Acting Chairman Jim Routh called to Order the Randolph County Zoning Board of Adjustment meeting. 2 . Hal Johnson, Planning Director , called roll of the Members : Charles Adams, Chairman, absent; Aweilda Williams, Vice Chairman, absent; Tim Poole, present; Lynden Craven, present; Jim Routh, present; Bill Dorsett, present; Phil Brower, present; and Maxton McDowell, Alternate, present. 3 . Bill Dorsett made the motion, seconded by Lynden Craven, to approve the Minutes from the October 3 , 1995 Randolph County Zoning Board of Adjustment meeting. The motion passed unanimously. 4 . Swearing in of the Witnesses: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you, God. " 5 citizens took this Oath. 5 . REQUESTS FOR A VARIANCE: A: ROGER HARVEY, Asheboro, North Carolina, is requesting a Variance of a rear setback of 10 feet in lieu of the required minimum setback of 30 feet. Location: 1986 Manorview Road; Crestview Manor, Section 2 , Map 2 , Lot 49; . 70 acres; Cedar Grove Township; Zoning Map #7659; Zoning District RM. **Arguments For Granting this Request Johnson explained to the Board that Neal Craven, developer of Crestview Manor, could not attend this meeting. Harvey was not present either. Johnson explained that it was impression that the mobile home was placed on the property in this manner due to the location of the septic tank and there were some topography problems. **Arguments Against Granting this Request Phillip Slycord, adjoining lot owner, said that he called the Planning Office because he left for work one day and the lot was vacant and when he came home there was a trailer in his backdoor. Slycord said that he would have not purchased this lot from Mr. Craven if he had known this was going to happen. **Board Discussion: Conclusions Based on Findings of Fact Johnson advised the Board that in the event that there was this problem, he felt it would be more fair to everyone involved if the case was postponed until the developer could be present. The Board Members agreed. **Order of the Board of Adjustment The Board tabled this request until next month. B: EDDIE HERT, Thomasville, North Carolina, is requesting a Variance to allow 5 residences on a 9 acre tract without State Road frontage in lieu of the required minimum 5 acre tract per residence on a private road. Location: 7112 Young Oak Drive; 9 . 20 acres; Trinity Township; Zoning Map #6796; Zoning District RA. **Arguments for Granting this Request Hert was present and explained that he needed an additional septic tank for another mobile home on this property. Hert said there are currently 4 homes on the 9 acre tract, all occupied by family except 1 rental unit. Hert said this new space would also be a rental trailer for an elderly friend and her son. **Arguments Against Granting this Request There was a lady present that owns the property the driveway cross and explained to the Board that Hert does not have an easement to cross her land. She said that her sister lives beside this drive (and also uses the drive) and that no one keeps the road up. She is not opposed to Hert but is concerned about the drive . Hert said that his family has used the drive for 50 years and would be willing to fix the road up. **Board Discussion: Conclusions Based of Findings of Fact Bill Dorsett said that no hardship had been proven just a desire to develop an addition rental space has been shown. **Order of the Board of Adjustment Dorsett made the motion, seconded by Maxton McDowell, to deny this request. The motion passed by a vote of 5 to 1 , Phil Brower voted against the motion. C: V.K. DELK, Asheboro, North Carolina, is requesting a Variance of lot size in a WQCA watershed to allow two 20 , 000 sq. ft. lots to be developed (with a residence on each lot) in lieu of the required 80, 000 sq. ft. per residence. Location: Hwy 64W (approx. 400 ft. past Audie ' s) ; . 92 acres; Lake Reese Watershed; Tabernacle Township; Zoning Map #7712; Zoning District RA. **Arguments for Granting this Request Johnson explained that this subdivision was platted several years ago when the County only required 20 , 000 sq. ft. per building lot. Johnson explained that the watershed regulations require a property owner with contiguous vacant lots to combined lots to meet the watershed lot size requirements . The reason the County passed the regulation was because we had received information from the State that this would be their requirement. However , when the State passed their regulations this was made an option for the counties . Johnson said that Randolph County has always grandfathered lots that were created under the old regulations . Johnson added that this type of variance would be compatible to this subdivision. Maxton McDowell excused himself due to a conflict of interest. Delk said that these would be site built homes and would be able to meet all setback requirements currently in place. **Arguments Against Granting this Request There was no one present in opposition. **Board Discussion: Conclusions Based of Findings of Fact Bill Dorsett said that this would not be out of conformity with the neighborhood and this was not a hardship brought on by the landowners own doing. **Order of the Board of Adjustment. Bill Dorsett made the motion, seconded by Lynden Craven, to approve this request for a Variance. The motion passed unanimously. 6 . The meeting adjourned.
