1 . Chairman Charles Adams called to Order the Randolph
County Zoning Board of Adjustment.
2 . Roll Call of the Members: Charles Adams, Chairman,
present; Aweilda Williams, Vice Chairman, present; Tim
Poole, present; Lynden Craven, present; Jim Routh,
present; Bill Dorsett, present; Phil Brower, present;
and Maxton McDowell, Alternate, absent.
3. Lynden Craven made the motion, seconded by Jim Routh,
to approve the Minutes of the September 7 , 1995 ,
Randolph County Zoning Board of Adjustment Meeting.
The motion passed unanimously.
4 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
7 citizens took this Oath.
5. VARIANCES:
A: GARY MATNEY, Randleman, North Carolina, is
requesting a Variance to allow the placement of a
2nd mobile home on a 3. 29 acre tract (without
State Road frontage) in lieu of the minimum
requirement of 5 acres per residence (of property
without State Road frontage) . Location: 1929
Wicker Lovell Road, Franklinville Township, Zoning
Map #7773 , Zoning District RA.
**Arguments For Granting the Request
Matney was present and explained that he wanted
his daughter to be able to move next to him.
Matney said his property is approximately 400
feet off Wicker Lovell Road. Matney added that he
has lived here for 3 years.
Betty Cole, Matney' s daughter, said that she
couldn't afford a lot at this time but wished to
buy her own home now.
Matney said he would not rent the property if she
�' moved the home later.
**Arguments Against Granting the Request
There was no one present in opposition to the
request.
**Board Discussion: Conclusions Based on Findings
of Fact
Lynden Craven said that since there would be no
deed transaction, he didn't see a problem with
allowing the Variance to be granted. For this
reason Craven made the motion to approve this
request. The motion died for a lack of a second.
**Order of the Board of Adjustment
Dorsett made the motion to deny this request for a
Variance due to no hardship being proven. Phil
Brower seconded the motion the motion passed with
a 5 to 2 vote, Craven and Adams voted against the
motion.
B: DOROTHY WALL, Franklinville, North Carolina, is
requesting a Variance to allow the addition of 2
accessory mobile homes for family use for a total
of 6 family residential structures on the
property. Location: 84 . 28 acres , Wall Country
Drive, Franklinville Township, Zoning Map #7774,
Zoning District RA.
**Arguments For Granting the Request
Wall explained that she wanted to allow 2 of her
grandchildren to move on to her property. Wall
said there would be no deed transactions and she
has 1200 feet of State Road Frontage.
**Arguments Against Granting the Request
Ottway Burton, Attorney, was present and presented
a map of the property (he is an adjoining land
owner) . Burton said that he would be opposed to
this variance because it may set a precedence of
decisions for land development for this area.
Burton said that he sent letters to all the
adjoining property owners (of this site) and 6 of
these citizens responded with opposition to the
request.
April Corder, adjoining property owner, expressed
concerns of the mobile homes being used for a
mobile home park in the future.
Joe Johnson, adjoining property owner , said that
he just built a house here and would like to know
that he could sale the home for what he paid for
it to be built. Johnson said that he felt that
this would decrease his property values . Johnson
said that he family has lived here for several
generations and he would hate to see the land
degraded.
Curtis Lowden, adjoining property owner, said that
he would be opposed to additional mobile homes .
Lowden said this would not improve the community.
**Board Discussion: Conclusions Based on Findings
of Fact
Dorsett said that there has been no plans supplied
(as to the lay-out of the property) ; she has
enough property to deed 5 acre tracts to each
grandchild; and there has been no hardship proven.
**Order of the Board of Adjustment
Tim Poole made the motion, seconded by Aweilda
Williams , to deny this request for a Variance.
The motion passed unanimously.
C: LEWIS ANDREWS, Asheboro, North Carolina, is
requesting a Variance to allow the placement of a
2nd mobile home on a 3 . 49 acres tract (without
State Road frontage) in lieu of the minimum
requirement of 5 acres per residence (for property
without State Road frontage) . Location: 495
Spencer Meadow Road, Back Creek Township, Zoning
Map #7721 , Zoning District RA.
**Arguments For Granting the Request
Andrews explained to the Board that he has several
medical problems and wants his son to put a
double-wide manufactured home here to take care of
himself and his wife. Andrews said that the
doctor has said that within the next couple of
years he will need someone to held him to get up
and get around. There will be no deed
transactions due to the fact the he only has one
son and he will own it all one day. Andrews said
that his wife is also in very poor health.
Andrews said that she has had 4 back surgeries and
is scheduled for another this month. Andrews
asked the Board to approve this request.
Lenny Andrews, son, said that his father is
suffering from a bone deteriorating disease and
diabetes and has had several eye surgeries.
Andrews said that the property cannot be seen from
any neighbors residence and for this reason he
worries that something could happen (such as a
fire, etc . ) and his parents would not have any
help.
**Arguments Against Granting the Request
There was no opposition present.
**Board Discussion: Conclusions Based on Findings
of Fact
1 . The Board found that a hardship was not a
result of the applicant' s own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found that the use will not
substantially injure the value of adjoining
or abutting property.
**Order of the Board of Adjustment
Aweilda Williams made the motion, seconded by Tim
Poole, to approve this request for a Variance.
The motion passed unanimously.
6 . The meeting adjourned.
