06JunePB MINUTES RANDOLPH COUNTY PLANNING BOARD June 6, 1995 1. Chairman Charles Adams called to Order the Randolph County Planning Board meeting at 7 : 00 p.m. 2 . Hal Johnson, Planning Director, called roll of the members: Charles Adams, Chairman, present; Aweilda Williams, Vice Chairman, absent; Tim Poole, present; Jim Routh, present; Lynden Craven, present; Bill Dorsett, present; Phil Brower, absent; and Maxton McDowell, Alternate, present (substituting for regular member Aweilda Williams) . 3. Lynden Craven made the motion, seconded by Bill Dorsett, to approved the Minutes of the May 2 , 1995 Randolph County Planning Board meeting. The motion passed. 4 . REQUEST FOR PROPERTY REZONING: TOM BRITT, Asheboro, North Carolina, is requesting that 2 . 57 acres located at 4360 US Hwy 64E (just before Ramseur Housing Showcase) , Franklinville Township, be rezoned from Residential Agricultural to Highway Commercial/Conditional Use. Zoning Map #7781 . It is the desire of the applicant to construct a structure to building race car bodies and use the existing house for antique sales . Britt was present and explained the majority of work performed in the body shop would be just placing sheet metal on frames. The building would be built 60x100 and there would be approximately 4 employees . Britt added that all storage would remain in the building (none outside) and there would be no engine work. Britt explained the antique business would employee one person once the house has been remodeled. Audry Overman, Pine Ridge Drive, said she lives in the new housing development at the rear of this property. Overman discussed the "run-off" water problems from this property into the development. Overman presented pictures of the problems . Overman said the antique could create junk storage and rat problems and the community already has an eyesore with the Ramseur Housing Showcase that adjoins this site . Overman said she also feared the run-off could create well problems . Board member Craven asked Overman if they currently were experiencing any water problems. Overman said they have not tested their wells . Britt said he had no plans to do anything outside of the buildings. Britt said that he has other businesses and he doesn' t run any junkie businesses and as for the antique business everything will be stored within the existing house. Britt said as for the water problems he has not done anything to the land (it is still as it was when he purchased the property) so the drainage of the property would be natural drainage except for the movement of dirt, by the developers , for the development of the housing development. Britt said that it appeared that the developer should have cut ditches and placed culverts along the back of each lot on the north side of the subdivision. No other opposition was present. Board member Routh asked Britt if he would be doing any grading of the property. Britt said that he would be done a little grading (in order the construct the building) but all the grading would be at least 300 ft. from any of the houses . Lynden Craven said that it is obvious that this ---' property has always had this drainage problem and should have been corrected during the early stages of the development of the subdivision. Bill Dorsett said that this is ideal commercial property and it is just a matter of what type of commercial a business should be located here. Dorsett said he felt that the proposed business seemed appropriate. Dorsett said that the water problems are not just on Britt' s property and just digging a ditch on his property would not settle the problem. Dorsett said due to the fact that Britt doesn' t have authority on the adjoining parcels and since he did nothing to create the drainage problems , he should not be responsible for fixing the problem. Craven made the motion, seconded by Bill Dorsett, to recommend to the Commissioners that this request be approved as consistent with the Land Development Plan with the following restrictions: **no outside storage **all activities must be maintained under roof (for both businesses) **50 ft. natural buffer at the rear of the property be maintained The Board unanimously passed this motion. 5 . Swearing in of the Witnesses: "Do you swear or affirm the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you God. " 14 citizens took this Oath. 6. SPECIAL USE PERMIT REQUESTS: A: NANETTE YATES, Trinity, North Carolina, is requesting a Special Use Permit to operate a tanning bed parlor in an existing building at her residence located at 2673 Ross Wood Road, Tabernacle Township, on 1 . 52 acres, Zoning Map #7701 , Zoning District RA. Yates explained he intentions to operate a tanning bed business in a portion of an existing building (16 x 32) . Yates said she would operate Monday through Saturday, by appointments . There was no one present in opposition to this request. ....- Jim Routh made the motion, seconded by Lynden Craven, to approve this request for a Special Use Permit. The motion passed unanimously. B: HOYT WILLIAMS, Staley, North Carolina, is requesting a Special Use Permit to operate a machine shop business with gun-smith & fire arm sales at his residence located at 6458 Sandy Creek Church Road, Columbia Township, on 63 acres, Zoning Map #8725, Zoning District RA. Williams said that the businesses would be located in separate buildings and would be operate as part-time businesses by his son. Williams said that the businesses would be a 1 person operation. There was no one present in opposition to the request. Lynden Craven made the motion, seconded by Tim Poole, to approve this request for a Special Use Permit. The motion passed unanimously. C: RITA INGRAM, Ramseur, North Carolina, is requesting a Special Use Permit to locate a 12x30 mobile home for a beauty shop at her residence located at 7685 US Hwy 64E, Columbia Township, on 5. 70 acres, Zoning Map #8712 , Zoning District RA. Ingram was present and explained her intentions to operate a beauty shop at her residence. There was no one present in opposition. Bill Dorsett made the motion, seconded by Lynden Craven, to approve this request for a Special Use Permit. The motion passed unanimously. D: STACEY CHAMBERS, Asheboro, North Carolina, is requesting a Special Use Permit to obtain a use car dealers license at her residence located at 1135 Jarvis Mill Road, Back Creek Township, on 3 . 60 acres, Zoning Map #7722 , Zoning District RA. Johnson explained that Chambers had contacted the office last Friday and withdrew her request for a Special Use Permit. E: CLINTON TALBERT, Asheboro, North Carolina, is requesting a Special Use Permit to operate a fire arms sales business at C' s Transmission located at 2334 Mack Road, Cedar Grove Township, on z acre, Zoning Map #7649, Zoning District RR. Talbert was present and explained that he is renewing his gun sales license and due to new regulations created by the State he is required to operate a store building (with a store front) solely for the purpose of gun sales. This is why he is required to have a Special Use Permit. Talbert said that for the past 3 years he has had his license for a hobby. Talbert said he only deals in "title collectables" (guns mainly purchased for a collection and not to shoot) . There was no one present in opposition. Dorsett said that he would be concerned with the fact that this would be a 2nd business on this residential property (causing the primary use of the property appear to be more commercial than residential) . Talbert said that he will be phasing out the transmission business within the next year to eighteen months . Johnson explained to the Board that once the transmission business was closed (due to the fact that this business is non-conforming) it could not be re-opened without coming back to this Board. Dorsett seemed less concerned once given this knowledge. Lynden Craven made the motion, seconded by Tim Poole, to approve this request for a Special Use Permit. The motion passed unanimously. 7 .
