12DecemberPB • a MINUTES 177% RANDOLPH COUNTY PLANNING BOARD December 3, 1996 There was a meeting held at 6: 30 p.m. , on Tuesday, December 3, 1996, of the Randolph County Planning Board in the Commissioners' Meeting Room, Randolph County Office Building, 725 McDowell Road, Asheboro, North Carolina. 1. Chairperson Aweilda Williams called the meeting to Order at 6: 30 p.m. 2 . Hal Johnson, Planning Director, called roll of the members: Aweilda Williams , Chairperson, present; Maxton McDowell, Vice Chairman, present; Charles Adams , present; Lynden Craven, present; Jim Routh, present; Bill Dorsett, present; and Phil Brower, absent. 3. Bill Dorsett made the motion, seconded by Lynden Craven, to approve the Minutes of the November 12 , 1996 Planning Board meeting. The motion passed. 4 . REZONING REQUEST: A: CHARLES GLASS, SR. , Asheboro, North Carolina, is requesting that 34 . 77 acres located on Green Farm Road, Back Creek Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7732 . It is the desire of the applicant to develop a restricted residential subdivision of 7 lots . Glass was not present for the meeting. Roger Grosswald, neighbor to the site, said that it was his understanding that the development would be for site built homes and that this would be good development for the County. Grosswald supported this request. Johnson said that this would be a relatively short private road and only two lots would front on Green Farm Road. Craven said that since the neighbors seem to be in support and this is a 5+ acre tract subdivision, which he likes to see , he would see no reason to postpone this request (since Glass was not present) . Craven made the motion, seconded by Adams, to recommend to the Commissioners that this request be approved as consistent with the area. The motion passed unanimously. 5. Swearing in of the Witnesses: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you God. " 21 people took this Oath. 6 . REQUESTS FOR A SPECIAL USE PERMIT: A: PERCY COBB, Trinity, North Carolina, is requesting a Special Use Permit to obtain an automotive dealer' s license and operate a car sales lot at his residence located at 7471 Flint Hill Road, 1 . 2 acres , Tabernacle Township, Zoning Map #7725, Zoning District RA. Cobb explained his plans to use an old chicken house (and tear down the additional old chicken house on the property) to work on cars . Cobb said he would be purchasing strictly wholesale . Cobb said that this would not be a car lot and no more than a couple of cars would be displayed on the property (for sale) . Cobb said that he would remove the mobile home on the property and there would be no night work in the business . Cobb said they would be straightening automobile frames and would also being doing work for the public . Dorsett questioned what they would be doing with scrap material (if they would have outside storage) . Brad Nelson, 954 Loflin Hill Road, said that he would be Cobb' s partner and that they would sell scrap material to the local junkyards . Henrietta Walker, 747 Flint Hill Road, said that they property is an eyesore and Cobb has owned the property for 3 years and has never attempted to cleaned in up. Walker said her concern would be that the property would become even more of a problem. Walker said that this neighborhood has several real nice developments and well kept homes and this would not be consistent with the area. C.A. Parris, 3888 Level Plains Road, discussed his concern for the run-off to his property of fluids and oils . Parris ' property is in the rear of this site and due to topography it is down hill from the site. Charles Dwayne Sink, 3932 Level Plains Road, expressed concern for run-off into the creek. Gary Cox, 3409 Giant Oaks Road, said he felt this would lower property values in the area and cause added traffic to the road. Ronnie Clodfelter, Level Plains Road, said that he also felt this would hurt property values . There were 10 citizens present in opposition to this request. Nelson said that he understood the concerns expressed but there would be no paints, oils , or grease run-off. Cobb said that EPA would regulate this and not allow run-off. Dorsett said that what they are asking for is different than what they had applied for and he didn' t feel the Board should allow the additional request. Routh said that he sympathized with Cobb wanting to use his property that he already owned but he didn' t feel this would be the right place. Routh said he realized there were other businesses in the area but that most of those businesses were there prior to zoning. For this reason Routh made the motion, seconded by Dorsett, to deny this request for a Special Use Permit. The motion passed unanimously. B: KELLY BROWN, Archdale, North Carolina, is requesting a Special Use Permit to operate an automotive repair business and welding shop from an existing 30 ' x 40 ' building at his residence located at 5112 Clifton Drive, . 4 acre, New Market Township, Zoning Map #7727 , Zoning District RM. Brown explained that he has done this type of work for several years and would like the opportunity to work for himself. Brown said that he would not be doing any painting or major auto repairs. Brown said it would only be light auto repair work and a welding business . Brown said his hours would not be late night and it would be a full-time business . Brown said that the scrap would go to Cecil Tate' s Scrap Yard or store in an old existing building, outside storage would be minimal and kept neat close to the buildings . Brown presented a petition to the Board of 12 signatures from the community in support of his request. There was no one present in opposition to this request. �. Craven made the motion to approve this request of a Special Use Permit with the following restrictions: **hours from 7 am to 7 pm **minimal outside storage kept in neat order Adams seconded this motion. The motion passed unanimously. C: LARRY WOOD, Franklinville, North Carolina, is requesting a Special Use Permit to located a planned unit development (his house - son' s mobile home - 2 rental mobile home spaces) at his residence located on 46 acres at 3368 Carl Allred Road, Franklinville Township, Zoning Map #7794 , Zoning District RA. Wood explained that this would only be an addition of 1 mobile home rental space (the additional development is existing) . Wood presented pictures of his property and the location of the new mobile home space. Wood said he owned approximately 900 feet of road frontage on Carl Allred Road and that the home would sit 150 ' off the road as the other mobile homes do. Wood said he didn' t intend on `' locating any more mobile homes on the property. Glenn Reeder, 3324 Carl Allred Road, said that Wood' s property is neat and well kept and for this reason he would be in support of this request. There was no one present in opposition to this request. Lynden Craven said that the property is well kept and knowing Wood personally he was sure it would be kept compatible to the community. For these reasons Craven made the motion, seconded by McDowell, to approve this request for a Special Use Permit. The motion passed unanimously. D: STEPHEN PARRIS, Archdale, North Carolina, is requesting a Special Use Permit to obtain a dealer' s license at his residence located at 6901 Mendenhall Road on 1 acre, Trinity Township, Zoning Map #6798 , Zoning District RA. Parris said that this would be just for wholesale. Parris said that he is disabled and this would be to purchase cars and his daughters would detail the vehicles . Then Parris would carry the cars to car lots to sell. Parris said that he would have no more than 3 or 4 cars on his property at anytime (for the business) and it would only be part-time. David McDade, 1868 Riverview Road, Lexington, said that he is Parris ' partner and that this would be strictly part-time, that he works with the Sheriff' s Department full-time and this would be a side job. Parris said that there would be no mechanic work done on the site, just detail work. There was no one present in opposition to this request. Adams made the motion, seconded by Routh, to approve this request for a Special Use Permit. The motion passed unanimously. 7 . Recommendation for Zoning Ordinance Amendment Allowing Civil Penalties for Zoning Ordinance Violations. Johnson explained that the County Attorney had brought to his attention the fact that the Zoning Ordinance only allows him to bring Criminal Penalties to violators of the Zoning Ordinance. Johnson said that if the violators were brought up on civil penalties the burden of proof was not quite as difficult and that the judges were more apt to prosecute offenders. Craven made the motion, seconded by McDowell, to recommend to the Commissioners that this Amendment to the Zoning Ordinance be made. The motion passed unanimously. 8 . Special Meeting Johnson set the date of December 16 , 1996 at 3 : 00 p.m. for a special meeting of the Planning Board to discuss the new proposed Zoning Ordinance. 9 .
