080789RANDOLPH COUNTY BOARD OF COMMISSIONERS MINUTES August 7, 1989 The Randolph County Board of Commissioners met in regular session at 2:00 p.m. on August 7, 1989 in Courtroom B, County Courthouse, Asheboro, NC. Commissioners Frye, Langley, Davidson, Petty and Comer were present. Invocation was given by Rev. Ronald Hester of Clearview Baptist Church, Franklinville. On motion of Petty, seconded by Comer, the Board approved the minutes of the July 10 and 31 meetings. Petition to Pave SR 1925 Roy Frazier presented a petition from members of the Ebenezer United Methodist Church on SR 1925 requesting that this road be paved. Mr. Frazier stated that his mother, Mrs. Clara Frazier, owned all the property along this road and that obtaining right-of-way would be no problem. Chairman Frye advised Mr. Frazier that the Board would forward the petition to the NC Department of Transportation so they can investigate the request. rahl nXri c4 n*, D.K. McLaughlin of Cablevision informed the Board that their annual franchise fee check recently submitted to the County totals $48,235.59. He noted that this is a significant increase from their first annual check of $2000 several years ago. Mr. McLaughlin reported that the Seagrove area now has activated cable, as well as Old Farmer Road, the Cedar Square and Glenola areas, and spurs off 220 South. He said 60 miles of cable have already been built this year and that they plan to build 20-25 more. CBA Programs Update Dennis Redding, President of the CBA Task Force in Randolph County, gave an overview of the 4 CBA programs currently funded in this county (2 In -School, 1 Day Camp, 1 Court Counseling Incentive Program). On motion of Davidson, seconded by Langley, the Board approved Budget Amendment #2 to accept $138,623 CBA funds from the State. A copy of this budget amendment is included by reference. Position Reclassification - Health Devartment George Elliott, Health Director, requested that the Board reclassify the Community Health Assistant position.allocated July 1, 1989 to an LPN position. He stated that with ongoing problems of recruiting RN's (4 current RN vacancies), an LPN can be trained to perform many of the duties heretofore carried out by RN's in the Home Health Program. He noted that he has funds to support this position from lapsed salaries. On motion of Comer, seconded by Petty, the Board approved the requested reclassification from Community Health Assistant to LPN. 8/7/89 Minutes Page 2 Dumpster Program Update Mr. Elliott reported that the Farmer and Coleridge dumpster sites are operating successfully after one month of having guards and compactors at the sites. He did report that there is a problem resulting from the compacting of the garbage --the liquid squeezed out during this process creates a terrible smell. He stated that there has not been a problem with illegal dumping at the dumpster sites at Seagrove and Melancton. Animal Cruelty Investigator Major Larry Emerson explained that under current state law, any citizen can go to a magistrate and seek a criminal warrant against any individual for cruelty to animals. However, this citizen could not take possession of the animal until after a conviction in court and an order for siezure from the judge. If the Commissioners appoint an animal cruelty investigator, there is a special statute which allows him to go before.a magistrate and swear to a situation of animal cruelty. If the magistrate finds probable cause, the magistrate issues an order authorizing the investigator to take immediate custody of the animals and to provide for their care, at the owner's expense. Major Emerson stated that Sheriff Mason and his department are fully supportive of this appointment because it would be a tremendous help to them, as they do not have time to investigate calls regarding animals. He said that in their dealing with Cheryl Routh, who is seeking this appointment, and who already serves as animal cruelty investigator for the Humane Society of Randolph County, she has shown good judgment and worked with them to accomplish her goals. Mrs. Routh told the Board that the Humane Society would absorb the costs that could not be collected from animal owners. George Elliott, Health Director, also spoke in support of Mrs. Routh's work. On motion of Comer, seconded by Petty, the Board appointed Cheryl Routh to a one-year term as animal cruelty investigator. On motion of Langley, seconded by Davidson, the Board approved the badge Mrs. Routh carries identifying her as animal cruelty investigator. This badge is of a shield design. Guil-Rand Fire District Tax Neil Allen, Emergency Services Director, informed the Board that he had been notified by a citizen who remembered the 1953 referendum establishing the Gull -Rand Fire Tax that the maximum tax that could be levied under that referendum was lOG per $100 valuation of the taxable property in that district. Mr. Allen said that he had checked records in his office, County Manager's office, Clerk of Court, Randolph County and State Board of Elections, and Guil-Rand Fire Department and had found no reference to the 1953 election. However, the Clerk to the Board found minutes of a December 10, 1953 joint meeting of the Randolph and Guilford County Commissioners in which they adopted a resolution setting a maximum of a 10(,, per $100 valuation tax levy. County Manager Frank Willis read a letter he had written to the Randolph County Tax Collector advising him that a 10C tax rate is the maximum amount that can be legally levied in the Guil-Rand Fire District and requesting that the Tax Commission release 1G of the llG levied for this fiscal year. He then read the 8/7/89 Minutes Page 3 reply from Billy Chilton, Tax Collector, stating that the Tax Commission had met and approved the release of 1C from the 11G fire tax levied in Guil-Rand Fire District. Mr. Chilton advised the Board that those who have already paid this tax will be getting a refund and an explanatory letter. Those who have not yet paid will be receiving a corrected billing with an explanatory letter. All mailings will be mailed this week. On motion of Langley, seconded by Petty, the Board approved Budget Amendment #4, which reduces the Guil-Rand Fire District tax collections remitted by $52,708, which is the amount of refunds and adjusted bills created by a 10fi levy instead of an 11c. levy in that district. A copy of this budget. amendment is included by reference. Urbanized Thoroughfare Plan - Public Hearing Chairman Frye opened a public hearing on the High Point, Jamestown, Archdale, Davidson and Randolph County Urbanized Thoroughfare Plan. No one asked to speak. The public hearing was closed. Action on the plan was delayed until later in the meeting. Rezoning Requests - Public Hearing Chairman Frye declared a public hearing for rezoning requests to be in session. Hal Johnson presented the following requests: 1. Barry Smith, Asheboro, is requesting that 12 acres of a 15 -acre tract on SR 1163, Cedar Grove Township, be rezoned from RA to RA/CU for construction of a building to be used for automotive repair work. The Planning Board unanimously recommended approval. 2. John McElreath, Trinity, is requesting that 2 acres on SR 1314, Concord Township, be rezoned from RA to HC/CU so he can use an existing mobile home for a beauty shop and used car sales office with some display of used cars on the property. The Planning Board recommended approval with the condition that not more than 8 cars be allowed on the property at any given time. 3. Donald Hutchens, Ramseur, is requesting that 14 acres on the northwest corner of Hwy 64/SR 2848, Columbia Township, be rezoned from RA to LI for industrial purposes. The Planning Board unanimously recommended approval. 4. Ricky Welborn, Ramseur, is requesting that 1 acre from a 13 -acre tract on the south side of Hwy 64 just before Deep River, Franklinville Township, be rezoned from RA to HC for commercial activity (imported car repair). The Planning Board recommended approval. 5. Billy Walker, High Point, is requesting that 16 acres on the southeast corner of SR 1547/SR 1651, Trinity Township, be rezoned from RA to RR for a site -built redidential subdivision. The Planning Board unanimously recommended approval. Comments on Rezoning Requests No one asked to speak for or against any rezoning request. The public hearing was closed. 8/7/89 Minutes Page 4 Action on Rezoning Requests On motion of Davidson, seconded by Comer, the Board approved the request of Barry Smith. On motion of Langley, seconded by Petty, the Board approved the request of John McElreath, with the condition that no more than 8 cars be on the lot at any given time. On motion of Comer, seconded by Petty, the Board approved the request of Donald Hutchens. On motion of Petty, seconded by Langley, the Board approved the request of Ricky Welborn. On motion of Comer, seconded by Petty, the Board approved the request of Billy Walker. Pawnbroker's License Alice .Dawson, Clerk to the Board, provided information on a new state law (NCGS Chapter 91) which requires county commissioners to license pawnbrokers who desire to operate in the unincorporated areas of a county. She said that the Manager's office has already received one request from Frank Chamberlin for such a license. First, however, a local policy must be adopted stating the length of time a license is valid; what fee will be charged; what information -is to be provided in the application; and who will be responsible for approving applicants. She also informed the Board that Chapter 91 will be superceded by Chapter 91A on October 1, 1989. Chapter 91A includes more stringent regulations that a pawnbroker must abide by and is more specific concerning the licensing procedures. Mrs. Dawson then presented a sample policy for the Board's consideration. On motion of Langley, seconded by Davidson, the Board adopted the proposed policy as submitted with two changes: the license shall be valid until October 2, 1989 and no fee shall be required. By October 2, 1989, the Board will adopt a new policy under the regulations of Chapter 91A of the NC General Statues, which will supercede this temporary policy. Addition On motion of Davidson, seconded by Comer, the Board approved the addition of Antioch Church Road in the Lewis Ray King Subdivision. Hal Johnson noted that this road will be officially named at public hearing before the Planning Board because there is a duplication of this name already in the system. A copy of the resolutin approving this road is included by reference. Proclamation — I Can Make A Difference Month On motion of Petty, seconded by Comer, the Board adopted a proclmation declaring September as "I Can Make A Difference" Month, in conjunction with the NC Department of Transportation's highway cleanup program. A copy of the proclamation is included by reference. Budget Amendment — Encumbrances On motion of Langley, seconded by Davidson, the Board approved Budget Amendment #1, which encumbers funds in the amount of $55,368 from last year's 8/7/89 Minutes Page 5 budget for items ordered but not received as of June 30, 1989. Copy included by reference. Budget Amendment - Social Services On motion of Comer, seconded by Davidson, the Board approved Budget Amendment #3 to bring forward to this fiscal year $2071 from CP&L (Crisis Intervention), which was allocated on a calendar year basis. A copy of this budget amendment is included by reference. Urbanized Thoroughfare Plan Hal Johnson described the 20 -year High Point, Jamestown, Archdale, Davidson and Randolph County Urbanized Thoroughfare Plan which was recommended by a technical advisory committee and technical coordinating committee to the NC Department of Transportation. He said the Hwy 311 Bypass around High Point would affect Randolph County more than any other proposed change. On motion of Davidson, seconded by Comer, the Board approved the Urbanized Thoroughfare Plan as presented on the map. A copy of this resolution is included by reference.
