RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT

11F19 April 4, 1995
1 . Chairman Charles Adams called to Order the Randolph
County Zoning Board of Adjustment meeting.
2 . Hal Johnson, Planning Director called roll of the
members : Charles Adams , Chairman, present; Aweilda
Williams, Vice Chairman, present; Tim Poole, absent;
Lynden Craven, present; Bill Dorsett, present; Jim
Routh, present; Phil Brower, present; and Maxton
McDowell, Alternate, present (substituting for regular
member Tim Poole) .
3 . Lynden Craven made the motion, seconded by Jim Routh,
to approve the Minutes of the Randolph County Zoning
Board of Adjustment meeting held on March 7 , 1995 . The
motion passed unanimously.
4 . Swearing in of the Witnesses:
"Do you swear or affirm the information you are about
to give is the truth, the whole truth, and nothing but
the truth, so help you God. "
2 people took this Oath.
5 . VARIANCES:
A: ONETA BALLENTINE, Asheboro, North Carolina, is
requesting a variance to allow the division of 5
lots (to be given to her children) on a private
drive in lieu of the 5 acre lot size minimum.
Location: Old Humble Mill Road (just east of
Richland Village Mobile Home Park) , 8 . 9 acres ,
Grant Township, Zoning Map #7679 , Zoning District
RA.
**Arguments For Granting the Request
Ballentine explained her intentions of wanting to
divide her property equally among her children
prior to her death. Ballentine said it would be
like an estate settlement. Ballentine said that
not all the children would locate on this
property. The ones that did not would sell their
lot to the adjoining children. Ballentine said
that only 3 of the children planned to build here .
**Arguments Against Granting the Request
There was no one present in opposition.
**Board Discussion: Conclusions Based on Findings
of Fact
Bill Dorsett said that he could see no hardship in
this case .
Johnson said that this would be an estate
settlement and since she really will only have 3
individual lots (instead of 5) , he would advise
that she have the property preliminary platted to
show this division prior to any approval.
**Order of the Board of Adjustment
The Board decided not to take any action on this
request at this time.
B: BASIL ALBERTSON, Trinity, North Carolina, is
requesting a variance to allow the division of two
lots for family use (less than 5 acres) on a
private drive in lieu of the required 5 acre lot
size minimum. Location: Meadowbrook Drive, 15. 88
acres, Trinity Township, Zoning Map #7707 , Zoning
District RA.
**Arguments For Granting the Request
Albertson said that this property had been in his
family name since the turn of the Century.
Albertson wants to deed his sons property to
build on. One lot would be 2 acres in size and
the other would be approximately 3 acres in size.
Albertson said that the remainder of the property
will eventually be given to his son but that for
now Albertson plans to allow the remainder to stay
in pasture (which is fenced for farming purposes) .
**Arguments Against Granting the Request
There was no one present in opposition.
**Board Discussion: Conclusions Based on Findings
of Fact
Bill Dorsett said that he felt like this was a
request that should be granted a Variance due to
the fact that Albertson will see that this land
remains in the family.
**Order of the Board of Adjustment
Bill Dorsett made the motion, seconded by Lynden
Craven, to approve this request for a Variance.
The motion passed unanimously.
6 . The meeting adjourned.
