August 20, 1991 Minutes
The Randolph County Board of Commissioners met in special session at.9:00.
a.m. on August 20, 1991, in the Commissioners Meeting Room, County Office
Building, 707 McDowell Road, Asheboro, to conduct business relative to the jail
facilities bond referendum. Commissioners Frye, Davidson, Langley, Petty and
Comer were present.
Law Enforcement Facilities Bond Referendum Application
County Manager Frank Willis read a letter from the Local Government
Commission stating that Randolph County's application requesting their approval
for issuance of $10,600,000 law enforcement facilities bonds had been recorded as
having been filed on August 19, 1991 and accepted for submission to the Commission
at its next meeting. He stated that acknowledgement of the filing of the
application must be received before the bond order can be introduced.
Introduction of Bond Order
Commissioner Darrell Frye introduced the following bond order:
"BOND ORDER AUTHORIZING THE ISSUANCE OF $10,600,000
LAW ENFORCEMENT FACILITIES BONDS OF THE COUNTY OF RANDOLPH"
WHEREAS, the Board of Commissioners of the County of Randolph deems it
advisable to make the improvementshereinafter described; and
WHEREAS, the Board has caused to be filed with the Secretary of the Local
Government Commission of North Carolina an application for Commission approval of
the bonds hereinafter described as required by The Local Government Finance Act,
and the Secretary of the Commission has notified the Board that the application
has been filed and accepted for submission to the Commission; NOW, THEREFORE.,
BE IT ORDERED by the Board as follows:
Section 1. The Board determines that it is necessary to provide law
enforcement and detention center facilities in the County, including the
construction of new law enforcement and detention center facilities and the
renovation and expansion of existing law enforcement and detention center
facilities, and including the acquisition and installation of necessary
furnishings and equipment and the acquisition of land or rights -in -land required
therefor and to pay capital costs of such improvements.
Section 2. To raise the money required to pay capital costs of providing the
improvements described above, in addition to any funds which may be made available
for that purpose from any other sources, bonds of the County are hereby authorized
and shall be issued pursuant to The Local Government Finance Act. The maximum
aggregate principal amount of bonds authorized by this bond order shall be
$10,600,000.
Section 3. Taxes sufficient to pay the principal of and interest on those
bonds when due shall be annually levied and collected.
Section 4. A sworn statement of the County's debt has been filed with the
Clerk to the Board and is open to public inspection.
Section 5. This bond order shall take effect when approved by the voters of
the County at a referendum.
Resolution Setting Public Hearing on Bond Referendum
On motion of Frye, seconded by Petty, the Board adopted the following
resolution, which was read at length:
WHEREAS, the bond order entitled, "BOND ORDER AUTHORIZING THE ISSUANCE OF
$10,600,000 LAW ENFORCEMENT FACILITIES BONDS OF THE COUNTY OF RANDOLPH" has been
introduced at the meeting of the Board of Commissioners of Randolph County held on
August 20, 1991, and the Board desires to provide for a public hearing thereon and
the submission of a statement of debt in connection therewith as required by The
Local Government Finance Act; NOW, THEREFORE,
BE IT RESOLVED by the Board as follows:
A. The public hearing upon that bond order shall be held on September 3,
1991 at 7:00 o'clock p.m., in the Commissioners Meeting Room of the Randolph
County Office Building, 707 McDowell Road, Asheboro, North Carolina.
B. The Clerk to the Board is hereby directed to cause a copy of the bond
order to be published with a notice of the hearing in the form prescribed by law
in a qualified newspaper no fewer than six days prior to the public hearing.
C. The County's Finance Officer is hereby directed to file with the Clerk to
the Board prior to publication of the bond order with the notice of such public
hearing, a statement setting forth the debt incurred or to be incurred, the
appraised value of property subject to taxation by the County and the net debt of
the County.
Filing of Sworn Statement of Debt
Frank Willis, Finance officer, filed with the Clerk to the Board a sworn
statement setting forth the debt incurred or to be incurred, the appraised value
of property subject to taxation by the County and the net debt of the County. The
debt statement must remain on file in the Clerk's office and available for public
inspection through the date of the public hearing. The whole purpose of this debt
statement is to insure that the proposed bond issue will not exceed the statutory
debt limitation, which is 8% of the appraised valuation of property within the
county. A copy of this statement of debt is attached by reference.
Adoption of Bond Referendum Schedule
On motion of Davidson, seconded by Langley the Board adopted a bond
referendum schedule. A copy is included by reference
