4 int% * RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT
February 13, 1996
There was a meeting of the Randolph County Zoning Board
of Adjustment held at 6 : 30 p.m. , on Tuesday, February 13 ,
1996, in the Commissioners ' Meeting Room, County Office
Building, 725 McDowell Road, Asheboro, North Carolina.
1 . Chairman Charles Adams called the meeting to Order.
2 . Hal Johnson, Planning Director, call roll of the
members : Charles Adams, Chairman, present; Aweilda
Williams, Vice Chairman, present; Tim Poole, absent;
Phil Brower, absent; Bill Dorsett, absent; Lynden
Craven, present; Jim Routh, present; and Maxton
McDowell, Alternate, present.
3. Lynden Craven made the motion, seconded by Aweilda
Williams, to approve the January 16, 1996 Zoning Board
of Adjustment Meeting. The motion passed.
4. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
7 citizens took this Oath.
5 . REQUESTS FOR VARIANCE:
A: CHRIS HINSHAW, Sophia, North Carolina, is
requesting a variance to allow a lot that is
18, 881 sq. ft. and 73 feet in width in lieu of the
required lot size minimum of 30 , 000 sq. ft. and
minimum lot width of 100 feet. Location: Morning
Glory Drive, Forest Park Section 2 lots 42-44 ,
Randleman Township, Zoning Map #7763, Zoning
District RM.
**Arguments for Granting this Request
Hinshaw said that he purchased this land in 1952
and it was only 3 lots. The property has never
been developed but he would like to do so now.
Johnson said that the first subdivision ordinance
was established in 1973, several years after this
subdivision was developed.
**Arguments Against Granting this Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions Based on Findings
of Fact
1 . The Board found that a hardship was not a
result of the applicant' s own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found that the use will not
substantially injure the value of adjoining
or abutting property.
**Order of the Board of Adjustment
Routh made the motion, seconded by Maxton
McDowell, to approve this request for a Variance.
The motion passed unanimously.
B: ELLIS NORMAN BROWN, JR. , Asheboro, North Carolina,
is requesting a variance to allow 5 mobile homes
for family use on an individual tract of land.
Location: 51 . 40 acres, Checkmark Road, New Hope
Township, Zoning Map #6695, Zoning District RA.
**Arguments for Granting this Request
Brown said that currently he and one of his sons
has a residence on this tract. Brown expressed
his intentions of allowing his three other
children to live on the property. Brown said he
has owned this property for 20+ years.
**Arguments Against Granting this Request
Hoyt Loflin, father ' s property adjoins site, said
he was speaking for his father who is currently in
the hospital with heart problems . Loflin said
that his father owns the property that the drive
is on that these people use. Loflin said that
there is no easement deeded for this access.
Loflin said that the road has created a serious
dust problem because there are currently 12
residences using this road.
**Board Discussion: Conclusions Based on Findings
of Fact
Williams said that she was very concerned about
this road that is poorly maintained. Williams
said that her car bottomed out three times before
she got to the end of the road. Routh agreed that
this road doesn' t appear to be maintained by
anyone.
**Order of the Board of Adjustment
Craven made the motion to deny this request for a
Variance. Williams seconded this motion, and
asked that the record reflect that there is a
serious problem with any emergency services being
able to drive down this road. The motion passed
unanimously.
C: EVELINA PRICE, Trinity, North Carolina, is
requesting a variance to allow 2 additional mobile
homes for family members on a 5 acre tract
fronting on a private road in lieu of the required
minimum lot size of 5 acres per residence
(fronting on a private drive) . Location: 2820
Refuge Church Drive, Tabernacle Township, Zoning
Map #6795, Zoning District RA.
**Arguments for Granting this Request
Price was not present for the meeting.
**Arguments Against Granting this Request
Sammy Price, 2879 Refuge Church Road, said that he
is the son of Evelina Price and that she just
wants to be able to bring some of her kin folks in
that drink and do drugs and he doesn' t want them
around. Price said that two years ago he told his
mother he would help her get this five acres next
to him because she was living in High Point and
having to keep up this rough crowd and she was
getting too old for this, she needed someone to
keep and take care of her. The agreement was that
she would not allow them to come and live here.
Now she is offering to allow them here. Price
said that his neighbors are against this but they
asked them to come and take care of this .
**Board Discussion: Conclusions Based on Findings
of Fact
The Board noted that a hardship had not been
proven.
**Order of the Board of Adjustment
Lynden Craven made the motion, seconded by Maxton
McDowell , to deny this request. The motion passed
unanimously.
D: TIMOTHY WOODALL, Liberty, North Carolina, is
requesting a variance to allow a 1 acre lot
(without State Road Frontage) in lieu of the
required minimum lot size of 5 acres (for
properties fronting on a private road) . Location:
off York Martin Road, Liberty Township, Zoning Map
#8728, Zoning District RA.
**Arguments for Granting this Request
Louise Woodall was present and said that she has
lived here for 20+ years on the same tract as her
mother. Now she wants to move her single wide off
and replace it with a double-wide and she needs a
deed to her property for the loan on the new home.
**Arguments Against Granting this Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions Based on Findings
of Fact
Maxton McDowell said that it is obvious that the
applicant wants to improve the site and the
current manufactured home has been there for 20+
years (prior to any zoning) .
**Order of the Board of Adjustment
McDowell made the motion, seconded by Craven, to
approve this request for a Variance. The motion
passed unanimously.
E: LANDON K. PARKER, Asheboro, North Carolina, is
requesting a lot size variance of 2 lots (1 . 79
acre lot and 1 . 74 acre lot) without State Road
Frontage in lieu of the required 5 acre lot size
minimum (for properties fronting on a private
drive) . Location: 2955 Tigerflower Road, 3 . 60
acres , Grant Township, Zoning Map #7667 , Zoning
District.
**Arguments for Granting this Request
Parker' s wife was present and explained that her
husband past away on December 21 , 1995. She
explained that there are 2 modular homes existing
on the property with an easement to the State
Road. 1 modular home are her in-laws and the
other is hers . Her in-laws plan to move to Holden
Beach and want to sale their home here. In order
of them to sale the residence they would need to
deed the tracts separately.
**Arguments Against Granting this Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions Based on Findings
of Fact
The Board noted that the development is existing
on the property and would not be additional homes
added to the private access.
**Order of the Board of Adjustment
Craven made the motion, seconded by Routh, to
approve this request for a Variance. The motion
passed unanimously.
