177g . October 5, 1993
1 . Chairman Phil Brower called to Order the Randolph
County Zoning Board of Adjustment meeting at 7 : 00 p.m.
2. Roll call of members: Phil Brower, Chairman, present;
Aweilda Williams, Vice Chairman, present; Bill Dorsett,
present; Charles Adams , present; Lynden Craven,
present; Jim Routh, present; Doyle Stout, absent; Tim
Poole, Alternate, absent; and Maxton McDowell,
Alternate , present.
3 . Bill Dorsett made the motion, seconded by Lynden
Craven, to approve the Minutes of the September 14 ,
1993, Randolph County Zoning Board of Adjustment
meeting. The motion passed unanimously.
4 . Swearing in of Witnesses:
There were 4 people that took the following Oath:
"Do you swear or affirm that the information you
are about to give is the truth, the whole truth,
and nothing but the truth, so help you God. "
5. VARIANCE:
BILLY WALKER, Archdale, North Carolina, is requesting a
Variance of lot size requirement of 39, 000 sq. ft. in
lieu of the required 40 , 000 sq. ft. for a residential
building lot. Location: Country Meadows Subdivision,
Section 2 , lot 10 , on Country Meadows Lane (off Finch
Farm Road) , Trinity Township, Zoning Map #6796, Zoning
District RR.
**Arguments for Granting Request
Mr. Walker was not present. Neal Craven, Surveying
Services , was present to answer questions concerning
the Subdivision survey.
Initially this subdivision was surveyed by using
concrete monuments but during title searches the
attorneys saw that a poplar tree should have been used.
When the property was resurveyed a difference of 8 feet
was created causing the lots to be smaller in size.
Neal Craven went to the Regional Office of the
Department of Environment and Human Resources in
Winston Salem to determine what could be done for this
situation. Craven explained that he had allowed as
many lots as possible to have 40 , 000 sq. ft. but was
`.. not able to for all the lots because of the road all
ready being built and the easement for the road being
• established in deeds all ready transferred to new
owners . The State Regional Office of Environmental
Services sent a request for a Variance (from the
Watershed lot size requirements) to the Raleigh Office
and this office notified Mr. Craven that the amount of
land difference was so minor they would not rule
(therefore approving the request) .
**Arguments Against Granting Request
RAYMOND STANLEY, Country Meadows Lane , (lot #9) told
the Board of being inconvenienced by the delay of the
sale of the property. Stanley stated that Walker had
misrepresented the reason for the delays.
SANDY COOK, Country Meadows Lane, (lots 11 & 12) stated
that Walker had also inconvenienced her also and her
closing date for the purchase of this property was
postponed due to Walker.
JERRY DRY, Archdale, explained that he was a friend of
Cook and that it appeared to him that all the lots
(8 , 9, 11 , 12) had been altered.
**Board Discussion: Conclusions based on Findings of
Fact
Jim Routh stated that there was an obvious error made
during the original surveying (not by any intentional
wrong doing of the surveyor) , and felt the Board of
Adjustment should approve zoning dimensional lot size
variances for those affected lots judged suitable for
septic tank systems .
Aweilda Williams stated that these people have been
inconvenienced by the developer but by granting this
Variance they will not be further inconvenienced.
**Order of Board of Adjustment
Aweilda Williams made the motion, seconded by Jim
Routh, to approve this request for a Variance of lot
size. The motion passed unanimously.
6 . The meeting adjourned at 7 : 40 p.m.
