RANDOLPH COUNTY ZONING BOARD OF ADJUSTMENT
October 4, 1994
1 . Chairman Jim Routh called to Order the Randolph County
Zoning Board of Adjustment meeting.
2 . Hal Johnson, Planning Director, called roll of the
Members : Jim Routh, Chairman, present; Aweilda
Williams, Vice Chairman, present; Tim Poole, present;
Lynden Craven, present; Charles Adams, absent; Bill
Dorsett, present; Phil Brower, absent; and Maxton
McDowell, Alternate, present.
3 . Approval of the Minutes of the September 13 , 1994
Randolph County Zoning Board of Adjustment meeting.
The Board accepted the Minutes as written. Chairman
Routh announced the minutes stand approved.
4 . Swearing in of the Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you God. "
�-' 6 people took the Oath.
5 . VARIANCES:
A: CLIFFORD GILPIN, Sophia, North Carolina, is
requesting a Variance to allow a second mobile
home on 9 . 37 acre tract (without State Road
Frontage) in lieu of the required 5 acre tract
size per residence located on a private road.
Location: Kivett Lakes Subdivision Section 6 lot
2; at end of Twinleaf Drive; 9 . 37 acres; Zoning
Map #7733; Zoning District RA.
**Arguments for Granting the Request
Gilpin was present and explained that he wanted to
allow a man and his family to move on to the
property to give them a break.
**Arguments Against Granting the Request
Everette Kickler, Jr. , 2163 Twinleaf Drive, said
that he has turned and 'drug' the road (maintained
the road) be himself. Kickler said that Gilpin
has talked about purchasing gravel but has yet to
assist in the maintain/gravel purchase . Kickler
said that there is no road maintenance agreement
and for this reason he is opposed to another
residence being added to the road. Kickler said
he would like to see a road agreement drawn up
prior to any more residences being added.
**Board Discussion: Conclusions Based on Findings
of Fact
Bill Dorsett said he did not see any hardship to
allow this Board to approve this request.
**Order of the Board of Adjustment
Bill Dorsett made the motion, seconded by Tim
Poole, to deny this request for a Variance. The
motion passed unanimously.
B: WILLIAM SISK, Liberty, North Carolina, is
requesting a Variance to allow a second residence
on 7 . 76 acre tract (without State Road Frontage)
in lieu of the required 5 acre tract size per
residence located on a private road. Location:
Poplar Hollow Farms Phase 1 lot 20; 3767 Hollow
Tree Drive; Liberty Township; Zoning Map #8706;
Zoning District RA.
**Arguments for Granting the Request
Sisk explained his intentions to put a new double
wide mobile home in the rear of his residence for
his step-daughter and her children to live in.
Sisk said that he wanted to give his daughter the
opportunity to get out of a rental agreement and
have a nicer place to live. Sisk said the
property will not be subdivided, it will remain a
7 . 76 acre . Sisk added that the private deed
restrictions allows a second residence on the
tract.
**Arguments Against Granting the Request
There was no one present in opposition to this
request.
**Board Discussion: Conclusions Based on Findings
of Fact
1 . The Board fet that a hardship was not a result
of the applicant' s own doing.
2 . The Board found that this variance would not
violate the intent of the County Ordinance.
3 . The Board found that the use will not
substantially injure the value of adjoining or
abutting property.
**Order of the Board of Adjustment
Bill Dorsett made the motion, seconded by Lynden
Craven, to approve this request for a Variance.
The motion passed unanimously.
6 . The meeting adjourned. Approximately 8 people were
present for this Board of Adjustment meeting.
