* 1179 August 6, 1996
1 . Chairman Aweilda Williams called to Order the Randolph
County Planning Board meeting at 6 : 30 p.m.
2 . Hal Johnson, Planning Director, called roll of the
members: Aweilda Williams , Chairman, present; Maxton
McDowell, Vice Chairman, present; Charles Adams,
present; Lynden Craven, present; Jim Routh, present;
Bill Dorsett, present; and Phil Brower, absent.
3. Routh made the motion, seconded by McDowell, to approve
the Minutes of the July 9, 1996 Planning Board meeting.
The motion passed.
4. REZONING REQUESTS:
A: PAUL DEAN STALEY, Julian, North Carolina, is
requesting that 85. 40 acres located on Randolph
Church Road, Providence Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7797 . It is the desire
of the applicant to develop a subdivision of 18
lots that would allow site built homes, modular
homes, or Class A double-wide manufactured homes
on permanent foundations . Property Owner: Linda
D. Beasley.
Staley was present and explained his intents to
develop a subdivision with lot sizes from 2 to 10
acres. Staley said there would be 2 to 6 lots
fronting on Randolph Church Road and the remainder
of the lots would front on a private road.
Johnson questioned Staley on the amount of flood
zone on the property. Staley said there was
approximately 12 acres . Johnson expressed concern
that this flood zone was not showing on the
preliminary plat of the proposed development.
There were 9 people present in opposition to this
request.
Sarah Snider, 3438 Randolph Church Road, expressed
her strong opposition to another mobile home
development coming into this area. Snider said
that when she built her $150 , 000 home here the
bank questioned how close this site was to a
mobile home. Snider said that the bank implied
that this would effect her property values .
Snider questioned what guarantee the community
would have of the look of the manufactured homes
in 18 years. Snider discussed the potential
problems with mobile home developments and
referred to the Courier-Tribune coverage of
problems within a mobile home park in Randolph
County. Johnson explained that this rezoning
request (to Residential Restricted) was the
highest residential zoning classification. Snider
said she would be opposed to any type of
manufactured housing coming into her community.
Cynthia Allen, adjoining resident and property
owner, said that she was concerned with population
density increasing without the increase in
services . Allen said that there are no speed
limit signs even posted on this road and more
residences would only increase the number of
traffic problems they currently deal with. Allen
spoke of increase in littering problems since the
increase in development started in this area.
Allen said that the burden this has placed on
their school system (Grays Chapel Elementary) has
been too much to ask for. Allen said that
currently the lunch schedule begins at 9 : 30 a.m.
for the children and the shortage in school
supplies have caused the children to not be
allowed to bring books, etc. home. Allen said
they were told by the Board of Education that it
would be at least 5 years before this area would
even be considered for a new school.
Richard Allen, adjoining property owner, said that
he is building a $150, 000 home adjacent to this
site and he is not opposed to a site built
development but he is opposed to manufactured
housing.
Grady L. Allen, adjoining resident and property
owner, said that the development has increased at
such a rate that it seems he is coming to one of
these public hearings every month. Allen said
that the tremendous population growth in the edge
of Randolph County, where there are no water and
sewer service and very little other service, is
his main concern. Allen said that he is opposed
to mobile homes of any kind. Allen said that if
nothing else can be done he would at least like to
see the number of lots reduced.
Dorsett said that if this was approved it should
not be allowed to decrease the size of the lots on
the private road (in the back) if he looses lots
in the front due to flood zone requirements.
Routh said that he didn' t feel that the lot size
was the problem. Routh said that the main concern
of the neighbors appeared to be the restrictions
that will be placed on the subdivision. Routh
said that development patterns in this area has
gone to mainly stick built homes and this proposal
may be out of character for this community without
restriction covenants .
Dorsett said he would need to see a more detailed
plan with the flood zone over-layer on the
proposed lots . Dorsett said that it was his
feeling that the 2 acre lots on the front were too
small for this area.
McDowell made the motion, seconded by Craven, to
delay decision on this request until the developer
can provide more information on the flood zone
location and proposed private restrictions . The
motion passed unanimously.
B: BILL JOHNSON, Ramseur, North Carolina, is
requesting that 36. 43 acres (out of 140 . 02 acres)
located on Hinshaw Town Road, Coleridge Township,
be rezoned from Residential Agricultural to
Residential Restricted. Zoning Map #8710 . It is
the desire of the applicant to develop a
restricted residential subdivision of 12 lots .
Johnson was present and provided the Board with a
copy of the proposed restrictions . Johnson said
that each lot will have 2 acres or more outside of
the flood zone. The average proposed lot size is
2i acres and only site built or modular homes will
be allowed. Johnson said that no mobile homes of
any kind will be allowed. The restrictions will
include:
**no mobile homes
**no commercial livestock
**minimum house size of 1 , 100 sq. ft.
**paved road
Johnson said that he has adjoining property that
has access to Ramseur City Water and he has plans
to pull this water to his subdivision (all lots
will have access to Ramseur City Water) .
Johnson told the Board that he lives and farms on
the adjoining tract of land and he plans to keep
the subdivision as he would like to live next to.
Tim Moffitt, Hinshaw Town Road, explained that
there are many chicken houses in the community and
large livestock. Moffitt said that his main
concern was that if people move to the country
will they be happy with the family farming
operations adjoining this development. Moffitt
discussed his possible intentions of building hog
houses on his property and he didn't want these
people (that would purchase these lots) to sue
him.
Hal Johnson told Moffitt that his point was well
taken. Johnson said that in North Carolina if you
are a farmer and you are going about your business
of farming you are taken care of and protected.
Johnson added that for being at this public
meeting and expressing your concerns, you probably
have added to your level of protection.
Moffitt said that new neighbors were not the
problem, he would just be concerned of the effect
this type of development may have on the farming
operations in the area.
Craven made the motion, seconded by Adams, to
recommend to the Commissioners that this request
be approved as consistent with the area. Craven
said he was pleased with the site layout and the
fact that Ramseur City Water would be provided.
The motion passed unanimously.
C: ROBERT DEESE, Biscoe, North Carolina, is
requesting that 19. 09 acres (out of 22 . 09 acres)
located on NC Hwy 159, Grant Township, be rezoned
from Residential to Restricted Restricted. Zoning
Map #7667 . It is the desire of the applicant to
develop a residential restricted subdivision of 11
lots .
Deese provided the Board with proposed
restrictions. Deese said that this would be an 11
lot subdivision with average lot sizes of 1 . 4
acres . Deese said that only site built homes
would be allowed and the minimum homes sizes would
be:
**1 story home - 1 , 900 sq. ft.
**12 story home - 2 , 000 sq. ft.
**2 story home - 2, 100 sq. ft.
Deese said all homes must front the newly
constructed road. Deese added that he will be
building his home and moving to this development.
There was no one present in opposition to this
request.
Dorsett made the motion, seconded by Routh, to
recommend to the Commissioners that this request
be approved. The motion passed unanimously.
D: JERRY HODGES, Ramseur, North Carolina, is
requesting that 3.20 acres located on Isom Road,
Columbia Township, be rezoned from Residential
Agricultural to Residential Mixed/Conditional Use.
Zoning Map #8701 . It is the desire of the
applicant to develop a three (3) space mobile home
park.
Hodges explained that he has 3 mobile homes on the
property that have all been occupied by his
family. His family has now moved out and he wants
to rent the existing homes. Hodges said that he
didn' t want any new spaces.
McIntyre, Isom Road, said that the original owner,
Mr. Isom, was too old to care for the property but
that since Hodges took ownership the property has
been cleaned up considerably. McIntyre said he
had no opposition to his request.
There was no one present in opposition to this
request.
Routh made the motion, seconded by Adams , to
recommend to the Commissioners that this request
be approved with the restriction that no addition
units would be placed on the property and the
property could not be subdivided. The motion
passed unanimously.
E: LEROY & VILENE HOOVER, Asheboro, North Carolina,
is requesting that 2 . 63 acres located at 6298 US
Hwy 64 West, Tabernacle Township, be rezoned from
Highway Commercial to Residential
Mixed/Conditional Use. Zoning Map #7702 . It is
the desire of the applicants to convert the old
Hoover ' s Motel into a three (3) unit apartment
building.
Joyce Blanton, Hoover ' s daughter, said that the
building actually has 10 units, but they want to
convert the building into a 3 unit apartment
building. Blanton said that they have had the
property' s septic tank checked and it has been
approved for this proposal.
There was no one present in opposition to this
request.
McDowell made the motion, seconded by Routh, to
recommend to the Commissioners that this request
be approved. The motion passed unanimously. The
Board noted that this would be an improvement to
the property.
F: WILSON REALTY, Asheboro, North Carolina, is
requesting that 1 . 02 acres located on Bus 220
South (approximately 2/10 mile past New Hope
Church Road) , Richland Township, be rezoned from
Residential Restricted to Light
Industrial/Conditional Use. Zoning Map #7657 . It
is the desire of the applicant to locate a vinyl
siding/home repair business with warehouse
storage.
Pam Stutts, real estate agent, said that this
would be a warehouse/office for his (her potential
buyer) home repair business. Stutts said the
building would be located toward the rear of the
property to the right of the pond. Stutts said
that she was not sure of the proposed building
size. There will be no more than 3 employees and
this would be used mostly for storage (not
creating in & out traffic) .
There was no one present in opposition to the
request.
Johnson said that the property' s highest and best
use would probably not be residential, due to its
location. Johnson did express concern for the
residences in the subdivision at the rear of the
property. Johnson said he felt at least a 25 '
rear buffer (no cut area) should be placed on the
property.
Craven made the motion to recommend to the
Commissioners that this request be approved with
the following restrictions:
**25 ' buffer of natural (uncut) area
**no outside storage
Adams seconded this motion, and the motion passed
unanimously.
G: ELLEN HOWELL & DAVID NORCOM, Asheboro, North
Carolina, is requesting that 168 . 41 acres (out of
187 . 30 acres) located on Caraway Mountain Road,
Back Creek Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning
Map #7732 . It is the desire of the applicants to
develop a restricted residential subdivision of 81
lots.
Norcom said that he and his mother live in the
Caraway Mountain area (on a 150 acre tract of
land) and would like to preserve this community.
Norcom said that this proposal would be for 2 1/3
acre lots with a single entrance to SR 1004.
Norcom said the entrance (on to SR 1004) would be
buffered and they would provide underground
utilities . Norcom described the development as
being similar to Cedar Creek or River Run. Norcom
said that the homes would 1800 sq. ft. and they
would only cut trees for the house sites and the
road. It is their intention to save as many trees
as possible. Norcom said this would be developed
in phases and he plans to build his home here
also.
Glenn Simpson, Soil Scientist, said that they
checked 100 different sites on this property and
the soils were more uniformed than he anticipated.
Simpson said that he found two types of soils:
**deep red clay
**sandy clay loam
Simpson said that rocks are littered on the
surface which can lead to misconceptions but that
there were some good deep soils underneath.
Simpson said that there were some slope
restrictions , a couple of ravines and some
unsuitable, shallow soils. Simpson said that in
general 80 to 90 percent of the soils were good.
Norcom said that the major of the land was on the
north side of the mountain.
Charles Harris, Director of Camp Caraway
Conference Center, said that he could not speak
for the Conference, but that as a resident of the
area he was very much in favor of this
development.
Annie Hughes Wooten, Caraway Mountain Road, said
that she questioned the proposed sewer and water
services . Wooten said that they live in the
valley and this would effect them very much.
Wooten said that she felt that the developer
didn' t care much for preserving the mountain or he
wouldn't be trying to develop it. Wooten said she
felt the trees should be preserved. Wooten said
that she has lived here all her life and she felt
the mountain should be preserved. Wooten said
Randolph County develops too much.
Michael Munzer, Caraway Mountain Road, said that
it would seem that if Norcom wanted to develop he
would develop his 150 acres at his residence.
Munzer expressed concern for the traffic with an
additional 240 vehicles spilling out on to SR
1004 . Munzer expressed concern for the following:
**traffic
**littering
**stray animals
Munzer asked what size of a buffer had been
proposed. Norcom answered 20 feet. Munzer said
that this should be at least 80 to 100 feet.
Munzer spoke of the illegal deer stands placed on
his property that his located in sight of another
subdivision. Munzer said that if preservation is
the intention that the lot sizes of 2 1/3 acres is
too small. Munzer said that a good example of
preservation would be the request heard tonight
concerning the old motel.
Ben Yates, Caraway Mountain Road, said that the
drive with the traffic currently on SR 1004 is
dangerous and with this new entrance it would only
make it worse. Yates said that he would like to
see larger lot sizes .
Dorsett said that he has heard two legitimate
concerns:
**traffic concerns
**lot sizes
Dorsett said that to preserve integrity the lot
sizes should be 5 acres . Dorsett added his
concerns for the run-off and what effect this will
have on people living below this site. Dorsett
said his main concern was lot sizes.
Routh said that this area has been inundated with
mobile homes and it is so pleasant to see someone
plan something so aggressive. Routh said that
this would be a good wholesome addition to our
neighborhood (Routh explained he lives in this
area) . Routh said that he didn' t see a thing
wrong with the lot sizes .
Williams said that she understands the concern of
disrupting the view of Caraway Mountain, but that
we cannot stop development. Williams said that
she appreciates the size of the houses and the no
timber cutting, Williams said this is pleasant.
Craven said that he felt the lot sizes were
perfect and made the motion, seconded by Routh, to
recommend to the Commissioners that this request
be approved. The motion passed with a 3 to 2
vote, Dorsett and Adams voted against the motion.
Dorsett said that he wanted the record to reflect
that the only reason he was opposed to the request
was that he would like to see some guidance given
for larger lot sizes in this area.
5 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
5 people took this Oath.
6 . REQUESTS FOR A SPECIAL USE PERMIT:
A: A PLACE IN THE HEART, INC. , Sophia, North
Carolina, is requesting a Special Use Permit to
allow a multi-conference and dining facility on
property located on Beckerdite Road on 48 . 73
acres; Back Creek Township, Zoning Map #7734,
Zoning District RA.
Billy Thorton, Westwood Avenue, High Point,
grounds keeper of A Place in the Heart, provided
the Board with a pamphlet describing their
facility and their plans. Thorton said that the
Ken Helser ministry has no plans to charge for the
use of their facilities, but donations would be
accepted. Helser has owned the property for 9 to
10 years and has lived across the street for 25
years.
There was no one present in opposition to this
request.
Williams said that Ken Helser' s ministry is kind,
gentle, and giving.
Adams made the motion, seconded by McDowell, to
approve this request for a Special Use Permit.
The motion passed unanimously.
B: BARBARA HOGLEN, Archdale, North Carolina, is
requesting a Special Use Permit to obtain license
for sales and service of boats in an existing 60 x
80 building at her residence located on 1 . 31 acres
at 5766 Green Acres Drive, Trinity Township,
Zoning Map #7708, Zoning District RM.
Hoglen said this building has been used for
building furniture frames and they now want to use
it for boat repair and sales . Danny Carol,
Hoglen' s son, said that there will be 4 to 5 boats
a week coming in for repair and will be removed
after they are repaired.
There was no one present in opposition to this
request.
Adams made the motion, seconded by McDowell, to
approve this request for a Special Use Permit.
The motion passed unanimously.
C: KENNETH & PATRICIA MALCOM, Denton, North Carolina,
is request a Special Use Permit to allow an
automotive repair business in a 30 x 40 building
(to be constructed on site) at his residence
located on 3 . 80 acre at 7110 Brantley Gordon Road,
Concord Township, Zoning Map #6688, Zoning
District RA.
Malcom said that he purchased a building permit
for this structure not realizing he need a Special
Use Permit. Malcom said that he hoped the
business would be full-time in a year. Malcom
said that he would not have any junk vehicle or
part storage and there would be no employees .
Malcom described the building as 30 x 40 with 2
bays .
There was no one present in opposition to this
request.
There were 8 people present in favor of the
request.
Craven made the motion, seconded by McDowell, to
approve this request for a Special Use Permit.
The motion passed unanimously.
7 . Micellaneous Business:
Policy Change - McDowell made the motion, seconded by
Craven, to implement a policy where the Chairman of the
Planning Board/Zoning Board of Adjustment will vote
when there is an odd number of members present at a
meeting. The motion passed unanimously. This
clarification was needed to avoid situations where a
tie vote would go to Commissioners .
8. The meeting adjourned at 8 : 15 p.m. There were 59
citizens present for this meeting.
