1 . Chairman Charles Adams called to Order the Randolph
County Planning Board meeting at 6 : 30 p.m.
2. Hal Johnson, Planning Director, called roll of the
members: Charles Adams , Chairman, present; Aweilda
Williams, Vice Chairman, present; Bill Dorsett,
present; Jim Routh, present; Phil Brower, absent;
Lynden Craven, present; and Maxton McDowell, present.
3. Craven made the motion, seconded by Routh, to approve
the Minutes of the April 1 , 1996 County Planning Board
meeting. The motion passed unanimously.
4. REZONING REQUEST:
A: DAVID TRIMNAL, Thomasville, North Carolina, is
requesting that 2 . 67 acres located on Wright Road
(just past Young Oak Drive) , Trinity Township, be
rezoned from Residential Agricultural to Light
Industrial/Conditional Use . Zoning Map #6796 . It
L is the desire of the applicant to operate a
woodworking business in a 76x40 building with
possible expansion in the future.
Johnson said that this property in question was
one of the first rezoning request in Trinity
Township back in 1979 .
Trimnal said that he plans to move his turning
operations to this location. Trimnal makes table
legs and chair arms. Trimnal said that he has 3
full-time and 2 part-time employees and his plans
in the future would be to add for enclosed
storage. Trimnal said that he has an EPA approved
dust system that handles 98% of the dust from his
operation.
Jim Marshall, 7052 Woodale Forest Lane, said that
he is what is called "one of those damn jankees"
that has lived here for 17 years . Marshall spoke
for his community and explained their opposition
to a furniture factory moving into their
neighborhood. Marshall said they enjoy their
quiet residential area and would like to keep it
this way (this neighborhood adjoins this property
to the East) . Marshall discussed limited services
`' such as road maintenance, police patrol, and fire
protection for this area.
There were 7 people present in opposition to this
request.
Johnson told the Board that due to new State
Watershed Regulations, the property would only be
allowed to covered by 24% impervious surface
allowed for the Board to place appropriate buffer
zones for this residential community, if the Board
so chose.
Dorsett made the motion to recommend to the
Commissioners that this request be approved,
recognizing that the existing structure on the
property could only be used for commercial or
industrial activity. Dorsett noted that the
portion of the property that Trimnal is requesting
to be zoned does not immediately join the
residential community (the 4+ acres portion of
property that would remain zoned RA will buffer
between the two types of development) . Lynden
Craven seconded this motion, and the motion passed
unanimously.
B: SUMMIT HOME BUILDERS, INC. , Thomasville, North
Carolina, is requesting that 37 . 86 acres located
on Fuller Mill Road (just past Tree Hollow Road) ,
Trinity Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning
Map #6795 . It is the desire of the applicants to
develop a restricted residential subdivision of 35
lots .
Summit said that he has had a soil scientist
evaluate the property with good results and his
plans are to develop a stick built subdivision
with all the lots fronting on the newly created
roads . Summit said that his minimum house size
would be 1 , 100 heated square feet.
There was no one present in opposition to this
request.
Williams made the motion to recommend to the
Commissioners that this request be approved.
Williams said she felt this was a well planned
community. McDowell seconded this motion and the
motion passed unanimously.
C: RONNIE & LISA YORK, Franklinville, North Carolina,
is requesting that 2 . 67 acres located on NC Hwy 22
North, Franklinville Township, be rezoned from
Residential Agricultural to Highway Commercial/
Conditional Use. Zoning Map #7795 . It is the
desire of the applicant to operate an auto repair
garage in an existing 30x40 building.
York said that he built a garage beside his
residence, for personal use, 9 to 10 months ago.
York said he has had a lot of support from the
community to operate a commercial garage. York
presented the Board with a petition of 180+
signatures in support of this request. York said
that he would not allow the business to become an
eyesore, he would not store vehicles on the
property for more than 30 days at a time, and he
would be willing to build a privacy fence if the
Board felt this would be necessary. York said
that when he came before the Board a couple of
months ago there were only 2 people that spoke
against he and they both lived at least a mile
from his property. York said that one of these
people has been causing problems for him
constantly calling the County Planning Department
saying things that are not so. York described
those things as operating a garage (the department
found no signs of this) and running a used car lot
(York sold a personal vehicle) . York presented
the Board with pictures showing commercial
operations in the Community. York said that he
would only operate his business 5 days a week and
the hours of operation would be 8 am to 6 pm.
Dorsett questioned the number of unlicensed
vehicles on the property. York said that a Code
Enforcement Officer, from the County Planning
Office, came and showed him what vehicles would
have to be removed. York showed the Board the
agreement written up by the County. York said
that he has moved all the vehicles that the County
told him to remove.
Bob Scherer, Randolph County resident, said that
York has made a significant improvement of his
property over the last 2 years with home
improvements and property improvements. Scherer
said that York works on his cars (at Scherer ' s
residence) and that he has known him to be a good
honest businessman. Scherer said that in his line
of work (County School System) he has the
opportunity to see growth in the County and he
felt this would be an asset to this community.
Scherer said that a petition of 180+ community
citizens speaks for itself.
Todd Thompson spoke highly of York and said that
this business would be helping the community.
Ida Groce, neighboring resident, said that York' s
place is well maintained.
Clifton Brock, next door neighbor, said that he
has lived here for 3-4 years and the York property
has been improved each year. Brock said that York
is a good neighbor and a good mechanic .
Chris Elbeno, Kidd' s Mill Road, said that York
takes good care of his property.
Phil Kearns, Charles Street, Asheboro, said that
York is a good man and has helped him in the past.
Tommy Groce, neighboring resident, said that he
felt the Board should allow York to operate a
garage here and if they wanted York to build a
fence he would be glad to help him.
There were 18 citizens present in support of the
request.
There was no one present in opposition to the
request.
Craven said that he felt that if the Board did not
approve this request they would be doing an
injustice to Ronnie and the Community. Craven
made the motion, seconded by Routh, to recommend
to the Commissioners that this request be
approved.
Dorsett asked Craven if he would amend his motion
to added the following restrictions :
**compliance with the Junk Vehicle Ordinance
**no storage allowed in front of the building
Craven and Routh said that they would have no
problem with these restrictions. The restrictions
were added to the motion and the motion passed
unanimously.
D: BOBBY & CONNIE TAYLOR, Whitsett, North Carolina,
is requesting that 25 . 45 acres located on Liberty
Grove Road, Liberty Township, be rezoned from
Residential Agricultural to Residential Mixed/
Conditional Use. Zoning Map #8738 . It is the
desire of the applicants to develop a mobile home
park of 18 spaces.
Taylor was present and explained his intentions to
develop a mobile home park. Taylor said that he
plans to purchase the property, build a street
down the middle of the property and locate mobile
home lots on each side of the street. Taylor said
he would require newer model mobile homes and they
would have to be underpinned. Taylor said that he
plans to purchase the additional land that lies in
Guilford County if this park is approved.
Johnson questioned Taylor ' s plans for the old
house and barn on the property. Taylor said he
would have them torn down.
Dorsett asked Taylor about the management of the
park. Taylor said he would oversee the management
of the park. Taylor said he lives approximately
15 minutes of the site.
Ralph Evans, Attorney in Liberty, represented the
residents in the Community opposed to this
rezoning. Evans said that this community is very
low density with a lot of open space. Evans said
that he is aware that there is a nearby mobile
home park but that it is only 7 lots (not 18) and
it was developed prior to zoning regulations in
this area. Evans added that the existing park
owner lives on the same property as the park.
Evans described the area as rural, residential ,
and agricultural. Evans said that the park would
not be consistent to the area and would detract
from the make up of the community. Evans
described additional erosion problems that may be
cause during development of this property, due to
topographical elevations . Evans presented a topo
map of the property. Evans said that he didn' t
feel the well kept, existing 7 space mobile home
park should be considered when making this
decision due to the fact that it was developed
property to zoning and the remainder of the area
is primarily site built. Evans presented the
Board with a petition of opposing residents in the
community.
Mac Whatley, an Asheboro Attorney, Mayor of
Franklinville, and member of the Historical
Society. Whatley spoke about the time that the
County hired him to inventory the historic
buildings within the County in 1986 . Whatley said
that he was speaking to the Board as a friend of
the County. Whatley said that this house would be
1 of the top 20 most important historic structures
in the County. Whatley said that this house was
built for Congressman John Long who served in the
North Carolina House and the United States House
of Representatives. Whatley said the book of
historic buildings with the County has been
published, approximately 30% of the structures
featured in the book have been destroyed. Whatley
said that it would be a great cultural and
historical loss to Randolph County for us to
participate in the destruction of this site.
Whatley said that John Long was also the
grandfather of John Wesley Long, Jr. whom Wesley
Long Hospital was named after . Whatley said that
he realized that the present Zoning Ordinance
speaks of Land Use but he would encourage the
Board to consider including the designation of at
least a couple dozen structures in Randolph County
as historic sites through the zoning ordinance.
Whatley discussed the general statutes that allow
the County to regulate historic sites. Whatley
said he would be glad to help the County in any
way. Whatley said that he realized this is a
Conditional Use zoning request and he would ask
the Board to consider that the house and some area
around the house be preserved. Whatley said that
he realized this would not be the best solution
but it could help to preserve history.
Lynn Taylor, Edgewood Drive, Burlington, real
estate agent for this property, said that there
are 22 elder heirs involved that have fond
memories of this house that had hopes of someone
restoring it. Taylor said this has not happened.
Taylor said she has shown the house to
approximately 50 people and have not been able to
sale the property. Taylor said that she felt
Taylor would keep the property well maintained and
operate a nice park. Taylor said she didn' t want
the Board to think that the heirs were not
insensitive to the historic value of the property.
Dawn Hemphill, 6654 Island Oak Drive, Liberty,
said that she grew up in this community and is
strongly opposed to someone from another county
coming into Randolph County to develop a mobile
home park. Hemphill said that she thought if
Taylor was really sensitive to the area he would
have some proposed regulations for this proposed
park. Hemphill also said that there have been
reasonable offers made on the property from some
people in Liberty but they have not been accepted
by the property owners .
There were 20 people present in opposition to the
request.
`-' Dorsett said that the Board is concerned of the
future of Randolph County and this development
would be out of keeping with Land Development
Plans for this area. Dorsett said that one of the
main reasons for beginning Zoning in Randolph
County was due to the County becoming a bedroom
community to Guilford County. Dorsett said he
thought the Board should deny this request
totally.
Craven agreed with Dorsett made made the motion to
recommend to the Commissioners that this request
be denied. Dorsett seconded this motion and the
motion passed unanimously.
E: ROGER & LINDA DUNLAP, Seagrove, North Carolina, is
requesting 59 . 80 acres located at end of Forest
Hills Drive, Union Township, be rezoned from
Residential Agricultural to Residential Mixed.
Zoning Map #7636. It is the desire of the
applicants to develop an 11 lot subdivision that
would allow site built, single-wide manufactured
homes, double-wide manufactured homes or modular
homes.
Dunlap was present and told the Board that there
is an existing 60 ' right-of-way running through
this property to the properties adjoining at the
rear. Dunlap said that the roads are being built
to state specifications and will have a buffer of
trees on each side. Dunlap presented a proposed
road maintenance agreement for future lot owners .
Dunlap said this road would access from another
private road through a mobile home subdivision.
Bill Smith, 2509 Forest Hills Drive, said the
private section of Forest Hills Drive has been a
problem for the 5 years he has lived here. Smith
said that if another private road with road
maintenance agreements were tied to this road it
would be an asset to this private road.
Roy Bryte, Forest Hills Drive, said that he lived
on the State maintained section of Forest Hills
Drive and the private section is full of pot holes
and no one will do anything to maintain the road.
Bryte said he felt Dunlap would help this
situation.
Gene Trogdon, 2382 Forest Hills Drive, said that
he had no objections to this development but he
was concerned about the road maintenance. Trogdon
requested a copy of the proposed agreement.
Jerry Chriscoe, Forest Hills Drive, said that
actually Dunlap has had the property timbered, cut
the road, but hasn't done anything to help the
soil erosion and mud problems he has created.
Chriscoe said he would just like to see some grass
sowed on the edge of the road.
McDowell questioned how enforceable these private
road agreements were. Johnson said that private
roads are a real problem because they are not
enforceable by the County and in the past few
subdivision lot owners have enforced their
restrictions in court. Johnson said that
approving this request would be adding 11 more
residents to this road that the county or state
will not keep up.
Craven said that this is a problem that we 've seen
may times (people not maintaining their roads) .
Craven said this would be 11 additional lots with
22 more cars and this would not correct the
existing bad situation. Craven added his concern
for emergency services providing services to
residents if this was approved.
Williams said that in the past an extension of a
private (with road maintenance problems) has not
helped turn around the problem, it has only
worsened the problem.
Craven made the motion, seconded by Williams, to
recommend to the Commissioners that this request
be denied. The motion passed unanimously.
F: MCDOWELL TIMBER COMPANY, Asheboro, North Carolina,
is requesting that 33. 36 acres (out of 105 . 98 acre
tract) located on Hwy 42 South (approximately
mile past Fairview Farm Road) , Grant Township, be
rezoned from Residential Agricultural to
Residential Restricted. Zoning Map #7689 . It is
the desire of the applicant to develop a
restricted residential subdivision of 42 lots.
Ken McDowell was present and stated their
intentions to develop a subdivision with 30 , 000
sq. ft. lots fronting on paved roads . McDowell
said that all the lots except 3 lots will front on
the newly created streets . McDowell said the
Health Department has looked at some of the sites
and the soils are good. McDowell said the homes
would be prefab or site built.
John Hulin, 3088 Bethel Friends Road, presented an
article about sprawling growth and the loss of
farm land in this country. Hulin read the article
to the Board. Hulin said that this development
would be of no financial gain to the county and
this would create the need for modular units at
the Coleridge School before their new school is
completed.
Karen Coble, 4254 Little Bean Store Road, told the
Board that there are 26 residences on more than
261 arces (with an average of 10 acres per
residence) in the area surrounding this site.
Coble said that this proposal of 42 lots on 33 . 36
acres would not be compatible to their community.
Coble questioned the type of environmental buffers
to be including in this development (there are
none) . Coble expressed concern for the farms in
the area expanding their existing farms in the
future if this development is built. Coble said
she felt this would effect their property values
negatively. Coble said she would like to see their
community be maintained like it is. Coble
discussed concern for possible problems with
density, traffic, schools, and the type of
residences .
Jerry Macon, Hwy 42 , said that he owns property
adjoining an entire side of this development and
he would like to see the houses and the lots
increase in size. Macon said that his family has
operate this farm here for more than 60 years .
Terry Rhamey, Hwy 42 , said that they moved here 2
months ago and may not have purchased the land if
they realized this would be developed. Rhamey
said there would be no wooded buffer between his
home and this development.
There were 24 citizens present in opposition to
this request.
Craven made the motion to recommend to the
Commissioners that this request be denied. Craven
said that this is a rural farming community and he
didn' t feel this would compatible to land use
patterns in this rural setting.
Dorsett said that he felt the small lot sizes
would be incompatible to the community. Dorsett
seconded the motion and the motion passed by 5 to
1 vote - Jim Routh voted against the motion.
G: MCDOWELL FAMILY LIMITED PARTNERS, Asheboro, North
Carolina, is requesting that 13. 91 acres (out of
155 . 20 acres) located on Providence Church Road
(just past Oxendine Road on left) , be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7777 . It is the desire
of the applicants to develop a restricted
residential subdivision of 11 lots.
Ken McDowell discussed their intentions to develop
a subdivision on this site that is adjoined by a
mobile home park and in an area with all housing
types . McDowell said that some of the builders
that are currently building in Woodfield Acres
( 1- mile down the road) have expressed interest in
building on these proposed lots . McDowell said
this would have restrictions like Woodfield Acres ,
with a minimum house size of 1200 sq. ft.
There was no one present in opposition to this
request.
Dorsett made the motion to recommend to the
Commissioners that this request be approved as
compatible to the Community.
Williams said that this would be as compatible to
this community as the last request was in
compatible to that community. Williams seconded
the motion and the motion passed unanimously.
5. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
10 people took this Oath.
6 . REQUESTS FOR A SPECIAL USE PERMIT:
A: DAVID & LOU WILSON, Randleman, North Carolina, is
requesting a Special Use Permit to operate an
Adult Development Center on 3. 70 acres located at
3971 Heath Dairy Road; Back Creek Township; Zoning
Map #7754; Zoning District RA.
Dean Wilson, Fox Street, Randleman, explained that
their operations are somewhat similar to the
Sheltered Workshop. The help aging adults become
more independent. Wilson said he didn' t feel this
would change the community in anyway. Wilson said
they would operate 7 to 8 hours a day and the
classes would be to teach basic living skills and
some job skills.
There was no one present in opposition to this
�'' request.
Adams commended this type of program and said that
his cousin had been in one of this programs and is
now a productive member of society due to the
program.
Williams made the motion, seconded by Craven, to
approve this request for a Special Use Permit.
The motion passed unanimously.
B: JIMMY & PAMELA NIXON, Trinity, North Carolina, is
requesting a Special Use Permit to operate an
automotive repair shop in an existing 12x24
building on 2 . 86 acres located at 3382 Thayer
Road; Tabernacle Township; Zoning Map #7705;
Zoning District RA.
Nixon said he had lived here for 10 years and
would like to operate this business at his home.
Nixon said that he plans to construct a privacy
fence. When questioned about junk vehicle storage
on the property, Nixon said that most all the
vehicles on the property would run if he placed a
battery in them and he has removed 9 junk vehicles
from his property.
There was no _one present in opposition to this
request.
Dorsett said that he counted 21 vehicles and a
tractor on the property that are possibly junk.
Dorsett said that he felt this property was in
direct violation of the Junk Car Ordinance and
should be brought into compliance before we
consider any issuance of a Special Use Permit.
Routh agreed with Dorsett and for this reason
Routh made the motion to deny this request for a
Special Use Permit, but added that the Board would
reconsider the request once the property was
brought into compliance with the regulations .
Craven seconded this motion and the motion passed
unanimously.
C: DWIGHT & NANCY MEREDITH, Trinity, North Carolina,
is requesting a Special Use Permit for an
additional 5 lots in Riverside Estates Mobile Home
Park for a total of 17 lots on 18 . 89 acres on Old
Mountain Road; Trinity Township; Zoning Map #6795;
Zoning District RM/CU.
Meredith said that he wants to add 5 lots within
the existing boundaries of his park. Average lot
size would be 1 . 45 acres for the entire park.
Meredith said that he maintains the roads,
provides dumpster for trash disposal, and is in
and out of the park about everyday. Meredith said
this park was developed in 1990 . Meredith added
that his other park (adjoining this site) was
developed in 1986 and Meredith said he provides
natural buffers of trees around both of the parks .
There was no one present in opposition to this
request.
Johnson said that he has never had one complaint
with any of Dwight' s mobile home parks, Johnson
added that he couldn' t say this for many of the
parks in the County.
Craven made the motion, seconded by Routh, to
approve this request for a Special Use Permit.
The motion passed unanimously.
D: HENRY DELK, SR. , Denton, North Carolina, is
requesting a Special Use Permit for a planned
business development located on 7 . 95 acres at Hwy
64 West (just past Stutts Road) ; Cedar Grove
Township; Zoning map #7731; Zoning District LI.
Delk said that he operates Asheboro Well Company
and there is a cabinet shop on this property now.
Delk said that he wants to add a business where
the operators put sheet metal on NASCAR race cars
for Petty, Martin, and others . Delk said that
there would be no engine work or painting done to
the cars at this location. The business would
operate 5 days a week during daytime hours.
Johnson questioned Delk about the portion of his
property where the dirt has been hauled off. Delk
said that the portion of property between his
fence and the state road is in the state
right-of-way. Delk said that the state hauled
this off and made the eyesore that it is .
There was no one present in opposition to this
request.
Craven made the motion, seconded by McDowell, to
approve this request for a Special Use Permit.
The motion passed unanimously.
E: BOYD RILEY, High Point, North Carolina, is
requesting a Special Use Permit to obtain a
wholesale license at his residence located on 4 . 92
acres at 5431 Racine Road; Providence Township;
.., Zoning Map #7776; Zoning District RA.
Riley described his part-time business of selling
bobcats and farm tractors . Riley said that he
would not have any junk storage and there would
normally be no inventory of this equipment (for
sale) on the property. Riley said that once the
house is completed he plans to move the building
to the back of the property.
Rod Richards, neighbor, said that he is really not
opposed to the request but just concerned of how
close this would be to his house.
Riley said that it would be on the opposite side
of his property from Richards .
Mrs. Richards, neighbor, questioned the amount of
equipment that would be stored for sale on the
property.
Riley said that there would never be more than 1
piece of equipment (for the business) on display.
Routh made the motion to approve this request with
the restriction of not more than 1 piece of
equipment on display at one time. McDowell
seconded this motion, and the motion passed
unanimously.
F: TOMMY D. YATES, JR. , Sophia, North Carolina, is
requesting a Special Use Permit to allow an
archery shop/fire arm sales in an existing 600 sq.
ft. building on 2 . 77 acres located on 2 . 77 acres
at 4370 Caraway Mountain Road; Back Creek
Township; Zoning Map #7733; Zoning District RA.
Yates said he purchased the property in March of
this year. Yates said that he would be the only
employee for this part-time business . Yates ' wife
operates a day-care on the premises. Yates said
that he would have an archery range but not a
firing range. Hours would be 5-8 pm during the
week and 9-1 on Saturdays .
Johnson questioned the proximity of the girl scout
camp from the property. Yates said it is right
across the road.
Yates ' wife said that the day-care closes around 4
pm and the bows will be shot away from the girl
scout camp.
Lawrence Wall, Snowberry Trail, expressed concern
of shooting on the premises.
Michael Munzer, Caraway Mountain Road, presented
notarized letters from neighbors opposed to the
request. Munzer expressed concern of fire arms on
the premises in an area with a large number of
children. Munzer said that he is strongly opposed
to the commercialization of Caraway Mountain and
storage of ammunition in this residential
community.
Dorsett said that weapons and children do not mix
and this would be entirely the wrong area for this
type of business.
McDowell questioned if the Board should just
consider the archery end of this request.
Craven agreed with Dorsett and made the motion to
deny this request for a Special Use Permit.
Dorsett seconded this request and the motion
passed 5 to 1 with Williams voting against the
motion.
7 . Election of Officers:
Chairman
Dorsett made the motion, seconded by McDowell, to elect
Aweilda Williams, Chairman. The motion passed
unanimously.
Vice Chairman
Craven made the motion, seconded by Dorsett, to elect
McDowell, Vice Chairman. The motion passed
unanimously.
8 . The meeting adjourned at 9 : 54 p.m. There were 158
citizens present for this meeting.
