7775 RANDOLPH COUNTY PLANNING BOARD
October 7, 1987
There was a meeting of the Randolph County Planning Board on Wednesday,
October 7, 1987, at 1 :30 p.m. , in Courtroom B, Randolph County Courthouse,
145 Worth Street, Asheboro, North Carolina.
1. Don Hancock, Chairman, called to order the Randolph County Planning Board
at 1:45 pm.
2. Hal Johnson, Planning Director, called roll of the members: Don Hancock,
Chairman, present; Doyle Stout, Vice Chairman, present; Ray Farlow, present;
Charles Adams, present; Guy Troy, present; Tal Harrison, absent; Bud Osborne,
absent; Lynden Craven, Alternate, present; Arlie Culp, Alternate, present;
Bill Dorsett, Alternate, present; and Maxton McDowell, Alternate, was late
in attendance as noted in the minutes.

3. Charles Adams made the motion, seconded by Guy Troy, to approve the minutes
of the September 9, 1987 meeting. The motion passed.
4. SUBDIVISIONS:
A: LANIER SUBDIVSION (Preliminary Plat) ; Concord Township; SR 1312;
15 Lots. Donald W. Lanier - Owner.
Donald Lanier was present at the meeting explained to the Board
that all lots would be facing a State maintained road or have deeded
access to a State maintained road. He also stated that this subdivision
would be for manufactured or site built housing and that individual wells
and septic tanks would be used. Mr. Lanier expressed to the Board his
thoughts of changing the name of the subdivision on the final plat.
Ray Farlow made the motion, seconded by Guy Troy to approve the
�-� preliminary plat. The motion was passed.
B: DEERFIELD SOUTH, Section 3 (Preliminary Plat) ; Level Cross Township;
Highway 220 Business; 27 Lots. B. J. Lawrence - Owner.
Hal Johnson explained to the Board the subdivision exceeded the
lot requirements and that the subdivisions would be for site built
homes.
Guy Troy made the motion, seconded by Doyle Stout the approve the
preliminary plat. The motion passed.
C: FARLOW PARK, Section 6 (30 lots) & Section 7 (31 lots) (Preliminary
Plat) ; Grant Township; SR 2839. S. Neal Craven, Phillip R. Craven,
& Bobby L. McDuffie - Owners.
Phillip R. Craven was present at the meeting and told the Board
the subdivision restrictions for this subdivision was similar to the
County's Subdivision Ordinance. He also stated this subdivision would
be for site built or manufactored housing.
Doyle Stout made the motion, seconded by Ray Farlow to approve
the preliminary plats. The motion passed.
5. REZONING REQUESTS:
A: Clinton Richardson, Seagrove, North Carolina, requested that approximately
12 acres of land located on the east side of SR 2902 near the intersection
of SR 1002/SR 2902, Richland Township, be rezoned from Residential
Agricultural to Residential Mixed/Conditional Use. Zoning Map #7696.
Clinton Richardson was present at the meeting and explained to the
Board his desire to locate a mobile home park on his property. He told
the Board he lived near the proposed site, that the park would be kept
neat and clean, the lot sizes would be 1 acre with individual septic
tanks and a community well system. Mr. Richardson showed the Board
pictures of adjoining properties and explained that he wished to develop
this park for an income when he retires.
Hal Johnson asked Mr. Richardson if he was aware of the State
road requirements and he said he was.
Chairman Hancock asked if anyone would like to speak in favor of
this rezoning.
Thomas Steve Richardson, Seagrove, North Carolina, spoke in favor
of the rezoning explaining he was an adjoining property owner and
had no objection to a mobile home park being located beside his property
Glenda Richardson Purvis, Seagrove, North Carolina, spoke in
favor of the rezoning and said she had 1} acres adjoining this property
and that she had no objections to the mobile home park being located
at the proposed site because she knew that her father would have a nice
park. Hal Johnson asked Ms. Purvis if she would object to someone other
than her father locating a mobile home park beside her property and she
said no as long as they kept the park nice.
Dana Richardson Black also spoke in favor of the park explaining
she also had adjoining property.
Chairman Hancock asked if there was anyone who would like to speak
in opposition of the rezoning.
Shirley Richardson told the Board she was representing Mabel E.
Blue, an adjoining.property owner who lives in Washington, D.C. , and
that Ms. Blue's attorney, Ottway Burton, was in court and could not be
present at this time. She present the Board with a notorized letter
from Mr. Burton's office asking that the hearing be posponed until he
could be present. Hal Johnson explained to Ms. Richardson that the
Board had already posponed the meeting once for Mr. Burton to be present
and that since the case would be heard by the County Commissioners
before a final decision he did not feel it would be fair to pospone
Mr. Richardson's request again. Bill Dorsett, Board member, stated he
felt the case should be heard by the Planning Board.
Harris Richardson, Seagrove, North Carolina, spoke in opposition
of the request. He said there was already 5 trailers on Clinton Richardson's
property and that he was opposed to 12 more coming in because he felt this
was too many trailers for this area. He also stated that this would cause
too much conjestion on those country roads and that it will knock down the
value of adjoining property.
Guy Troy made the motion (with notice of the request from the attorney
asking for the hearing to be delayed) , seconded by Doyle Stout to
recommend approval of the request. The motion passed.
[Maxton McDowell entered the meeting during the discussion of the Clinton
Richardson case and was present through the rest of the meeting. ]
B: Roger L. Gregory, Asheboro, North Carolina, requested that approximately
5 acres of land fronting on the west side of SR 1107, north of Highway
49 (Southern half of his 10. 162 acre tract) , Cedar Grove Township, be
rezoned from Residential Agricultural to Light Industrial/Conditional
Use. Zoning Map 41 7629.
Maxton McDowell asked to be excussed from discussion of this case
because he is an adjoining property owner. Chairman Hancock excussed
him.
Hal Johnson showed the Board a video tape of the property and the
surrounding community.
Roger Gregory was present at the meeting and explained to the Board
he wished to construct a building (40' x 75') for a furniture frame shop
and employ 4 people.
Chairman Hancock asked if there was anyone who would like to speak
in favor of this request and there was no one so he asked if there was
anyone who would like to speak in opposition of this request.
Walter Gordon, SR 1107, explained to the Board that he lived in
the area of the proposed site and that he felt if this request was approved
it would open the area up for more industry. Mr. Gordon said he would
like to see the character of the area preserved. He also stated he
was not against industry but he was opposed to it being located in this
area.
Maxton McDowell, Route 3, Asheboro, North Carolina, explained to the
Board that he did not live in this area but he did own adjoining property.
Mr. McDowell said he felt the integrity of the area was at stake for this
residential agricultural community and that he did not believe that this
request was in keeping with the Commissioners intent for zoning.
Chairman Hancock Expressed his opinion that this request was
totally out of character for this area.
Ray Farlow made the motion seconded by Lynden Craven to recommend
to the County Commissioners this request be denied. The motion was
passed.
C: Roger Bouldin, Asheboro, North Carolina, requested that approximately
one acre of land fronting on the west side of SR 2846 between SR 2910
and SR 2848, Richland Township, be rezoned from Residential Restricted
to Highway Commercial/Conditional Use. Zoning Map #7665.
Hal Johnson showed the Board a video tape of the proposed site and
adjoining properties.
Roger Bouldin was present at the meeting and explained to the Board
he wished to add a 25 ft. addition to his existing business for washing
diesel motors and trucks before he works on them. He also stated that
at the present time when he washed motors the water just went on top of
the ground and that if he built his proposed addition he would have a
trap in it to trap all the dirt coming off the motors.
Doyle Stout expressed his opinion tht the addition would make
the situation more environmental safe with the sedament being trapped
instead of running on to the ground.
There was no one at the hearing that spoke in opposition of this
request.
Maxton McDowell made the motion, seconded by Charles Adams to
recommend approval of this request. The motion passed.
6. MISCELLANEOUS:
A: Hal Johnson explained to the Board the Poultry House Sub-Committee had
met three times over the past weeks. There initial meeting was with
representatives of the Agricultural Extension Service, the second meeting
was to receive input from the Poultry Industry that supplied Randolph County
and there last meeting was to review information they had received and
formulate recommendations to the Planning Board.
Mr. Johnson explained that the Sub-Committee had hoped that the
meeting with the Poultry Industry would generate self regulations and would
allow the County not to be forced to adopt regulations. Twelve (12)
invitations were forwarded for this meeting and only two (2) companies
attended. The Sub-Committee felt that regulations from the County would
be necessary because of lack of participation from the Poultry Industry.
Mr. Johnson stated the Sub-Committee's recommendations would not
prohibit chicken houses it would just regulate them. The recommendations
were as follows:
1. Poultry Houses must be located on a minimum ten (10) acre tract.
2. No Poultry House shall be located within one hundred (100) feet
of a property line.
3. A plan indicating the procedures and process for litter and
dead bird disposal shall be filed with the County upon application
for a permit.
4. The developer must provide a list of names of adjoining property
owners and indicate that these persons have been notified of the
intended development.
5. New Poultry Houses shall be located only in Residential-Agricultural
District.
6.. Prior to Construction the developer shall obtain a Poultry House
Permit from Randolph County which will indicate he is in compliance
with these regulations.
Mr. Johnson also stated that the Sub-Committee recommended that the
Planning Board conduct a Public Hearing on this issue of Poultry House
Regulations and that this could be scheduled at the next Board meeting.
Guy Troy, Sub-Committee member, said that the idea of not restricting
or zoning the Farmer is the concept behind the propised Poultry House
regulations. The true Farmer has large acreage and is looking for options
to use his land. This was the thinking behind the ten (10) acre minimum
lot size. The real Farmer is not the cause of current Poultry House Complaints.
The problem arises for those people getting into Poultry operations that are
not Farmers. There people do not live on the land but merely look to it as
a commercial investment. Mr. Troy said he feels there regulations are
designed to protect the true Farmer in Randolph County.
Guy Troy made the motion, seconded by Lynden Craven, Sub-Committee
member, to hold a Public Hearing on this issue at the next Board meeting.
The motion was passed. Hal Johnson explained that the Board could use
the news media for advertising.
B: Hal Johnson asked that the Board delay any decision on rescheduling their
meetings or limiting the number of cases they heard until the Board could
fore see a trend of numerous cases.
