MINUTES
1 . Chairman Phil Brower called to Order the Randolph
County Planning Board meeting at 7 : 00 p.m.
2 . Hal Johnson, Planning Director, called roll of the
Board members: Phil Brower, Chairman, present; Aweilda
Williams, Vice Chairman, present; Jim Routh, present;
Charles Adams, present; Lynden Craven, present; Bill
Dorsett, present; Doyle Stout, present; Maxton
McDowell, Alternate, absent; and Arlie Culp, Alternate,
absent.
3. Lynden Craven made the motion, seconded by Aweilda
Williams, to approve the Minutes of the Randolph County
Planning Board meeting on December 8 , 1992. The motion
passed unanimously.
4. REQUEST FOR REZONING:
PHILLIP CRAVEN, Asheboro, North Carolina, is requesting
that 71 . 65 acres located on SR 1114 (Pisgah Covered
Bridge Road) (across from SR 1248) , Union Township, be
rezoned from Residential Agricultural to Residential
Restricted. Zoning Map # 7646 . It is the desire of
the applicant to develop a 58 lot restricted
subdivision.
Hal Johnson explained that this request had come before
the Board a couple of months ago for Residential Mixed
(single wide/double wide manufactured housing, site
built development allowed in this zone) and was
voluntarily withdrawn by the applicants due to concerns
raised by the Community. Johnson added that the
current request before the Board is for Residential
Restricted (the highest residential zoning district for
major subdivision development/site built and Class 'A'
double wide manufactured housing with permanent
foundations) .
Phil Craven (and partner Sonny Edmondson) was present
at this meeting and present to the Board a list of
proposed private deed restrictions . Johnson asked
Craven who would enforce these deed restrictions and he
answered a joint effort between the developers and the
County. Johnson explained that the only legal recourse
the County would have in enforcing private deed
restrictions would be any restriction that would fall
in the realms of zoning laws. Johnson stated that
private restrictions such as no junk vehicles could not
be enforced by the County if the lot only had 1 or 2
junked/unlicensed vehicles because the zoning codes
would address this problem under junkyards (defined as
600 sq. ft. of junked area) . Johnson said these type
issues would have to be handled by the developer or the
individual lot owners as the lots are sold.
Johnson questioned if there were any environmental
codes required to be met when land was stripped of
timber. Craven stated that he didn' t cut the timber he
purchased the property from the timber company after
the land was timbered.
Johnson asked Craven to describe the type of housing in
this area. Craven stated a mixture of housing with the
majority being single-wide mobile homes.
WALTER LUTHER, adjoining property owner, discussed
concerns of lot sizes, wells, septic tanks, the
one-lane bridge on the road, schools being at capacity,
property values, and effects this development will have
on the environment. Luther also stated that he feels
any private restrictions placed on this property would
not be enforced.
PAT MYERS, Pisgah Covered Bridge Road, Asheboro,
expressed concerns of traffic problems and stated that
she felt the acreage should be increased per lot.
JOEY MOFFITT, Pisgah Covered Bridge Road, Asheboro,
discussed his concerns of the type of effect this
development would have on the water table.
Johnson explained that just a few years ago any type of
residential subdivision could be developed in Randolph
County without being required to go through the zoning
process (at that time the mobile home subdivision
across the road from this site was developed) . Johnson
said that due to "problems" of large major mobile home
subdivisions developing over night in communities that
are primarily site built caused the County to build in
(to the zoning ordinances) the ability to be able to
consider the type of housing being allowed in major
subdivision. Johnson stated that prior to this as long
as the developer met our subdivision regulations he
could develop any type of housing. Johnson said the
County currently requires a developer to rezoning
property to RR or RM prior to development. RR
(Residential Restricted) is the most restrictive zoning
Randolph County has. This zone allows site built/class
"A" manufactured (modular) housing with permanent
..� masonry foundations. Johnson explained that the law
does not allow local governments to discriminate
against manufactured housing, therefore would not allow
the County to zone out all types of manufactured
housing. Johnson explained the minimum lot size
requirements in Randolph County (40, 000 sq. ft. in
watershed area, 80, 000 sq. ft. in water critical area,
and 30, 000 sq. ft. outside of these areas) and further
stated that there was just so much that the County
could legal impose.
Jim Routh described this property as having the
appearance of a dog with the mange. Routh stated that
personally he would not be interested (as a builder) in
developing/purchasing any of this land because it would
not show off his work. Routh added the land is just
ugly. Routh went on to express his concerns of the
land reclaiming itself.
Doyle Stout stated that he felt Phil Craven was the
type of man to try to enforce this private restrictions
and that he knew Sonny Edmondson would do what ever he
could to see that the restrictions were upheld. Stout
said let' s face it the restrictions would not be
enforced. Stout said that he did not like it (to allow
this type of development) but that there was not
anything that he could do to stop it and that Craven
and Edmondson have done all that they can do (in
requesting RR zoning) . Stout then asked Craven with
all due respect if he would live down there (with this
statement the crowd began to roar) . Stout calmed the
crowd and explained his concerns of this type of
development occurring in the community in which he
lives.
Chairman Brower closed the public hearing and requested
a motion. The meeting stood quiet.
Aweilda Williams spoke up and explained to the crowd
that nobody wants to speak up in a case like this.
Williams added that it is not fun when you as a Board
member feel you must rule against the people. Williams
stated that she felt that legally the Board should
recommend this request be accepted. Williams made this
a motion.
Bill Dorsett stated that at one time he thought if all
of Randolph County was zoned RR everything would be
the perfect situation, this request has shown that that
is not true. Dorsett stated that there is nothing to
protect us from density and legally we are bound to
approve this request. Dorsett seconded the motion.
Jim Routh, Doyle Stout, Lynden Craven, and Phil Brower
voted against the motion. The motion did not pass.
Jim Routh made the motion to recommend to the
Commissioners that this request be DENIED based on
concerns raised by the Board and the Citizens . Doyle
Stout seconded this motion. The motion passed with a
4/3 vote with Bill Dorsett, Aweilda Williams, and
Charles Adams voting against the motion.
5. There were 38 citizens present at this meeting. The
meeting adjourned at 7 : 45 p.m.
