March 7, 1995
1 . Chairman Charles Adams called to Order the Randolph
County Zoning Board of Adjustment meeting.
2 . Roll call of members: Charles Adams, Chairman,
present; Aweilda Williams , Vice Chairman, present; Tim
Poole, present; Jim Routh, present; Lynden Craven,
present; Bill Dorsett; Phil Brower, present; and Maxton
McDowell, Alternate, absent.
3. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, nothing
but the truth, so help you God. "
9 citizens took this Oath.
4 . VARIANCES:
A: WANDA MCDANIEL, Asheboro, North Carolina, is
requesting a Variance to allow the placement of a
Class C Mobile Home on property in lieu of the
zoning requirement that allows Class A Double-Wide
Mobile Home (on permanent foundation) . Location:
3071 Providence Church Road, 1 acres, Providence
Township, Zoning Map #7787 , Zoning District RR.
**Arguments for Granting the Request
McDowell said that there was a single wide mobile
home on the property at one time. McDaniel
described many hardships in her life such as
several deaths (of close family members) in the
past year, marital problems, and the fact the her
husband is an alcoholic and she is a recovering
alcoholic . McDowell said that this property is
owned by her son and her son lives next to this
site. McDaniel said that the adjoining neighbors
are her daughter-in-law' s family and they have no
opposition to the variance.
**Arguments Against Granting the Request
There was no one present in opposition.
**Board Discussion: Conclusions Based on Findings
of Fact
1 . The Board found that a hardship was not a
result of the applicant ' s own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found that the use will not
substantially injure the value of adjoining
or abutting property.
**Order of the Board of Adjustment
Bill Dorsett made the motion, seconded by Aweilda
Williams , to approve this request for a Variance.
The motion passed unanimously.
B: ALLEN VESTAL,JR. , Randleman, North Carolina, is
requesting a Variance to allow the division of
property for family use (2 acre tract, 1 acre
tract, 4 . 66 acre tract) on a private drive in lieu
of the required 5 acre lot size minimum.
Location: end of Allen Drive (off George York
Road) , 7 . 66 acres , Franklinville Townsihp, Zoning
Map #7774 , Zoning District RA.
**Arguments for Granting the Request
Vestal said that all of his family lives here on
the road and that his wife ' s family lives hours
from this area. Vestal said that he just wants to
divide the property so that his wife ' s family
could move here. Vestal said that the road is
maintained by his brother and himself.
**Arguments Against Granting the Request
There was no one present in opposition to the
request.
**Board Discussion: Conclusions Based on Findings
of Fact
Dorsett said that he did not see a hardship case
being expressed in this request.
**Order of the Board of Adjustment
Lynden Craven made the motion, seconded by Phil
Brower, to approve this request for a Variance.
The motion passed with a 5 to 2 vote, Bill Dorsett
and Aweilda Williams voted against the motion.
C: MICHAEL ROYAL, Asheboro, North Carolina, is
requesting a Variance to allow the division of 1
acre for family use on a private drive in lieu of
�-- the required 5 acre lot size minimum. Location:
1555 Chapelwood Road Extension, 7 . 60 acres ,
Tabernacle Township, Zoning Map #6781 , Zoning
District RA.
**Arguments for Granting the Request
Royal explained that her father and sister live on
the property now and this would be a third
residence . Royal said that they would be placing
a modular home on the property.
**Arguments Against Granting the Request
Eddie Alfred, adjoining property owner, said that
he bought land her 9 years ago and there was a
contract on the road but no one has kept it up
except a very few people . There was also a
restriction of 1 house per 5 acres.
Jerry Hartman, adjoining property owner, said he
spoke at a hearing 2 months ago on this same
property to allow the 2nd residence and had no
problem with the additional residence but was
concerned about the road maintenance. Hartman
said that at that meeting the property owner said
that he would contact the neighbors and help fix
the road. Hartman said that he has not been
contact and he felt the Board of Adjustment was
more than considerate in approving the 2nd
residence . Hartman added that he heard they also
had a son that they wanted to put on the property
in the future . Hartman went on to say that if his
property is allowed to be developed this much all
the lots should be allowed this same benefit.
Brenda Alfred, adjoining property owner, said that
this property owner divided the land and placed
the restriction of 1 house per 5 acres on the
tracts.
There were 6 people in opposition to this request.
**Board Discussion: Conclusions Based on Findings
of Fact
There was a consensus of the Board that this was
not a hardship situation and therefore they should
not be allowed to divide the property.
**Order of the Board of Adjustment
Tim Poole made the motion, seconded by Phil
Brower, to deny this request for a Variance. The
motion passed unanimously.
5 The meeting adjourned.
