff's
Department. The car was confiscated ina drug-related case and -the -Sheriff has
received a court order to sell it. -The money -from the sale will go to the
County Schools. A copy of this resolution is included by reference.
Bob Crumley presented seven requests for new or reclassified positions within
the County.- On--motion-of Richard Pugh, seconded by Floyd Langley, the Commis-
sioners unanimously --approved all -positions except the one for Administrative
Officer I for the Mental Health Department.
Marion Smith, Social Services Director, informed the Board that North Carolina
has received an additional $1.000.000 for the AFDC Drogram. Randolnh Countv's

share is $6,070.- Mr. -Smith -asked -for permission to convert one of the current
AFDC workers -to a -fraud investigator and -to hire another eligibility specialist
with these new funds. On motion of Richard Pugh, seconded by -Darrell Frye, the
Commissioners unanimously approved a full-time temporary fraud worker as part
of a pilot program to end June 30, 1984.
On motion of Richard Pugh, seconded by Darrell Frye, the Commissioners unani-
mously set their next meeting date,for October 10 at 2:00 p.m.
Talmadge Baker, County Agriculture Extension Agent, informed the -Board that
Randolph County -has lost from 50-70% of most of its crops this -summer. He
plans to submit these -figures to the State Emergency Board -and needs a letter
from the Commissioners saying -that Randolph County requests disaster relief due
to the drought.- -On motion of -Darrell Frye, seconded by Richard Pugh, the
Commissioners authorized the County Manager to draft such a letter.
On -motion of Richard Pugh, seconded by Richard Petty, the Commissioners unani-
mously appointed Grady King to the Nursing and Rest Home Advisory Board.
On motion of Floyd Langley, seconded by Darrell Frye, the Commissioners unani-
mously appointed Dean Bailey and Pressley Barnette to the Mental Health Board.
On motion of Richard Pugh, seconded by Darrell Frye, the Commissioners unani-
mously appointed -the following to the Public Health Systems Agency: Floyd
Langley (Commissioner), Ad Penfield (Consumer), and Billie Vuncannon
(Provider.)
Bob Crumley informed the --Commissioners that the memorandum of agreement with
JRA Industries and the City of Asheboro -has been signed and is ready to be put
on record in the Register of Deeds Office.
On motion of Richard Petty, seconded by Floyd Langley, the Commissioners -unani-
mously authorized the Chairman of the Board to sign an agreement with Southern
Railway for running -water/sewer- -lines under railroad tracks to -the Goodyear
site. Southern Railway will require $50 for borings under the tracks.
The -Commissioners discussed convalescent -calls made by the Emergency Services
Department -and the -possibility of contracting with an individual to provide
this service. On motion of Richard Pugh, seconded by Darrell Frye, the Commis-
sioners recommended that between now and the first of the year the Commission-
ers make a specific recommendation for the future.
Bob Crumley made- a -presentation of- the Merit Pay Committee's proposals for
implementing longevity and merit increases. Merit Pay Committee -members George
Elliott, Marion Smith, and Talmadge Baker --also spoke in support of --the
presentation. The Commissioners took no action on this matter, deciding to
study it further.
Bob Crumley related to the Board a request from the Randolph County - Fire
Association that ---the County and the Fire Association- jointly- purchase- a
computer to be used by the Fire Marshal, Emergency Services, and the Fire
Association On motion of Richard -Pugh, seconded by Darrell Frye, the
Commissioners voted to table this matter.
Darrell -Frye -and -Bob Crumley gave a report from -the Water/Sewer Committee.- The
committee recommends that a task force be organized by the Commissioners to
provide a proposal for a unified and consistent county water resource policy.
The task force would investigate future water resources, the County's role in

water and/or- sewer lines to particular industries and water receipts. On
motion ---of Richard Pugh -,-seconded by Richard -Petty, the Commissioners unanimous-
ly -approved -a-resolution to adopt a task force. A copy of this resolution is
included by reference.
George Elliott, Health Director, informed the Board that it is uncertain how
much of the remaining -land in the county landfill is usable. -Soil -Testing
Services (STS) -of Raleigh and Moore/Gardner -of- Asheboro -have submitted
proposals for -investigating landfill -expansion areas. On —motion of Richard
Pugh, -seconded by -Darrell Frye, the Commissioners -unanimously voted to accept
STS's proposal.---It-'was felt that since Randolph County has -contracted with -STS
for several years and STS is thoroughly -familiar with the -area and the staff,
that it would be advisable to contract with them for this project, also.
On motion of Richard Petty, seconded by -Floyd Langley, the Commissioners unani-
mously- approved two budget -amendments presented by Frank Willis. Copies of
these amendments are included by reference. r
On -motion -of Richard Petty, seconded by Richard Pugh, the Commissioners unani-
mously agreed to pay Guilford County $135.46 for transporting a Randolph County
patient to Dorthea Dix.
Frank Willis informed the Commissioners that Marion Smith, Director of Social
Services, -has-, in the past, been- designated Deputy Finance Officer so that he
would be authorized -to sign checks. Now that all accounting is centralized in
the Finance Office and Mr. -Smith no --longer signs checks, there is no -need for
him -to hold this title. The County would save $150 each year in bonding fee by
rescinding -this title-. -On motion of -Richard Pugh, seconded- by -Darrell Frye,
the -Commissioners unanimously voted to rescind the title of Deputy Finance
Officer for Marion Smith.
Frank Willis presented a request from the Health Department that they be al-
lowed to keep up to $250 in receipts on hand beforehavingto make a -deposit.
On motion of Richard -Pugh, seconded by Floyd Langley, the Commissioners unani-
mously voted to allow this request.
Bill Boyd noted that Randolph County had received an excellent rating on the
recent jail inspection by the State.
On mot -ion of Richard Pugh, seconded by Richard Petty, the Commissioners voted
to adjourn.

RESOLUTION
WHEREAS, the Emergency Medical Services System in North Carolina provides
life-saving medical care to thousands of its citizens annually; and -
WHEREAS, thousands of emergency medical technicians, paramedics, emergency
department physicians and nurses have completed extensive and diversified
training in emergency medical procedures; and
WHEREAS, a large portion of our citizens have been trained in cardio-
pulminary resuscitation in order to help fellow citizens in time of need;
and
WHEREAS, concerned citizens and elected officials are serving on regional
emergency medical services councils throughout the state to further guide
the local development of a comprehensive emergency medical care system; and
WHEREAS, a large number of these individuals volunteer their time to provide
this valuable service; and
WHEREAS, vast improvements in emergency medical services have been made in
this state during the past ten years; and
WHEREAS, recognition is due those who serve on behalf of all North
Carolinians;
NOW, THEREFORE, I, William T. Boyd, Chairman of the Board of Commissioners
of Randolph County, do hereby proclaim the week of September 18-24, 1983 as
EMERGENCY MEDICAL SERVICES WEEK
in Randolph County and commend this observance to our citizens.

The Randolph County Board of Commissioners held a scheduled Public
Hearing at 2:30 p.m. on September 6, 1983, in Courtroom B of the Randolph
County Courthouse, Asheboro, NC.
Chairman Bill Boyd asked if anyone were present who wished to speak
on the issue of renaming Single Tree Lane to the proposed name of Cedar
Trail. No one spoke.
Next, Chairman Boyd recognized Hal Johnson, Director of Property
Development. Mr. Johnson presented a re -zoning request from Mr. Russell
Hoffman of High Point to convert a chicken house into a light furniture
frame manufacturing business. Chairman Boyd asked if anyone else present
wished to speak concerning this request. Mr. Hoffman spoke, saying that
he has 16 years of experience in the furniture business in a residential
section and has never had any problems.
On motion of Floyd Langley, seconded by Richard Pugh, the Commissioners
adjourned the Public Hearing.
