1 . Chairman Jim Routh called to Order the Randolph County
Zoning Board of Adjustment meeting.
2 . Hal Johnson, Planning Director, called roll of member:
Jim Routh, Chairman, present; Aweilda Williams , Vice
Chairman, present; Tim Poole, present; Lynden Craven,
present; Charles Adams , present; Bill Dorsett, present;
Phil Brower, present; and Maxton McDowell, Alternate,
absent.
3. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you, God. "
9 citizens took the Oath.
4 . VARIANCES:
A: JOHNNY AKINES & LISA AKINES, Sophia, North
`� Carolina, are requests a Variance to allow the 2
lots (1 . 37 acre tract & 2 acre tract) to be cut
without State Road Frontage from a 42 . 32 in lieu
of the minimum lot size requirement of 5 acres
(per lot) for property with no State Road
Frontage . Location: Baker Farm Road, New Market
Township, Zoning Map #7735, Zoning District RA.
**Arguments for Granting the Request
The Akines were present and explained that this
property would be deeded from their grandfather to
each of them separately. Akines said that the
proposed lots would be approximately a mile off
the State Maintained Road. The existing private
road is maintained and owned by the family.
There were 5 people present in favor of this
variance being granted.
**Arguments Against Granting the Request
There was no one present in opposition.
**Board Discussion: Conclusions based on Findings
�-- of Fact
1 . The Board found that a hardship was not a
`-- result of the applicant' s own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found taht the use will not
substantially injure the value of adjoining
or abutting property.
**Order of the Board of Adjustment
Lynden Craven made the motion, seconded by Charles
Adams , to approve this request for a Variance.
The motion passed unanimously.
B: JAMES KINLEY, Denton, North Carolina, is
requesting a Variance to allow a 1 acre lot
(without State Road Frontage) to be cut from a
7 . 60 acre tract in lieul of the required 5 acre
lot size minimum without State Road Frontage .
Location: 1555 Chapelwood Road Extension,
Tabernacle Township, Zoning Map #6781 , Zoning
District RA.
**Arguments for Granting the Request
Kindley explained his intentions to deed his
daughter and her husband 1 acre of land to locate
their 74 model 12 x 50 single wide mobile home.
Kindley said that this is all they have and would
probably build later in the future .
**Arguments Against Granting the Request
Jerry Hartman, Chapelwood Road Extension, said
that he didn' t have a problem with Mr. Kindley
allowing his daughter to live on his property but
he felt if the property was to be deeded out it
should be required that a more permanent residence
be located on the new site . Hartman said that if
this division was allowed and a double wide mobile
home or site built home not require, other lot
owners may want to do this for their children in
the future . Hartman expressed concern if this did
happen, Chapelwood Road Extension may then have
the appearance of a mobile home park.
Planning Director Hal Johnson asked Kinley if it
was really necessary to divide the property at
this time or would he be willing to allow the
tract to remain as is, if the Board agreed to
�-- allow him to locate an accessary mobile home on
the property (for family use) , and then bring the
request back to the Board at such time when a more
+�- permanent residence is being developed. Kinley
agreed to this.
**Board Discussion: Conclusions Based on Findings
of Fact
The Board felt a good compromise had been reached
by all parties concerned.
**Order of the Board of Adjustment
Bill Dorsett made the motion, seconded by Lynden
Craven, to deny the request as written but to
allow Kinley to locate an accessory mobile home
for family purposes on the tract (with no division
of property) . The motion passed unanimously.
5. There were 9 people present for this meeting. The
meeting adjourned.
