�. June 4, 1996
1 . Chairman Aweilda Williams called the Randolph County Zoning
Board of Adjustment Meeting to Order.
2 . Hal Johnson, Planning Director, called roll of the members:
Aweilda Williams, Chairman, present; Maxton McDowell , Vice
Chairman, present; Charles Adams, absent; Bill Dorsett,
present; Jim Routh, present; Lynden Craven, present; and Phil
Brower, absent.
3 . Lynden Craven made the motion, seconded by Jim Routh, to
approve the Minutes of the May 7 , 1996 Randolph County Zoning
Board of Adjustment Meeting. The motion passed.
4 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are about to
give is the truth, the whole truth, and nothing but the truth,
so help you God. "
3 citizens took this Oath.
5 . REQUESTS FOR A VARIANCE:
A: DOUGLAS JOHNSON, Asheboro, North Carolina, is requesting a
vairance to allow a 9 ft. side property line setback in
lieu of the required 10 ft. Location: 486 Mountain Brook
Road, . 81 acre lot, Back Creek Township, Zoning Map #7722 ,
Zoning District RA.
**Arguments for Granting the Request
Johnson said that the house was 75% complete when a new
survey was done for the mortgage loan. This survey showed
an error in the original survey. The house foundation was
sited 9 feet off the property line in lieu of the required
10 feet setback.
**Arguments Against Granting the Request
There was no one present in opposition.
**Board Discussion: Conclusions Based on Findings of Fact
The Board recognized an obvious hardship to the property
with the error that was made in the original survey of the
property.
**Order of the Board of Adjustment
Bill Dorsett made the motion, seconded by Jim Routh, to
approve this request for a Variance. The motion passed
unanimously.
B: JOHN FLOYD, Thomasville, North Carolina, is requesting a
variance to allow development of 8 (20,000 sq. ft. ) lots
as platted prior to WQCA and Watershed Regulations .
Location: Covered Bridge Road, Tabernacle Township,
Zoning Map #7703 , Zoning District RA.
**Arguments for Granting the Request
Johnson explained that this subdivision was platted
several years ago when the County only required 20 ,000 sq.
ft. per building lot. Johnson said that the watershed
regulations require a property owner with contiguous
vacant lots to combined lots to meet the watershed lot
size requirements . The reason the County passed the
regulation was because we had received information from
the State that this would be their requirement. However ,
when the State passed their regulations this was made an
option for the counties (instead of a requirement like the
State had originally planned) . Johnson said that Randolph
County has historically "grandfathered" lots that were
created under the old regulations . Johnson added that
this type of variance would be compatible to this
subdivision.
Floyd explained that he purchased the lots 30+ years ago
and he now wants to sell them as individual lots, as he
purchased them.
**Arguments Against Granting the Request
There was no one present in opposition to this request.
**Board Discussion: Conclusions Based on Findings of Fact
Dorsett said that area is sparsely developed and this
would not over-crowd the community.
**Order of the Board of Adjustment
Routh made the motion, seconded by McDowell , to approve
this request for a Variance. The motion passed
unanimously.
C: JIMMY TROTTER, Thomasville, North Carolina, is requesting
a variance to allow a subdivision for 5 lots (1 acre lots)
in lieu of the required 5 acres per lot on a private road.
Location: Carl Lee Drive, 7 . 81 acre, Tabernacle Township,
Zoning Map #6782 , Zoning District RM-CU.
**Arguments for Granting the Request
Terry Trotter (son of the applicant) said that there are 4
children that will inherit the property in the future, but
his father wants to go ahead and deed the lots out
separately to each of his children. Trotter informed the
Board that this road services a family division of
property and that some of the other family members want to
do this to their tracts for their kids also.
**Arguments Against Granting the Request
Johnson explained that the problem with this request was
that it was zoned for this development through the public
hearing process . Johnson said that the fact that this
property was not to be subdivided was clearly discussed at
that time, prior to the development of these rental
houses. Johnson said that he would not have a problem
with the division of the property if the road was brought
up to State Maintenance Standards but this development
went through this Board and the Board of Commissioners and
this fact should be considered.
**Board Discussion: Conclusions Based on Findings of Fact
Dorsett said that this road has the potential for this
type of request coming up for several tracts .
**Order of the Board of Adjustment
Dorsett made the motion, seconded by Craven, to deny this
request for a Variance. The motion passed unanimously.
6 . The meeting adjourned.
