03MarchPB 1 , y. ►,. r MINUTES /77SRANDOLPH COUNTY PLANNING BOARD • March 7, 1995 1 . Chairman Charles Adams called to Order the Randolph County Planning Board meeting at 7 : 00 p.m. 2 . Roll call of the members: Charles Adams, Chairman, present; Aweilda Williams , Vice Chairman, present; Tim Poole, present; Jim Routh, present; Lynden Craven, present; Bill Dorsett, present; Phil Brower, present; and Maxton McDowell, Alternate, absent. 3. Lynden Craven made the motion, seconded by Jim Routh, to approve the Minutes of the February 7 , 1995 Randolph County Planning Board Meeting. The motion passed. 4 . SPECIAL USE PERMIT REQUESTS: A: RANDOLPH COUNTY BOARD OF EDUCATION, Asheboro, North Carolina, is requesting a Special Use Permit for an expansion of Tabernacle School with a new athletic field located at 4901 Tabernacle School Road, on 21 . 26 acres, Tabernacle Township, Lake Reese Watershed, Zoning Map #7711 , Zoning District RA. Bob Scherear, Randolph County Board of Education, was present and explained that they had recently purchased an additional 121 acres for expansion. The new facilities will have a capacity of 650 students (there are 440 students attending this school) . There are currently 230 students in existing site built structure and the remaining students are are housed in trailers. There was no one present in opposition to this request. Aweilda Williams made the motion, seconded by Phil Brower, to approve this request for a Special Use Permit. The motion passed unanimously. B: STELLA SPENCER, Asheboro, North Carolina, is requesting a Special Use Permit to operate a craft store in an existing (14x24) building at her residence located at 2354 Mack Road, on 1 . 06 acres , Oak Grove Acres - lots 35-42 , Cedar Grove Township, Zoning Map #7648, Zoning District RR. Spencer was present and explained that she makes porcelain dolls now that she is retired. Spencer said that she wants to sell these dolls from her house and added that there are no deed restrictions on the property to prevent this activity. There was no one present in opposition. Dorsett said that he did not feel this type of business would have any negative impacts on the property. Lynden Craven made the motion, seconded by Phil Brower, to approve this request for a Special Use Permit. The motion passed unanimously. C: E.P. CLODFELTER, JR. , Randleman, North Carolina, is requesting a Special Use Permit to construct a (50x20) building for mini-warehouse storage at his residence located at 10680 Randleman Road, on 74 .23 acres, Level Cross Township, Polecat Creek Watershed, Zoning Map #7768, Zoning District RA. Clodfelter explained that the building would be located behind the existing trailers on the property. Chriscoe Builders will construct the building, the property will be fenced and lighted. Clodfelter described many commercial buildings `� across the road from this site. Clodfelter said that this business would be for his retirement and to help provided as he is a single parent with 2 young children. Dorsett said that he would concerned if the building is located too close the Hwy 220 but he would not have a problem if the building is located behind the woods . Betsy Clodfelter Byerly, adjoining property owner, presented pictures of the property and a sketch plat of the properties. Byerly said that she felt the building should not be jammed up against her property because this would destroy her ability to sell the property for residential purposes. Clodfelter said he would be willing to leave woods between her property and this building. Byerly said she would not have a problem with the building if he would leave a 100 ' buffer of trees between her property and this building. Johnson advised the Board that he could work out �— the setback problems with the two property owners if they decided to approve the permit. Lynden Craven made the motion, seconded by Jim Routh, to approve this request for a Special Use Permit with the condition that both property owners work out the setback requirements with Hal Johnson, Planning Director. Additional restrictions: *buffer zone minimum 150 ' *fencing of structure *lighting of the facility The motion passed unanimously. D: TOMMY SHELTON & OSCAR HILL, Asheboro, North Carolina, is requesting a Special Use Permit to operate a sales lot for utility trailers located on Hwy 42 (just past Old Humble Mill Road) , on 31 . 70 acres, Grant Township, Zoning Map #7679 , Zoning District RA. Shelton explained there would be an office on the property and approximately 12 trailers for sale. Shelton said he has lived here all his life and has spoken with all the neighbors concerning this business and they have no opposition. No one was present in opposition to the request. Board member Bill Dorsett said he would have reservation to the location of this many trailers in view of the road. Dorsett added that this would not be attractive and would change the character of the neighborhood. Lynden Craven made the motion, seconded by Jim Routh, to approve this request for a Special Use Permit. The motion passed with a 6 to 1 vote , Bill Dorsett voted against the motion. 5 . REQUESTS FOR REZONING: A: LARRY EAST, Sophia, North Carolina, is requesting that 67 . 07 acres located on Hwy 311 (just south of Marlboro Church Road) , New Market Township, be rezoned from Residential Agricultural to Light Industrial. Zoning Map #7745 . It is the desire of the applicant to develop an industrial park of 21 lots. Johnson explained that this request was considered a couple of months ago and recommended to the Commissioners that the zoning change be approved with the condition that Stewart Street be paved to the entrance of the industrial park. At the Commissioners ' meeting the developers provided information showing that this requirement would be so costly that it would not be feasible. The Commissioners sent the request back to this Board of further review. Terry Bowling (representative for East) , Real Estate Agent, informed the Board that Jeff Picklesimer , NCDOT District Engineer, said that all roads in Randolph County are on schedule to be paved by the year 2006 . Bowling said that the developers asked adjoining property owners if they would be willing to help absorb the cost of paving the road and they were not. Chuck Powell told the Board that they purchased the property in 1981 and bought a building permit to construct their business . Business slowed down and they decided not to build at that time. Powell said that he corresponded with O.G. Mills , Southern Railroad, for 3 years and the railroad would not allow him to access across the tracks . Mills did offer a possible access if Powell would carry a $2 million insurance policy. Powell had his insurance carrier to look into this kind of policy and it was determined that this would cost $10, 000 a year for coverage. Powell said this was not feasible for him. Powell said that they built a paved road to State standards into the property a few years ago for this type of develop. Powell presented a petition of property owners on Stewart Street that where not opposed to this development. Powell told the Board that he did not want to access Stewart Street but he did not have a choice at this time. Powell said if he could get a business into this development that would put a spur on the railroad, Southern Railroad would given him access to cross the tracks. Louise Newby Brim, Newb Hill Road, said that this development would not be compatible to the character of the area and would have a negative impact on their way of life. Brim added that this would also have a negative impact on property values in the area. Beverly Shipton, Stewart Street, expressed concerns of this dirt road being used as the access for this industrial park. Shipton said that at the Commissioners meeting the developers said that the pavement of this road would cost $94,000 and Shipton said that Jeff Picklesimer, NCDOT, told her it would cost $21 ,000 for the State to pave the road. Shipton added that this road is number 134 on the State ' s priority list to paving roads . East said if he could get the road paved for $21 , 000 he would pave the road. East said that he received his bid to fix the road from Thompson-Author Paving Company. Phil Brower asked East if he asked for any other bids; East did not. Loraine Shipton, Stewart Street, described the entrance as not being adequate for large trucks. Shipton said that there are ruts cut in the property on the other side of the road because of trucks (East has cows on the property) turning into the road. Shipton said that this road has a terrible dust problem and these extra trucks will only make this problem worse . Shipton explained her allergy problems and her daughter-in-law' s heart disease problems. Phil Brower said $94 , 000 bid didn' t seem right. Aweilda Williams said she felt the Planning Board' s recommendation was correct. Williams said there has been no change in the evidence presented. For this reason Williams made the motion that this request be approved with the requirement that the road be paved to the industrial park road entrance. Lynden Craven seconded this motion. Jim Routh said he was not sure that the Board could require the road be paved when the property fronts on a State Maintained Road. Bill Dorsett said that he felt the Board could due to the fact that if the development is approved without the road being paved it would effect the public health of adjoining property owners . Hal Johnson said that the Board has recommended this restriction because there is not adequate access of the industrial development. Jim Routh said that if we are requiring the pavement due to dust problems that OSHA would require the State to pave the road if the dust was a problem. The Motion passed with a 6 to 1 vote. Jim Routh voted against the motion. B: W.T. COX, Ramseur, North Carolina, is requesting that 22 .35 acres located on Hwy 64 (just east of Hwy 49 intersection) , Columbia Township, be rezoned from Residential Agricultural to Highway Commercial. Zoning Map #8702 . It is the desire of the applicant to use the property for commercial development. Property Owner: Viola Staley. Cox stated that 33% of the property is in the Town of Ramseur and zoned for commercial development. Cox said this would be a shopping center with a new 32 ,000 sq. ft. grocery store. This property has an access to Hwy 64 and to Hwy 49 . Cox said he plans to use both access and equally landscape each entrance. Cox said that Ramseur needs this development and presented statistics to show this need. Cox said that the people of Ramseur only has one grocery store and this does limit product selection and availability. Cox said that Ramseur needs this economic growth and presented a letter of endorsement signed by all the Town Commissioners and the Mayor of Ramseur. Cox added that there will be extensive landscaping of the property to make the development as attractive as possible. Mayor Odell Cox spoke in favor of the development. Cox said that he has spoken to several people in town and most citizens support this development. Ray Albright, Chairman of Ramseur Zoning Board, said this would be in keeping with the Town' s zoning and he would like to see the County approve this request. Earl Glover, trustee of Oakland Baptist Church, said he was not opposed to the development but he was concern about where the access would be on Hwy 49 and he also felt a natural buffer should be reserved between the Oakland Baptist Church Cemetery and this new development. Cox said he plans to reserve a buffer zone for the Cemetery and would have no problem with the Board making a recommendation with an appropriate buffer. Cox showed the plans to Glover and he had no problem with the access to Hwy 49 as it is presented. Chairman Adams said that as a minister he would request that if there is a funeral while construction is going on, that they stop construction for the service. The developer agreed to this request. Jim Routh made the motion, seconded by Tim Poole, to recommend to the Commissioners that this request be approved with the restriction of a 50 ' buffer maintained next to the cemetery. C: ROBERT BRASWELL, Randleman, North Carolina, is requesting that 11 .63 acres located on Hwy 311 (just north of Plainfield Road) , Back Creek Township, be rezoned from Residential Agricultural to Light Industrial. Zoning Map #7745 . It is the desire of the applicant to use the property for industrial development. Property Owner: Lawrence B. Cranford. Braswell explained that he wants to operate a structural steel business (to build frames for commercial structures) on this property. Braswell said that he would have approximately 20 employees and access on to Plainfield Road. There was no opposition present. Lynden Craven made the motion, seconded by Jim Routh, to recommend to the Commissioners that this request be approved. The motion passed unanimously. D: PAUL DEAN STALEY, Julian, North Carolina, is requesting that 52 .67 acres located on Randolph Church Road (1 mile east of Hwy 22) , Providence Township, Sandy Creek Watershed, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7797 . It is the desire of the applicant to develop a restricted residential subdivision of 9 lots. Property Owners : Laura Frye & Others . Staley said that this would be for site built homes only with a minimum house size of 1200 sq. ft. of heated space. The average lot size will be 5+ acres with private roads . There was no opposition present. Lynden Craven made the motion, seconded by Jim Routh, to recommend to the Commissioners that this request be approved as consistent with the Land Development Plan for this area. The motion passed unanimously. 6.
