MINUTES 779 RANDOLPH COUNTY PLANNING BOARD September 9, 1987 There was a meeting of the Randolph County Planning Board on Wednesday, September 9, 1987, at 1:30 p.m. , in Courtroom B, County Courthouse, Asheboro, North Carolina. The following members were present: Doyle Stout, Vice Chairman ABSENT Guy Troy Don Hancock, Chairman Tal Harrison O. H. Osborne Ray Farlow Charles Adams Bill Dorsett (Alternate) Lynden Craven (Alternate) Maxton McDowell (Alternate) Arlie Culp (Alternate) 1. Charles Adams made the motion, seconded by Guy Troy to approve the minutes of the August 5, 1987 meeting. The motion passed. 2. Guy Troy made the motion, seconded by Bill Dorsett to approve the Rules and Procedures of the Zoning Board of Adjustment. The motion passed. 3. Hal Johnson, Planning Director, advised the Board of the Board of Commissioners decision on their request of an interpretation on the clause in the County's Subdivision Ordinance which states: "Removal of Rubish: The subdivider shall remove or bury (provided it is not buried within 100 feet of a house site on the same lot) all cut or fallen trees, stumps or rubbish from the subdivision." Hal Johnson explained the Commissioners were very interested in their request because they thought it was vague in the way it could be interpreted. They asked that the Planning Board come back to them with more specific recommendations about how to deal with this matter. The Commissioners asked until they get this recommendation and act on it, the Planning Board interprete the clause as not applying to five (5) acre lots or greater and lots less than five (5) acres that it only apply to the area where the house and septic tank system will be located. 4. Hal Johnson gave the Board a brief update on the Poultry House Subcommittee and their upcoming meeting with the Department of Agriculture and the commercial chicken suppliers in this area. 5. Doyle Stout made a change in the agenda to hear the Britt Realty Company case that was held over from the previous meeting first. Britt Realty.Company, High Point, N.C. requested a Special Use Permit for a Rural Family Occupation to construct a building for storing restored cars and to locate trucks for servicing on approximately 6 acres of land located on the Roy Farlow Road (SR# 1534) , Trinity Township, Zoning Map #7726, Zoning District R-A. Jackie Hartsoe, Realtor of Britt Realty, and Don Farlow, seller of the property, were present at the meeting. Don Farlow showed the Board pictures and a sketch layout of the property in questions with the exact location of the proposed building. Mr. Farlow explained to the Board that the proposed building would be located several hundred feet from the Crotts residence and the Frazier residence with plenty of trees for buffer zones. Gary Crotts of Route 2, Trinity, N.C. , spoke in opposition of the permit because of concerns of noise from both the race cars and the furniture trucks. He also presented the Board with a petition signed by immediate neighbors opposed to the issuance of this permit. Bill Dorsett made the motion to disapprove the request based on four (4) reasons: (1) There would be two (2) businesses on this property located in a agricultural and residential area. (2) The buyer would not suffer any hardship because he does not own the property. (3) The request is incompatible with the residential and agricultural neighborhood in this area. (4) The request is opposite to the intent of zoning. This motion was seconded by Maxton McDowell. Tal Harrison obstained his vote. The motion was approved and the request was denied. 6. SUBDIVISIONS: 1. PROVIDENCE VILLAGE (Preliminary Plat) ; Providence Township; SR# 2230; Section 1, 12 Lots; Total Plat, 117 Lots. Ed Routh - Owner. Ed Routh and his attorney, Wes Moser, was present at the meeting. Mr. Moser explained to the Board that to his knowledge Mr. Routh had complied with all regulations. Hal Johnson told the Board that the subdivision exceed the lot size requirements and that all other requirements had been met. Guy Troy asked Mr. Moser about the problem of only one access road to such a large subdivision. Mr. Moser told the Board Mr. Routh would be willing to make more access to the subdivision if necessary. • Mozelle Key, Maria Key, and Katrina Black of Route 1, Pleasant Garden, spoke in opposition of the subdivision because of density problems and excessive traffic problems. Guy Troy made the motion to approve Section 1 of the Subdivision with the restriction that prior to future development of the subdivision Mr. Routh must have an approved plan for another access road. This motion was seconded by Tal Harrison. Lynden Craven and Charles Adams voted against the motion. The preliminary plat was approved. 2. FOREST HILLS SOUTH, Section 3 (Final Plat) ; Union Township; SR# 1114; 17 Lots. Phillip Craven & Others - Onwers. Tal Harrison made the motion, seconded by Lynden Craven to approve the subdivision. This motion passed. 3. PISGAH WOODS (Preliminary Plat) ; Union Township; SR# 1114; 46 Lots. Herman K. McDowell & W. Reid Kearns - Owners. Charles Adams made the motion, seconded by Tal Harrison to approve the plat. The motion passed. 4. FARMER WEST, Section 2 (Final Plat) ; Concord Township; off SR# 1001; 16 Lots. Herman K. McDowell & W. Reid Kearns - Owners. Motion was made by Tal Harrison, seconded by Charles Adams to aprove the plat. Motion passed. 7. REZONING REQUESTS: 1. Roberts Realty Co. , Asheboro, N.C. , requested that approximately 8 acres of land located on the south side of Highway 64 and west of intersection SR# 2626/2481, Columbia Township, be rezoned from Residential Agricultural to Highway Commercial. Zoning Map #8712. Walter Roberts, Roberts Realty, and the buyer of the property, Alton Goldston, were present at the meeting. Mr. Roberts supplied the Board with signed affidavits from the adjoining property owners stating they had no objections to the rezoning. Maxton McDowell made the motion, seconded by Bill Dorsett to recommend approval of the request. The motion passed. • 2. Jerry Wayne & Billie Sue Waisner, Asheboro, N.C. , requested that approximately 14} acres of land located on the south side of SR# 2845, east of SR# 2831, Richland Township, be rezoned from Residential Restricted to Residential Agricultural/Conditional Use. Zoning Map #7677. Jerry Waisner was present at the meeting and told the Board he wished to sale/install tires and batteries. Charles Adams asked Mr. Waisner what would be done with the old tires. Mr. Waisner explained they would be kept in a building until disposed of. Guy Troy made the motion to recommend approval of the request with the condition of no outside storage. This motion was seconded by Lynden Craven. Motion passed. 3. Carl E. Kinney, Ramseur, N.C. , requested that approximately 2 acres of land located south of Highway 64, fronting on SR# 2626, south of SR# 2621, Columbia Township, be rezoned from Residential Restricted to Residential Agricultural/Conditional Use. Zoning Map #8711 or #8712. Carl Kinney was present at the meeting and explained to the Board that he and his Father will buy wrecked cars and restore them. Bill Dorsett asked about outside storage and Mr. Kinney answered he would have some behind his building. Lynden Craven made the motion to recommend approval with the restriction of storage to be inside or undercover. This motion was seconded by Bill Dorsett. Motion passed. 4. Steve Davis, High Point, N.C. , requested that approximately 32 acres of land located on the northeast side of Highway 311 near intersection SR# 1527, New Market Township, be rezoned from Residential Agricultural to Light Industrial. Zoning Map #7746. Steve Davis told the Board that he planned to build body shop to fix wrecked cars and also said he would fence the property to block view from the adjoining property owners. Fred Frank, Route 2, Sophia, N.C. spoke in opposition of the rezoning because he believed the property would turn in to a junkyard. He also had concerns with the traffic because the area is highly conjested at present with traffic. Ken Spivey, Pastor at Marlboro Friends Church, Sophia, N.C. voiced concerns of the property becoming an eyesore, traffic problems, and noise. Steve Davis then requested using just the front ten (10) acres for the rezoning and leaving the remaining twenty-two (22) acres as Residential Agriculture. Guy Troy made the motion to delay action on the request because the request had changed substantially. No vote was taken because of change in request. 5. James B. & Ann M. Slaughter, Route 3, Trinity, N.C. , requested that approximately 4 acres of land fronting on the north side of Highway 62, immediately southwest of intersection SR# 1558/Highway 62, Trinity Township, be rezoned from Residential Restricted to Residential Agricultural/Conditional Use. Zoning Map #7707. Ann Slaughter explained to the Board that she planned to operate a toy-gift shop and tanning salon from a building that is already on the property. She expressed her need to be closer to home and more space for her business. Charles Adams made the motion to recommend approval for the request and Guy Troy seconded the motion. Motion was passed. 6. Klaussner Industries, Asheboro, N.C. , requested an addition to a Conditional Use Permit on approximately 41 acres of land fronting on the west side of Business 220 South, near Teague's Exxon at Ulah, adjacent to existing plant, Cedar Grove Township. Rodney Miller represented Klaussner Industries and expressed their wishes to build a power generating plant. Mr. Miller explained the wood waste from the lumber mill and from other sites would be converted to gas which would be burned to generate electricity. He also explained to the Board the plant operation would be environmental sound and the plans had been approved by the N.C. Utilities Commission. Keith and Sandra Shular, Route 7, Asheboro, expressed their concerns of abundance of noise, water supplies, and abundance of traffic. Shirley Fleming, Route 7, Asheboro, N.C. explained to the Board her concerns of the 50 foot buffer zone that was destroyed. Doyle Stout told her the Planning Department would look in to that matter. Guy Troy made the motion, seconded by Lynden Craven to recommend approval of the request. The motion was pasted. 8. SPECIAL USE PERMIT: 1. Lilton Williamson, Trinity, N.C. , Requested a Special Use Permit for a Rural Family Occupation to construct a grading and road work business, on approximately 7 acres of land located on Fairview Church Road (SR# 1566) , Trinity Township, Zoning District R-A, Zoning Map #7717. Rebecca Williamson explained to the Board the equipment located on the property: dump truck, tractor, front-end loader, bush hog, plow, and a disc. She also told the Board there would be no storage of gravel, etc. on the property. Donald Madden and Jeff Madden, Trinity, N.C. spoke against the request because of additional traffic, dust problems, noise, and their concerns of property values in the area. Donald Madden also made mention of a sign that was located on the Williamson property without a permit. Rebecca Williamson explained to the Board she was unaware this was a violation at the time the sign was put up, but as soon as Randle Brim, Deputy Zoning Administrator, informed her of this the sign was changed. Jim Morgan, attorney for Ms. Bowman (an adjoining property owner) , spoke in opposition with concerns of traffic and the type of business that would be on the property. Bill Dorsett made the motion, seconded by Lynden Craven to approve the permit. The motion passed. 9. Ottway Burton, attorney of Asheboro, N.C. , requested the Clinton Richardson case be moved to the end of the agenda because his presence was required in Superior Court. Clinton Richardson, Seagrove, N.C. , requested that approximately 12 acres of land located on the east side of SR# 2902 near the intersection of SR# 1002/ SR# 2902, Richland Township, be rezoned from Risidential Agricultural to Residential Mixed/Conditional Use. Zoning Map #7696. Clinton Richardson was not present at the meeting. His son, Thomas Steve Richardson explained to the Board that Mr. Richardson wished to operate a mobile home park of twelve lots to supplement his retirement income. He also stated he was an adjoining property owner and was in favor of this because he knew the park would be kept nice. Glenda Richardson Purvis and Dana Black of Seagrove, N.C. , also spoke in favor of the park. Eric Richardson, Seagrove, N.C. , told the Board he was opposed to the idea of a mobile home park being located in his community. Tal Harrison made the motion to postpone the hearing until Mr. Burton �.� could be present to represent his client. This motion was seconded by Lynden Craven. Motion passed. 10. MISCELLANEOUS: 1. The Board had a general discussion on moving their meetings to later in the afternoons or early evenings. Further discussion will continue at the next regular session. 11 .
