RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT

August 8, 1995
1. Chairman Charles Adams called to Order the Randolph
County Zoning Board of Adjustment.
2 . Hal Johnson, Planning Director, called roll of members:
Charles Adams , Chairman, present; Aweilda Williams ,
Vice Chairman, present; Tim Poole, absent; Jim Routh,
present; Lynden Craven, present; Bill Dorsett, present;
Phil Brower, present; and Maxton McDowell, Alternate,
absent.
3. Lynden Craven made the motion, seconded by Jim Routh,
to approve the Minutes of the July 11 , 1995 Randolph
County Zoning Board of Adjustment Meeting. The motion
passed unanimously.
4. Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you, God. "
3 people took this Oath.
5. VARIANCES:
A: LEWIS RAY KING, Asheboro, North Carolina, is
requested a variance to allow the division of 4 -
30 , 000 sq. ft. lots without State Road Frontage in
lieu of the required 5 acre minimum lot size for
lots fronting on a private road. Location: Lewis
Country Drive (off Bus . Hwy 220S) , 27 . 40 acres,
Cedar Grove Township, Zoning Map #7657 , Zoning
District RA.
**Arguments For Granting the Request
Rosey Powers, granddaughter of Lewis King, said
that King placed 4 mobiles homes on his property
for his children (King was allowed to place these
homes on his property for family use) . Powers
said that because of the placement of the septic
tanks and wells, King could not deed 5 acres to
each child. King wants to deed the property to
his children and they could take care of the taxes
on these lots . King said that the children were
wanting to make improvements to their homes and
the bank would requirement them to own their
property.

There was no opposition present.
**Board Discussion: Conclusions Based on Findings
of Fact
Craven asked King if this variance was granted
would he be back for additional lots later. King
answered no.
**Order of the Board of Adjustment
Craven made the motion, seconded by Aweilda
Williams , to approve this request for a Variance
with the restriction that all additional
subdivision of the tract meet to
Zoning/Subdivision Ordinance Requirements . The
motion passed with a voted of 4 to 2 , Jim Routh
and Phil Brower voted against the motion.
B: MARIA BARNES, Randleman, North Carolina, is
requested a Variance to allow a second residence
on a 3. 80 acre tract of land without State Road
Frontage in lieu of the required 5 acres per
residence for private roads . Location: 1064
Heritage Mountain Trail, Heritage Mountain Estates
- Lot 103B, Randleman Township, Zoning Map #7764 ,
Zoning District RA.
**Arguments For Granting the Request
Barnes was not present for this request.
**Arguments Against Granting the Request
An adjoining land owners was present for this
meeting and explained that the original plan of
the development was for 5 acre tracts. He said
that this tract was divided into 3 lots and
currently has 3 mobile homes on the lots . He said
that the poor topography does not lend itself for
development.
**Board Discussion: Conclusions Based on Findings
of Fact
The Board noted that Barnes was not present and
therefore a hardship could not be realized.
**Order of the Board of Adjustment
Lynden Craven made the motion, seconded by Bill
Dorsett, to deny this request for a Variance. The
motion passed unanimously.
6 . The meeting adjourned.
