080513 Closed Willam BrownClosed Session III (William Brown Claim) August 5, 2013 At 7:26 p.m., the Board, already in closed session on another matter, began closed session on a different matter in order to consult with our attorney to consider and give instructions concerning a potential or actual claim, administrative procedure, or judicial action pursuant to N.C.G.S. 143-318-I1(a)(3). Commissioners Holmes, Frye, Kemp, Lanier and Haywood were present. Also present were County Manager Richard Wells; Will Massie, Assistant County Manager/Finance Officer; County Attorney Ben Morgan; Aimee Scotton, Associate County Attorney; Cheryl Ivey, Clerk to the Board; Amanda Varner, Deputy Clerk to the Board and Bonnie Renfro, EDC President. Commissioner Darrell Frye said that he wanted to inform the other Board members, County Management and Legal staff that the Brown's home owners insurance company, Nationwide, had informed the Browns (in writing) that their insurance would be cancelled on 8/7/13 unless all repairs had been made to the home. He also read a portion of a court decision from a case in Lee County that was provided to him by Mr. Brown. Associate County Attorney Aimee Scotton reiterated (from closed session the previous month) that in the event that a suit is filed, the County's insurance company should be the one to defend it. At 8:32 pm, on motion of Haywood, seconded by Lanier, the Board voted unanimously to end closed session and return to regular session. J. Harold Holmes, Chairman Darrell L.
