January 5, 1995
1 . Chairman Jim Routh called to Order the Randolph County
Planning Board meeting at 7: 00 p.m.
2 . Hal Johnson, Planning Director called roll of members:
Jim Routh, Chairman, present; Aweilda Williams , Vice
Chairman, present; Tim Poole, present; Lynden Craven,
present; Charles Adams, present; Bill Dorsett, present;
Phil Brower, present; and Maxton McDowell, Alternate,
present.
3. Charles Adams made the motion, seconded by Lynden
Craven to approve the Minutes of the Randolph County
Planning Board meeting on December 6, 1994. The motion
passed.
4. Swearing in of Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you, God. "
16 citizens took the Oath.
5. REQUESTS FOR REZONING:
A: ARCHIE RICH, Asheboro, North Carolina, is
requesting that 2 . 40 acres located on Hwy 64 west
of Asheboro (just past Scenic Point Drive) ,
Tabernacle Township, be rezoned from Residential
Agricultural to Light Industrial/Conditional Use .
Zoning Map #7712 . It is the desire of the
applicant to operate a furniture manufacturing
business on the property.
Rich was present and explained that he purchased
this property 20 years ago, has paid taxes on this
property all this time, and feels this is a moral
matter to deny him the right to use this property
for his business . Rich said that he purchased the
property for this reason. Rich said that this
upholstery business (with a maximum of 6
employees) would be in a "Myrick" style building
with buffers if the Board feels this would be
necessary. Rich stated that he felt this would be
an asset to this community which is 70%
undeveloped. Rich said there would be few
transfer truck traffic and only air compressors
are used in the business which create very little
noise . Rich said he felt it is good to have
�• businesses out in scattered locations instead of
in a concentrated area, this would help relieve
traffic problems.
Sandra Lawmaster, lives across from the existing
business (on Garren Town Road) , said the business
has never been a problem and feels this proposed
business would not be a problem for the adjoining
property owners.
An employee of Rich spoke and said that since the
business only operates one shift there would be no
noise problems at night when most of the residents
would be home.
James Skeen, adjoining property owner, said that
he was at the auction when the land was sold and
it was sold for this purpose of business
development.
Donald Franks, adjoining property owner, said he
plans to build a $150 , 000 home here and would have
no problem with this business .
Phyllis Haithcox, adjoining property owner, said
that she felt this is a residential area and
should not have business located in this
subdivision. Haithcox expressed concerns of
traffic problems .
Jonathan Spain, adjoining property owner,
expressed his opposition to a commercial business
locating in a residential subdivision.
Kenneth Hill, adjoining property owner, stated
that this commercial business would not be an
asset to a residential community. Hill said that
they don' t oppose progress but they are opposed to
this business being located here. Hill added that
those that are present speaking in favor of this
request live at least a mile away from this site.
Candace Haithcox, adjoining resident, said that
this development doesn't allow mobile homes and
requires the houses to be built to a certain size .
Haithcox spoke of concerns of traffic dangers .
There were 6 people present in opposition.
Aweilda Williams said that she felt the Board had
made the correct decision at the first public
meeting and Williams made the motion, seconded by
Lynden Craven to recommend to the Commissioners
that this request be denied as not compatible to
the area. The motion passed unanimously.
B: C.E.R. DEVELOPMENT COMPANY, Asheboro, North
Carolina, is requesting that 254 . 12 acres off
Pisgah Covered Bridge Road (addition of Quail
Ridge Subdivision) , Union Township, be rezoned
from Residential Agricultural to Residential
Mixed. Zoning Map #7646 . It is the desire of the
applicant to develop 36 additional lots (average
lot size 7+ acres) .
Sonny Edmondson was present and explained that
this would be an addition of 36 lots with 1
development site per lot. Edmondson said the same
restrictions (currently in effect in Quail Ridge)
would be applied to the new lots . Edmondson said
that approximately 30 families would be exiting to
each road (Pisgah Covered Bridge Road and Howard
Auman Road) . Edmondson said that a homeowners
association is currently forming in the existing
development and will take over road maintenance
responsibilities once 80% of the lots have been
sold.
Board member Bill Dorsett asked if the residents
of the new section will help maintain existing
roads . Edmondson said that each lot owner will be
responsible for an equal portion of the road
maintenance cost. Johnson asked if the developers
will be responsible for this equitable arrangement
and Edmondson said this will be arranged by the
homeowners association.
David Pratt, Treasure of Homeowners Association,
spoke for 97% of the property owners in Quail
Ridge Subdivision. Pratt said that this addition
will have the appearance of a mobile home park and
presented the Board with a petition of 97% of the
homeowners ' (in Quail Ridge) signature . Pratt
complained of the existing roads being too narrow
and poorly maintain (this is the responsibility of
the developers at this time) . Pratt said that
there are now 18 families in the development and
this will be an addition of 30 families.
Hal Johnson asked Pratt how developed was this
homeowners association. Pratt said that they have
elected officers and have had several meetings.
Pratt said that they have also discussed creating
a road maintenance fund which the residents will
pay into on a yearly basis. Pratt said currently
the figure $150 per family per year was being
discussed.
Jarrell Rice, resident of Quail Ridge, discussed
his concerns of allowing this property to be zoned
for smaller than 10 acre tracts . Rice said that
if the Board rezoned this property, then the lot
owners in Quail Ridge wanted their properties
rezoned for 5 acre tracts also. Rice added that
they would file for this request.
Bob Bacon, Vice President of Homeowners
Association, said he felt that the Board could not
listen to either side and believe what they were
being told. Bacon said that he had been elected
Vice President and was only invited to attend one
of their meetings . Bacon said he did not believe
the Board should allow these smaller lots but that
there is a "click" in the subdivision that wants
to control everything.
Pam Bacon, Quail Ridge Subdivision, raised some
questions concerning the road maintenance
agreement (possibility that it is not the same on
all the deeds) .
Don Falk, President of the Homeowners Association,
expressed his concern of the private roads being
so long and said that these roads are only single
lane roads . Falk said he felt the developers
should have to widen the roads to double lanes
prior to the development being approved.
Sonny Edmondson said that the right of way is 50 '
wide and initially the roads were 16 ' to 18 ' wide
but that over time the gravel moves toward the
center of the road. When asked Edmondson
explained that they had no plans to bring the
roads up to minimum state standards.
Bill Dorsett said that he did not feel that the
Board could legally deny the request as long as it
meets the County minimum standards due to the fact
that this would be the only possible use of the
land. Dorsett made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request be approved. The motion passed with
a 6 to 1 vote, Phil Brower voted against the
motion.
C: GHS CORPORATION, Denton, North Carolina, is
requesting that 5 acres (from a 37 .34 acre tract)
located at the corner of Hwy 49/SR 1183 , New Hope
Township, be rezoned from Residential Agricultural
to Light Industrial. Zoning Map #6686 . It is the
desire of the applicant to use the property for
industrial purposes. Property Owner: James
Edward Morris .
Levon Hopkins owner of GHS Corporation said that
their business is in distribution of Walker Riding
Lawn Mowers . These mowers are around $10 , 000 in
cost and are used for commercial purposes such as
golf courses , etc. Hopkins said he has hired and
engineer to design the property for a stucco &
stone building, lake, and for his residence. GHS
plans to employee around 5 people .
Bill Dorsett asked if any repair work will be
performed on the premises . Hopkins said work is
normally handled at their dealerships in other
locations but that he did not want to be limited
to no repair work.
Lola Mae Scarboro, adjoining property owner, said
she has lived here for 45 years and that Hopkins
runs a real nice business .
There was no one present in opposition.
Aweilda Williams made the motion, seconded by
Lynden Craven, to recommend to the Commissioners
that this request be approved. The motion passed
unanimously.
D: RICHARD & JADENE HILL, Randleman, North Carolina,
is requesting that 20 . 32 acres located off Hwy 311
on Poole Road, New Market Township, be rezoned
from Residential Agricultural to Light Industrial .
Zoning Map #7727 . It is the desire of the
applicant to use the property for industrial
development.
Jadene Hill was present and explained that there
is a trucking company on the property
(approximately 22 ,500 sq. ft. originally
constructed for a manufacturing plant) . Hill
explained that she knew the property could only be
developed up to 24% due to Watershed Regulations.
Hill said that this would be around 42 acres .
Hill said she only wanted to build a 10, 000 sq. ft.
structure for furniture warehousing. Hill
presented the Board with a list of businesses
located in the area.
Carol Mitchell (Trucking Company) said that they
would be in favor of this development and said
that this would create a greater security for
their business.
Rome Collins, adjoining property owner, said that
the businesses that are located in this Community
were there before zoning came into effect.
Collins said that the community was already
burdened with the noise from the trucking company
(all hours of the night) .
Hill said that Collins has a business in his home
and his brother-in-law operates a trucking company
at his home. Collins said that he operates a
carpet cleaning business and his home is used only
for his office.
James Tuttle, adjoining property owner, said that
this is a residential community and many of the
businesses in the area are no longer in operation.
Tuttle said that the soil is questionable (for
perking) in this area.
Board member Charles Adams expressed his
reservations due to this being the fastest growing
area of the County. Adams added that the fact has
been established that the businesses in this
community were started prior to zoning. Adams
also expressed concerns of water quality and that
often times the structures original intent (when
built) change after constructed. Adams used the
example of the trucking company building was
originally built for a manufacturing plant.
Charles Adams made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request be denied. The motion passed with a
4 to 3 vote, with Williams - Poole - Routh voting
against the motion.
E: RICHARD HOLMES, Summerfield, North Carolina, is
requesting that 2 acres (from 41 . 60 acre tract)
located on Hwy 64 (just east of Hicks Farm Road) ,
Columbia Township, be rezoned from Residential
Agricultural to Highway Commercial/Conditional
Use. Zoning Map #8732 . It is the desire of the
applicant to use the property for sales of horse
trailers & related horse tack & equipment.
Property Owner: Flora Smith Estate.
Holmes explained his intentions to purchase the
entire tract and using 2 acres to sell horse
trailers, tack, equipment, etc . Holmes said he
may employee 3 to 4 people.
There was no opposition to this request.
Lynden Craven made the motion, seconded by Bill
Dorsett, to recommend to the Commissioners that
this request be approved. The motion passed
unanimously.
F: LARRY EAST, Sophia, North Carolina, is requesting
that 67 . 07 acres located on Hwy 311 (just south of
Marlboro Church Road) , New Market Township, be
rezoned from Residential Agricultural to Light
Industrial. Zoning Map #7745 . It is the desire
of the applicant to develop an industrial park of
21 lots.
Terry Bowling, Real Estate Agent, said that this
central location (between High Point & Asheboro)
has good access to Hwy 311 and would be
appropriate for industrial development. Bowling
said that a paved road was constructed into the
property off Stewart Road (and not Hwy 311) due to
the cost it would require to access over the
railroad to Hwy 311 . Bowling said that he has
spoken with Randolph Economic Development
Corporation and was told they felt this would be a
good area for industrial growth. Bowling said
that East plans to lease and built to suit, not
sale the lots.
James & Beverly Shipton, Stewart Road, expressed
their concerns for the road not being paved and
this type of traffic creating a severe dust
problem. Shipton said that they were not opposed
to the industrial development as long as the road
is paved. This seemed to be the opinion of all
the neighbors present.
Bowling said that East is willing to assist with
the paving of the road.
Lynden Craven made the motion, seconded by Bill
Dorsett, to recommend to the Commissioners that
this request be approved with the stipulation that
the developer be required to pave the road to the
far corner of his property (abutting Stewart
Road) . The motion passed with a 6 to 1 vote ,
Charles Adams voted against the motion.
***Maxton McDowell left the meeting at this time.***
6 . SPECIAL USE PERMIT REQUESTS:
A: GENE DARRELL VESTAL, Trinity, North Carolina, is
request a Special Use Permit to construct a 45x70
building to store old automobiles at his residence
located at 3892 Old Glenola Road, on 7 acres, New
Market Township, Zoning Map #7727 , Zoning District
RA.
`+ Vestal described 5 classic vehicles that he plans
to store in this building to be located
approximately 300 ' off the road behind his
residence. Vestal added that the back-hoe would
also be placed in the building.
Dorsett questioned Vestal about all the outside
storage he currently has on the property (old
vehicles, junk material, etc . ) . Vestal explained
that he would remove the cars located under the
power lines and clean up all the unsightly
materials/storage on the property.
June McDowell Davis, represented 10 members of the
Davis Family, said that they were against
additional structures be added to the property.
Davis said that this would devalue the Davis
property which is currently undeveloped. Davis
spoke of the unsightly storage on the property.
Dr. Chung, adjoining resident, expressed concerns
of the junk vehicles currently on the property and
said he was afraid the property may become a junk
yard.
There were 5 people present in opposition.
Bill Dorsett said that the building would allow
Vestal to get some of these vehicles and the heavy
equipment out of sight and for this reason made
the motion, seconded by Lynden Craven, to approve
this request for a Special Use Permit with the
following restrictions:
**all vehicles are to be removed from the property
or stored within the building (excluding the
vehicles he drives daily) .
**all permanent storage of junk/debris must be
removed from the property or stored in the
building.
**all unsightly material must be removed prior to
issuance of the permit.
The motion passed unanimously.
B: JAMES VERNON TROGDON, Asheboro, North Carolina, is
requesting a Special Use Permit to construct a
40x100 building for automotive repair and personal
storage at his residence located on 14 . 36 acres at
3380 Buffalo Ford Road, Grant Township, Zoning Map
#7780, Zoning District RA.
Trogdon said he plans to restore his personal
vehicles and store his farm equipment in the
building. Trogdon said he would only repair his
personal vehicles from this site . Trogdon added
that there would be no outside storage.
Board members Bill Dorsett and Charles Adams
complimented Trogdon on his property and how nice
he took care of his property. Adams added that
Trogdon runs a very clean automotive garage up in
north Asheboro.
There was no one present in opposition of this
request.
Charles Adams made the motion, seconded by Phil
Brower, to approve this request for a Special Use
Permit. The motion passed unanimously.
C: DONALD & ALICE WOODS, Sophia, North Carolina, is
requesting a Special Use Permit to develop 1
additional space in their existing 3 space mobile
home park located on 4 .20 acres at 1935 Groom
Road, Back Creek Township, Zoning Map #7744 ,
Zoning District RM-CU.
Hal Johnson reminded the Board that they reviewed
this request a few months ago and one of the
reason the request was denied was concerns of road
maintenance of this private road.
Woods presented the Board with a petition signed
by all but 2 of the property owners on the road
concerning their agreement of road maintenance and
to this additional mobile home being placed on the
property.
W.T. Nelson, owner of the farm on the west side of
this site, said a gasoline tank, highway tractor,
9 buildings , and 3 trailers already on the
property. Nelson said that the double wide mobile
home they are wanting the place on the property
was moved in months ago and is very large (in
size) and is in poor condition. Nelson spoke of
littering, trespassing, and vandalism problems
that the people on this road have experienced.
Nelson suggested that if this approved requiring
the Woods to construction a 5 ' chain link fence
around the entire property.
Danny Cecil, adjoining property owner, said that
his concern (in the previous meeting) was that he
thought they needed 1 acre per dwelling and than
no more land has been purchased (to increase the
parcel size) since this last meeting.
Hope Duncan, adjoining property owner, said that
the right-of-ways for this property cross her
property and they are bothered by the road
traffic, telephone and power lines, that currently
existing on her property. Duncan complained of
cigarette smoke that comes from this property and
prevents her from having fresh air outdoors at her
residence .
Lynden Craven made the motion, seconded by Charles
Adams , to approve the Special Use Permit to allow
this additional mobile home. The Board noted that
this would be the last addition to this mobile
home park. The motion passed with a 6 to 1 vote ,
Aweilda Williams voted against the motion.
7 . There were 97 citizens present for this meeting. The
meeting adjourned at 9 : 10 p.m.
