09SeptemberBOA (71 fy�,,. MINUTES �t RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT September 7, 1995 1. Chairman Charles Adams called to Order the Randolph County Zoning Board of Adjustment meeting. 2 . Roll Call of Members: Charles Adams, Chairman; Aweilda Williams, Vice Chairman; Tim Poole, absent; Jim Routh; Lynden Craven; Bill Dorsett; Phil Brower, absent; and Maxton McDowell, Alternate, absent. 3. Bill Dorsett made the motion, seconded by Lynden Craven, to approve the Minutes of the August 8 , 1995, Randolph County Zoning Board of Adjustment meeting. The motion passed. 4 . Swearing in of the Witnesses: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you God. " 4 people took this Oath. 5 . VARIANCE: WILLIAM PINNIX, Asheboro, North Carolina, is requesting a Variance to divide a 39 , 992 sq. ft. lot into 2 lots (1 - 18 , 609 sq. ft. , 1 - 21 ,383 sq. ft. ) in lieu of the minimum lot size requirement of 30 ,000 sq. ft. Location: corner of Hopewell Friends Road/Wilson Drive; Country Lane Estates, lots 4-5; Cedar Grove Township, Zoning Map #7638 , Zoning District RR. **Arguments for Granting the Request Pinnix explained that his mother passed away in June and since this time he has been trying to settle her estate. Pinnix said when the subdivision was originally developed the minimum lot sizes were 20 ,000 sq. ft. Pinnix said that due to the original survey markers the house was built on the lot to meet the setback requirements of that time. Pinnix said that a survey was requested because Pinnix and his sister were purchasing the house from their mother. Pinnix said that the house had been on the lot for 13 years and they never knew of this error. Pinnix said that at this time his mother only owned lot 5 and he had to purchase lot 4 due to this error. Pinnix said that now he his just trying to regain his losses . Pinnix said that the house was going to be purchased by one child and the vacant lot by another. The plans for the �-' vacant lot are to construct a 1 ,200 sq. ft. home that will meet all setback requirements and septic tank requirements . Pinnix said the lot has been evaluated by the Health Department and he has been told that the lot (even with a portion being deeded to lot 5) will meet all requirements. **Arguments Against Granting the Request There was no one present in opposition. **Board Discussion: Conclusions Based on Findings of Fact Jim Routh said that he felt the Board should give Pinnix this variance to divide the property so it would be marketable . Bill Dorsett said that the lots appear to be one lot and this variance may create an injustice to the neighborhood. Aweilda Williams said that she didn' t have a problem with this variance and he has proven a hardship relate to the land that another man caused, not the property owner. Williams said that he is just trying to regain some of his losses . **Order of the Board of Adjustment Williams made the motion, seconded by Lynden Craven, to approve this request for a Variance. The motion passed with a 5 to 1 vote, Dorsett voted against the motion. 6. The meeting adjourned.
