__1779_ - April 6, 1993
1 . Chairman Phil Brower called to Order the Randolph
County Planning Board meeting at 7 : 00 p.m.
2 . Roll call of Board members: Phil Brower, Chairman,
present; Aweilda Williams , Vice Chairman, present; Jim
Routh, present; Lynden Craven, present; Bill Dorsett,
present; Doyle Stout, absent; Charles Adams, absent;
and Maxton McDowell , Alternate, absent.
3. Aweilda Williams made the motion, seconded by Lynden
Craven, to approve the Minutes of the Randolph County
Board Meeting of March 2 , 1993 and March 16 , 1993 . The
motion passed unanimously.
4 . REQUESTS FOR PROPERTY REZONING:
A: CHRIS ISOM, Asheboro, North Carolina, is
requesting that 2 . 47 acres located on Lassiter
Mill Road (800 ft. off Science Hill Road) , Cedar
Grove Township, have additional Conditions add to
the present zoning of Light Industrial/Conditional
Use. Zoning Map #7629. It is the desire of the
applicant to make an addition to the existing
manufacturing building of 40 ' x 75 ' and a wood
storage shed.
Isom explained his intentions to make an addition
of 40 ' x 75 ' to mainly be used for storage. Isom
said he employed 10 people and needed the extra
room to be able to expand the business.
THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS
REQUEST.
Ax Lanier, adjoining property owner, said this
business was a very responsible neighbor.
Earl Green, Green Oak Road, described the business
as a neat, clean establishment and he was proud
this business is a part of their community.
Green presented a letter from his son, Roger
Green, in favor of this request.
Mrs . Leon Williams expressed her opinion that the
business doesn' t detract from the area.
Hal Johnson stated that in all the rezoning
classes over the years he has never seen a
Community come out in support of a business like
this case.
THERE WAS NO ONE PRESENT IN OPPOSITION TO THIS
REQUEST.
Bill Dorsett made the motion, seconded by Lynden
Craven, to recommend to the Commissioners that
this request be approved. The motion passed
unanimously.
B: TERRY RHAMY, Asheboro, North Carolina, is
requesting that 1 acre out 22 . 9 acres located on
Hwy 49 South (2/10 mile west of SR 1174) , Concord
Township, be rezoned from Residential Agricultural
to Highway Commercial. Zoning Map #7608 . It is
the desire of the applicant to use the property
for commercial purposes .
Rhamy described the business as a drilling
business for elevator shafts . Rhamy stated his
plans to build his residence at this location in
the future. Rhamy said the main office (for this
business) is located in New Jersey and that the
rigs are usually not at this site. Rhamy said he
planned to construct a metal building of 40 ' x 60 '
and the access would be off the 4-lane of Hwy 49 .
Charles Cranford, adjoining property owner,
(brother to the lady selling the property) stated
that he has no objections to this rezoning.
Cranford stated that his sister has been sick for
2 years and in the hospital 35 times during this 2
years .
Jaretta Johnson, Hwy 49 , (lives across the road) ,
presented the Board with pictures of the property
and a petition of opposition to the request with
57 signatures. Johnson stated that she would like
to see Farmer remain as the name implies, a
farming community. Johnson stated that the
Commission had foresight to zone the property
residential agricultural and she would like to see
this remain.
Cindy Garner, adjoining property owner, stated
that they purchased this property for the country
atmosphere and to raise their children here.
Aweilda Williams made the motion, seconded by Jim
Routh, to recommend that this request be denied as
not consistent with the Land Use Plan for this
area. The motion passed unanimously.
C: ALFORD JOHNSON, Franklinville, North Carolina, is
requesting that .29 acres located on Old Liberty
Road ( 4 mile past Hall Road) , Franklinville
Township, be rezoned from Residential Restricted
to Highway Commercial. Zoning Map #7785 . It is
the desire of the applicant to use the property
for commercial purposes .
Johnson said that his hobby is exotic birds and he
would like to operate a small business from an
existing old store building. Johnson said only
himself and his wife would work here and that he
has already obtained a license from the State.
Don Phillips, adjoining property owner, stated
that Johnson owns an adjoining 2+ acres that he
currently raises game chickens on and that he felt
this was a commercial activity and the entire
property should be required to be zoned if he was
to continue operations . Phillips expressed his
opposition to this request and stated that there
is no commercial zoning within a 2 mile radius of
the property.
Johnson stated that the chickens belong to his son
and they fight the chickens in Virginia. Johnson
�.. stated that he would not sell the chickens from
this building. Johnson also told the Board that
his son lives in the back portion of this
building.
Dorsett told Johnson that if the Building was
zoned Commercial he would not be allowed to use
the building (any portion) for a residences .
Hal Johnson discussed complaints the department
has had concerning junk and trash in back of this
building.
Dorsett asked Johnson if he understood that he
would have to conduct the entire operation from
this building and not from his residence. (located
in behind this building. ) Dorsett said that he
doesn' t like to zone commercial sites in
residential areas but this building is there and
feels there will be no further detraction from the
area.
Lynden Craven made the motion to recommend to the
Commissioners that this request be approved with
the following conditions :
*building could not be used for anything else (but
the described business)
*all storage must be contained within the building
*trash and junk on property must be cleaned up
Jim Routh seconded the motion, and the motion
passed unanimously.
D: LARRY MCKENZIE, Asheboro, North Carolina, is
requesting that 14 . 36 acres located on Old NC Hwy
49 (2/10 mile West of Thornburg Road) , Cedar Grove
Township, be rezoned from Residential Agricultural
to Residential Restricted. Zoning Map #7730 . It
is the desire of the applicant to develop a
restricted residential subdivision of 12 lots .
McKenzie said there would be no mobile homes
allowed only stick built homes with a minimum sq.
ft. of 1200 . McKenzie presented a preliminary set
of restrictions.
Stafford Starcher, adjoining property owner,
requested to see a copy of the plat.
Craig Branson, lives 3 miles from the site, stated
that the development would be first class and an
asset to the community.
John Noahe, adjoining land owner, stated that he
bought out here to get out of the city not to be
against a housing development.
Bill Dorsett made the motion, seconded by Jim
Routh, to approve this request. The motion
passed unanimously.
E: PATRICIA MEDLIN, Asheboro, North Carolina, is
requesting that 1 . 95 acres located on the
northeast corner of Caraway Mountain Road/Old
County Home Road (Mountain View Estates lots
21-34) , Back Creek Township, be rezoned from
Residential Agricultural to Highway Commercial.
Zoning Map #7732 . It is the desire of the
applicant to use the property for commercial
purposes.
Medlin stated her intentions to build a small
country store. Medlin said she would sell gas and
convenient items (bread, milk, etc. ) . Medlin
described the commercial establishments in the
area (garage, N.C. lumber company, etc. ) Medlin
said David Ezzell, Health Department, has approved
an area for a septic system. Medlin said she
would employee 6 people and stated she felt it
would be good for the community.
Kenneth Varner, adjoining resident, stated that he
felt this would improve the community.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by
Aweilda Williams, to recommend to the
Commissioners that this request be approved. The
motion passed unanimously.
5 . REQUESTS FOR A SPECIAL USE PERMIT:
A: KEITH FARLOW, Sophia, North Carolina, is
requesting a Special Use Permit to operate a pawn
shop/horse tack supplies out of a tract trailer on
1 . 12 acres located on SR 1524 (Beckerdite Road) ,
New Market Township, Zoning Map #7745, Zoning
District RA.
Farlow told the Board that he works in the barber
shop (on the property) part-time and this would be
a part-time operation from noon til 7 p.m. Farlow
stated he would not have any employees.
J.B. Farlow, Beckerdite Road (across from site) ,
expressed his concerns that pawn shops a crime
targets and this type operation would lower the
property values and change the character of the
community.
Keith Farlow withdrew the request stating that he
did not want to create hard feelings in the
community or devalue anyone ' s property.
B: MANUEL RODRIGUEZ, Ramseur, North Carolina, is
requesting a Special Use Permit for a Rural Family
Occupation to operate a bakery business at his
residence located on Hwy 42 , Shiloh Acres lot 14 ,
Coleridge Township, Zoning Map #8608 , Zoning
District RA.
Rodriguez stated his plans to build an outside
adobe for bread baking. Rodriguez plans to have a
kiln type oven that would be heated with wood.
Rodriguez said he would operate the oven 2-3 days
a week.
Chairman Phil Brower asked Rodriguez if has
contact the Health Department and he said he had
not.
Sherton Cale, adjoining resident, told the Board
that the private deed restrictions for this
subdivision states the property is to be used for
residential purposes only (no business) . Cale
stated he felt this would devalue his property.
The Board delayed any decision on this request
until Hal Johnson could consult with the Health
Department concerning regulations they may need to
comply with.
6. The meeting adjourned at 8 : 25 p.m. There were 72
citizens present for this meeting.
