September 14, 1993
1 . Chairman Phil Brower called to Order the Randolph
County Board of Adjustment.
2 . Roll call of the Members: Phil Brower, Chairman,
present; Aweilda Williams, Vice Chairman, absent; Jim
Routh, present; Lynden Craven, present; Charles Adams,
absent; Doyle Stout, absent; Bill Dorsett, present;
Maxton McDowell, Alternate, absent; and Tim Poole,
Alternate, present (substituting for regular member
Aweilda Williams) .
3 . VARIANCE REQUESTS:
A: ROGER HOLDER, Greensboro, North Carolina, is
requesting a Variance to allow a second residence
on a 8 . 20 acre tract (in lieu of the required 5
acre tract size per residence on a private drive)
located at the end of Shady Hollow Drive (off
Kidds Mill Road) , Franklinville Township, Zoning
Map #7794 , Zoning District RA.
**Arguments for Granting Request
Holder was present and explained his intentions of
building a house for his retirement and possibly a
second residence on the property if his parents
ever needed him to take care of them (if their
health deteriorated) . Holder stated that he
doesn' t plan to deed the property separately.
**Arguments Against Granting Request
There was no one present in opposition.
**Board Discussion: Conclusions based on Findings
of Fact
Bill Dorsett stated that there is not currently a
hardship in existence and Holder still has use of
his property. Dorsett stated that he didn' t feel
the Board could approve this request and still be
within the law.
Lynden Craven stated that he felt Holder was
trying to prepare for a possible hardship. Craven
said he felt this would be a viable request.
**Order of Board of Adjustment
Bill Dorsett made a motion to deny this request
because no emergency exists . Dorsett stated that
the Board should further review this request at a
later date if a hardship should occur. The motion
was seconded by Jim Routh and the motion passed
with a vote of 4/1 . Lynden Craven voted against
the motion.
B: DEXTER BLAKELY, Liberty, North Carolina, is
requesting a setback Variance of 25 ft. from a
road right of way in lieu of the required 50 ft.
to allow an addition of 30 ft. to the front of an
existing building located at 5892 Browns Meadow
Road, Liberty Township, Zoning Map #8718 , Zoning
District RA.
**Arguments for Granting Request
Blakely stated that the existing building was
constructed in 1978 (prior to building
inspections) and is currently 6000 sq. ft.
Blakely stated that his father owns the property
(approximately 200 acres) . Blakely described a
pond, septic tank field, and bad topography to the
rear of the building and stated that it would not
be feasible to build to the south of the structure
because it would eliminate most of his parking.
Blakely stated that he currently has 5 storage
trailers and quite a bit of outside storage that
he would be able to get inside of the building if
the addition was approved.
**Arguments Against Granting Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions based on Findings
of Fact
Routh expressed his opinion that this would
improve and enhance the property/community and to
deny this request would not be in the best
interest of the community. Routh added that he
did not feel this variance would violate the
intent of the County Ordinance.
**Order of Board of Adjustment
For the above reasons stated, Jim Routh made the
motion, seconded by Bill Dorsett, to approve this
request for a Variance. The motion passed
unanimously.
4 . The meeting adjourned at 8 : 10 p.m.
