177 RANDOLPH COUNTY PLANNING BOARD
August 8, 1995
1 . Chairman Charles Adams called to Order the Randolph
County Planning Board meeting at 7 : 00 p.m.
2 . Hal Johnson, Planning Director, called roll of members:
Charles Adams, Chairman, present; Aweilda Williams ,
Vice Chairman, present; Tim Poole, absent; Jim Routh,
present; Lynden Craven, present; Bill Dorsett, present;
Phil Brower, present; and Maxton McDowell, Alternate,
absent.
3. Lynden Craven made the motion, seconded by Jim Routh,
to approve the Minutes of the July 11 , 1995 Randolph
County Planning Board Meeting. The motion passed.
4. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you, God. "
15 citizens took this Oath.
5 . SPECIAL USE PERMIT REQUESTS:
A: DOYLE STOUT, Asheboro, North Carolina, requested a
Special Use Permit to operate a
computer/electronic repair shop in an existing
20x30 building at his residence located on 5. 60
acres at 587 Stout Farm Road, Cedar Grove
Township, Zoning Map #7657 , Zoning District RA.
Stout was present and discussed his
computer/electronic business . Stout said that he
currently has 7 corporation, 1 law firm, and 1
dental office as clients . Stout said that he
tries to provide service repairs at each business
location but if repairs are required to be
performed at his shop, he personally picks up the
equipment and returns if after repairs are
completed. South said very little customer
traffic comes to his shop. Stout described his
business as part time but he hopes it will become
full time in the future. Currently he has no
employees but hopes to have a couple in the
future.
�--` There was no one present in opposition to the
request.
Lynden Craven made the motion, seconded by Phil
Brower, to approve this request for a Special Use
Permit. The motion passed unanimously.
B: JOHN & SHARON ALEXANDER, Climax, North Carolina,
requested a Special Use Permit to obtain a dealers
license at their residence located on 5 acres at
3804 Lilliewood Lane, Providence Township, Zoning
Map #7795, Zoning District RA.
Alexander said that he hoped his business would
grow to full time within the next 6 years with the
help of his son. Alexander said that he would
keep no more than 30 cars on the premises at any
one time. All the cars would be kept out of view
from the road. Alexander said he would perform
minor repairs (to the cars he purchased) but there
would be no storage of junk vehicles or parts on
the property. Alexander discussed plans to
renovate an existing structure to repair vehicles
in.
Bill Sheffield, 6503 Old Liberty Road (adjoining
property owner) , said that the community is
primarily residential and he would like to see it
._. remain this way. Sheffield discussed noise
problems he is currently experiencing from
residences on this private drive and said the one
lane road could not handle traffic created from a
business . Sheffield said that a business would be
more appropriately located on Old Liberty Road or
N.C. Hwy 22 . Sheffield expressed his concerns of
junk storage, liquids from the cars effecting the
environment, etc .
Bill Dorsett said that this is a prime example of
a desire to have a commercial business without
rezoning the property. Dorsett said that to allow
an individual to obtain a dealers license is one
thing but 30 vehicles is another.
Jim Routh asked if the 30 vehicles is a desire or
the plan. Alexander said that this is the most he
would have . Alexander said that he currently has
14 cars (personal) on the property now and they
are not visible from the road. Alexander added
that he has spoken to all the residents of
Lilliewood Lane and all of them have given him
their blessing.
Johnson explained to Alexander that a Special Use
Permit is for a low impact business that would not
effect the residential community adversely.
Johnson asked Alexander what would the minimum
`— number of vehicles he would be willing to be
restricted to, Alexander answered 5 .
Dorsett asked Alexander how long he had lived in
this community. Alexander answered 6 years .
Aweilda Williams questioned if the 14 vehicles he
spoke about were licensed. Alexander said that 3
are but the remainder are old classics he plans to
restore.
Routh made the motion, seconded by Lynden Craven,
to approve the Special Use Permit with the
following conditions:
**maximum of 5 cars
**all vehicles must be stored behind residence
**no major service repair on the property
The motion passed unanimously.
C: RONNIE YORK, Franklinville, North Carolina,
requested a Special Use Permit to operate an
automotive storage yard and garage at his
residence located at 5009 NC Hwy 22N,
.— Franklinville Township, Zoning Map #7795, Zoning
District RR.
Jimmy Hill, attorney representing York, explained
that it was his understanding that York' s request
came about from a complaint to the Zoning Office.
York was unaware that his property was zoned and
that it would require a Special Use Permit to
operate his business at his residence. Hill said
that once the Enforcement Officer notified York of
this and he filed for this request. Hill said
that there are 19 cars currently stored on this
property. York' s profession is car restoration
and mechanical work. Hill presented a plan of the
property (4 . 2 acres) with adjoining development
visible on the map. Hill said that there are
several businesses in the area, Randolph Stair &
Rail (adjoining property) , VW Repair Shop, Walker
Furniture, an old store building, the Church and a
School. Hill said the property is completely
buffered by trees or natural growth except in one
area on the southwest side (that adjoins
undeveloped land) and that York would be willing
to locate a fence in this area if the Board felt
this would be necessary. Hill presented
photographs taken (while standing on the site) of
adjoining property to demonstrate the amount of
buffering the property has . Hill also presented
pictures of businesses in the community. Hill
referenced the comment made during the Alexander
Request that commercial businesses would be more
suited on N.C. Hwy 22 . Hill said that he agreed
with this comment and that he did not feel
allowing this Special Use Permit would degrade the
adjoining properties . Hill added that this would
not be for public repairs only restoring vehicles
and the maximum junk vehicles he would store would
be 20 .
Vance Davis, Randolph Stair & Rail, said that he
had no objections to the Special Use Permit.
Max May, 4649 Hwy 22N, presented the Board with a
petition against the request with 30 signatures .
May said that the community began seeing junk cars
going into the property on a daily bases and
called the County to determine what the activity
was . May said that the Church would not be for a
junkyard being established across the road from
their property and May presented pictures of the
property showing the junk vehicles .
Grant Smith, located 2/10 mile from site, said
that the VW repair business is only part time and
�... described other development that has occurred in
the area that the community was upset about (the
minor mobile home 5 lot subdivision - he referred
to as a trailer park and "the zoo" - a residence
that has moved several farm animals in that has
become an eyesore to the community) . Smith said
that this development would decrease property
values in the community.
Bill Dorsett said that York has said he doesn' t
plan for a business but that this request has the
appearance of one . Dorsett said that this type of
activity is entirely out of character with the
community and in appropriate for a rural family
occupation (to be considered as a Special Use
Permit) . Dorsett said the development would be
more appropriate in a commercial zoned area.
Dorsett added that this Board did not consider
schools or churches as businesses . For these
reasons Dorsett made the motion, seconded by Phil
Brower, to deny this request for a Special Use
Permit. The motion passed unanimously.
D: BRYAN & DONNA RUGG, Archdale, North Carolina,
requested a Special Use Permit to obtain a dealers
license and operate a used auto sales lot at their
residence located at 7996 US Hwy 311N, New Market
Township, Zoning Map #7737 , Zoning District RR.
Rugg was present and explained that he does a
little work "on the side" in back of his
residence. Rugg said that there would be no
employees except himself and there would only be
2-5 cars on the property for his business . Rugg
said that he would use an existing business to do
repair on the vehicles that he plans to sale but
that there would be no outside storage of junk
vehicles, parts, etc.
Johnson said that the Planning Department had
received a letter from an adjoining property owner
that did not have a problem with this request.
There was no one present in opposition to the
request.
Rugg added that only 1 vehicle will be displayed
for sale on the property and the others will be
taken to auction.
Lynden Craven made the motion, seconded by Aweilda
Williams , to approve this request for a Special
Use Permit. The motion passed unanimously.
E: STEPHEN PARRIS, Archdale, North Carolina,
requested a Special Use Permit to operate an
upholstery shop from an existing (30x40) building
at his residence located on 1 acre at 6899
Mendenhall Road, Trinity Township, Zoning Map
#6798 , Zoning District RA.
Parris was present and explained that this would
be a 2 person operation behind his residence in
this existing building. Parris said that the
business would be part time now and hopefully move
to full time later. Parris added that he would be
working in the evenings on Saturday but there
would be no Sunday work.
There was no opposition present at the meeting.
Dorsett said that this area seems to be going
commercial and asked why not rezone the property.
Johnson said that this a part time business and
the primary use of the property is still
residential. Johnson said that if the primary use
changes they the property owner would need to
rezone the property.
Williams made the motion, seconded by Routh, to
approve this request for a Special Use Permit.
The motion passed unanimously.
�-- 6 . REQUESTS FOR PROPERTY REZONING:
A: RANCIE MOORE, Asheboro, North Carolina, is
requesting that 1 .53 acres located at 1424 Mt.
View Church Road, Back Creek Township, be rezoned
from Residential Agricultural to Light Industrial.
Zoning Map #7722 . It is the desire of the
applicant to use the property for industrial
purposes.
Moore explained that he has had this
non-conforming business here since 1978 but is
surveying off the business (separate from his
residence) to deed to his sons. Moore said that
there will be no change to the business (a 30x60
building) but that the bank felt it necessary to
bring the business into compliance with zoning.
Moore discussed existing businesses on this road
(Hunt' s Auto Parts & Zooland Sandblasting) . Moore
said there would be no outside storage and that
this business is consensus of environmental
concerns.
There was no opposition present.
Williams made the motion to recommend to the
Commissioners that this request be approved with
the condition of no outside storage. Routh
seconded the motion and the motion passed
unanimously.
B: JOYCE DAVIS, Asheboro, North Carolina, is
requesting that 56. 30 acres located at the end of
King View Road, Richland Township, be rezoned from
Residential Agricultural to Residential Mixed.
Zoning Map #7655 . It is the desire of the
applicant to use the property for an 11 lot
subdivision that would allow site built or
manufactured housing.
Davis said that she plans to cut only the trees
necessary for development (she will not allow the
land to be timbered) . Davis described development
of double-wide and single-wide manufactured
housing with brick underpinned and site built
homes . Davis said she felt this would be in
harmony with the adjoining development. The homes
would all have to be newer than 10 years and on
permanent foundations . Davis said that King View
Road is State Maintained and she plans to build
the road to state standards without pavement and
divide the lots into 5+ acre tracts.
James & Marie Emery, adjoining property owner ,
�-' said the property they owned had been in their
family for 100+ years and they would be opposed to
any residential development of the property.
Emery said she would like to see the property
remain farmland. Emery spoke of concerns of
polluting the creek and questioned if the property
actually has State Road Frontage.
Bill Dorsett said that the road concerned him and
he thought it should be verified before it goes to
the Commissioners . Dorsett said that if the
property does have State Road Frontage he would
not have any problem with the development.
Williams said that she would like to see the homes
be restricted to no older than 5 years . Craven
agreed.
Dorsett made the motion to recommend to the
Commissioners that this request be approve with
the following conditions:
**no home over 5 years old
**developer check right-of-way to be sure the
property has State right-of-way.
Williams seconded this motion and the motion
passed unanimously.
C: JAMES GLAUSER, Charlotte, North Carolina, is
requesting that 2 . 65 acres located at 6228
Prospect Street, Trinity Township, be rezoned from
Light Industrial to Heavy Industrial/Conditional
Zoning Map #6798. It is the desire of the
applicant to operate a chemical manufacturing
facility.
Glauser was present and explained that he plans to
use the existing facility to make chemicals used
in paper/pulp textiles (dying and bleaching
chemicals) . Glauser said this would be a "zero"
discharge manufacturing facility with only
sanitary discharge. There will be no air, water,
or noise pollution created from the facility. The
facility will employee 10 to 15 people, and there
will be no business waste going to the landfill
(all will be recycled) .
When questions about the safety of adjoining
residents (if the facility was to catch on fire)
Glauser said that they would work with 911 on
possible accidents, to help train EMS workers .
Johnson asked the Board to allow him to research
�--� this request further so see that this type
activity would comply with the Watershed
Regulations.
David Thompson, 6568 Thompson Road, said that his
well is within 150 feet of this building and he
would be concerned with ground water
contamination. Thompson said that he did not
believe that there was such a facility as a "zero"
discharge facility. Thompson reminded the Board
of the mess that was left for Greensboro and High
Point to clean up when a chemical plant had a
spill into a local river when the plant closed.
There were 2 people present in opposition to this
request.
Williams made the motion to postpone this request
until further study concerning the watershed could
be made. Jim Routh seconded this request and the
motion passed unanimously.
7 . Approval of the I-85/Northwest Randolph Development
Assessment Report. Bill Dorsett made the motion,
seconded by Lynden Craven, to recommend to the Joint
Council Meeting of High Point, Thomasville, and
Randolph County Commissioners that this be approved.
The motion passed unanimously.
7 . The meeting adjourned at 9 : 00 p.m. There were 34
people present.
