Chairman Aweilda Williams called the Randolph County Planning Board Meeting to Order at 6: 30 p.m. Planning Director Hal Johnson announced that the TERRY RHAMY request had been postponed due to a death in his family. Johnson said that this request would be heard at the July 9th Board meeting. 2. Hal Johnson, Planning Director, called roll of the members: Aweilda Williams , Chairman, present; Maxton McDowell, Vice Chairman, present; Charles Adams, absent; Bill Dorsett, present; Jim Routh, present; Lynden Craven, present; and Phil Brower, absent. 3. Lynden Craven made the motion, seconded by Jim Routh, to approve the May 7 , 1996 Planning Board Meeting Minutes. The motion passed. 4. REQUESTS FOR PROPERTY REZONING: A: WILLIAM & BETTY COLLIER, Liberty, North Carolina, are requesting that 21 . 47 acres (out of 54. 81) located at 1006 Old 421 Road, Liberty Township, be rezoned from Light Industrial to Heavy Industrial. Zoning Map #8727 . It is the desire of the applicants to operate a furniture manufacturing business. Walter Sprouse, Randolph Economic Development Corporation, was present at the meeting. Sprouse discussed the proximity of the site to Liberty Industrial Park and Ultra Craft Corporation. Sprouse explained the dry kiln operation being proposed and explained that the lumber would be brought in all ready cut and bundled. This facility would only be kilns that would remove the moisture from the lumber. Sprouse stated that this development would cost around $1 . 5 million and employee approximately 17 people. Sprouse said the operation would require no burning or smoke and have no wastewater. Sprouse said it is the intentions of the prospective buyers to maintain the buffer zone and develop with in the existing clearing on the property. The lumber would be used for furniture companies and Sprouse described this operation as a good "support" company for the existing furniture manufacturers in the County. Sprouse explained their desire to maintain a right-of-way from Southern Railway to use an access at the far southern end of the parcel, but explained that the parcel currently has right-of-way at the opposite end of the tract. Sprouse said that this property is currently zoned industrial and will be used for an industrial business. Sprouse noted that this would be more desirable than several things that could come in under the Light Industrial Zoning District. There were 4 area residents present at the meeting and Doris McMasters, adjoining resident, said that she was not sure if she was opposed, but she doesn' t want to see the buffer of trees removed from the property. Betty Collier, property owner, said that they would not want to put anything in their neighborhood that would hurt their neighbors . No one spoke in opposition to the request. Maxton McDowell made the motion to recommend to the Commissioners that this request be approved. Lynden Craven seconded this motion and the motion passed unanimously. B: BOBBY L. PUGH, Elon College, North Carolina, is requesting that 50 acre (out of 76 . 35 acres) located at corner of Iron Mountain Road and Spoons Chapel Road, Grant Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7780 & 7770 . It is the desire of the applicant to develop a site built residential subdivision of 31 lots. Pugh explained his intentions of selling the property to Thomas and William Ellison for site built construction. Pugh said that a soil scientist has visited the property and the proposal would be compatible to the area. Thomas Ellison said that he and his brother have live here all their lives and their families are here. Ellison said that they have obtained their General Contractors License and they want to build the homes in the development. Ellison said that they will maintain as many trees as possible (only remove for the roads and the house sites) . Ellison said that the average lot size would be 1 . 6 acres and only allow site built homes with a minimum of 1400 heated sq. ft. Ellison said that no mobile homes or modular homes would be allowed. Phyllis Smith, questioned were the proposed road would access. Ellison answered that the road would intersection with Spoons Chapel Road. There was no one present in opposition to the request. Jim Routh made the motion, seconded by Lynden Craven, to recommend to the Commissioners that they approve this request for rezoning. The motion passed unanimously. 5. Swearing in of the Witnesses: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you God. " 13 citizens took this Oath. 6. REQUESTS FOR A SPECIAL USE PERMIT: A: RODNEY BROWN, Cedar Falls , North Carolina, is requesting a Special Use Permit to operate an automotive and tractor repair shop in a portion of an existing (100 x 120) building, located on . 95 acre at 2299 Whiles Memorial Road, Franklinville Township, Zoning Map #7784, Zoning District HC-CU. Johnson said that this property was originally rezoned to HC-CU by the County in 1989 . Brown explained that currently there is a warehouse and general contracting business in the building. Brown said this may require 2 additional employees but there would be no outside storage. Johnson complimented Brown on his property saying that the facility was extremely clean and well kept. There was no one present in opposition to the request. Craven made the motion, seconded by Routh, to approve the request for a Special Use Permit. The motion passed unanimously. B: TERRY RHAMY, Asheboro, North Carolina, is requesting a Special Use Permit to allow outside storage of drilling equipment at his residence located on 7 . 47 acres at 3401 NC Hwy 42 South, Grant Township, Zoning Map #7689 , Zoning District E-1/RA. This request has been rescheduled for July. C: DAWAN MARTIN, Asheboro, North Carolina, is requesting a Special Use Permit to operate a motorcycle repair shop in an accessory building (27 x 30) at his residence located on 6 . 21 acres at 4464 Buffalo Ford Road, Grant Township, Zoning Map #7790, Zoning District RA. Martin said that the building was constructed for his hobby and it has worked into a part-time business . Martin said that he has one other person that works with him but that he wants to keep the business small. Leonard Hatcher, adjoining property owner, said that he lives here in a mobile home and he is building a house here that will be located closer to the Martin property. Hatcher said that Martin keeps a neat place, doesn' t work late hours, and has a very nice, professional operation. William Brown said that he lives across the road from Martin and he has no objections to this request. Arnold Davis, Taylors Creek Drive, Asheboro, said that he owns property adjoining Martin and he was concerned with the wastewater disposal from washing motors . Davis said that he also questions the clientele this type of business may bring to the area. Martin said that he keeps the oils and fluids in containers and has a company that will come by and pick up to dispose them properly. Dorsett said that this is a very neat operation but that he would like to include the restriction of no storage in front of the building. Dorsett said that the building is very well buffered. Martin said that he would not have a problem with this restriction. Dorsett made the motion to approve this request for a Special Use Permit with the restriction of no storage in front of the building. Routh seconded the motion and the motion passed unanimously. D: GEORGE POE, SR. , Franklinville, North Carolina, is requesting a Special Use Permit to operate a motorcycle and small engine repair shop in a 30 x 40 building (to be constructed) at his residence located on 5 . 06 acres at 3852 Hardin Ellison Road, Franklinville Township, Zoning Map #7794, Zoning District RA. Johnson said that Poe ' s residence is approximately 1/5 mile off the road and is very well buffered. Johnson said that there is one other residence back in the property and he asked Poe who lived there . Poe said his son. There was no one present in opposition to this request. Craven made the motion, seconded by McDowell, to approve this request for a Special Use Permit. The motion passed unanimously. E: CARL CHESHIRE, Asheboro, North Carolina, is requesting a Special Use Permit to operate a variety store/fast food restaurant, at N.C. 159 (property on left at corner of NC 159 and Zoo Spur) , Grant Township, Zoning Map #7668 , Zoning District E-1 , Property Owner - Lewis Thomas. Cheshire, 481 Walnut Drive, Asheboro, explained his intentions to develop the property. Cheshire presented a site plan that included campground facilities and hotel along with the variety store and fast food restaurant. Johnson said that the plan showed considerable more than the request filed. Cheshire said that he plans to construct a 60 x 80 building with a separation wall for both the restaurant and variety store . Cheshire said that he would come back with a request in the future for the Board to consider the hotel and campground facilities. Cheshire said that the access would be on Hwy 159 where he owns 200+ frontage. Cheshire said that he is now the property owner, he purchased the property 30 days ago. Lewis Thomas, previous property owner, said that he felt there is a need for progress in Randolph County and this would be good for the area. Glenn Adams, representative for the N.C. Zoo, said that he would like time to take a good look at the plans . Adams said that the Zoo has roughly 800, 000+ visitors each year and this could create a potential traffic problem for this 2 lane section that this development would access. Adams said that they are not necessarily opposed to the proposed development of this 15 acres but without seeing the proposed plans, he could not say. Adams said that with the State ' s large investment here, he would like to ask the Board to not take any action until they had an opportunity to work with the property owners and review the plans. Dorsett said that every request that comes to this Board is important, but this one is unique on how it effects the Zoo. Dorsett said this effects not only Randolph County citizens but the citizens of this State due to its proximity with one of the main entrances to their zoo. Dorsett said that if this was put on a ballot for a vote, this would be denied and we should deny this request. Routh said that he agreed with some of Dorsett' s comments but that he believed this is Randolph County owned property and a property owner has the right to use their property. Routh said that he felt this was one of the most pristine areas in the County, especially in the Zoo entrance area, and the esthetics of development here should be considered. Routh said that he felt proper plans should be required, with appropriate time for review. �" Dorsett said that the Board has the right to require development plans and should be required for this property to allow the County to review along with the assistance of the N.C. Zoo personnel. Dorsett added that he still felt this is just too close to the main entrance of the Zoo. Lewis Thomas said that he was born here on this property and the State didn' t ask him about constructing the Zoo here . Thomas said that he thought a man should be able to building what he wants on his own property. Dorsett made the motion to deny this request with the possibility of bringing a more detailed site plan back for review at a later date. The motion died for a lack of a second. Routh made the motion to delay a decision on this request until such time that more detailed plans could be provided for the Zoo personnel (Routh said although he was not an advocate of government) and the Board has time to review the plans properly. The motion was seconded by McDowell and the motion passed unanimously. F: SARAH TOOMES, Randleman, North Carolina, is requesting a Special Use Permit to operate a sewing business in an existing 11 x18 building (business will be moved into an existing 30 x 30 building in the future) at her residence located on 2 . 3 acres at 2129 Millboro Road, Franklinville Township, Zoning Map #7774 , Zoning District RA. Toomes said that she started hiring employees in November of last year and that she currently has 7 employees. Toomes said that she was not aware that the building or zoning codes effected her property. Toomes said that when the code enforcement officer visited her property, she came in to try to comply with County regulations. Toomes said that the building she is currently in doesn't have bathroom facilities, but the 30 x 30 building that she is remodeling to use will. Currently they are using the bathroom facilities of the residence. When questioned when the new facility would be ready, Toomes answered maybe in 60 days. Toomes presented a petition of people that reside within 1 mile in favor of this request. There was no one present in opposition to this request. Craven made the motion, seconded by Routh, to approve this request for a Special Use Permit. The motion passed unanimously. G: LEWIS DANIELS, Randleman, North Carolina, is requesting a Special Use Permit to operate a rural family occupation of a variety/grocery store in an existing building at his residence located on 1 . 1 acres at 2809 Old Liberty Road, Franklinville Township, Zoning Map #7773, Zoning District RR. Daniels said that this existing structure was used for a grocery store until 1975 . Daniels said that he doesn' t plan to have additional employees (besides himself) . Daniel presented a petition of neighboring residents in favor of his request. Robert Norris, 3224 Old Liberty Road, said he would like to see a country store in this area. There was no one present in opposition to this request. Craven made the motion, seconded by McDowell, to approve this request for a Special Use Permit. The motion passed unanimously. 7 .
