1 . Chairman Jim Routh called to Order the Randolph County
Planning Board Meeting at 7 : 00 p.m
2 . Hal Johnson, Planning Director, called roll of the
members : Jim Routh, Chairman, present; Aweilda
Williams , Vice Chairman, absent; Tim Poole, present;
Lynden Craven, present; Charles Adams , absent; Bill
Dorsett, present; Phil Brower, present; and Maxton
McDowell, Alternate, present.
3. Phil Brower made the motion, seconded by Lynden Craven,
to approve the Minutes of the May 3 , 1994 Randolph
County Planning Board meeting. The motion passed.
4 . REZONING REQUEST:
MITCHELL HURLEY, Troy, North Carolina, is requesting
that 4 . 17 acres located on Randall Hurley Road, Union
Township, be rezoned from Residential Agricultural to
Residential Mixed/Conditional Use . Zoning Map #7624.
It is the desire of the applicant to develop a 4 space
mobile home park.
Hurley was present and explained that there is 1
existing mobile home space on the property and he
wishes to add 4 additional spaces making a total of 5
spaces on the 4 . 17 acres . Hurley presented a petition
of 151 signatures in favor of this mobile home park and
stated that the signatures were from people who live in
this community. Hurley said he would manage this park
if this is approved.
James Satterfield, neighbor, said he felt Hurley would
operate a nice park and for this reason he would be in
favor of this request 100% .
Hurley's daughter spoke stating she would like to see
her father develop this property, where he can control
who would be living here, instead of selling the land
in lots where anyone could live here.
Bobby Marion, neighbor, said he felt Mitchell Hurley
would do a good job and take care of this area.
There were 18 people present in favor of this request.
Rhonda Callicutt, Randall Hurley Road, (adjoining
property owner) , said she is opposed to this
development. Callicutt said this is so far out of town
she did not feel the location would attract good
renters .
Rachel Callicutt, Randall Hurley Road (adjoining
property owner) , said it will be the adjoining property
owners having to deal with this park not Hurley because
he does not live beside this site . Callicutt
questioned why 3 mobile homes were allowed on this
tract. She was explained that a portion of the
property was deeded to Bill Lynthicum and so only 2
mobile homes are on this site.
Kenneth Callicutt, Randall Hurley Road, presented
pictures to show how close one of the existing mobile
homes was placed to his house. Callicutt said he felt
this was located here because it was as close as Hurley
could place this trailer to his home .
Dossie Callicutt, Randall Hurley Road, said she had
lived beside Hurley all his life and she did not.
appreciate Hurley moving that mobile home so close to
Kenneth Callicutt' s home.
There were 17 people present in opposition to this
request.
Eugene Hurley, owns adjoining land, asked questions on
what a Conditional Use Zoning is . Johnson answered
that the property would be zoned for a specific use and
would only be allowed to develop the property for this
use conforming to the restrictions implied.
Lynden Craven stated that this is a very rural
community. Craven said there are mobile homes in the
area but they are under single ownership, no mobile
home rental parks .
Lynden Craven made the motion, seconded by Tim Poole,
to recommend to the Commissioners that this request be
denied as not consistent with the Land Development Plan
for this area.
5 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
44 people took this Oath.
6 . SPECIAL USE PERMIT REQUESTS:
A: MICHAEL STEVENS, Archdale, North Carolina, is
requesting a Special Use Permit to operate an
automotive repair business in an existing building
at his residence located at 5520 Elmont Drive,
Manor Ridge Subdivision, lot 44 , Zoning Map #7727 ,
Zoning District RM.
Stevens was present and explained his intentions
of operating a business to clean up cars and
perform minor repairs for a car lot he works at
called ALS Motors . Stevens said he works on newer
model vehicles and would have no more than 4 or 5
cars at a time (for the business) at his
residence. Stevens presented a letter from
Advance Auto stating he disposes of all his motor
oil at their business . Stevens presented pictures
of his property (he has owned for 12 years)
showing a privacy fence he has built for a buffer .
Stevens presented a petition of 70 signatures of
residents of the subdivision that have no
objections to this business . Stevens said his
operating hours would be from 9 am - 6 pm.
Johnson asked Stevens about possible congestion
problems this business may create due to his
property being a corner lot. Stevens said he has
been using the side drive , that has cause a few
problems , but he plans to move the drive entrance
to the front which would eliminate these problems .
Johnson questioned if there are other businesses
operating in this development. Stevens said he
has heard of a few other mechanics and
upholsterers but he was not sure .
Kelly Brown, adjoining property owner/resident,
said he has lived here for 8 years and Stevens has
done extensive grading, built a privacy fence, and
has bent over backwards to accommodate the
neighbors (and spent a lot of money) to make the
property right. Brown said he had no opposition
and felt the Board should approve this request.
Olen Harrelson, adjoining property owner/resident,
said Stevens is a nice guy, keeps his property
clean, and he did not feel this business would be
problem for the community.
There were 6 people present in favor of this
request.
Bertie Holloman, neighbor (across the road) , said
she felt the lot was too small for this business,
he is parking cars over the septic tank system for
his house (Holloman said this area has septic tank
problems) , he works late at night and on Sundays ,
and he parks vehicles on the side of the road.
Holloman added that if any oils/anti-freeze gets
on the ground it would pollute a near by creek.
David Holloman, adjoining property owner , said
Stevens began building the building without a
Building Permit and when he and his wife
complained he was made to get a permit by the
County. Holloman said he has operated this
business for 3 or 4 months without proper permits .
Holloman presented a log of vehicle traffic this
business has created.
Benny Kindley, a friend of the Hollomans , said he
has witnessed this extra traffic.
There were 5 people present in opposition to this
request.
Bill Dorsett questioned the lot size and Stevens
said his lot is 100 ' x 150 ' . Johnson said that
this is a small lot, but the subdivision was
developed in 1965 prior to any zoning or watershed
regulations.
Dorsett said a commercial operation would not
really be in keeping with the remainder of the
development, and if this was approved he felt
there should be some restrictions place like
operating hours, no parking on the street, and the
business should be maintained all within the
fenced area.
Maxton McDowell made the motion, seconded by Bill
Dorsett, that this Special Use Permit be approved
with the following restrictions :
***no more than 5 cars on the property for the
business (must be contained within the fence)
***no outside storage of junk cars , parts , etc .
***no parking on the street
***maintain proper dispose of all fluids
***no signs
***operating hours 7 : 30am-6pm, no Sunday work
***all of the business must be contained within
the fence
the motion passed unanimously.
B: CENTEL CELLULAR OF NORTH CAROLINA, Chicago,
Illinois, is requesting a Special Use Permit to
locate a 300 ft. guide cellular tower & accessory
building (12x28) on 5 . 00 acres, Bypass 220S
(directly across from NC Hwy 159) , Cedar Grove
Township, Zoning Map #7657 , Zoning District RA.
Maria Lynch, Attorney, 2626 Glenwood, Raleigh,
represented Centel Cellular and introduced 3
speakers to address the Board for this request.
Keith Price, Vice President of Anderson &
Associates , Inc. , Friendly Avenue , Greensboro,
told the Board that the tower would far exceed any
setback requirements imposed by the County, these
setbacks of the tower are 245 ' front, 120 ' side,
and 195 ' rear. Price said that evergreens would
be planted around the compound for screening.
Price stated that there as mixed development of
residential, commercial, and the property adjoins
a By-Pass and a power sub-station is also in the
area.
Dee Keel, Lawrence Bell Associates, stated that
this is a favorable to site to the FAA. Keel said
there has been impact studies conducted that have
shown the tower to have adequate safety and the
installation would have no detrimental effect on
adjoining property values .
Steve Zisco, Electrical Engineer, Centel Cellular,
presented the Board with Centel ' s certificate of
public necessity and described this tower as a low
power/high frequency tower with EMF exposure
equivalent to 5 to 8 100 watt light bulbs lit at
the top of this tower. Zisco presented a map
showing Centel customer ' s need for this tower in
this area.
There was no one present in opposition to this
request.
Hal Johnson, Planning Director, complimented the
applicant ' s on a fine presentation.
Lynden Craven made the motion, seconded by Maxton
McDowell , to approve this request for a Special
Use Permit. The motion passed unanimously.

C: DONALD CROTTS, Asheboro, North Carolina, is
requesting a Special Use Permit to obtain a
dealer ' s license at his residence located at 1679
Southmont Drive (property on (L) just before
bridge) , Cedar Grove Township, Zoning Map #7659,
Zoning District RM.
Donald Crotts was present and said he would like
to be able to buy/repair/sell vehicles for a
hobby. Crotts said he would only have 4-5 cars on
the property and would not allow junk vehicles or
sign on the property. Crotts said this would be
part-time, that he works full-time for Black &
Decker.
Johnson said his office has received two phone
calls opposed to a used car sales lot, but he did
not feel the neighbors would be opposed to this
small of an operation.
There was no one present in opposition.
Bill Dorsett made the motion, seconded by Tim
Poole, to approve this request for a Special Use
Permit with the following restrictions :
***no junk cars , parts, etc.
***no more than 5 cars
the motion passed unanimously.
D: TIMOTHY CULBRETH, Liberty, North Carolina, is
requesting a Special Use Permit to obtain a
dealer ' s license at his residence located at 8175
Old Liberty Road, Liberty Township, Zoning Map
#8706 , Zoning District RA.
Culbreth described his intentions as similar to
Crotts . Culbreth explained that he is a school
teacher and will only operate on a small bases .
Culbreth said he would have no problem with a 5
car limit restriction being imposed on his permit.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by Tim
Poole, to approve this request for a Special Use
Permit with the following restrictions:
***no more than 5 cars
***no junk vehicles, parts , etc.
the motion passed unanimously.
E: JACK TOMASINO, Denton, North Carolina, is
requesting a Special Use Permit to operate a car
lot and off-site towing service at his residence
located at 7826 NC Hwy 49S (just past SR 1304) ,
Concord Township, Zoning Map #6697 , Zoning
•
District RA.
Tomasino said he had a dealer ' s license in the
State of New York. Tomasino said he would like to
operate a used car lot on the corner with
approximately 10-15 cars . Tomasino said he would
like to also operate an off-site towing service
(the vehicles would be towed to another location,
not to this property) with the wreckers being
parked at this site.
There were 15 people present in opposition to this
request.
Elizabeth Charles, adjoining property
owner/resident, presented pictures to the Board of
the area and explained that she would like to see
this area remain rural residential without any
more commercial activities. Charles said the area
already has an eyesore of Richard' s Junkyard and
does not any development of this type. Charles
presented the Board with a petition of 141
signatures opposed to this development. Charles
added that this would depreciate the property
values of this community.
Lee Hilliard, adjoining property owner/resident,
said he was bothered by the existing junkyard and
would like to see this area remain country.
Tony Cranford, adjoining property owner/resident,
said he, his father, his aunt, and his brother own
several acres of land in this rural farming
community. Cranford said this would not improve
the area and express environmental concerns .
Bill Dorsett said in view of the negative impact
this would have on the community he would make the
motion to deny this request for a Special Use
Permit. Phil Brower seconded this motion and the
motion passed unanimously.
7 . The meeting adjourned at 9 : 00 p.m. There were 92
people present at this public meeting.
