RANDOLPH COUNTY PLANNING BOARD
February 13, 1996
There was a meeting of the Randolph County Planning
Board, held at 6 : 30 p.m. , on Tuesday, February 13 , 1996 , in
the Commissioners ' Meeting Room, Randolph County Office
Building, 725 McDowell Road, Asheboro, North Carolina.
1 . Chairman Charles Adams called to Order the Randolph
County Planning Board meeting at 6 : 30 p.m.
2 . Hal Johnson, Planning Director, called roll of the
members : Charles Adams, Chairman, present; Aweilda
Williams, Vice Chairman, present; Tim Poole, absent;
Bill Dorsett, absent; Phil Brower, absent; Jim Routh,
present; Lynden Craven, present; and Maxton McDowell,
Alternate, present.
3 . Lynden Craven made the motion, seconded by Aweilda
Williams, to approve the January 16, 1996 Randolph
County Planning Board Meeting Minutes . The motion
passed.
4 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
10 citizens took this Oath.
5. REQUESTS FOR A SPECIAL USE PERMIT:
A: THURMAN HOGAN, Asheboro, North Carolina, is
requesting a Special Use Permit to obtain a
dealer ' s license at his residence located at 2520
Hopewell Friends Road, on 24 . 56 acres , Cedar Grove
Township, Zoning Map #7639, Zoning District RA.
Hogan explained that he collects and restores ' 67 ,
' 68 , and ' 69 cameros and currently has 41 stored
on this property. Hogan said that 19 of these
will be carried will soon be carried to Cranford' s
Junkyard and eventually he will only be storing 12
vehicles at a time. Hogan said that he needs the
dealers license to purchase and sale cars at the
car sale. Hogan said he will not have a sign and
there should be no additional traffic because he
does not sale at his residence.
John Hill, 2490 Hopewell Church Road, said that he
was just concerned if this would change the zoning
in this area. Hill said that since it will not
change the zoning, he didn't have a problem with
this request.
Lynden Craven made the motion, seconded by Maxton
McDowell , to approve this request for a Special
Use Permit. The motion passed unanimously.
B: PAUL NELSON, Archdale, North Carolina, is
requesting a Special Use Permit to place a 30x60
building on at his future residence for an
automotive repair shop on 2 . 18 acres, at the
corner of Hwy 62/Irwin Street, Longview Acres lots
12-17 & 43, Trinity Township, Zoning Map #6797 ,
Zoning District RR.
Nelson explained that this would be a part-time
business to work on brakes and tires . Nelson said
that there are no deed restrictions on the
property and that he would be working from 4 : 30
p.m. to 9 : 00 p.m. and on Saturdays . Nelson said
that he would not have any outside storage.
Nelson presented a site plan of the proposed
development.
Mary Easter, 4555 Irvin Street, said that she
lives in front of this property and would have no
problem with this with the following restrictions :
**must help keep the private road up
**building must be painted block or vinyl siding
**no noise after 9
**no outside storage of tires
**sign indicating children at play at the
beginning of the road
**no more than 2 cars stored outside of the
building
Easter was speaking for 6 of the neighbors who
were all present.
Cheryl Isley, adjoining property owner, said that
she was opposed for the following reasons :
**effect on property values
**traffic and noise in the evenings
**commercial activity in residential area
Isley said that they did not realize that the
restrictions in the subdivision had run out or
they would have had them re-instated. Isley
presented a petition of 20 signatures of neighbors
in opposition to the request.
Jerry Nance, 4556 Jerry Street, reminded the Board
that they had denied a turkey shoot in this
neighborhood a few months ago and he would like to
see this commercial activity denied also. Nance
said the community is residential and should
remain this way.
Richard Hatley, 4571 Jerry Street, said that
Nelson' s property backs up to his and he feels
this would effect the value of his property.
Danielle Evans, adjoining property owner, said
that she is concerned of safety and the noise the
business would create. Evans said that she has
purchased a lot here to build their home and would
not have if they knew the intentions of this
property owner.
There were 10 people present in opposition to the
request.
Routh said that this is a nice residential
community and if approved this would disturb the
character of the neighborhood.
Williams said that the fact that there were
restrictions on the subdivision at one time meant
that this property was never intended for
business . Williams made the motion, seconded by
Routh, to deny this request for a Special Use
Permit. The motion passed with a 4 to 1 vote,
Craven voted against the motion.
C: BELLSOUTH PCS, Charlotte, North Carolina, is
requesting a Special Use Permit to located a 300
ft. Cellular Tower, on 47 . 41 acres located at 7190
US Hwy 311N, New Market Township, Zoning Map
#7736, Zoning District HC.
Tracy Harris, BellSouth; Richard Warden, North
State Telephone; Bill Dulla, Engineer, BellSouth;
and Darrell Dennis, BellSouth were present.
Harris explained that there are no existing towers
in this area and this tower will be designed for a
co-location to allow other antennas to be attached
to the tower. Harris said that they had spoken
with all the adjoining property owners and had
taken lots of time in find the right location.
Routh questioned if there was any liability of
falling ice with the tower located so close to the
road. Dulla said that the ice would fall within
100 ft. radius and come off in such small sections
that there would be no danger.
Hodgin, the property owner, was present and stated
that he plans to build his house approximately
1200 feet from the site of the tower and feels
there should be no problems with the tower being
located on this site.
There was no one present in opposition to the
site.
Johnson complimented BellSouth for the well given
presentation and their sensitivity to the
adjoining property owners .
Lynden Craven made the motion, seconded by Aweilda
Williams , to approve this request for a Special
Use Permit. The motion passed unanimously.
6 . REQUESTS FOR PROPERTY REZONING:
A: RANDY SUMMIT, Thomasville, North Carolina, is
requesting that 88.26 acres located on Tree Hollow
Road, be rezoned from Residential Agricultural to
Residential Restricted. Zoning Map #6795 . It is
the desire of the applicant to develop a
restricted residential subdivision of 72 lots.
Al Horne, land surveyor, said that it was Summit ' s
intention to develop a site built subdivision at
the end of Tree Hollow Road and bring this road
(Tree Hollow Road) coming into the property up to
State standards (pave the road) .
Summit said that he has had a soil scientist do
some preliminary evaluations on the property and
70% of the property perks for conventional septic
tank systems and 30% of the property will require
a low pressure pipe system. Summit said that this
is to only entrance to the property that could be
used. Summit said the other roads that come into
the property have such an elevation problem that
it would not be feasible to use them as entrances .
J.C. Russell, 7025 Tree Hollow Road, said that he
and the other property owners on this road have
maintained the road for 20 - 25 years . Russell
said that there is a 2 ft. reserve section at the
end of Tree Hollow Road, put in place by the
original developers, to prevent any extension of
this road. Russell said that they did not want
there road up graded and that 8 of the 11 lots
that would be effected are present in opposition.
Russell said that he had spoken with Mr. Coley at
the N.C.D.O.T. and he told him this was a private
road and could not be used.
Summit said that he owns one of the last lots on
Tree Hollow Road and that his insurance company' s
attorneys had researched this access and said the
road is a public right-of-way and that it could be
used.
Joe Styers, Tree Hollow Road, said that with the
under cut that will have to be done to the road
and the pavement it would be a burden to he and
the other residents on this road.
Gene Pittman, Tree Hollow Road, said that he
wouldn't object if the developer had an additional
access but this would create so many more cars on
this road with 72 lots that it would be too much
of a burden to Tree Hollow Road. Pittman said
that Wright Road or Fox Trail comes into this
property.
Roger Foley, Tree Hollow Road, discussed the
septic tank problems in to area.
There were 8 people present in opposition to this
request.
Routh discussed his concern of there being only
one access proposed for so many lots . Routh also
spoke about his concern of this road (whether or
not it could be used with the reserve strip at the
end and the ownership of the road being
questionable) .
Johnson said that the concerns with this request
are the road ownership, the density, and the
access.
Craven made the motion to recommend to the
Commissioners that this request be denied. The
motion died for a lack of a second.
Johnson advised the Board that they could delay
any action until the concerns (road ownership,
density, and access) could be researched further.
Johnson suggested that the developer and the
property owners on Tree Hollow Road try to get
together to work out some of the problems with
ownership of the road.
McDowell made the motion, seconded by Williams , to
delay and action until these concerns could be
resolved. The motion passed unanimously.
B: UNITED INVESTMENTS, Staley, North Carolina, is
requesting that 30. 95 acres located on Langley
Road (approximately 4. 10 mile off Browns
Crossroads Road) , Columbia Township, be rezoned
from Residential Agricultural to Residential
Restricted. Zoning Map #8733 . It is the desire
of the applicant to develop a subdivision of 8
lots that would allow site built homes, double
wide manufactured homes on permanent foundation,
or modular homes. The applicant has submitted a
new proposal increasing the size of 4 lots on the
state road.
Jim Wilson, Attorney, was present and explained
that there would be 4 wooded lots fronting on the
road and presented a copy of the proposed
restrictions to the Board.
Penny Sillmon, 762 Langley Road, expressed her
concerns of the 4 acre tract that adjoins her that
was cut out and sold since the last meeting.
Sillmon questions if that tract would be allowed
to be re-subdivided. Johnson said no that if this
was proposed, this development/intentions would be
looked upon as "not in good faith" and would not
be allowed without coming back to this Board.
Bill Allred, 1139 Langley Road, was present in
opposition.
Craven made the motion, seconded by Routh, to
recommend to the Commissioners that this request
be approved. The Board noted the reduction in the
number of lots fronting on Langley Road. The
motion passed unanimously.
C: RICHARD & FAYLENE WHITAKER, Climax, North
Carolina, is requesting that 43 acres (out of
108. 85 acres) located on Wayne White Road,
Providence Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning
Map #7798 . It is the desire of the applicants to
develop a restricted residential subdivision of 40
lots .
Glenn King, Developer, was present representing
the Whitakers and explained their intentions to
develop a subdivision for site built homes only.
King said the minimum lot size would be 1 acre and
he presented a copy of the proposed restrictions .
King said that the Whitakers live and farm near
this property and plan to farm the remaining 65
acres . King said that this development would be
similar to Johnston Downs Subdivision (located
near this site) . King explained that there has
not been fitting weather to perform any soil
evaluations.
Frank Coolman, adjoining property owner, requested
a copy of the proposed restrictions.
Cindy Allen, adjoining property owner, discussed
her concerns about the area becoming so densely
populated and with no near infrastructure what
would the community do if the septic systems began
to fail. Allen discussed her concerns of adding
an additional burden to the already over crowded
school system.
Lawrence Allen, Randolph Church Road, said that
there has been a population explosion in this area
and he would like to see the lot sizes larger.
There were 4 people present in opposition to the
request.
Craven made the motion, seconded by McDowell, to
recommend to the Commissioners that this request
be approved. The motion passed unanimously.
D: DONALD OSBORNE, Randleman, North Carolina, is
requesting that 41 . 05 acres located on Providence
Church Road (directly across from Old Providence
Church Road) , Providence Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7777 . It is the desire
of the applicant to develop a restricted
subdivision of 40 lots .
Osborne explained that he lives on this property
and plans to only allow site built homes . Osborne
said the minimum house size would be 1400 sq. ft.
and the rest of the restrictions would be similar
to those in nearby Woodfield Acres Subdivision.
There was no one present in opposition to this
request.
Routh made the motion, seconded by Williams, to
recommend to the Commissioners that this request
be approved. The motion passed unanimously.
E: WILSON REALTY, Asheboro, North Carolina, is
requesting that 19 . 25 acres located on Business
Hwy 220 South (just past Leo Cranford Road) , Cedar
Grove Township, be rezoned from Residential
Agricultural to Light Industrial. Zoning Map
#7658 . It is the desire of the applicant to
develop the property for industrial purposes.
Billie Wilson was present and explained that the
property is surrounded by businesses (Klausner
Lumberyard, a service station, TV repair shop, and
a church) . Wilson said they wanted to market the
property for business uses.
Shirley Fleming, adjoining resident, said that
there are 8 homes that adjoin this property and
that her home is 50 ft. from their property line
(at the rear of her home) . Fleming said they
would have no objection to rezoning the property
with a Conditional Use, where they would know what
type of business would be their neighbor.
Fleming said that this straight zoning could bring
a type of use that many be a nuisance.
Robert Fleming, adjoining resident, said that he
had the same concerns and would like to see the
Commissioners require the property to be zoned
with a Conditional Use. Fleming discussed
possible problems with noise and dust.
Williams made the motion, seconded by Craven, to
recommend to the Commissioners that this request
be denied. The Board noted that they would
reconsider a request for a Conditional Use zoning.
The motion passed unanimously.
7 . The meeting adjourned at 8 : 44 p.m. There were 76
citizens present for this meeting.
