Acting Chairman Jim Routh called to Order the Randolph County Planning Board meeting at 7 : 00 p.m. 2 . Hal Johnson, Planning Director, called roll of Members : Charles Adams, Chairman, absent; Aweilda Williams,Vice Chairman, absent; Tim Poole, present; Lynden Craven, present; Jim Routh, present; Bill Dorsett, present; Phil Brower, present; and Maxton McDowell , Alternate, present. 3 . Bill Dorsett made the motion, seconded by Lynden Craven, to approve the Minutes from the October 3 , 1995 Randolph County Planning Board meeting. The motion passed unanimously. 4 . Swearing in of the Witnesses: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you God. " ~' 8 citizens took this Oath. 5 . REZONING REQUESTS: A: UNITED INVESTMENTS, Staley, North Carolina, is requesting that 30 . 95 acres located on Langley Road (approximately 4/10 mile off Browns Crossroads Road) , Columbia Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #8733 . It is the desire of the applicant to develop a subdivision of 10 lots that would allow site built homes , double wide manufactured homes on permanent foundation, or modular homes . Hal Johnson explained that this request was considered by the Planning Board and Board of Commissioners a couple of months ago for RM zoning and denied. Jim Wilson, Attorney, explained that the Board has received a new plat with some of the lot sizes changed but due to the fact that there was a lot sold between lots 5 & 6 some of the lots could not be altered much. Wilson said that this request is for double-wide mobile homes (on permanent foundations) , modular homes , and site built homes . Wilson said the restrictions would include : **no homes older than 3 years **double-wides must be underpinned within 3 months **no rental property Wilson said the lots would range in cost from $15 , 000 to 35 , 000 . Wilson added that within 1 mile of the site there are 10 single-wides and 3 double-wides and although there are farms in the area, it was his opinion that the development would be consistent to the area . Doug Coble, 1370 Langley Road, said that the lots had not changed (but very little - some being on . 01 of an acre) and it was his concern that this would effect the attractiveness of the area with 7 lots still being proposed on Langley Road. Coble said that the restrictions will only be enforced by the neighbors and not the County and this could cause problems for the community. Coble added that he did appreciate the change of housing type from single-wides to double-wides . Coble went on to say that 4 of the single-wides mentioned by Wilson are owned by United Investments . Boyd Langley, 1046 Langley Road, said that he has a breeder hen operation business adjoining this site and if the request was denied it would solve problems later. Penny Sillmon, 1076 Langley Road, said that the neighbors felt these small lots would be grossly incompatible to the area. Sillmon said if the lots were to be combined and reduce the number of lots fronting on Langley Road the area could retain its country atmosphere. Bill Allred, 1139 Langley Road, added his concerns for the lot sizes . There were 11 citizens present in opposition to the request. Lynden Craven said he did not see much change in the design of the development, the only change he could really see was from allowing single-wides to requiring at least a double-wide . There seemed to be a consensus of the Board that the developer should combine some of the lots to increase their size . Bill Dorsett made the motion, seconded by Tim Poole , to recommend to the Commissioners that this request be denied on the grounds that there are too many small lots being proposed on Langley Road. The motion passed unanimously. B: LEE & VANCE ROBERTS, Asheboro , North Carolina, is requesting that 80 . 47 acres located on Grantville Lane (across from Young Road) , Grant Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7790 . It is the desire of the applicants to develop a restricted residential subdivision of 40 lots . Lee Roberts presented a summary of his development plans and also a visual aid to describe the community. Roberts said the lots size minimum would be approximately 2 acres and house size minimum would be 1200 sq. ft. Roberts said only shingled roofs would be allowed and described the buffers they plan to impose . Roberts said the Grantville Lane side would have a "no cut zone" of 25 ' , and the remainder of the site would have a 50 ' "no cut zone" buffer . Roberts said that within the development each side property line would have a 10 ' "no cut zone" buffer also. Roberts described the adjoining development as one side having a large mobile home park and the other side adjoining a large mobile home subdivision. Roberts showed (on a map) the Board the large number of mobile home developments in the area and also those few restricted residential developments . Faye Cox, 1211 Grantville Lane, told the Board that they are infested with mobile homes and they are sick of it. Cox discussed concerns for the wells in the area and explained that some wells have gone dry due to the growth. Cox said that there are 5 chicken farms , 3 cattle farms, and a furniture manufacturing business in this area. Cox said that there have been 4 fatalities on this road and additional traffic would just cause more dangers driving conditions . Cox said that there is not much country left in their area and they would like to keep what they have left. Richie Everette, 1669 Grantville Lane , expressed concern for added traffic congestion. Everette added that he felt the representation of mobile homes was adequate in this area. Fat Cox, Cox Brothers Road, said that he farms chickens , cows , and strawberries and that this is a farming community. Roberts said that they are not asking anyone to give up their livelihood. Roberts said that they own the land and felt this would be the highest and best use of the land. Melvin Cox, 1347 Grantville Lane, said that he felt this development was just for monetary gain. Faye Cox added that the Board denied a request on Young Road for a development around a year ago due to traffic concerns . Vance Roberts said that this would be a nice and properly maintained subdivision and the restrictions would prevent it from becoming any type of a junk hole. Roberts said that these are not typical standards here. Roberts added that he was an appraiser and this restricted development would help to increase value of the area. Lynden Craven made the motion, seconded by Phil Brower, to recommend that this request be denied due to density and traffic concerns . Bill Dorsett said that if this property could not be used for this what could it be used for. �-- Dorsett said that the Land Use Plan shows this as an appropriate use. Phil Brower agreed with Dorsett but added that his concern was density, not the type of development. Dorsett agreed. Tim Poole said that he thought that this was a good job in proposing these buffers but that he just could not go along with this many lots. The motion passed unanimously. C: GLENN COLEY, Climax, North Carolina, is requesting that . 69 acres located at corner of NC Hwy 22 and Mack Lineberry Road, Providence Township, be rezoned from Residential Agricultural to Highway Commercial/Conditional Use . Zoning Map #7796 . It is the desire of the applicant to develop a used car lot. Coley said that he would have 3 to 10 cars with a 10x10 office building. Coley said he would landscape and conform the property to the community. Coley said he felt this would be a good use for such a small lot because he won' t need a well or septic tank. Coley said the business would be a part-time business and the entrance would be from Mack Lineberry Road. Coley said there would be only sales no repair work of cars . Doug Coble, Coley' s partner, said that he had a full-time job and this would only be part-time. Max Hinshaw, NC Hwy 22N, said that he lived directly across from this site and it would be concerned of who would make him keep the property up if the business closed. Hinshaw said that there is a new housing development for site built homes (in site of this location on Mack Lineberry Road) and this would devalue the residential properties in the area. Lee Wall, NC Hwy 22N, said he lives beside Hinshaw, and that if this was approved this would mean he would get up and look at used cars everyday. Wall said he felt this would create a hindrance to his life and his home . Wall spoke of concerns of driving hazards being created by this being in this intersection and also the increase risk of crime. Bill Dorsett said that he looked at the area and did not object to a small building being here but that this was the wrong thing to place in this area. Dorsett said the lot is too small to allow for any type of screening. Craven made the motion, seconded by Bill Dorsett, to recommend to the Commissioners that this request be denied. The motion passed unanimously. D: EDWARD FINKENBINDER, Liberty, North Carolina, is requesting that 2 . 91 acres located on NC Hwy 49N (just past Willard Road) , Liberty Township, be rezoned from Residential Agricultural to Highway Commercial/Conditional Use. Zoning Map #8725 . It is the desire of the applicant to construct a 2 , 500 sq. ft. building to operate a pet store . Finkenbinder said that when they purchased the property in April of last year his realtor and himself was under the impression that the entire 5z acre tract was zoned commercial. Finkinbinder explained some of the business close by: Freeman Ford, Liberty Farm & Garden, Roush Racing, and a convenience store. Finkinbinder said that there was a commercial garage operating on this property before they bought it. Finkinbinder said that they currently sell exotic birds , AKC dogs , and small animals from their basement (of their home) . Finkinbinder said that he plans to construct a 2 , 800 sq. ft. building with a 1000 sq. ft. area for a free-flight aviary beside his residence . There was no opposition present. Craven made the motion, seconded by Tim Poole, to recommend to the Commissioners that this request be approved. The motion passed unanimously. 6 . REQUESTS FOR A SPECIAL USE PERMIT: A: KEITH ELKES, Archdale, North Carolina, is requesting a Special Use Permit to obtain a dealers license (will be limited storage of automobiles) at his residence located on 2 acres at 5464 Elkes Place; New Market Township; Zoning Map #7737 ; Zoning District RA. Elkes was present and explained that he only wants his dealers license for a hobby and he will store no more than 1 car on the property. Elkes said he will not have a car lot. All of the Elkes family (that live on this road) ..� were present in support. There was no opposition present. Craven made the motion, seconded by Phil Brower, to approve this request for a Special Use Permit. The motion passed unanimously. B: DOROTHY BASS, Trinity, North Carolina, is requesting a Special Use Permit for an additional lot in her mobile home Park (Dogwood Hills MHP) located at 5614 Parinna Drive; Tabernacle Township, Zoning Map #7703 , Zoning District RA. Johnson explained to the Board that Bass was present at the beginning of the meeting with pneumonia and he asked her to leave . Johnson told Bass that it was obvious that she was very ill and that he would be glad to present her case to the Board. Johnson told her he appreciated her attending but that the Board would not require her to be present when she was so ill. Johnson said that he has never received any complaints on her mobile home park and that this would be the last mobile home she could request (due to property limitations in a watershed) . There was no one present in opposition to this request. Craven made the motion, seconded by Phil Brower , to approve this request for a Special Use Permit. The motion passed unanimously. 7 . The Planning Board scheduled a special working session meeting to discuss new proposals for the Zoning Ordinance for Randolph County. The meeting will be held on Thursday, November 30 , 1995 , at 2 : 00 p.m. 8 . The meeting adjourned at 8 : 55 p.m. There were 58 citizens present for this meeting.
