RANDOLPH COUNTY PLANNING BOARD MINUTES
September. 27, 1979 1:00 P.M.
The Randolph County Planning Board me!- on Thursday, September 27, 1.9'7"
at 1:00 p.m. in the Board of Commissioners Meeting Room, County Courthouse,
Asheboro, N. C. The following members were present:
Don Pancock, Chairman
Andrew Lueker
Elmer Routh
Doyle Stout
Hal Johnson, Administrative Officer.
1. Don Hancock, Chairman, recognized Dr'J e Stout as a newly appointed
member of the Planning Board. Mr. Stout was introduced to the Board
members.
2. Andrew Lueker made the motion, seconded by Ulmer Routh, to approve
the minutes of the July 25 and August 23 Planning Board Meetings. This
motion was unanimously passed.
3. The Board reviewed the request of Aichie L. Honbarrier, P. O. Bo:: 7007,
High Point, N. C. , that approximately 42 acre, bordering Southern Railroad,
Highway 29-70; Old Thomasville Road; Bethel Drive; Pineview Avenue; and
Bolivar Street; (Zoning Map 1-1, Trinity Township) he re-zoned from
Residential-Suburban to Light Industr.i.al. use. Mr. Ilonbarrier. 's request
had been approved by the Planning Board at the meeting on. July 25, but was
referred back to the Planning Board for additionalstudy by the County
Commissioners on September 10.
There were several area residents in attendance at the Planning Board
Meeting. They had come to the Board Meeting to express their opposition
to the re-zoning request of Archie Honbarrier.
Jimmy R. Newton, 118 Bolivar Street, High Point, N. C. , spoke against.
the re-zoning request. Mr. Newton advised the Board that Mr. Honbarrier
had six possible outlets to his property, and Mr. Newton did not see why
Mr. ilonbarrier would use Bolivar Street as one of these outlets.
Mr. Newton said that the purpose of Zoning was to have controlled
orderly growth, as long as it did not infringe upon the other property
owners. Newton advised the Board that the construction Mr. Honbarrier
currently had underway was very unsightly. Trucks would park on the
sides of Bolivar. Street and the truck drivers would throw out beer
bottles and use profanity. Mr. Newton said that this was not conducive
to bringing up children.
Mr. Newton also stated that the Randolph County Zoning Ordinance
Summary stated that a Residential-Suburban Zoning District was designed
to give the homeowner more property value protection than other zoning
district areas. Hal Johnson advised Mr. Newton that the "Zoning Ordinance

Summary" of which Mr. Newton bad a copy, was merely produced as working u'rets
for the Planning Board by the County Planner during the period of time when
the Zoning Ordinance was being formulated and developed. The "Zoning Ordinance
Summary" was not adopted by the County Commissioners as the official County
Zoning Ordinance. Mr. Johnson read the definition of a Residential-Suhurben
Zone from the official County Zoning Ordinance which did not mention the
"property value protection" statement as contained in the Summary. Mr.
Johnson also told Mr. Newton that the Summary that Mr. Newton has was dated
July, 1978, and the final County Zoning Ordinance was not adopted until
January, 1979. Mr. Newton said that he had been given a copy of the Zoning
Ordinance Summary by the County Manager and was under the impression that
that was the official County Zoning Ordinance.
Mr. Newton asked the Planning Board that due consideration he given
to not re-zoning the property.
Glenn Connor, Old Thomasville Pond , High Point, N. C. , advised the
Board that he was not a resident of the immediate re-zoning area, but
was interested because the same thing could happen to him. Mr. Conner
stated that he felt that rules and regulations should apply equally to every-
one. He felt that in Mr. Honbarr.i.et:'s rase, this was not so. Mr. Conner
stated that he just wanted orderly growth or to forget zoning.
David Parker, 11.6 Pinevi.ew Avenue, High Point, NC, advised the Board
that he had worked hard for zoning and did not want to see High Point come
in and zone the area because it would be industrial. lie asked that the
re-zoning request he denied.
Hal. Johnsonadvised the Board that the County Zoning Ordinance ma:i.n-
tai.ned very little difference between Highway Business and Light Industrial
zoned districts. Mr. Johnson said that most uses permitted in the Light
Industrial Zone were also permitted in the Highway Business Zone. The
difference in the two zones is that Light :industr_i.a.lnnnes favor. large
tracts of land with good r.ai.land highway ecce_ss and minimal development
costs. Highway Business zones usually require only small amounts of land.
with high visibility considered important. For this reason, should the Penr''
recommend that Honharrier. 's property be re-zoned, it would he appropriate
to re-zone to Light Industrial District Cinss:ificati.on.
Hal Johnson advised the Planning Board that the Board was not a policy
making body under terms of the County Zoning Ordinance when considering
District Re-zoning requests. The Planning Board could only make recommendations
to the Board of County Commissioners. Among those factors which should be
considered in making a recommendation as to a change in Zoning District
Classification are the general existing land uses in the area, and whether
the re-zoning is consistant with the overall intent of. the County Land
Development Plan. Mr. Johnson advised the Planning Beard that any restriction
which they placed with the re-zoned land were merely recommendations and should
not be used by the Planning Board to determine whether or not to recommend that
property he re-zoned. The County Zoning Ordinance permits by right many di_Ficrent
uses in a Light Industrial zone and Mr. llonha.rrier would be able to use his
property for any one of these permitted uses. Restrictions which were not
spelled out in the Zoning Ordinance would not be enforceable, however, should
Mr. Honbarrier develop his property in such a manner as to require a "Special
Use Permit" under terms of the County Zoning Ordinance the Planning Board
would review the proposed development plans and could at that time impose
restrictions as provided by the Zoning Ordinance.
Don Hancock, Chairman, asked if there was a motion from the Planning
Board to not re-zone Mr. Honbarrier's property. No motion was made.
Andrew Lueker made the motion, seconded by Doyle Stout, that it be
recommended to the Commissioners that Archie Honbnrrier's property, as

outlined in the Re-zoning Petition. Roqu er. be ro-z ned from Rosidenttai. to
Light Industrial with the following recommendations:
1. There shall he a 50 foot building sotbnek from those property
which abuts a lot used for r.esidrntinl. nnrposes.
2. Within the 50 foot building sett-nett from those property lines as
defined above, there shall be a "Buffer Strip". This "Buffer Strip"
will be a planted strip of land at least ten feet in width and r' m-
posed of living deciduous and/or evergreen trees spaced not more
than ten feet apart and not less than onP row of dense, living ever-
green shrubs spaced not more than 5 foot apart. This "Buf.fer. Strip"
will be maintained in perpetuity by the owner.
3. The County will request that the State place "No Parking" signs on
Bolivar Street to end the problem of trucks par.kinR On the side of
the street. Mr. . Lueker withdrew the .3rd stipulation when Jimmy
Newton objected because Mr. Newton said it would also stop home
owners on Bolivar Street from parking on the side of the road.
Hal Johnson advised the Board that the above stipulations wonld not
apply to that construction already unde.n.ay because of the "Grandfather
Clause" as interpreted by the County.
The above motion, excluding the 3rd stipulation, was passedunani.mou.sty
by the Planning Board.
4. Iris A. Frazier, Route 5, High Point, N. C. , requests that 2.435
acres of property on the corner of State Road 1616 and State Road 1618
be re-zoned from Residential Agriculture to Light Industrial zoning use.
Zoning Map 1-1, Trinity Township.
Hal Johnson advised the Board that the Randolph County ilonith Dept.
had forwarded a letter which said the soil percolation rate was deemed
unsuitable for sub-surface sewage disposal.
Andrew Lueker made the motion, seconded by Elmer Routh, to deny
the re-zoning request because of unfavorable Health Dept. reports. The
motion was passed unanimously.
5. Andrew Lueker made the motion, seconded by Elmer Routh, to approve the
following Preliminary Subdivision Plats:
A. Sylvan Hills, Property of C. W. & Frank McCrary. Back Creek
Township, 8 Lots.
B. Westbriar Estates, H. T. Rogers & Lee Roy Hunt, Owners &
Developers, Cedar Grove Township, 11 Lots.
6. Being no further business, the meeting was adjouned by Chairman Don
Hancock.
