1779 August 2, 1994
1 . Chairman Jim Routh called to Order the Randolph County Planning
Board Meeting at 7 : 00 p.m.
2 . Hal Johnson, Planning Director, called roll of the Members : Jim
Routh, Chairman, present; Aweilda Williams, Vice Chairman,
present; Tim Poole, present; Lynden Craven, presnt; Charles
Adams , present; Bill Dorsett, present; Phil Brower, present; and
Maxton McDowell, Alternate, absent.
3 . Charles Adams made the motion, seconded by Lynden Craven, to
approve the Minutes of the Randolph County Planning Board
Meeting on July 12 , 1994 . The motion passed.
4 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are about to
give is the truth, the whole truth, and nothing but the truth,
so help you God. "
2 citizens took this Oath.
5 . SPECIAL USE PERMIT REQUESTS:
A: MONNIE MILLER, Staley, North Carolina, is requesting a
Special Use Permit to operate a greenhouse business at his
residence located on 3 . 30 acres at 6115 Whites Chapel Road,
Columbia Township, Zoning Map #8714, Zoning District RR.
Miller was present and explained his intentions of
developing a greenhouse/nursery business. Miller said he
would construct 2 35 'x96 ' buildings and also have some
shade sheds . The nursery will be retail sales and Miller
will provide a private drive to the business .
There was no one present in opposition.
Lynden Craven made the motion, seconded by Bill Dorsett, to
approve this request for a Special Use Permit. The motion
passed unanimously.
B: GORDON MCCULLEN, Trinity, North Carolina, is requesting a
Special Use Permit to allow an additional commercial
business (car sales lot) to the Circle 'J' convenience
store property. Location: 4829 NC Hwy 62 , Trinity
Township, Zoning Map #6797 , Zoning District HC. Property
Owner: Carrie C. Simmons .
McCullen was present and explained that his business would
face Unity Street (not Hwy 62 like the store does) and he
would use an existing mobile unit for an office. McCullen
said there would be 16 to 20 cars for sale on the property
and he would employ one additional person.
Bill Dorsett asked McCullen if he would be working on any
of the vehicles at this site . McCullen said he would be
doing minor clean-up but there would be no repairs done on
site . McCullen explained that he hired out all his
mechanical work. Hal Johnson advised the Board that if
they approve this request they should place restrictions on
the permit not to allow repair of vehicles on site because
this type operation would be detrimental to the area.
Dorsett asked McCullen if he owned the additional
businesses on this site. McCullen said Ron Smith was the
owner of the store and grill.
There was no one present in opposition to this request.
Charles Adams made the motion, seconded by Lynden Craven,
that this request be approved with the restriction that no
repair work of vehicles be done on this site . The motion
passed unanimously.
6 . REZONING REQUESTS:
A: BOBBY G. EARNHARDT, JR. , Asheboro, North Carolina, is
requesting that 53 .43 acres located on Hoover Hill Road,
Tabernacle Township, be rezoned from Residential
Agricultural to Residential Restricted. Zoning Map #7715 .
It is the desire of the applicant to develop a 55 lot
restricted residential subdivision.
Bobby Earnhardt was not present at the meeting but was
represented by his surveyor, Jim Stevens, Jamestown
Engineering. Stevens said the average lot size was 39, 600
sq. ft. and the roads will be built to State Standards.
Johnson asked Stevens if there were any designated wetlands
on this property. Stevens said he did not think so, but
that was not his expertise. Craven added that the Soil
Conservation Office defined wetlands as an area of land
that is under water for more than 21 consecutive days .
Dorsett asked Stevens if this property would be served by a
public water supply. Stevens answered that it would be
serviced by at 6" water line on Hoover Hill Road owned by
Davidson Water, Inc .
Linda Brown, adjoining property owner, asked why the
current zoning is not sufficient to develop this
subdivision. Johnson answered that County Zoning requires
that major subdivisions (more than 5 lots) be zoned to
assure that the type of housing, planned for the
development, is consistent with the community. Brown asked
what would happen if she decided to develop her property
with cattle or chicken houses . Johnson explained that
currently the State doesn' t allow County Zoning
Jurisdictions to regulate agricultural uses, so this type
of activity would be allowed in any county zoning district.
Brown asked if this property was located in a watershed?
Stevens answered that a small portion of lots 2 through 10
is located in a watershed and for this reason he surveyed
these lots to be at least 40 , 000 sq. ft.
Brown said she didn' t care what her neighbors did with
their property, she just objects to the property being
rezoning. Brown made it clear that she is opposed to any
type zoning regulations in Randolph County.
There were 2 people present in opposition.
Bill Dorsett made the motion, seconded by Aweilda Williams ,
to recommend to the Commissioners that this request be
approved as consistent with land use patterns in the area.
The motion passed unanimously.
B: HAROLD BROWER, Staley, North Carolina, is requesting that
8 . 37 acres (731 ' x 500 ' ) from a 20 . 30 acre tract located at
2530 NC Hwy 49N, Columbia Township, be rezoned from
Residential Agricultural & Highway Commercial/Conditional
Use to Highway Commercial. Zoning Map #8713 . It is the
desire of the applicant to use the property for commercial
development.
Brower was not present for this meeting.
Hoover Lednum, adjoining property owner, said he was
present for the first rezoning of this property and was
told the site would be used to construct a building for
auto parts sales with no outside storage and no auto repair
work. Lednum said Brower has a sign up now that says
"sales & service" and he is servicing cars, painting
tractors , working on lawn mowers and farm equipment, and
building storage buildings on this property. Lednum said
less than 3 months after his property was rezoning for the
parts business Brower built another building with a pit and
lift to work on cars and buried and underground storage
tank. Lednum said Brower has no respect or concern for his
neighbors and could care less what his neighbors think.
Lednum spoke of all the dumping of demolition waste
(building materials, etc. ) and how he is filling in the
property. Lednum said he did not see why Brower would be
asking for a rezoning because he has already declared the
property rezoned.
James Connor, adjoining property owner, said he felt
Brower should have gotten this zoning cleared up before he
started anything else. Connor said Brower seems to be able
to do what ever he wants without any thought of the
Community.
Lednum said he felt if the County approved this request
they would just be "rubber stamping" what Brower has all
ready done.
Bill Dorsett said if he extending his operation (further
down the property) he would be encroaching upon the church.
Dorsett said that so many times we have seen people out of
compliance with zoning come in to compliance by making an
effort to work with the neighbors in the Community and work
with the County. Dorsett said this case seems that Brower
just plain disregards any regulations .
Tim Poole made the motion, seconded by Lynden Craven, to
recommend to the Commissioners that this request be denied.
The motion passed unanimously.
7 . The meeting adjourned at 7 : 45 p.m. There were 8 citizens
present for this meeting.
