RANDOLPH COUNTY PLANNING BOARD MINUTES January 17 , 1980 The Randolph County Planning Board met on Thursday, January 17 , 1980 , at 12 : 30 pm, in the Board of Couuuissioners Meeting Room, County Courthouse, Asheboro , North Carolina. The following members were present : Don Hancock, Chairman Ray Farlow, Vice-Chairman Lorene Walker , Secretary Elmer Routh Doyle Stout Jimmy Newton Hal Johnson, Administrative Officer 1 . Don Hancock, Chairman, recognized Jimmy Newton, 118 Bolivar St . , High Point , N. C. , as a newly appointed member of the Planning Board. Mr . Newton was introduced to the Board members . 2 . Don Hancock advised the Board that this was the month that the Planning Board needed to elect new officers . Elmer Routh made the motion, seconded by Lorene Walker, that Don Hancock be reappointed to another term as Chairman of the Planning Board . This motion was unanimously passed. Lorene Walker made the motion, seconded by Elmer Routh, that Ray Farlow be appointed Vice Chairman of the Planning Board. This motion was passed unanimously. Doyle Stout made the motion, seconded by Elmer Routh , that Lorene Walker be appointed Secretary to the Planning Board. This motion was passed unanimously by the Board. 3. Hal Johnson advised the Planning Board that at the January meeting of the Board of County Commissioners a resolution was passed that would empower the Planning Board to perform those duties of a Zoning Board of Adjustment , as outlined by the General Statutes of the State of North Carolina and the Randolph County Zoning Ordinance. As such , Planning Board members would be appointed for three year terms . Each member of the Planning Board was given a copy of the "Oath of Office" that is required of all County Boards and officials as outlined in Article V1 , Section 7 , of the Constitution of North Carolina. The oath reads as follows : "I , do solemnly swear or affirm that I will support and maintain the Constitution and the laws of the United States and the laws and Constitution of the State of North Carolina not inconsistent there with , and that I will faithfully discharge the duties of my office as a member of the Randolph County Planning and Zoning Board of Adjustment , so help me God . " A record of these oaths of office will be maintained at the County Courthouse. 4. Ray Farlow made the motion, seconded by Doyle Stout , that the minutes of the November Planning Board be approved. This motion wasassed. (The Planning Board did not meet during the month of December January 17 , 1980 RANDOLPH COUNTY PLANNING BOARD MINUTES PAGE 2 S . Bob Morris , Real Estate Developer , Asheboro , N . C . , appeared before the Board to request that a portion of land located off of Cox Road , State Road 2834, he re-zoned to Commercial use . Mr . Morris advised the Board that Roby Kidd had purchased the land in December and wanted to build a nice home on the property . However , Mr . Kidd also wants to construct a Building to relocate his electrical contracting business and storage facilities . Mr . Morris advised the Board that Mr . Kidd would construct the facility to any specifications the Board desired . Mr . Morris told the Board that Mr . Kidd knew the property was zoned by the County for residential use when he purchased the land and had asked Mr . Morris to represent him before the Planning Board . Jiiiuiiy Newton asked Mr. Morris what size Building Mr . Kidd would be building and Mr . Morris stated that it would be around 30 by 40 feet in size , although this may vary somewhat . Doyle Stout asked Mr . Morris the exact location of the property and Mr. Morris stated that it was across from the Church located on the mountain top . The property was the orginal property of James Bullard and had been deeded to Mr. Kidd in December Mr . Morris stated. Mr . Morris stated that the Asheboro City Manager , Tom McIntosh, had told him that he could connect to the City water . Mr. Morris also advised that the land had been perked by the County Health Dept . Don Hancock reminded Mr. Morris that the property in question was in a residentially restricted zoned area, and Mr. Hancock again asked Mr . Morris if Mr . Kidd had been aware of the residentially zoned status of the property when he purchased the land . Mr . Morris said that Mr . Kidd knew the land was zoned against commercial use . Hal Johnson advised the Board that the portion of land that Mr . Kidd desired to use for commercial purposes would have to go through a re-zoning classification procedure before it could be used for commercial purposes . Don Hancock advised Mr. Morris that it was the purpose of the Planning Board to review and make recommendations to the Board of County Couuuiissioners on matters of change of Zoning District classifications . The final authority for re-zoning of property rested with the County Commissioners . Hal Johnson advised the Planning Board that they should carefully consider the intent of the Randolph County Land Development Plan which projects only residential use of property around the N.C . Zoo zoned area. Commercial use of property in this area in very closely restricted . Jimmy Newton made the motion , seconded by Doyle Stout , that the Planning Board not recommend that the property be re-zoned for commercial use. This motion was passed unanimously by the Planning Board. Don Hancock advised Mr . Morris that he could appeal a decision of the Planning Board to the Randolph County Board of Commissioners if he so desired . 6. Lorene Walker made the motion , seconded by Ray Farlow, to approve the following Final Subdivision Plats : A: DAVIDS PLACE SUBDIVISION, New Market Township , 8 Lots , SR 1926 , David Angel , Owner , Barry Osborn , Surveyor . B : COUNTRY PLACE SUBDIVISION, Asheboro Township , 110 Lots , Larry Callahan , Surveyor , Richard Wall , Owner . 7 . Don Hancock asked the Planning Board if they would prefer establishing a new meeting time and date for the Planning Board. After some discussion it was decided that the new meeting date and time would be on the : THIRD WEDNESDAY OF EACH MONTH AT 1 : 00 PM. January 17 , 1980 RANDOLPH COUNTY PLANNING BOARD MINUTES Page 3 8 . Hal Johnson , distributed to the Planning Board members newly typed and printed copies of the following : 1 : County Zoning Ordinance 2 : County Subdivision Ordinance 3 : County Zoning Ordinance Summaries Members of the Planning Board were also given copies of a book published by the UNC-Institute of Government entitled : "The Zoning Board of Adjustment in North Carolina" . The Planning Board was also shown newly printed copies of the Zoning Maps which were printed by the Piedmont Triad Council of Governments using a method which made the various Zoning Districts easier to identify. Hal Johnson asked that those members of the Planning Board that did not have a copy of the Randolph County Land Development Plan should let him know, and they would be provided a copy. 9 . Bill McDaniel , Chief Building Inspector , and Jim Martin , Supervising Sanatarian for the Health Department , were present at the Planning Board Meeting and were introduced to the Board members . Hal Johnson stated that he would like to have a member of the Building Inspections Department and the Public Health Sanatarians Office represented at meetings of the Planning Board when possible . 10 .
