1779 * RANDOLPH COUNTY PLANNING BOARD
September 10, 1996
There was a meeting held at 6: 30 p.m. , on Tuesday,
September 10, 1996, of the Randolph County Planning Board in
the Commissioners' Meeting Room, Randolph County Office
Building, 725 McDowell Road, Asheboro, North Carolina.
1. Chairwoman Aweilda Williams called the meeting to Order
at 6: 30 p.m.
2. Hal Johnson, Planning Director, called roll of the
members: Aweilda Williams, Chairwoman, present; Maxton
McDowell, Vice Chairman, absent; Charles Adams, absent;
Bill Dorsett, present; Jim Routh, present; Lynden
Craven, present; and Phil Brower, present.
3. Jim Routh made the motion, seconded by Lynden Craven,
to approve the August 6, 1996 Randolph County Planning
Board Meeting Minutes. The motion passed.
4. REQUESTS FOR PROPERTY REZONING:
A: DEAN STALEY, Julian, North Carolina, is request
that 85. 40 acres located on Randolph Church Road,
Providence Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning
Map #7797 . It is the desire of the applicant to
develop a residential subdivision of 17 lots that
would allow site built homes, modular homes, or
Class A double-wide mobile homes on permanent
foundations. Property Owner: Linda D. Beasley.
Johnson said that this request was originally
tabled a few months ago, and explained that the
concerns were the amount of flood zone on the
property and the lack of proposed deed
restrictions. Johnson said that the request
currently presented to the board reduces the
number of lots fronting on the state road from 6
to 5 and the proposed deed restrictions indicate
that these lots must be either site built or
modular. Johnson said the 12 lots that would
front on the proposed private road would allow
also double wide mobile homes. Johnson said the
surveyor has calculated that there is 60 , 000 sq.
ft. of usable land located outside the indicate
flood zones in lot 6 and lot 7 .
Staley was present but had no additional
information to add.
Grady L. Allen, adjoining property owner, said
that he owns property on both sides of this
property. Allen said that it seems there are no
restrictions on the lots fronting on the private
road due to the fact that mobile homes would be
allowed on those lots . Allen questioned the
responsibility of perking the lots (the buyer or
the seller) and said there were perking problems
in this area. Allen said that Grays Chapel School
is grossly over populated with an enrollment of
700 students. Allen said the school was designed
for only 500 students. Allen went on to discuss
traffic problems on Randolph Church Road.
Sarah Snider, Randolph Church Road, said that at
the last meeting she shared her real concern with
mobile homes be located in this area. Snider said
that she is very concerned of property values and
she feels this would de-value her property.
Snider said it appears there would be no
restrictions on the majority of the lots. Johnson
clarified the fact that zoning restrictions would
be enforceable on the property (if the request was
approved) . Snider asked the Board to give this
community zoning restrictions that could protect
the property values. Snider said that
restrictions could be applied to these properties
that would allow them to remain proud of their
community, Snider said they didn' t want to be
ashamed of it.
There were 7 citizens present opposed to this
request.
Routh said that he felt the restrictions on the
front lots were okay but they were very vague.
Routh said that in order to maintain the integrity
of the community they (the restrictions) need to
be more specific.
Williams asked Staley if he would be open to
consider additional restriction suggestions.
Staley said yes.
Johnson told the Board that they could request
this be done before the Commissioners meeting.
Johnson said that his main concern was for the
flood zone area of the property and if the private
road access to those rear lots would have flooding
problems. Staley said that he will install a
culvert that would meet standards set up by the
NCDOT for a road situation such as this, this
would prevent any flooding problems.
Phil Brower made the motion, seconded by Jim
Routh, to recommend to the Commissioners that this
request be approved with the requirement that the
developer meet with the Planning Director (prior
to the Commissioners' meeting) to come up with
appropriate deed restrictions. The motion passed
unanimously.
B: MCDOWELL TIMBER COMPANY, Asheboro, North Carolina,
is requesting that 33. 36 acres located on Hwy 42
South (approximately z mile past Fairview Farm
Road) , Grant Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning
Map #7689 . It is the desire of the applicant to
develop a residential subdivision of 38 lots that
would allow site built only.
Johnson said that this request was originally
denied by the Planning Board due to the concerns
raised about density and the lack of proposed deed
restrictions (the Commissioners denied the
original request based on the same concerns) .
Johnson noted that the Commissioners advised
McDowell that he could resubmit his request if he
reduced density and provided clear deed
restrictions pertaining to development of the
subdivision. Johnson described the original
request as 42 (30, 000 sq. ft. ) lots with 3 lots
fronting on Hwy 42, and the new request as 38 lots
with 2 fronting on Hwy 42 .
McDowell was present and presented copies of the
proposed restrictions and the design of the
proposed permanent entrance sign. McDowell said
the minimum house size would be 1,200 sq. ft. and
all homes would be site built. McDowell said he
has spoken with some builders that are interested
in building within this development if it
approved. McDowell said he felt he would probably
have less than 38 lots due to some topography
problems.
Terry Rhamy, Hwy 42 South, said that this
development would surround his property. Rhamy
said that he is concerned with the number of homes
being proposed. Rhamey said he purchased here to
get out of the city and live in the country.
Rhamy said if McDowell is allowed to develop this
subdivision he will not be living in the country
any longer. Rhamy told the Board that they turned
this request down last time due to the number of
homes and since McDowell only reduced the lots
from 42 to 38 he asked the Board to deny this
request also for the same reason. Rhamey said
that McDowell made the statement that he wouldn' t
have purchased the property if he couldn' t develop
it, Rhamey told the Board that maybe they need to
send a message (by denying this request) that a
developer can' t just assume that they will be able
to develop it (that they should go through this
process before they purchase the property) .
There were 8 citizens present in opposition to
this request.
Williams said that the communities' sons and
daughters usually buy these lots.
Dorsett said that he was still concerned with the
number of lots being proposed and the fact of a
subdivision coming into an area were there aren' t
subdivisions currently. Dorsett said that he
would like to see the smallest lot 1 acre in size.
Craven said that he rides this road every day.
Craven said that when he sees this land he thinks
of how many cows you can get on it and when
McDowell sees the land he thinks of how many homes
he can get on it. Craven said that he agreed with
Dorsett, he would like to see a minimum lots size
of at least an acre.
Dorsett made the motion to recommend to the
Commissioners that this request be denied because
the density has not be reduced enough. Craven
seconded this request and the motion passed with a
vote of 3 to 2 . Routh and Williams voted against
the motion. Dorsett said that he wanted it noted
that he would have gone along with this proposal
if the minimum lot size was 1 acre.
C: JOHN CRAWFORD, Thomasville, North Carolina, is
requesting that 7 acres located on Post Road,
Tabernacle Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning
Map #6794. It is the desire of the applicant to
develop a 6 lot residential subdivision that would
allow site built homes or modular homes.
Crawford said that the smallest lot size he was
proposing was 1 acre and his private deed
restrictions would restrict the housing to only
include site built homes or modular homes with
both a front and back porch.
There were 6 citizens present in favor of this
request.
Michael Cook, 6295 Post Road, said that he was not
necessarily opposed to this request but he did
want the record to show that he owns a farm across
the road from this property and there is traffic
of large trucks that come in and out of his
property.
There was a resident of Post Road that said he was
opposed to the request due to the density. He
said that this is within 1 mile of the proposed
Trinity City Limits and he didn' t want to be
incorporated by this area (felt the area may be
included if the population continues to grow in
this area) .
There were 6 citizens opposed to this request.
Dorsett said that you can' t stop progress and he
didn' t feel this development would hurt the
County. For this reason Dorsett made the motion
to recommend to the Commissioners this request be
approved. Craven seconded this motion and the
motion passed unanimously.
D: MICHAEL & WANDA FAYNE, Thomasville, North
Carolina, is requesting that 41 . 16 acres located
on Post Road (off Fuller Mill Road) , Tabernacle
Township, be rezoned from Residential Agricultural
to Residential Restricted. Zoning Map #6795 . It
is the desire of the applicants to develop a
residential subdivision of 30 lots that would
allow site built homes, modular homes , or Class A
double wide manufactured homes on permanent
foundations .
Fayne said that they had designed the lots long so
there would be at least 200 feet of wooded buffer
on both sides (surrounding) the development.
Fayne said that there will be restrictions on
garages, outdoor animals , and quality of property
maintenance. Fayne said that the minimum lot size
is greater than 1 acre.
There were 6 people present in favor of the
request.
Wayne Taylor, Kennedy Road, said that he owns the
land beside of this site. Taylor said that there
has all ready been a 46 lot subdivision approved
in the area and they didn't need this additional
one. Taylor said that when Fayne purchased the
land he said that he would develop the property in
5 acre lots and only allow site built homes.
Taylor said he would not be opposed to that type
�-- proposal.
Robert Howard, Tabernacle Church Road, said that
he agreed with Taylor and that he would not be
opposed site built homes, but he would be opposed
to modular homes or manufactured homes of any
kind.
Tom Menius, Post Road, questioned where this would
be located.
Mrs. Gwen, Todd Drive, questioned if the road
system could hand the added traffic. Gwen also
spoke of additional concerns: water problems ,
sewer disposal, and safety for the school buses
and children.
Dorsett questioned the location of the site and
Brower questioned a street dead ending into an
adjoining property. Brower said that he had some
confusion due to the fact that the plat referenced
the property location to be Guilford County.
Dorsett made the motion to recommend that this
request be approved, Dorsett said that he was not
real comfortable with this proposal but that the
lots were all over 1 acre and a public road
(paved) and there was just so much that they could
legally do. Brower seconded this motion, and the
motion passed with a 4 to 1 vote, Craven voted
against the motion.
E: CRAWFORD KNITTING, Asheboro, North Carolina, is
requesting that 14 acres located at 7718 US Hwy 64
East, Columbia Township, be rezoned from Light
Industrial/Residential Agricultural to Heavy
Industrial/Conditional Use. Zoning Map #8712 . It
is the desire of the applicant to operate a
hosiery plant in an existing 130 ' x 184 ' building
with future expansion of approximately 27 , 000 sq.
ft. and an aeration system holding tank.
Property Owners: Resortwear Industries.
There was no one present from Economic Development
Corporation or from Crawford Knitting. Johnson
explained that this property was originally
rezoned by the County, Light Industrial. Johnson
said that Ramseur plans to extend water and sewer
lines to the site for an expansion and that they
will probably annex the property in the future.
Johnson said the County Commissioners have already
approved a $250 , 000 grant to Ramseur to apply to
the state for water and sewer aid.
There was no one present in opposition to this
request.
Brower made the motion, seconded by Dorsett, to
recommend to the Commissioners that they approve
this request. The motion passed unanimously.
F: JOSEPH FARLOW, Greensboro, North Carolina, is
requesting that 8 . 63 acres located in Marvin
Williams Subdivision (lots 1 & 2) , on Health Dairy
Road/Dairy Breeze Drive, Back Creek Township, be
rezoned from Residential Agricultural to
Residential Mixed/Conditional Use. Zoning Map
#7754 . It is the desire of the applicant to
develop a 7 space mobile home park that would have
access on a private road (Dairy Breeze Drive) .
Farlow was present discussed his intentions of
developing a mobile home park. Farlow said the
access for these 7 spaces would be on Dairy Breeze
Drive. Farlow said that he has a house on this
property that he rents. Johnson asked Farlow who
maintains the private road. Farlow didn' t know,
he said there was no formal agreement. Johnson
asked Farlow if he had made any arrangements to
maintain this private road if this park was
approved. Farlow said he had not.
Dorsett discussed his concerns for the pond and
the run-off/over-flow it would receive. Farlow
said the pond would not receive any run-off from
these proposed spaces.
Brower asked Farlow would each lot have individual
wells and septic tanks . Farlow said that each lot
would have an individual septic tank, and he would
probably install at least 2 wells .
Alfred Thomas, Dairy Breeze Drive, said that he
has lived here for 9 years and the water from this
property does run-off into the pond. Thomas said
that he owns this pond and 12+ acres . Thomas
described the private road as a "driveway" , that
it is only 10 feet wide and that the cars have to
stop now and let each other by. Thomas presented
pictures of the road and the neighborhood. Thomas
also gave the Board a petition opposing the
development. Thomas said that he has been
scrapping the road and maintaining it himself, but
he wouldn' t if the park is approved. Brower asked
Thomas if Farlow had ever participated in the road
maintenance. Thomas said that each of the
residents pitch in on the purchase of the gravel
when it is bought, but Farlow has only given $50
one time.
Beth Hollingsworth Bullins told the Board that she
has lived here all her life. Bullins said there
are 3 families of 3 generations that live on this
road. Bullins said that they would like to see it
remained zoned as it is. Bullins said that she is
a bus driver and that she would like the Board to
please remember all the children having to get to
schools from way out in the country and that when
they are discussing these major subdivisions they
should require the lots to be at least 5 acres.
Bullins also discussed water problems in the area.
Chuck Jones, Dairy Breeze Drive, said that he
owned this property before Farlow and that he told
Farlow that they didn' t want to have a mobile home
park here. Jones said that Farlow' s rental
property is poorly kept. Jones showed the Board
pictures of that house and all the well kept
houses in the area. Jones said that he felt these
small mobile home parks should be a thing of the
past and shouldn' t be dumped in these nice
residential areas.
Don Williams, Dairy Breeze Drive, spoke of the
concern of the additional traffic and drainage
problems.
Angela Garner, Heath Dairy Road, said that this
would be directly behind her home. Garner said
that her main concern is how it is maintained.
Garner said that they all ready have a neighbor
that dumps old building materials , asbestos, etc. ,
behind their homes.
There were 25 citizens present in opposition to
this request.
Routh said that he was not an advocate of small
lots, but said that small lots in rental mobile
home parks would not be good.
Craven made the motion to recommend to the
Commissioners that this request be denied as not
compatible to the area. Dorsett seconded this
motion and added that the topography of the area
would allow contamination of neighboring property
and the private road would not support the added
traffic. The motion passed unanimously.
G: JANET HILL, Liberty, North Carolina, is requesting
that 25. 79 acres located on Old 421 Road/US Hwy
421 South, Columbia Township, be rezoned from
Residential Agricultural to Light Industrial.
Zoning Map #8735 . It is the desire of the
applicant to use the property for industrial
purposes.
Hill said that her family lives across the road
from this site and they have been working with
Randolph Economic Development Corporation to
develop the land. Hill said that the access would
be on old Hwy 421 and that Liberty is trying to
run water down to the property next to this (this
would allow for the possibility of water if this
site) .
There was no one present in opposition to this
request.
Brower made the motion, seconded by Dorsett, to
recommend to the Commissioners that this request
be approved. The Board noted that it is adjacent
to additional industrial property. The motion
passed unanimously.
H: JUDY STALDER, High Point, North Carolina, is
requesting that 43. 90 acres located on Turnpike
Road (at the County line) , Trinity Township, be
`-- rezoned from Residential Agricultural to Light
Industrial. Zoning Map #6798 . It is the desire
of the applicant to use the property for
industrial purposes. Property Owner: Joseph E.
Bird, Sr. Estate.
Stalder said that the property is listed for sell
with adjoining acreage that is currently zoned
industrial. Stalder said that the County Land Use
Plan projects the property to be industrial.
There was no one present in opposition to this
request.
Craven made the motion, seconded by Routh, to
recommend to the Commissioners that this request
be approved. The motion passed unanimously.
I: WINFRED COUCH, Kernersville, North Carolina, is
requesting that 11. 99 acres located at the
intersection of Tabernacle Church Road/Snyder
Country Road, Tabernacle Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7704 . It is the desire
of the applicant to develop a restricted
residential subdivision of 9 lots.
Couch was present and explained that he originally
purchased the property to build his retirement
home and now he has planned to subdivide the
property and sale the land to a young builder in
the community, Michael Kennedy, that lives on
adjoining land. Couch said the homes would only
be site built and the lots sizes range from 1 . 1
acres to 2 . 1 acres. Couch said that he felt this
would be good for the community. Couch said that
the homes would range in size from 1 , 350 sq. ft.
to 18 , 000 sq. ft.
Robert Howard, 1999 Tabernacle Church Road, said
that this is across the road from his home.
Howard said that his home is worth in excess of
$200, 000 and he feels this would devalue his
property. Howard described his property as a
1 , 800 sq. ft. brick home on 13+ acres. Howard
discussed possible traffic concerns and said that
he would like to see homes and lot sizes
comparable to his.
There were 2 people present in opposition to this
request.
Routh said he would be in favor of Couch working
with the Planning Director to put together
restrictions to protect the adjoining property
owners.
Craven made the motion, seconded by Dorsett, to
recommend to the Commissioners that this request
be approved, with the condition that Couch meet
with the Planning Director prior to the
Commissioners meeting to work on appropriate deed
restrictions. The motion passed unanimously.
5. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
3 people took this Oath.
6. REQUESTS FOR A SPECIAL USE PERMIT:
A: JUDY CAGLE, Asheboro, North Carolina, is
requesting a Special Use Permit to operate a
beauty shop in an existing 12 x 14 building at her
residence located on 1 acre at 7062 New Hope Road,
New Hope Township, Zoning Map #6695, Zoning
District RA.
Cagle explained that this would be only a 1 person
operation.
There was no one present in opposition to this
request.
Craven made the motion, seconded by Brower, to
approve this request for a Special Use Permit.
The motion passed unanimously.
B: LARRY JAMES MANESS, Asheboro, North Carolina, is
requesting a Special Use Permit to obtain an
automotive dealer' s license at his residence
located on 1 . 4 acres at 1786 NC Hwy 42S, Grant
Township, Zoning Map #7770, Zoning District RA.
Maness explained that this would be part-time,
that he his a mechanical contractor by trade.
Maness said that he would have approximately 6 to
8 cars and there would be no on-site car repair
work. Maness said that he has spoken with his
neighbors and they have no problems with this
request. Maness said that he maintained his
property well and he plans to place most of the
cars in a screened area.
Dorsett discussed his concerns of the numbers of
cars and if they would be visible.
There was no one present in opposition to this
request.
Dorsett made the motion to approve this request
with the restriction of no more than 2 cars
visible from the road, no more than 6 additional
cars (that must be screened-not visible from the
road) , and no outside storage of car parts. The
motion was seconded by Craven and the motion
passed unanimously.
7 . The meeting adjourned at 8 : 24 p.m. There were 79
citizens present for this meeting.
