�' 1771 * RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT
May 7, 1996
1 . Chairman Charles Adams called to Order the Randolph
County Zoning Board of Adjustment meeting.
2 . Hal Johnson, Planning Director, called roll of the
members : Charles Adams , Chairman, present; Aweilda
Williams, Vice Chairman, present; Bill Dorsett,
present; Jim Routh, present; Phil Brower, absent;
Lynden Craven, present; and Maxton McDowell, present.
3. Craven made the motion, seconded by Routh, to approve
the Minutes of the April 2, 1996 Randolph County Zoning
Board of Adjustment meeting.
4. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
�... nothing but the truth, so help you God. "
10 people took this Oath.
5 . REQUESTS FOR A VARIANCE:
A: LEE DAVID ROBINSON, JR. , Archdale, North Carolina,
is requesting a variance to allow 8 ft. side
setback in lieu of required 10 ft. side setback
for an addition to residence on . 60 acre .
Location: 5259 Jasper Drive , New Market Township,
Zoning Map #7737 , Zoning District RR.
**Arguments for Granting this Request
Wendy Robinson was present and explained that
their lot is located in a culdesac. Robinson said
that due to the location of the septic tank system
the only way they can added to their home would be
on the right side of the house. Robinson said
their family has grown and they will have to move
if they cannot add to their home . Robinson said
they need to add 2 bedrooms and a garage to the
structure . Robinson said that they have spoken to
their neighbors and they have no opposition to
this addition to this house.
**Arguments Against Granting this Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions Based on Findings
of Fact
Dorsett said he felt the applicant had established
a true hardship.
**Order of the Board of Adjustment
Williams made the motion, seconded by Routh the
approve this request for a setback variance. The
motion passed unanimously.
B: ELBERT & PATRICIA CANTER, Archdale, North
Carolina, is requesting a variance to allow a 2 . 20
acre tract with no state road frontage in lieu of
5 acre minimum lot size requirement. Location:
Canter Lane, New Market Township, Zoning Map
#7737 , Zoning District RA.
**Arguments for Granting this Request
Canter said that he would like to deed his
daughter 2 acres of his property to allow her to
build her home here. Canter said that the portion
of property to be deeded would be approximately
500 feet from the State road. The daughter
currently lives in a mobile home on the property
and if the home is built the mobile home will be
removed. Canter said that this property is his
home place and he intends to split the property
evenly in his will to be deeded between his 2
daughters . Canter said that he raises tobacco on
this property and if he is required to deed 5
acres to his daughter it could cause a farming
hardship to his property.
**Arguments Against Granting this Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions Based on Findings
of Fact
McDowell said that he felt the applicant had shown
a hardship to the property and if the applicant is
allowed to divide the property he will be
upgrading the development on the property from a
temporary structure to a site built home.
**Order of the Board of Adjustment
McDowell made the motion, seconded by Craven, to
approve this request for a Variance. The motion
passed unanimously.
C: JAMES & CAROLYN EDWARDS, Sophia, North Carolina,
is requesting a variance to allow a 3rd residence
on 2 . 39 acres. Location: Sharon Acres
Drive/Forest Trail, Back Creek Township, Zoning
Map #7734, Zoning District RM.
**Arguments for Granting this Request
Edwards said that his daughter has a trailer and
can' t find a place to locate the home. Edwards
said that he and his son all ready live on the
property and he has lived here for 23 years .
**Arguments Against Granting this Request
E.T. Suits, Sharon Acres Drive, said that he is
opposed to the addition of this residence on this
small lot. Suits said that this would hinder him
as a property owner in being able to sale his

property.
Sherrill Shaw, 209 Shaw Street, said that when he
developed Brookfield Acres in 1973 the original
covenants only allowed for one single family
residence per lot. Shaw said these restrictions
are on record in the Register of Deeds Office .
Calvin Williams, Forest Trail, said that this
would make this property look like a trailer park.
Williams said that if this lots is allowed to have
all these mobile homes, all the lots in Brookfield
Acres should be allowed to a multiple homes .
Williams said that the Edwards have a lot of junk
storage on their property and don't keep up the
property. Williams said that to allow an
additional family member on the property it will
only get to be more of an eyesore.
**Board Discussion: Conclusions Based on Findings
of Fact
Craven noted the private restrictions on record in
the Register of Deeds Office. Craven added that
there has been no hardship proven in this case.

Craven made the motion, seconded by Williams, to
deny this request for a Variance. The motion
passed unanimously.
