1. Chairman Charles Adams Called to Order the Randolph
County Planning Board meeting at 7 : 00 p.m.
2. Roll call of members: Charles Adams, Chairman,
present; Aweilda Williams, Vice Chairman, present; Tim
Poole, absent; Lynden Craven, present; Bill Dorsett,
present; Jim Routh, present; Phil Brower, present; and
Maxton McDowell, Alternate, present (substituting for
regular member Tim Poole) .
3. Lynden Craven made the motion, seconded by Jim Routh,
to approve the Minutes of the Randolph County Planning
Board meetings held on February 27 , 1995, and March 7 ,
1995. The motion passed unanimously.
4. REQUESTS FOR PROPERTY REZONING:
A: MARK LANGLEY, Liberty, North Carolina, is
requesting that 36 acres located on Old Staley
Road (3/10 mile off Hwy 49) , Columbia Township, be
rezoned from Residential Agricultural to
Residential Mixed. Zoning Map #8724. It is the
desire of the applicant to develop a 15 lot
subdivision that would allow both site built and
mobile home development. Property Owner: Ruth
Smith.
Langley explained that he originally requested 42
lots to be subdivided, but after speaking with the
adjoining property owners and finding this to be a
major concern of the neighbors, changed the
request to 15 lots . Langley said that the private
restrictions will exclude junk (vehicles , yards ,
etc. ) , require brick foundations for every
residence, all decks must be at the rear of the
residence, paved roads , etc. Langley showed the
Board aerial photos and property line maps of the
area and stated that the type of house and lot
sizes would be compatible to the area. Langley
said that only the rear lots will possible contain
single wide mobile homes (none at the front of the
subdivision) .
Brenda Cox, adjoining home owner, explained that
she was much against the original request of 42
lots but has no problem with the 15 lots being
u request. Cox said that she appreciated Langley
allowing the neighbors to have some say in the
development because someone else (that may would
purchase the property) might not.
Eldridge Smith, property owner, said that he had
offered the property to the adjoining land owners
and no one wanted to buy the property. Smith said
that this would be a change for a good
development. Smith said Langley is a member of
this community and he was sure that he would not
develop something that would harm the area.
David Stanley, adjoining home owner, said that he
would not be against this subdivision as long as
he develops the property as he says he will.
Stanley said that he would prefer him restricting
the property to no single wides but he could live
with the development.
Floyd Pugh said that he felt this would be a
nuisance to the community. Pugh express concern
of pets, crime, garbage, and traffic problems .
Todd Rickman said that as long as he requires
permanent foundations and only allows site built
residences and double wide manufactured homes he
would not be opposed to the development. Rickman
said that he felt that single wide mobile homes
would have an effect on adjoining property values .
There were 40 people present in opposition to the
request.
Johnson advised the Board that due to the
significant change in the request from 42 lots to
15 lots they could postpone a decision until their
next meeting if they so desired.
Langley said that if the community wanted he to
change his request to Residential Restricted (RR)
instead of the Residential Mixed (RM) he has
requested he would be willing to do so.
Bill Dorsett said he could see no need for a delay
under the conditions Langley has agreed to.
Lynden Craven agreed.
Lynden Craven made the motion to recommend to the
Commissioners that this request of changing the
zoning from Residential Agricultural to
Residential Restricted for a subdivision of 15
lots be approved. Maxton McDowell seconded the
motion and the motion passed with a 6 to 1 vote.
Jim Routh voted against the motion.
B: DONALD LANIER & LARRY MCDOWELL, Asheboro, North
Carolina, is requesting that 222 .70 acres located
on Jackson Creek Road (across from Golden Meadows
Road) , Concord Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7710 . It is the desire
of the applicants to develop a 68 lot subdivision
for restricted residential development.
Lanier explained the intentions to develop a site
built subdivision with an average lot size of 3
3/4 acres . Lanier said that the minimum house
size would be 2000 sq. ft. of heat space with a
minimum of 3000 sq. ft. under roof.
There was no one present in opposition.
Jim Routh made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request be approved. The motion passed
unanimously.
C: DAVID WALKER, Asheboro, North Carolina, is
requesting that 1 . 86 acres located at the corner
of Hwy 49S/Union Church Road, Cedar Grove
Township, be rezoned from Residential Agricultural
to Highway Commercial/Conditional Use. Zoning Map
#7639 . It is the desire of the applicant to
operate a convenience store/deli/gas station.
Property Owner: Vernon & Olga Cagle .
Walker was present and explained his intentions to
construct a 40 x 60 building for a small grocery
store (with produce, gas , & deli) . Walker said
there would be a natural wood boarder between the
station and the rear property line (of 15 ' that
would be 112 ' in length) with an entrance/exit to
each road. The store would operate 7 days a week
(and all holidays) from 6 am to 10 pm with 3
employees operating 2 shifts .
Mark Walker, Cedar Grove Community, expressed
safety concerns at this intersection that has a
lot of school traffic (11 bus routes pass through
at least twice a day) and presented pictures of
traffic in the intersection. Walker said he did
not feel the buffer (expressed to be 15 ' ) would be
enough and questioned if the property would be
large enough to accommodate the proposed
development due to the large amount of property
located within State right-of-way. Walker spoke
of environmental concerns of the underground tanks
that would be located for the gas. Walker
mentioned the disruption this development would
have to this residential community (added noise,
crime, trash, etc . ) . Walker added that the Farmer
Station (small community store) was meeting the
current needs of this type of commercial service
to the community.
Vernon Cagle, property owner, said that when the
banks are cut down for the development the traffic
problems will be assisted (adding more visibility
to this intersection) . Cagle said that if he
could not sell the property for this development
he would locate single wide mobile homes on the
property for rental purposes .
There were 17 people present in opposition.
Board member Maxton McDowell spoke of the
intersection as a dangerous place on this road.
McDowell said that the Farmer Station is a good
community place but that he could see were there
is a need for this type of service in this area
since there is no commercial place of this type on
Hwy 49. McDowell spoke of concern of this
becoming a hang-out for the children in the
community (possibly causing some problems) .
McDowell said that this is a rural community and
the Board needs to consider all factors both pro &
con.
Board member Bill Dorsett said that to add a
business into an area where there is none would
definitely change the character of a community.
Dorsett said that the property is not owned by
Walker and to deny this request would not be
depriving him of use of his property.
Board member Jim Routh said that he is not against
free enterprise but would be more concerned to see
the site plan for this type of development prior
to an approval.
Jim Routh made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request bedenied based on lack of information
of the development. The motion passed
unanimously.
D: DONALD CLAPP, Asheboro, North Carolina, is
requesting that 2 acres (out of 7 acres) located
on Hwy 64E (across from Dewey Road) , Franklinville
Township, be rezoned from Residential Agricultural
to Light Industrial/Conditional Use . Zoning Map
#7781 . It is the desire of the applicant to
operate a machine shop (50 ' x 75 ' building) .
Clapp was present and explained that this area has
several business located on Hwy 64 and this would
be a machine shop with 2 employees.
There was no one present in opposition.
Lynden Craven made the motion, seconded by Bill
Dorsett, to recommend to the Commissioners that
this request be approved as consistent to the
area. The motion passed unanimously.
5 . Swearing in of the Witnesses:
"Do you swear or affirm the information you are about
to give is the truth, the whole truth, and nothing but
the truth, so help you God. "
5 people took this Oath.
6 . SPECIAL USE PERMIT REQUEST:
A: WAYNE THOMAS, Trinity, North Carolina, is
requesting a Special Use Permit to construct an
accessory building (40 ' x 60 ' ) at his residence
(under construction) at 5998 Brantley Gordon Road,
32 . 50 acres , Concord Township, Zoning Map #6698 ,
Zoning District RA.
Thomas said the building would be used for
personal storage and his wife would operate a
ceramic/art shop in a portion of the building.
There was no one present in opposition.
Lynden Craven made the motion, seconded by Phil
Brower, to approve this request. The motion
passed unanimously.
B: CLAUDE F. TOOMES, II, Randleman, North Carolina,
is requesting a Special Use Permit to construct a
beauty shop at his residence located on 3 . 48 acres
at 10353 US Hwy 220 Bus N, Level Cross Township,
Zoning Map #7767 , Zoning District RA.
Toomes was present and said that his wife is
currently attending beauty school and would like
to operate a beauty shop at their residence.
Toomes said that the building would be 20 x 25
with a front porch and would be paint blue to
match his residence.
�-- There was no one present in opposition.
Bill Dorsett made the motion, seconded by Jim
\-- Routh, to approve this request. The motion passed
unanimously.
C: DAVID WHITE, Archdale, North Carolina, is
requesting a Special Use Permit to operate an
automotive repair business at his residence
located on 1 . 23 acres at 6714 Muddy Creek Road,
New Market Township, Zoning Map #7738, Zoning
District RA.
White said that he currently operates a small
business up the street from his residence and
would like to be able to move the business to his
home. The shop would be behind his residence and
no more than 5 cars would be on the property at
any one time for the business . White said that he
would haul all junk off in a reasonable amount of
time.
There was no one present in opposition.
Lynden Craven made the motion, seconded by Phil
Brower, to approve this request for a Special Use
Permit. The motion passed unanimously.
7 . There were 107 people present for this meeting. The
meeting adjourned at 8 : 30 p.m.
