1 . Chairman Charles Adams called to Order the Randolph
County Planning Board Meeting at 7 : 00 p.m.
2 . Hal Johnson, Planning Director, called roll of members:
Charles Adams , Chairman, present; Aweilda Williams ,
Vice Chairman, present; Tim Poole, absent; Jim Routh,
present; Lynden Craven, present; Bill Dorsett, present;
Phil Brower, present; and Maxton McDowell , Alternate
(substituting for regular member Tim Poole) .
3 . Lynden Craven made the motion, seconded by Bill
Dorsett, to approve the Minutes of the Randolph County
Planning Board meeting on June 6 , 1995 . The motion
passed.
4 . REQUESTS FOR PROPERTY REZONING:
A: RANDOLPH ECONOMIC DEVELOPMENT CORPORATION,
Asheboro, North Carolina, is requesting that 46 . 32
acres (out of 71 . 30 acres) located on Old 421 Road
(approximately 1/2 mile north of US Hwy 421, and
across from John Marsh Road) , Liberty Township, be
rezoned from Residential Agricultural to Heavy
Industrial. Zoning Map #8735 . Property Owner:
Patsy S. Smith. It is the desire of the applicant
to use the property for industrial development.
Walter Sprouse, President of the Randolph Economic
Development Corporation, presented this request on
behalf of the property owners . Sprouse said that
the Smiths own 2 adjoining parcels of land, with
the northern parcel in the Town of Liberty' s
Zoning Jurisdiction and is currently zoned
industrial. Sprouse said it is their request to
have this parcel also zoned for industrial
development. Sprouse described the EDC' s policy
of recruiting good, clean, environmentally healthy
businesses to locate in Randolph County. Sprouse
said that this particular parcel has had 2
obstacles against it becoming developed -- no
water and sewer lines servicing the property, and
the property is not properly zoned. Sprouse said
that water and sewer could be made available and
if this zoning request was approved his
corporation could help bring a good company to
this area. Sprouse said that the company that is
currently interested in the site is small but
would initially create 80 new jobs and would
provide higher than average pay with jobs paying
$9. 50 to $10 an hour.
Dorsett asked Sprouse if this property would be
used for one business or multiple businesses .
Sprouse answered one. Dorsett asked if he could
give the name of the company that is interested in
the property. Sprouse said not at this time
because there has not been a solid offer given at
this time. Dorsett said that the environment is
his main concern. Sprouse said that REDC
discourages companies that are not environmentally
sound from locating in Randolph County and this
can be seen by looking at REDC' s track record for
the last 10 years . Sprouse said that that the
business would be something like what has been
recruited by REDC in the past - Timken, Knorr Best
Foods, etc .
Routh asked if there had been any type of impact
study as to how this industry would effect the
agricultural community of this area. Sprouse said
that this area is currently project by the County
for industrial development and this portion of
this property is not currently being used for
agricultural purposes . Sprouse described the
preliminary plans of the interested party as
initially constructing a 60 , 000 sq. ft. building
with a possible future expansion of 60 ,000
additional sq. ft. Sprouse said that the
remainder of the 46 acres would be for their
landscaping plans to enhance the property.
Sprouse described these plans as extensive and
possibly as expensive as the actual construction
of the plant itself.
There was no one present in opposition to this
request.
Routh asked Johnson if the Planning Department had
received any calls from the community concerning
this request. Johnson answered no.
Lynden Craven made the motion, seconded by Maxton
McDowell , to recommend to the Commissioners this
request be approved. The motion passed
unanimously.
B: LEE & VANCE ROBERTS, Asheboro, North Carolina, is
requesting that 76 acres located on US Hwy 64W
(2/10 mile west of Sawyersville Road) , Back Creek
Township, be rezoned from Residential Agricultural
to Residential Restricted. Zoning Map #8735 . It
is the desire of the applicant to develop a
restricted residential subdivision of 32 lots .
Roberts provided copies of the proposed
restrictive covenants . Roberts described the
surrounding area as residential and explained that
this development would be very similar to the near
by Back Creek Hills Subdivision. Minimum heated
square footage for the proposed houses would be
1 , 200 .
Williams asked if there was anything in the
restrictive covenants against clear cutting lots.
Roberts said he did not think so but he would be
willing to entertain some no cut buffers .
There was no one present in opposition to this
request.
Bill Dorsett made the motion, seconded by Aweilda
Williams, to recommend to the Commissioners that
this request be approved as consistent with the
Land Development Plan for this area. The motion
passed unanimously.
C: WORTH HEATH, Randleman, North Carolina, is
requesting that 42 acres (out of a 57 acre tract)
located on Branson Mill Road (across from Mason
Drive) , Level Cross Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7768 . It is the desire
of the applicant to expand Toomes Woods
Subdivision by 34 lots.
Heath was present and explained that this would be
an extension of Kerr Drive and each lot will have
the same restrictive covenants as is currently in
place on the existing lots of Toomes Woods
Subdivision. Heath said there will be no single
wide mobile home development allowed, only double
wide manufactured homes with masonry foundations
or site built homes allowed.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by Phil
Brower, to recommend to the Commissioners that
this request be approved as consistent with the
current development within the area. The motion
passed unanimously.
5 . Swearing in of the Witnesses:
"Do you swear or affirm the information you are about
to give is the truth, the whole truth, and nothing but
the truth, so help you God. "
27 people took this Oath.
6 . SPECIAL USE PERMIT REQUESTS:
A: LOYD DALE BROWN, Randleman, North Carolina, is
requesting a Special Use Permit to operate a used
auto sales lot at his residence located on 1 . 3
acres at 8544 US Hwy 220 Bus N, Level Cross
Township, Zoning Map #7766 , Zoning District RA.
Brown explained his intentions to use the property
for the sale of vehicles (no junk vehicle storage
and no repair work) . Brown said he plans to have
at maximum of 25 cars on the property at one time
(most of the time there will be 10 to 15 cars) .
Brown said he has owned this property 1 to 2
months and did not realize it was residentially
zoned when he purchased it. Brown added that he
plans to use the existing building (the top floor)
as an office.
Dorsett asked Brown where he plans to park the
vehicles and Brown answered in front of the
existing building at the road. Dorsett said that
this area of highway has had problems with
vehicles being parked at the road and this could
cause problems with potential customers attempting
to park on the road. Dorsett asked Brown if the
junk materials stacked up beside the building were
his and Brown said that it was his neighbors and
his neighbor just hasn' t cleaned it up. Dorsett
asked Brown what type of sign he plans to use and
Brown answered a 4 ' x 6 ' lighted sign. When
questioned about his potential business hours he
said he would operate Monday through Friday 9 to 5
and Saturday 1 to 9 .
Jon Megerian, Attorney (representing neighboring
residents) , said that a Special Use Permit can
only be requested by a resident of the property
and Megerian said he questions if this is his
residence (Megerian added he felt sure he does not
live here) . Megerian said for this reason the
Board could not issue a Permit for this property.
Megerian said that this is a proposal to pack 15
to 25 cars on a relatively small lot in the middle
of a residential area. Megerian stated that if
this large of a car lot was placed on a
residential lot the primary use of the property
would no longer be the residence. To issue a
Special Use Permit the "rural family occupation"
must be considered coincidental to the residence .
The applicant plans for no screening, buffers ,
paving, in fact has no plan and this will have a
detrimental effect on the property values of this
residence. Megerian reminded the Board that this
is a WQCA area and there is a potential for
environmental concerns with fluids , etc. from
vehicles stored on the property. Megerian said
that this request would not be in harmony with the
Land Development Plan for this area.
Evan Smith, represented his father (an adjoining
land owner) , said that the area is already
handicapped by the salvage yard (that adjoins this
request) and it would be their desire to develop
their property residentially. Smith said to
develop the property residentially would be
impossible if this request is approved. Smith
added complaints of the agricultural odors (cows,
etc. ) produced on other neighboring properties .
There were 4 adjoining residents present in
opposition to this request.
Bill Dorsett said that the County Commissioners
have plans for cleaning up the County. Dorsett
said that he felt this request would further
detract from the goal of the Commissioners .
Dorsett also said that this size of business would
be more appropriately located in a commercially
zoned district and for these reasons Dorsett made
the motion to deny this request for a Special Use
Permit. Lynden Craven seconded the motion and the
motion passed unanimously.
B: ANDERSON & ASSOCIATES, Greensboro, North Carolina
is request a Special Use Permit for the placement
of a cellular tower on a 154 acre tract located at
the end of Nelson Park Road (SR 1945) , New Market
Township, Zoning Map #7746 , Zoning District RA.
(Property Owner: Perdie White Heirs)
Scott Smith, representative from GTE Mobilenet,
Mooresville, North Carolina, described the
cellular phone industry as a growing and demanding
utility. Smith said this request is driven by
customer demand, public safety issues and the FCC
which governs the agency. Smith said nationally
28, 000 new cellular users connect on a daily
bases . Smith quoted the statistic that two out of
ten citizens with in the Triad own a cellular
phone. Smith spoke of the fact that all emergency
agencies use cellular coverage and z million 911
calls were made by cellular phones . Smith said
that this site was selected because it is 800 feet
from the closest residence on a 154 acre tract.
Smith said this tower would not be required to be
painted or have lights due to the fact that the
tower would be less than 200 feet (it will be
approximately 185 feet) .
Dorsett spoke of concerns of the density of towers
locating in Randolph County. Smith said that the
engineers of the cellular companies have begun a
program of sharing towers (between the
competitors) to assist with this problem.
Smith stated that the facility would only be an
80 ' x 80 ' site, completely fenced with an 8 ' ft.
fence and the site would be lighted, no guide
wires will be used on the tower and the existing
wooded area will be retained for buffers .
There was no one present in opposition to this
request.
Jim Routh made the motion, seconded by Lynden
Craven, to approve this request for a Special Use
Permit. The motion passed unanimously.
C: ALLEN PARRISH, Randleman, North Carolina, is
requesting a Special Use Permit for the change of
use of a non-conforming business (from a welding
ship to a trailer manufacturing business) at his
residence located on 2 acres at 621 Providence
Church Road, Level Cross Township, Zoning Map
#7767 , Zoning District RA.
Parrish explained that he has had a welding
business here for 23 years and due to the fact
that he needs a dealers license (from DMV) to
place serial numbers on these trailers he now
plans to build, he needs to be classified for
manufacturing. Parrish said he has 3 full time
employees (himself, his wife, and his son) and 2
part time employees. Parrish said if his business
grew significantly larger he would move the
business from his residence to another area.
Dorsett told Parrish that he lived in a beautiful
area and that he would hate to see his front yard
full of trailers . Parrish assured him he would
not.
Preston Parsons, next door neighbor, spoke highly
of Parrish and said that he felt strongly that
Parrish should be granted this request.
Jim Routh asked Parsons (the neighbor) if he felt
comfortable with this coming into this residential
community. Parsons said he would be against a
large industry moving into the area but he knew
Parrish would not have a business that would be
detrimental to the area. Routh told Parsons his
opinion carries a lot of weight here and the Board
values his thoughts.
There was 9 people present in favor of this
request. There was no opposition.
Lynden Craven made the motion, seconded by Bill
Dorsett, to approve this request for a Special Use
Permit. The motion passed unanimously.
D: MICHAEL DEAN, Ramseur, North Carolina, is
requesting a Special Use Permit to use a 30x30
building (currently under construction) for an
automotive repair shop operations) at his
residence located on 11 . 55 acres at 4836 Log Cabin
Road, Coleridge Township, Zoning Map #8627 , Zoning
District RA.
Dean said that he would mainly be working on his
personal vehicles but in the future plans to do
some work for others . Dean said the shop is
located 400 feet of the road (across from his
residence) and this would not be a full time
business . Dean said he has lived here for 6
years .
Johnson questioned Dean if there would be any junk
vehicles stored at the business . Dean said if so
they would be placed behind the building. Johnson
asked Dean about the 11 junk vehicles currently on
the site and if he plans to move them. Dean said
that he could move them. Dean said that only 2 of
the vehicles are his and the remaining 9 vehicles
belong to a friend of his .
Craven asked Dean about disposal of liquids from
the vehicles . Dean said he would be using old
barrels . Craven asked if he would be taking them
to a disposal site and Dean answered that he
could.
Dorsett asked if he had any plans for containment
of liquids such as antifreeze, battery acid.
Containment such as a concrete pad. Dean said
hopefully then won't leak. Dorsett said that cars
do leak when they are in need of repair and for
this reason, if the request is approved, he will
need to be prepared to contain any liquids that
come from the vehicles.
Craven said that if this were to pass he would
like to see some restrictions of the number of
junk cars he can have on the property. Craven
suggested 5 or 6. Dorsett said that he would like
to see it limited to very few such as 2 or 3 junk
vehicles.
Johnson explained that the County is on the verge
of passing a junk vehicle ordinance and he
encouraged the Board to consider strict
regulations.
Williams said that she didn' t see why the Board
should allow large number of vehicles, that the
request is for an automotive repair business not a
small junk yard.
Johnson said he would recommend that the Board
restrict to not more than 2 non-operable vehicles
be allowed on the property for more than 30 days .
Dorsett said that he felt the Board should
stipulate that the junk vehicles currently on the
property be removed prior to any issuance of a
Permit.
Lynden Craven made the motion to approve this
request with the following restrictions:
**junk vehicles currently on the property must be
removed
**not more than 2 junk vehicles can be stored on
the property
**all non-operable cars must be removed from the
property within 30 days
Williams seconded the motion and the motion passed
with a 6 to 1 vote. Brower opposed the motion.
E: RICHARD WELBORN, Trinity, North Carolina, is
requesting a Special Use Permit to obtain a
dealers licence in a storage building (at the rear
of his property) at his residence located on 1 . 6
acres at 4521 Hoover Hill Road, Trinity Township,
Zoning Map #7715, Zoning District RA.
Welborn said that he has moved to a new residence
and needs to move his current dealers license to
this address . Welborn said that he is only in the
wholesaling business and will not have a car lot.
There was no one present in opposition.
Aweilda Williams made the motion, seconded by Jim
Routh, to approve this request for a Special Use
Permit. The motion passed unanimously.
7 . Johnson discussed the joint public hearing (before the
Planning Boards of Randolph County) that will be held
on Thursday, July 27 , 1995, at 7 : 00 p.m. , at Trinity
Memorial United Methodist Church (Fellowship Hall) ,
7140 NC Hwy 62 , Trinity, North Carolina. Johnson said
that this public hearing would be concerning the
I-85/Northwest Randolph County Development Assessment.
Johnson said that recommendations from the Planning
Boards will be presented to a joint public hearing
conducted by the County Commissioners and City Councils
of Archdale, High Point, and Thomasville in August.
8 . The meeting adjourned at 9 : 15 . There were 49 citizens
present for this meeting.
