July 12, 1994
1 . Chairman Jim Routh called to Order the Randolph County
Planning Board meeting at 7 : 00 p.m.
2 . Hal Johnson, Planning Director, called roll of Members : Jim
Routh, Chairman, present; Aweilda Williams, Vice Chairman,
absent; Tim Poole, absent; Lynden Craven, present; Charles
Adams, present; Bill Dorsett, present; Phil Brower, absent;
and Maxton McDowell, Alternate, present.
3. Bill Dorsett made the motion, seconded by Maxton McDowell , to
approve the Minutes of the June 7 , 1994 Planning Board and
Board of Adjustment meeting. The motion passed unanimously.
4 . REQUESTS FOR REZONING:
A: MICHAEL BRIAN ALLMON, Asheboro, North Carolina, is
requesting that . 50 acres located on SR 1142 (Hopewell
Friends Road) , Cedar Grove Township, be rezoned from
Residential Restricted to Residential Agricultural/
Conditional Use . Zoning Map #7639 . It is to allow the
applicant to place a mobile home on the property.
Allmon was present and explained that his parents have
lived on this property for 23 years and he wants to
located a mobile home on the property. Allmon presented
a list of signatures of people who live in the
subdivision with no objections to this development.
There was no one present in opposition.
Lynden Craven made the motion, seconded by Charles Adams ,
to recommend that this request be approved. The motion
passed unanimously.
B: ALLEN BULLARD, Asheboro, North Carolina, is requesting
that 80 . 6 acres located on NC Hwy 42S, Asheboro Township,
be rezoned from Residential Agricultural to Residential
Restricted. Zoning Map #7770 . It is the desire of the
applicant to develop a site built subdivision of 20 lots .
Bob Luck was present to represent Bullard. Luck
described the development as similar to the adjoining
"Ken-Lee" development. Luck provided the Board with a
list of proposed restrictions .
Johnson said that the only comments he has received from
citizens are that the development should be for site
built residences . Johnson said that it was his
understanding that a portion of this property is located
in Asheboro City Extra- Territorial Zoning Jurisdiction
and which will be released to the County to allow the
development to be regulated by one governing
jurisdiction. Luck told Johnson that Reynolds Neely has
told Bullard that the jurisdiction would be transferred
to the County.
There was no one present in opposition.
Charles Adams made the motion, seconded by Bill Dorsett,
to recommend that this request be approved. The motion
passed unanimously.
C: NEAL CRAVEN, Asheboro, North Carolina, is requesting that
35 acres located on Mack Lineberry Road (north of Tom
Brown Road) , Franklinville Township, be rezoned from
Residential Agricultural to Residential Restricted.
Zoning Map #7785 . It is the desire of the applicant to
develop a restricted residential subdivision of 38 lots.
Craven was present and explained that the development
plan is for 38 lots but realistically there will probably
be 25 lots . Craven said the property closest to the road
has poor soils and there are two streams that cross the
property (Craven described these streams as nothing
substantial) . Craven said he would allow site built
houses or double-wide manufactured housing on brick
foundations . Craven added that the roads would be paved
and built to public road standards .
Maxton McDowell asked Craven if he owned the property.
Craven said that he did not own the property but the
property is under contract.
Janet Routh (lives diagonally across from the property) ,
Mack Lineberry Road, Franklinville, described the area as
spaced out agricultural land with very low density.
Routh said most of the property is family land and is a
rural area not an urban setting (which she feels this
development implies) . Routh spoke of poor soils (perking
problems) , over-crowding of the schools , law enforcement
(patrolling) , traffic concerns , property values being
effected, and tax rate being effected. Routh said it is
the belief of the existing property owners that this
request would totally change the lifestyle and character
of their community.
Susan Moore (property surrounded by this development) ,
Mack Lineberry Road, Franklinville, said she felt this
proposed development would have a negative effect the
quality of life and integrity of her community. Moore
spoke of environmental concerns , traffic hazards ,
children' s safety, water contamination, and privacy
concerns for her family. Moore presented the Board with
a petition of 70 signatures from people the community
opposed to this development.
There were 37 people present in opposition to this
request.
Jonathan Little, Mack Lineberry Road, said he would be
opposed to any development with lot sizes less than 5
acres.
Odell Routh, NC Hwy 22N, spoke of the 1940 ' s when he
plowed the fields (that were on this property at that
time) on this property and watered his horses from the
springs on the property. Routh said the soils were very
poor and would not perk.
Maxton McDowell questioned if there were other
subdivisions (like this request) in the area. Johnson
answered no.
Lynden Craven said he would have a problem locating a
subdivision (of this density) in this rural area of
Randolph County. Craven said this was the reason for
Countywide zoning in 1987 . Craven said he would feel
comfortable approving a development with 3 to 5 acre lot
sizes because it would be more compatible to the area.
For this reason Craven recommended that this request be
denied. Charles Adams seconded this motion and the
motion passed unanimously.
5 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are about to
give is the truth, the whole truth, and nothing but the truth,
so help you God. "
6 people took this Oath.
7 . SPECIAL USE PERMIT REQUESTS:
A: MICHAEL KEITH MARSH, Sophia, North Carolina, is
requesting a Special Use Permit to obtain a dealer' s
license and operation a sales lot of around 4 cars at his
residence located on 2 . 20 acres, at 4243 Mt. Gilead
Church Road, Tabernacle Township, Zoning Map #7715 ,
Zoning District RA.
Marsh was present and explained his intentions of this
activity being a side job. Marsh said hopefully he would
be able to move the business from this location in a year
or so.
Thomas Price, adjoining property owner, said he was
concerned of where the cars would be parked. Marsh said
he would be reasonable and work this out with the Prices .
Marsh said he would not have junk vehicles on the
property for the business . He currently has 2 junk
trucks for personal use . Marsh added that he would
recycle the fluids (oils ,etc . ) at his current place of
employment.
Price spoke of concerns of people coming to his house
enquiring about the cars for sell since Marsh is rarely
at home. Marsh said he would post signs on the cars to
contact him by phone if he is not at the residence.
Price said he would be satisfied by these efforts .
Charles Adams made the motion, seconded by Lynden Craven,
to approve this request for a Special Use Permit. The
motion passed unanimously.
B: BOBBY MCDOWELL, Randleman, North Carolina, is requesting
a Special Use Permit to operate an auto repair shop in an
existing carport at his residence located on 8 . 90 acres,
at 1263 Jennings Road, Franklinville Township, Zoning Map
#7783, Zoning District RA.
McDowell was present and explained that he has lived at
this residence for 20 years and has discussed this
request with his neighbors (who have had no opposition) .
McDowell said this would be his full-time job, he will
operate from 8-6 with no Sunday work. McDowell said he
disposes of his oils at Advance Auto and would be willing
to park the cars around back (when not being worked on)
of his house.
There was no one present in opposition to this request.
Lynden Craven made the motion, seconded by Maxton
McDowell, that this request for a Special Use Permit be
approved with the restriction that the cars be parked in
the rear of the residence. The motion passed
unanimously.
C: DAVID DOBBINS, Asheboro, North Carolina, is requesting a
Special Use Permit to operate an archery shop shop in a
12 ' x 24 ' existing building at his residence located on
1 . 42 acres at 703 Neely Road, Cedar Grove Township,
Zoning Map #7740 , Zoning District RA.
Dobbins said he has hunted and shot in tournaments all of
his life and would like to operate this small 1-man
archery business . Dobbins said he has lived at this site
for 9 years and would place a small sign on the
property. Dobbins added that there would not be an
archery range at the site .
No one was present in opposition to this request.
When asked what Dobbins would name the business he
answered either "R & D" or "Dobbinhood" .
Bill Dorsett made the motion, seconded by Charles Adams,
that this request be approved. The motion passed
unanimously.
7 . SUBDIVISION:
Cable Creek Hills , Section 3 - SR 1320 (Cable Creek Road) ,
Cedar Grove Township, Zoning Map #7730, Zoning District RA.
Site Built Development.
Johnson said that the preliminary plat for this development
was approved around 1987 and for this reason, this proposed
plat would need to be approved by the Board.
Bob Luck (representing Allen Bullard - Developer) was present
and explained that the development would be for site built
homes (as is in the 2 existing sections) with larger lot sizes
than the older sections.
Lynden Craven made the motion, seconded by Maxton McDowell, to
approved this subdivision. The motion passed unanimously.
8 . The meeting adjourned at 7 : 47 p.m.
