There was a meeting held at 6: 30 p.m. , on Tuesday, July
9, 1996, in the Commissioners ' Meeting Room, Randolph County
Office Building, 725 McDowell Road, Asheboro, North
Carolina.
1. Vice Chairman Maxton McDowell called the meeting to
Order at 6: 30 p.m.
2. Hal Johnson, Planning Director, called roll of the
members: Aweilda Williams, Chairman, absent; Maxton
McDowell, Vice Chairman, present; Charles Adams,
absent; Bill Dorsett, present; Lynden Craven, present;
Jim Routh, present; and Phil Brower, present.
3. Phil Brower made the motion, seconded by Lynden Craven,
to approve the Minutes of the June 4, 1996 Randolph
County Planning Board meeting. The motion passed.
4. REZONING REQUESTS:
A: JIM WEAVER, Sophia, North Carolina, is requesting

that 1 acre (out of 114 acres) located on corner
of Unity Street/Wildwood Trail, be rezoned from
Residential Agricultural to Highway
Commercial/Conditional Use. Zoning Map #6797 . It
is the desire of the applicant to operate a
machine shop, with no retail traffic, in an
existing 100x100 building.
Weaver explained that the building is currently
used for airplane storage . Weaver said that his
business would be strictly mail order and there
would be no retail traffic. The operation would
consist of a lathe and a milling machine and he
would not have additional employees beyond
himself. Weaver said he works another job (2 days
on - 2 days off) and on his days off he would run
this part-time business during the hours of 8 am
to 5 pm (no late night work) . When questioned
about noise from the machines, Weaver said you
would not be able to hear the machines outside the
building.
There was no one present in opposition to this
request.
�. Phil Brower made the motion, seconded by Jim
Routh, to recommend to the Commissioners that the
rezoning be approved. The motion passed
unanimously.
B: REID KEARNS, Asheboro, North Carolina, is
requesting that 2 . 3 acres located on US Hwy 64
West, Tabernacle Township, be rezoned from
Residential Agricultural to Highway Commercial.
Zoning Map #7712 . It is the desire of the
applicant to rezone the remainder of the property
for commercial use.
Kearns was present and introduced Dottie Gregs,
Manager of Hampton Inn, to speak to the Board.
Gregs explained Hampton Inn' s intentions to add
more rooms and an indoor swimming pool and would
need additional advertisement for the operation.
Gregs said that they work hard to promote the
Asheboro area along with the Zoo and Pottery area.
Gregs said that it was their intention to place a
billboard sign on this property.
There was no one present in opposition to this
request.
Craven made the motion to recommend that this
request be approved by the Commissioners, due to
the fact that a portion of this tract is currently
zoned commercial. Phil Brower seconded this
motion and the motion passed unanimously.
C: DONALD & SUSAN SPELL, Archdale, North Carolina, is
requesting that 1 . 57 acres located on Marlboro
Church Road, New Market Township, be rezoned from
Residential Agricultural to Highway Commercial/
Conditional Use. Zoning Map #7736. It is the
desire of the applicants to operate a sewing
business in a 30x50 building.
Spell described his intentions to operate a small
sewing (hosiery) business . Spell said he would
pick-up work, bring it to this building, and then
carry the work to private homes for individuals to
do the sewing. This building would be used
primarily for inspection and distribution of the
work. Spell said that he did not want to be
limited to no sewing in the building because in
the future he may would like to bring some
machines in. Spell said that he has owned the
property for 8 to 10 years and the building would
be approximately 100 feet from the road.
Betty Aikens, 4213 Baker Farm Road, said that this
is a residential area with farms and homes.
Aikens said that this would be located in her
backdoor and she didn' t want to see a business of
any kind located in this community.
Janice Davis, 3186 Marlboro Church Road, said that
there are perking problems on this property and
this is a country area not commercial.
There were 4 people present in opposition to this
request.
When Spell was asked if there were any businesses
in the immediate area, Spell answered no.
Dorsett said that this small business could change
the character of this neighborhood.
Brower made the motion, seconded by Craven, to
recommend to the Commissioners that this request
be denied. The Board noted that this would not
conform to current land uses in the area. The
motion passed unanimously.
D: LEE & VANCE ROBERTS, Asheboro, North Carolina, is
requesting that 228. 58 acres located on Iron
Mountain Road, Franklinville Township, be rezoned
from Residential Agricultural to Residential
Restricted. Zoning Map #7781 . It is the desire
of the applicants to develop a restricted
residential subdivision of 119 lots.
Roberts provided the Board with a written proposal
of the development with proposed private
restrictive covenants. The development would
occur in phases with each phase having separate
minimum house sizes ranging from 1100 sq. ft. to
1450 sq. ft. The smallest lot size would be 1 . 2
acres with an average lot size of 1 . 8 acres. The
development would be restricted to only site built
homes with no manufactured housing. Roberts said
that they could have brought this development
request in a phase at a time but they wanted to be
up front with the Commissioners, Planning Board,
and the County and provide a good comprehensive
plan. Roberts said that they felt this plan would
be a continuation of the site built land use
patterns in this area. Roberts said they have met
with NCDOT about the entrances to the development
and the entrances have been selected with their
assistance. There will only be 3 to 6 lots that
will have frontage on Iron Mountain Road. Roberts
said that they are willing to forgo instant profit
(by not developing lots on Iron Mountain Road and
requiring several lots to use frontage on newly
created lots) to provide a quality development.
Glenn Simpson, Trinity, private soil scientist,
said that he has been a soil scientist for over 20
years and that normally in Randolph County you
find soils that are considered "streaky" , where
property has streaks of good soil and poor soil.
Simpson said that is not the case with this
property. Simpson described this property' s soils
as being very uniformed with good soil
characteristics.
Donald Routh, 237 Marshall Lane, expressed his
concern about an additional 119 lots and what
effect they will have with this many additional
septic tanks and wells being added to this area.
Routh asked if the Commissioners are willing to
compensate the community if the wells go dry and
asked who will stand accountable. Routh reminded
the Board of the problems that Guilford County
experienced with a development they approved in
the past. Routh said that they have no problems
with their Woodridge Subdivision neighbors but
that this many additional neighbors could cause
problems , no one ever knows . Routh added concern
of animal control problems that come with new
neighbors.
Dora Atlas, Iron Mountain Road, said that the
Commissioners approved 50 lots to be added to the
lower end of Iron Mountain Road last night and if
this end (of Iron Mountain Road) is approved for
an additional 119 lots, this will change the
character of this community. Atlas expressed her
strong objection to this request.
Bridget Wright, 276 Marshall Lane, told the Board
that she strongly objects to this request.
Genevieve Yahn, 369 Iron Mountain Road, said that
she is opposed to the entrance to this development
being in front of her house. Yahn said that if
public water and sewer is not provided there will
be problems.
Buster Leonard, 2159 Old Stagecoach Road,
expressed concerns of traffic congestion and the
drainage into creek and a nearby pond.
Roger Smith, 2542 Old Stagecoach Road, said that
he is concerned about pollution of his creek and
pond that he feeds his cattle with.
There were 8 people present in opposition to this
request.
Dorsett said that at first look at this
development he liked the plan but that with
thoughts of density and traffic concerns , he was
now concerned of what effect this might have on
the rural integrity issue of this community.
Dorsett said that at the present time the
developer doesn' t own the property and if the
request was not approved the developer would not
be denied the right to develop his property.
Roberts said that he did not feel this is a
relevant issue, because they have the right to
purchase the property. Roberts said that they are
near the 80 , 000 sq. ft. lot size and that he
didn' t know what else they could do to provide a
responsible development.
Simpson, Soil Scientist, said that public sewer
creates much smaller lots than the sizes proposed
(such as 1/4 acre lots instead of the 1 . 8 acres) .
Simpson said that most of these concerns that have
been expressed have been unfounded in areas where
subdivisions have been established for years.
Simpson discussed examples from Guilford County
and Kynwood Village Subdivision in Randolph County
where he currently lives . Simpson said he felt
the questions of density and traffic would solve
themselves with the lots being developed in
phases . When questioned about the impact this
might have on the streams on the property, Simpson
said that due to the controls currently in place
that the Health Department can enforce this would
not have much impact. When Board member Routh
questioned Simpson on the groundwater, Simpson
said that the poorer the soils the more potential
development would have an impact on the
groundwater. Simpson said that with the soils of
this property there would be very minimal effect
on the groundwater.
Adjoining property owner , Routh, explained his
intentions to pasturing his land for cattle and
asked if he would be safe in these plans if this
development was approved. Routh was told yes.
Routh told the Board that if the wells in the area
are damaged by this development there will be laws
suits . Routh asked if the County is ready for
this .
Board member Craven said that he first wanted to
say that he didn' t like to be compared to Guilford
County. Craven said that at first sight of the
plan, he felt this was a well prepared layout.
Craven said but he feels for all the neighbors and
if he lived beside it he wouldn' t want it either.
Craven said that it might meet all our
regulations, but he would like to see larger
tracts.
Board member Routh said that there is no good way
to address this request. Routh explained that
Roberts is a friend of his and on the other side
Don Routh is a relative. Routh said that if he
were in Don' s shoes he wouldn' t like it. Routh
asked what do we do. . .shut down the development
industry. Routh said that restrictive residential
development is the best zoning the County has to
offer. If the water runs out, we will have to
consider other options such as water from Ramseur
or Asheboro, but nobody knows what effects this
will have on our water supply. Routh asked again
do we stop development. . . it is not feasible to
justify additional restrictions on developers than
what has been proposed. Routh said the cost of
housing has already increased greatly due to the
almost 2 acre lot sizes that are being developed.
The additional acre adds in the $7 ,000+ range for
each home . Routh asked if we want to do this to
our children, Routh added I think not. Routh said
we don' t have County Water and Sewer and it will
be along time coming.
Board member Dorsett said that if development was
out in an area by itself, instead of stacked in
within 2 other developments, it would be know
question, but this is the issue. . .density.
Board member Brower said maybe there is a
compromise. . .there is not a right or a wrong
side here.
Vice Chairman McDowell said that this Board has
debated these issues many times (during regular
Planning Board meetings and during working
sessions) and this is not an easy decision to
make.
Brower said that based on the information at hand,
even though he hated to vote against the neighbors
present, the request merits to be approved. For
this reason Brower made the motion, seconded by
Routh, to recommend to the Commissioners that this
request be approved. The motion passed with a 3
to 1 vote, Craven voted against the motion.
E: RANDY SUMMIT, Thomasville, North Carolina, is
requesting that 87 . 50 acres located on Tree Hollow
Road, Trinity Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #6795 . It is the desire
of the applicant to develop a restricted
residential subdivision of 70 lots.
Summit was present and explained that this is a
continuation of Courtland Manor Subdivision that
was approved last month. Summit said that this
development will be served by Davidson Water Inc .
Johnson said that this development' s access will
not be off of Tree Hollow Road. Summit said that
Johnson was correct.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by Brower,
to recommend to the Commissioners that this
request be approved as consistent to the
surrounding Land Use Patterns. The motion passed
unanimously.
5. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
19 people took this Oath.
6 . REQUESTS FOR A SPECIAL USE PERMIT:
A: SHERIE WILLIARD, Randleman, North Carolina, is
requesting a Special Use Permit to allow the
applicant to operate a surveying business at her
residence located on . 96 acre at 668 Marsh Country
Lane, Level Cross Township, Zoning Map #7757 ,
Zoning District RA.
Williard explained that this area has needed a
local surveyor for many years . Williard said this
business would have only 1 employee working in the
office and a crew in the field during working
hours . Williard said she understood that there
were private restrictions that restrict businesses
from being established on the property. Williard
said she has spoken with the other 3 property
owners (that this restriction effects) and the
developer (of the minor subdivision) and have
their support to revise these restrictions .
Troy Davis, residence behind Williard, said that
he is opposed to a large business coming in to the
area, but not to the small operation Williard has
described. Davis said that if the operation was
to grow, he felt she would move the business to a
more commercial area. Davis said she has one of
the nicest homes in the area and she maintains it
well.
David Holton, 680 Marsh Country Lane, said that he
was all for this permit. Holton said this would
allow someone in the community to be at home
during the day and they could watch over his
property as well as their own.
Jackie Marsh, next door neighbor, said that there
are two septic tanks on this lot that is only an
acre of land. Marsh said that they use this extra
building for a residence and he would like to see
the structure pad locked until the private deed
restrictions run out. (The private restrictions
do not apply to his property)
Johnson said that he has received a letter from
the developer that supports this change (for a low
impact business) in the private restrictions.
Routh made the motion to approve this Special Use
Permit, contingent on the private deed
restrictions being amended, with the condition of
no more than a three man crew (working in the
field) and two full time office employees. Craven
seconded this motion, and the motion passed
unanimously.
B: TERRY RHAMY, Asheboro, North Carolina, is
requesting a Special Use Permit to allow him to
have outside storage of drilling equipment at his
residence located on 7 . 47 acres at 3401 NC Hwy 42
South, Grant Township, Zoning Map #7689, Zoning
District El/RA.
Rhamy present the Board with pictures of his
property and pictures of the proposed location of
his equipment and storage area for pipe . Rhamy
said the area would be approximately 500 feet off
the road, beside and behind his barn. Rhamy said
that 90% of the time the equipment would not be at
the site. Rhamy described the pipe storage area
as behind trees and out of site of the road. This
area would be 20 ' x 100 ' (a of an acre) .
Jerry Macon, 2950 NC Hwy 42S, said that Rhamy' s
property looks nicer than it has in years (since
Rhamy has purchased the property) . Macon said he
maintains the property well and he would not be
opposed to the permit.
There was no one present in opposition to the
request.
Craven made the motion, seconded by Brower, to
approve this request for a Special Use Permit.
The motion passed unanimously.
C: CLINTON & NORMA VONCANNON, Asheboro, North
Carolina, is requesting a Special Use Permit to
obtain an automotive dealers license at his
residence located on 10 acres at 594 Dawson Miller
Road, Cedar Grove Township, Zoning Map #7658 ,
Zoning District RA.
Johnson explained that this request was heard (by
this Board) a couple of months ago and the Board
asked Voncannon to clean up several junk vehicles
on the adjoining tract of land. Johnson said
that this has been done and Voncannon had done a
good job.
Voncannon said that he would only have 6 vehicles
(for the business) on the property at one time.
Norma Voncannon said that Voncannon had worked
very hard for this permit and had many sleepless
nights and she would like to see the Board approve
this request.
Billy Beane, 2471 Pisgah Covered Bridge Road, said
that this is a residential area and that the
community did not need a business here . Beane was
concerned with the number of vehicles that would
be brought to the property.
Snowdene Beane, 2471 Pisgah Covered Bridge Road,
said that she would be concerned of junk vehicles
being brought back to the property.
Norma Voncannon said that she had spoke to all
their neighbors that live on Dawson Miller Road
and none of them were opposed to this permit.
Dorsett said that it is a rarity for the County to
have someone clean up the amount of junk Voncannon
has taken care of. Dorsett said that he felt the
Board should approve this request.
Dorsett made the motion to approve this request
with the following restrictions:
**no more than 6 cars (for the business)
**cars must be operable
Craven seconded this motion and the motion passed
unanimously.
D: H & T AUTO & TRUCK SALES, Archdale, North
Carolina, is requesting a Special Use Permit to
allow a display of 15 automobiles for sale at his
residence located on 1 . 36 acres at 5699 Cedar Post
Road, Trinity Township, Zoning Map #6798 , Zoning
District RR.
Harold Mitchell was present and said that he has
lived here all his life. Mitchell said that he
had a dealer' s license in ' 84- ' 85 and then renewed
his license (after obtaining a Special Use Permit)
in ' 95. Mitchell told the Board that he is the
only business here.
There was no one present in opposition to this
request.
Johnson told the Board that he had had phone
complaints from neighbors concerned of the number
of cars he would be allowed to store.
Brower made the motion to deny the request due to
the number of cars being requested. Brower
withdrew this request to ask the applicant of the
number of cars he would be willing to live with.
Mitchell said that he could probably live with 10
or 12 cars.
Dorsett asked Mitchell if he would consider 5
cars, Mitchell reluctantly accepted.
Brower made the motion, seconded by Routh, to
approve the request with the restrictions of:
**no more than 5 cars (for the business)
**all cars must be in running order.
The motion passed unanimously.
E: PHILLIP CANTER, Archdale, North Carolina, is
requesting a Special Use Permit to obtain an
automotive dealers license (with approximately 10
vehicles on display) at his residence located on
4 . 92 acres at 2420 Canter Lane Extension, New
Market Township, Zoning Map #7737, Zoning District
RA.
Canter said that he would purchase cars that were
�-- re-constructable, repair the vehicles and resale
them. Canter said that he would not actually do
the body work, he would contract this out to body
shops . Canter said that this would be a part-time
business to sale vehicles .
There was no one present in opposition to this
request.
Dorsett said that he felt it was important for the
Board to include the restriction for all these
type dealer' s licenses requests to include that
the vehicles be in running order or running order
shortly after purchase of the vehicles. This
would prevent these locations from accumulating
junk vehicles.
Craven made the motion to approve this request
with the conditions:
**no more than 10 vehicles (for the business)
**all junk vehicles must be removed within 30 days
of arrival
Dorsett seconded this motion, and the motion
passed unanimously.
7 . The meeting adjourned at 9: 45 p.m. There were 81
people present for this meeting.
