RANDOLPH COUNTY PLANNING BOARD
July 13, 1993
1 . Chairman Phil Brower called to Order the Randolph
County Planning Board meeting at 7 : 00 p.m.
2 . Planning Director Hal Johnson called roll of Members:
Phil Brower, Chairman, present; Aweilda Williams, Vice
Chairman, absent; Charles Adams, absent; Bill Dorsett,
present; Lynden Craven, present; Jim Routh, present;
Doyle Stout, absent; and Maxton McDowell , Alternate,
present (substituting for regular member Aweilda
Williams) .
3 . Bill Dorsett made the motion, seconded by Lynden
Craven, to approve the Minutes of the June 8 , 1993
Randolph County Planning Board meeting. The motion
passed unanimously.
4 . SPECIAL USE PERMIT REQUESTS:
A: D.K. MCLAUGHLIN, (James T. Craven, Property
Owner) , Asheboro, North Carolina, is requesting a
Special Use Permit to locate a cablevision relay
station (30 x 30 block building with 150 ' steel
tower) on 2 . 22 acres located on corner of Doc
Hayworth Road/Hwy 42 , Coleridge Township, Zoning
Map #8608 , Zoning District RA.
McLaughlin was present and explained their
intentions to expand their service in Randolph
County. McLaughlin stated that the tower may be
less than 150 ' but that would be the maximum
height. The area would be completely fenced and
there will be 3 satellite discs on the property.
Lynden Craven questioned the effect this may have
on the powerlines on the property. McLaughlin
stated that he had a meeting with REMC tomorrow
and would do what ever is necessary to work with
them.
JERRY CRAVEN, Doc Hayworth Road, discussed his
concerns of interference with his private runway.
Craven stated that he had no opposition to the
tower but did not want it to interfere with his
private air strip.
Lynden Craven made the motion, seconded by Bill
Dorsett, to approve this request with the
following restrictions :
*must work with REMC concerning powerlines
*comply with FCC regulations concerning the
private air strip
*maintain as much vegetation as possible
The motion passed unanimously.
B: JOSEPH FRANKLIN, Franklinville, North Carolina, is
requesting a Special Use Permit to operate a
construction of Lawn Furniture business at his
residence in Asheboro East Family Campground, on
McDowell Mountain Country Trail , Franklinville
Township, Zoning Map #7782 , Zoning District RA.
Franklin was present and explained to the Board
that he occasionally has renters (in his
campground) that they built lawn furniture and he
wanted the appropriate permits to allow this
activity. Franklin stated that if this was a
problem with his neighbors he would just forget
about it because he had good neighbors and he
didn' t want to upset them.
Hal Johnson explained that the Planning Office had
numerous complaints for several months of this
manufacturing of lawn furniture at this site.
Johnson stated that he and the code enforcement
officer went out to see the site and there were
lawn chairs as far as the eye could see (the
complaints were very valid) . Johnson stated that
he felt the operation started small and just got
out of hand. Johnson told Franklin that it was
obvious, by the neighbors not attending, that the
neighbors think a great deal about Franklin.
Bill Dorsett stated that the intent of a Special
Use is to allow the homeowner to operate a small
family business at their residence, not to allow a
business within a residential campground. For
this reason Dorsett made the motion, seconded by
Lynden Craven, to deny this request. The motion
passed unanimously.
C: TONY SHEPHERD, Trinity, North Carolina, is
requesting a Special Use Permit for an automotive
body shop/car sales lot at his residence located
on 11 acres on Hoover Hill Road (just off Hwy
64W) , Tabernacle Township, Zoning Map #7714 ,
Zoning District RA.
Shepherd explained that there is currently a 2-bay
garage on the property that was built
approximately 5 years ago for the purpose of
working on trucks . Shepherd described his desires
to operate a small car lot (5-6 car maximum) and
an auto body repair business . Shepherd stated
that he would not have any outside storage of
junk.
Frank Lewis, Hoover Hill Road, discussed his
concerns of a body shop/car lot hurting property
values and expressed his opposition of the County
permitting such a business in this area.
Paul Myers, Florida, owns the land across the
road. He discussed his intentions of retiring on
the property. Myers said he doesn' t want to see a
body shop directly across the road.
J.R. Johnson, Hoover Hill Road, said that he is
very much opposed to this type of operation in
this residential community.
Boyd Pierce, Hoover Hill Road, expressed his
opposition to this request.
There were 13 people present in opposition to this
request.
Bill Dorsett said that if this request was allowed
it would completely change the character of the
area. For this reason Dorsett made the motion,
seconded by Jim Routh, to deny this request for a
Special Use Permit. The motion passed
unanimously.
D: JEFFERY STUTTS, Asheboro, North Carolina, is
requesting a Special Use Permit to locate a retail
sales of automotive tools business at his
residence located on 10 acres on Ross Harris Road
(approx. 3/4 mile off Hwy 159) , Grant Township,
Zoning Map #7667 , Zoning District RA.
Stutts explained that there would be no sales from
the property he only wanted the permit to park the
truck at his residence. Stutts stated that all
sales would be done at individual garages .
Hal Johnson stated that the Planning Office has
received letters in support of this request.
There was no one present in opposition.
Lynden Craven made the motion, seconded by Jim
Routh, to approve this request for a Special Use
Permit. The motion passed unanimously.
E: HOMER ALLRED, JR. , Sophia, North Carolina, is
requesting a Special Use Permit to operate a race
car workshop at his residence located on 12 . 8
acres on Marlboro Church Road (off Hwy 311) , New
Market Township, Zoning Map #7735, Zoning District
RA.
Homer Allred was not present for this meeting.
There were 5 people present in opposition.
Theresa White, Adjoining Property Owner, stated
that this community was church and home and she
wanted it to remain this way.
Gertrude Spainhour, Adjoining Property Owner, said
that this property adjoins Allred Heights
Subdivision which has deed restrictions and would
not allow this activity.
The Board decided to postpone this request until
the August meeting since Allred was not present.
F: W.T. COX, Ramseur, North Carolina, is requesting a
Special Use Permit for a rural family occupation
for a catering business to be located at his
residence on 36 acres on Foushee Road, Columbia
Township, Zoning Map #8712 , Zoning District RA.
Randy Macon, property owner, was present and
explained that Cox would be the builder of this
catering business if approved by the Board. Macon
stated that he and his wife have met with the
Health Department and their plans have been
approved.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by Maxton
McDowell , to approve this request for a Special
Use Permit. The motion passed unanimously.
5. REZONING REQUESTS:
A: KEARNS & MCDOWELL, Asheboro, North Carolina, is
requesting that 74 acres located on Fred Lineberry
Road, Level Cross Township, be rezoned from
Residential Agricultural to Residential
Restricted. Zoning Map #7777 . It is the desire
of the applicants to develop a site built
residential subdivision of 60 lots .
Reid Kearns and Ken McDowell were present at this
meeting and McDowell explained to the Board their
intentions of developing a continuation of
Woodfield Acres (adjoining site built
subdivision) . McDowell stated that there would be
no modular or prefab. homes . McDowell stated that
a soil scientist has preliminary approved the soil
for this proposed lots .
There was no one present in opposition to this
request.
Maxton McDowell made the motion, seconded by Jim
Routh, to recommend to the Commissioners that this
request be approved as consistent with the area.
The motion passed unanimously.
B: R.S. DAVIS, Randleman, North Carolina, is
requesting that 17. 82 acres located on Davis
Country Road, New Market Township, be rezoned from
Residential Agricultural to Residential Mixed/
Conditional Use. Zoning Map #7747 . It is the
desire of the applicant to operate a 6 space
mobile home park.
Davis told the Board that it was his original
intent to deed his 2 children each a tract of 4
acres and allow them to locate 2 mobile homes per
tract but that because of tax evaluation problems
he decided to request a mobile home park of 6
spaces for the entire tract. Davis stated that
currently this 2 . 3 mile stretch of road has 14
mobile homes . Davis presented the Board with a
set of restrictions that the tenants would be
required to follow. Davis said that he felt this
would be compatible to the existing development of
the community.
There were 11 people present in opposition to this
request.
Max Welborn, Davis Country Road, expressed his
concerns of a mobile home park entering the
community. Welborn stated that an individual
tract that has a mobile home on it may one day
have a house , but a mobile home park never moves .
Karen Welborn Walton, Davis Country Road, told the
Board that her son is the 6th generation of her
family to reside on this property. Walton stated
that the transient nature of people that live in
mobile home rental parks would cause security
problems, burden the school system, and effect
property values for this area. Walton stated that
the TV2 tower (in this area) would cause safety
hazards for the tenants of this park. Walton
described horror stories of ice accidents . Walton
added her concern of no buffer allowances .
David Jones, WFMY-TV2 , Greensboro, told the Board
he was not there to make a stand on where this
property is zoned, but he did want to express his
concerns of possible ice damage to these mobile
homes. Walton told the Board she requested TV2
be present for this meeting.
Elizabeth Welborn, Davis Country Road, told the
Board that TV2 has always honored their claims
from the ice damage but that this is a very
serious safety problem. Welborn told of ice going
through roofs of the houses , windshields in their
cars, and that once her husband was knocked down
by the ice.
Joe Welborn, Davis Country Road, spoke on addition
ice accidents .
Hal Johnson spoke of his concern of this potential
safety problem occurring and the County never
being notified by TV2 .
David Jones, TV2 , stated that they had no evidence
that ice has ever fallen on this property but he
wanted to make the Board aware of the potential.
Jones showed the Board a map of the area TV2
considered a danger zone .
Johnson stated that he felt (since this map has
been created) TV2 ' s engineers had done further
studies of this problem and that he would be
interested in seeing these reports .
Rick Walton, Davis Country Road, expressed
concerns of safety problems due to the elevation
of the tower.
Mrs. Welborn, Davis Country Road, said that she
did not want the Board to forget that they were
concerned of transient type residents in this
community would not add to the tax base but could
case an elevation in the crime level . Welborn
stated that they were already having to deal with
chicken houses from Mr. Davis ' property. Welborn
added that with as much land as Davis has he could
locate this park somewhere else.
Maxton McDowell expressed his opinion that this
�-- would be compatible to the mixed housing all ready
on this road.
Jim Routh stated that he felt the community was
concerned about transient type people that could
come with rental properties. Routh stated that
the Board would leave Sony with quite a few
options if this request was denied. For this
reason Routh made the motion to recommend to the
Commissioners that this request be denied.
The motion died for the lack of a second.
Bill Dorsett stated that he felt there was a true
need for this type of housing in Randolph County.
Dorsett said he didn' t feel 6 spaces would be
detrimental to the community and would not be out
of character. For these reasons Dorsett made the
motion, seconded by Maxton McDowell, to recommend
to the Commissioners this request be approved.
The motion passed with a 4-1 vote with Jim Routh
voting against the motion.
C: ALLEN BULLARD, Asheboro, North Carolina, is
requesting that 33 acres located on Racine Road
(across from Old Climax Road) , Providence
Township, be rezoned from Residential Agricultural
to Residential Restricted. Zoning Map #7788 . It
is the desire of the applicant to develop a
residential subdivision of 30 lots for site built
homes .
Bullard was present and explained that he wanted
to develop a maximum of 30 lots with paved streets
on this 33 acre tract. Bullard stated 8 lots
would front on Racine Road and the remainder would
be on new streets . Bullard said his plans were to
have the same type restrictions of Woodfield Acres
(on Providence Church/Racine Road) with 1400 sq.
ft. minimum housing.
Wolly Hockett, Racine Road, told the Board he just
did not want to see mobile homes located across
the road from him.
Bullard stated there would be no mobile or modular
homes . Bullard explained that he has signed a
statement with Mrs . Hockett (seller of the
property) that he would not locate any mobile
homes or modular homes on the property. Bullard
told Hockett that he would place this in his deed
restrictions.
Betsy Hockett, Racine Road, expressed concerns of
over burdening our school system and told the
Board she would like to see the area remain
countryside.
Bill Dorsett made the motion, seconded by Maxton
McDowell , to recommend to the Commissioners that
this request be approved as consistent with the
Community. The motion passed unanimously.
6. The meeting adjourned at 9 : 28 pm. There were 61
citizens present for this meeting.
