17711 January 16, 1996
There was a meeting held at 6: 30 p.m. , on Tuesday, January
16, 1996 , of the Randolph County Planning Board in the
Commissioners ' Meeting Room, Randolph County Office Building, 725
McDowell Road, Asheboro, North Carolina.
1 . Chairman Charles Adams called the meeting to Order at 6 : 30
p.m.
2 . Hal Johnson, Planning Director, called roll of the members :
Charles Adams , Chairman, present; Aweilda Williams , Vice
Chairman, present; Tim Poole, present; Lynden Craven,
present; Jim Routh, present; Bill Dorsett, present; Phil
Brower, present; and Maxton McDowell , Alternate, absent.
3 . Aweilda Williams made the motion, seconded by Bill Dorsett,
to approve the Minutes of the December 5 , 1995 Planning Board
Meeting. The motion passed unanimously.
4 . REQUEST FOR PROPERTY REZONING:
A: RUBY W. CRAVEN, High Point, North Carolina, is
requesting that 1 acre (out of 10 acres) located on
Hoover Hill Road (just South of Hoover Hill Court) ,
Trinity Township, be rezoned from Residential
Agricultural to Highway Commercial/ Conditional Use .
Zoning Map #7725 . It is the desire of the applicant to
construct a 30 x 50 building for a boat dealership on 1
acre.
Craven was present with her son Danny Carol . Craven
explained their intentions to purchase the property to
build their home and operate a boat sales and services
business . Carol said he has operate his business in
High Point for 20 years at 1301 South Main Street.
Carol said there would be no employees except himself.
Carol described other businesses in the area - tractor
trailer repair shop, TV repair business, and a lawn
mower repair business .
Ted Harrison, Hoover Hill Court, was present
(representing the neighboring properties) and provided
the Board with a packet of information that included a
letter of their reasons for opposition, a petition of
236 signatures of opposing neighbors , and a N.C.D.O.T.
traffic accident report for the past 3 years on Hoover
Hill Road (between Flint Hill Road and Kennedy Road) .
These concerns included safety, environmental hazards,
possible junk storage, property values, and quality of
life.
Ricky Bevan, Hoover Hill Road, explained that this is a
rural residential area and there has been no rezonings
.� (since Countywide zoning in 1987) in the immediate area.
Bevan said the County' s long range plan for this area is
RA and he would like to keep it this way. Bevan said if
the Board rezoned this 1 acre that has not been
subdivided, this would constitute "spot" zoning, which
is illegal in N.C. , and would be grounds for a court law
suit. Bevan provided the Board with pictures of the
terrible sight line on Hoover Hill Road.
There were 24 citizens present in opposition to this
request.
Williams said that there are no apparent businesses in
the area and this is a very residential community. For
this reason, Williams made the motion, seconded by Phil
Brower, to recommend to the Commissioners that this
request be denied. The motion passed unanimously.
B: EDDIE MORRIS, Asheboro, North Carolina, is requesting
that 252 .50 acres located on Union Grove Church Road
(north of Trinity Church Road) , Richland Township, be
rezoned from Residential Agricultural to Residential
Mixed. Zoning Map #7695. It is the desire of the
applicant to develop a residential subdivision of 39
lots that would allow site built homes and manufactured

homes.
Johnson explained that this request was previously
considered by the Board for the division of 1 acre
tracts fronting on the State Road and the remainder of
the property to be 5 acre tracts. Johnson said this new
proposal is for 1 acre tracts fronting on the State Road
and the remainder to be divided into 10 acre tracts .
Don Bristow, agent, was present and explained the
changes of the lot sizes and the length of the road
(change from 2 miles to less than a mile with 2
culdesacs) . Bristow said these changes were made in
order to attempt to answer concerns raised during the
last public hearings . Bristow said that they would
probably only have 10 lots on the road front (due to
perking situations) and that they were flexible about
this number and would be willing to except suggestions
from the Board.
Ray Chriscoe, adjoining property owner, said that he
owns a hog farm with 8500 hogs and there is another hog
farm on the other side of this proposed development.
Chriscoe said that there are approximately 30 chicken
houses within 2 miles of this site. Chriscoe said that
he didn' t want to cause trouble for these developers but
__- that this is farm country and he thought it should be
clear to everyone that it is and they intend on
continuing to farm here. Chriscoe said he just wanted
the Board to remember the farms in this area.
There were 16 people present in opposition to this
request.
Dorsett said that eventually the Commissioners will want
to grant a request here to develop and he felt the
Planning Board should recommend that the Board increase
the lot sizes fronting on the State Road and allow as
few lots as possible. Craven agreed with Dorsett and
said that the people in this community would probably be
more comfortable with the development if the number of
lots on the State Road were reduced.
Johnson offered to meet with the developers and work out
the number of lots that will front on the road.
Craven made the motion to recommend to the Commissioners
that this request be approved with the stipulation that
the developers work with the Planning Director on a
reasonable number of lots fronting on the State Road.
Bill Dorsett seconded this motion and the motion passed
unanimously.
C: J.C. CALLICUTT, JR. & HAL OTIS, Ether, North Carolina,
is requesting that 10 acres (out of 108 acres) located
on Fork Creek Mill Road (across from the northern end of
Cagle Loop Road) , Richland Township, be rezoned from
Residential Agricultural to Light Industrial/Conditional
Use. Zoning Map #7675. It is the desire of the
applicants to construct a 120 x 120 building to be used
as a frame manufacturing business.
Callicutt explained that they build frames for several
of the furniture manufacturers in Moore and Randolph
County. Callicutt said that within the first 6 months
they will employee 50-75 people , within the next 6
months 25-50 more, with a total number of employees at
full operation to be 100-125 people. Callicutt said
this is 1/8 of a mile off the road and away from any
houses. Callicutt said he plans to build a gravelled
road to the site.
Bobby Marsh, Cagle Loop Road, said that he feels the
property is currently zoned properly. Marsh expressed
concerns of traffic/safety problems on this crooked
road. Marsh said he could appreciate the fact that
Callicutt is trying to provide jobs to Seagrove, but
said he felt this was an inappropriate site.
John Holmgren, Fork Creek Mill Road, said expressed his
concerns of property values being effected, poor
visibility on Fork Creek Mill Road (that will cause
traffic hazards) , and the creek in back of the property.
Holmgren said that there are no other businesses within
5 miles of this location except pottery shops.
Mark Haywood, adjoining property owner, (representing
his family) , said that he would be looking into this
factory from his home everyday. Haywood said that he
wanted to see the farming community remain.
There were 19 citizens present in opposition to this
request.
Routh asked Callicutt how long he had owned the property
and Callicutt answered 6 to 8 months.
Routh said that he would not be comfortable rezoning
this site without a site plan to see how adjoining
property owners would be effected.
Dorsett said that the site could not be screened from
the neighbors and he would not be comfortable approving
the zoning.
Johnson explained that the land use plan for this area
called for the property to remain rural
residential/agricultural.
Jim Routh made the motion, seconded by Lynden Craven, to
recommend to the Commissioners that the request be
denied. The motion passed unanimously.
`-' D: ODELL & DOLORES ROUTH, Climax, North Carolina, is
requesting that 1 acre (out of 2 . 6 acres) located at
2852 Benny Lineberry Road (behind Routh Oil Company) ,
Providence Township, be rezoned from Residential
Agricultural to Highway Commercial (the remaining 1 . 6
acres is currently zoned Highway Commercial) . Zoning
Map #7796. It is the desire of the applicants to
develop the property commercially.
Routh explained that he has owned the property since
1969 and it is his intention to construct a building on
this portion of the property to work on his transfer
trucks that currently are stationed here. Routh said
that the servicing is currently done outside and he
plans to build this building to move all the servicing
inside.
There was no one present in opposition to the request.
Lynden Craven made the motion, seconded by Jim Routh, to
recommend to the Commissioners that this request be
approved to be zoned consistently with the remainder of
the property. The motion passed unanimously.
5. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are about
to give is the truth, the whole truth, and nothing but the
truth, so help you God. "
5 citizens took this Oath.
6. REQUESTS FOR SPECIAL USE PERMITS:
A: DONALD DEAN FIVECOAT, Southmont, North Carolina, is
requesting a Special Use Permit to have a dealer ' s
license issued at his residence located at 6574
Mendenhall Road on 44 . 24 acres; Trinity Township; Zoning
Map #6798; Zoning District RA.
Fivecoat said he has had a dealer' s license since 1971
and due to sickness allowed them to expire. Fivecoat
said he wants to be allowed to store 30 cars (for the
business) at his residence and wants to build a garage
to upgrade/work on his equipment. Fivecoat said he has
been doing mining (removal of dirt) and has for several
years from this location.
There was no one present in opposition.
Johnson said that he would have a problem with 30+ junk
vehicles being allowed to remain on this property.
Johnson said the Planning Office has received several
complaints of junk vehicles, soil erosion problems
(effecting house foundations) , etc. Johnson said he
would recommend to the Planning Board that they restrict
`-� the number of cars allowed to be stored on the property.
Dorsett said that he saw a gully of junk vehicles before
he got to Fivecoat' s residence and he felt before this
is approve the property should be brought in to
compliance with the new Junk Vehicle Ordinance. For
this reason, Dorsett made the motion, seconded by Lynden
Craven, to table this request. The motion passed by 6
to 1 vote, Aweilda Williams voted against the motion.
B: GEORGE HOPKINS, Asheboro, North Carolina, is requesting
a Special Use Permit to obtain an automotive dealer ' s
license at his residence located at 5531 Trails End Road
on 5 . 23 acres; Liberty Township; Zoning Map #8728;
Zoning District RR.
Hopkins explained that he would not allow junk cars -
all the cars would be operable. No more than 10-12 cars
would be on the property for the business and he would
not repair vehicles at this site. Hopkins said he would
use an existing building for the office.
Harold Foushee, adjoining property owner, said that
Hopkins rents this property and 2 years ago started all
this junk storage and has removed the junk vehicles
because the County came in and made him. Foushee
described this as a 7 day a week operation and
expressed his concerns about the secure problems this
could create.
Junior Layton, adjoining property owner, said this is a
residential community and reminded the Board about a
request 7 years ago that was denied for a auto garage to
be located in this area.
Joe Layton, Trails End Road, said that his family has
lived here all their lives and work hard to take good
car of the area. Layton said he didn' t want to see a
car lot here.
Winfred Garrett, Adjoining Property Owner, said that he
was concerned about water contaminates . Garrett said
his family has lived here for more than 100 years .
Lynn Scruggs, neighbor, said that she and her husband
moved here from Greensboro to live in County and get
away from the business districts . Scruggs said that she
did not want to have this view of a car lot each day.
Scruggs added that this would also effect the property
values in the area.
There were 13 people present in opposition to this
request.
Dorsett asked Hopkins if he would be interested in a
dealer ' s license without being allowed to store the
vehicles at this location. Hopkins said that if the
Board would grant him a permit to get his dealer ' s
license he would not store any vehicles on the property
except for his 3 personal vehicles .
Craven made the motion to approve this request with the
restriction that no vehicle storage, sales , or service
be allowed on the property. Aweilda Williams seconded
the motion and the motion passed unanimously.
C: KENNETH JOYCE, Kernersville, North Carolina, is
requesting a Special Use Permit for an eight (8) space
addition to Scenic Oaks Mobile Home Park located at 1802
Grantville Lane, 27 acres; Grant Township; Zoning Map
#7790; Zoning District RA.
Joyce was present and explained that he developed 31
lots in 1988 after being issued a Special Use Permit by
the Planning Board. Joyce explained that he has a
manager that lives in the park and only allows 2 cars
per mobile home.
Dorsett said that this is a neat park and asked Joyce
about the few mobile homes in his park that have not
been underpinned. Joyce said that he has 3 that are not
underpinned and that he is still working on getting this
taken care of.
There was no one present in opposition to this park
addition.
Bill Dorsett said that this is the type of park we
should encourage in Randolph County and made the motion,
seconded by Phil Brower, to approve this request for a
Special Use Permit. The motion passed unanimously.
7 . The meeting adjourned at 8 : 11 p.m. There were 92 citizens
present for this hearing.
