Chairman Jim Routh called to Order the Randolph County Planning Board meeting at 7 : 00 p.m. 2. Hal Johnson, Planning Director, called roll of the Members: Jim Routh, Chairman, present; Aweilda Williams, Vice Chairperson, present; Tim Poole, present; Lynden Craven, present; Charles Adams, absent; Bill Dorsett, present; Phil Brower, absent; and Maxton McDowell, Alternate, present. 3. Approval of the Minutes of the September 13, 1994 Randolph County Planning Board Meeting. The Board accepted the minutes as written. Chairman Routh announced the minutes stand approved. 4 . REQUESTS FOR PROPERTY REZONING: A: NEAL CRAVEN, Asheboro, North Carolina, is requesting that 110 . 40 acres located on Hopewell Friends Road (beside Southwest Randolph High School) , Cedar Grove Township, be rezoned from Residential Agricultural to Residential �' Restricted. Zoning Map #7648 . It is the desire of the applicant to develop a restricted residential subdivision of 48 lots. Craven was present and explained that the minimum lot size would be 1 acre in size and all the roads would be built to State Standards . Craven said the houses would be site built with minimum heated square footage of 1200 or 1400 . Craven said there would be no manufactured homes. Harry Van Daniel, 2474 Scott Mountain Road, (teacher at SWRHS) discussed concerns of traffic hazards/confusion the additional vehicles would cause on Hopewell Friends Road. Daniel spoke of the environmental concerns of this many new septic systems being added in this community where there is a heavy clay base soil . Daniel asked what would this do to the water quality. Daniel discussed population density and stated that this would totally change the character of this area. Terry Breitkreutz, 2520 Scott Mountain Road, stated that the current zoning is appropriate for this parcel of land. Breitkreutz said this is a rural area that is all ready burdened by heavy traffic (due to the schools) . Breitkreutz said that this type development is not compatible with the current suburban lifestyle of this area and would infringe on their quality of life. Breitkreutz added that she felt changing the density level of this community would be detrimental to property values. 34 people were present in opposition to this request. Bob Bigler, 2455 Scott Mountain Road, said that the show of hands (of people in opposition) express the large number of people concerned with this request. Lynden Craven made the motion, seconded by Tim Poole , to recommend that the Commissioners deny this request for the following concerns expressed: **density (over crowding) **traffic concerns **schools **not compatible with the adjoining lot sizes (approximately lot sizes of adjoining properties - 5+ acres) Jim Routh noticed that Worth Hatley, Randolph County Schools Superintendent, was in attendance and asked Hatley to explain traffic concerns at the schools . Hatley said that NCDOT has put turning lanes at the schools (after the construction of the middle school) which did help. Hatley noted that 70% of the students at the high school drive to school and 35% of the parents at the middle school bring their children to school as well as 25 buses. Hatley said the School Board requested that NCDOT widen the road but DOT denied this request. Hatley said that he did not feel it was the place of the School System to express an opinion of subdivisions being developed, that it was the schools responsibility to provide the education facilities for Randolph County citizens ' children. Hatley said that he could provide information to the Board concerning capacity levels of each school. Hatley said Southwest Randolph High School is currently operating at 105% capacity and Southwest Randolph Middle School is operating at 99% capacity. Aweilda Williams asked Hatley if the School Board had considered/ tried to purchase any of this property (due to the fact that this would be the only property for the schools to expand upon) . Hatley said the School Board can not speculate on future growth by purchasing additional land. Hatley said that this facility is the most crowded in this Randolph County School System. Neal Craven told the Board that it is a known fact that the schools are built too small in the beginning, but because of the opposition he would withdraw this request. B: MALCOLM MIZE, Asheboro, North Carolina, is requesting that 8 . 37 acres located just off SR 1004 on Back Creek Road (SR 1420) , Back Creek Township, be rezoned from Residential Agricultural to Residential Restricted. Zoning Map #7732 . It is the desire of the applicant to develop a restricted residential subdivision of 6 lots . Mize was present and explained his intentions of developing a subdivision to allow site built residences that would front on Back Creek Road. Hal Johnson asked Mize if he was aware, prior to their conversation earlier in the week, of the private covenants that may affect this property. Mize said no. Johnson explained that those restrictions are more restrictive than the County Zoning Laws . Johnson said these restrictions would require homes to have setbacks of - 75 ' in the front and 20 ' on the side. The restrictions also require the homes to be a minimum of 1200 sq. ft. in heated living space. Aweilda Williams asked Mize if he was selling the lots vacant or with homes . Mize said that his son would build the homes and then they would be sold. Mize said the Health Department has approved 5 preliminary sites (a few years ago) . Mize added that there would not be any manufactured homes . Kay Medlin, 1051 Back Creek Road, was present and stated that this area is quiet with large homesites (acreage) . Medlin said she would be concerned of this congestion being added to the road and she questioned if the property would perk. Medlin added that she was not opposed to the houses but was opposed to this many homes . Fred Davis, 1039 Back Creek Road, said he had no objections to building houses here but was opposed to this number of homes . Davis also expressed concerns for drainage running into the creek at the rear of the property. Writsell Smith, Back Creek Road, gave the Board a copy of the private deed restrictions for properties on this road and explained his concerns of Mize not abiding by these restrictions . Tony Hill, 1170 Back Creek Road, expressed concerns of topographical problems with the land, congestion added to the road, and what this would do to the neighborhood. There were 8 people present in opposition to the request. Aweilda Williams said that being a resident of this road she understood the concerns of the adjoining property owners . Williams said that Mize could develop 5 lots without having the property rezoned and this would allow the lots to be larger. Williams said the concerns of perking are valid but not with the Planning Board, this would be a concern of the Health Department. Williams made the motion to deny this request for rezoning. Lynden Craven seconded the motion and the motion passed unanimously. Hal Johnson told Mize that his request has been denied for 6 lots but he could develop a minor subdivision of 5 lots . C: HAROLD BROWER, Staley, North Carolina, is requesting that 8 . 37 acres (731 'x500 ' ) located at 2530 NC Hwy 49N, Columbia Township, be rezoned from Residential Agricultural/Highway Commercial-Conditional Use to Highway Commercial- Conditional Use . Zoning Map #8713 . It is the desire of the applicant to operate a planned business development. Johnson explained that two months ago this request can as a general use request and the Board recommended to the Commissioners this request be denied. At the Commissioners ' meeting the Commissioners felt that perhaps a Conditional Use zoning would be more favorable and asked that the request be reviewed again by the Planning Board. Brower explained that he wanted to do wood work (such as accessory buildings , swings, etc. ) with this son at this location. Dorsett expressed his concerns of the entire road frontage (of this tract) being zoned. Dorsett said that this would allow commercial activity too close to a neighboring church and residential properties . Brower said he would be willing to drop the 300 ' of road frontage next to the residential properties. Ricky Brower (Brower ' s son) said that he adjoins the property to the north and would have no problems with the rezoning. William Lednum, adjoining property owner, said that he has been up here 3 times for this request. Lednum said that the County visited Brower and found him to be out of compliance and that is the reason for this zoning request. Lednum said it appears that once Brower gets started he just keeps on going and doesn' t stop. Lednum reminded the Board that zoning is also to protect the adjoining land owners . Lynden Craven made the motion that the Board recommend to the Commissioners that this request be approved for wood working (not just a unified business development) and that the 300 ft. (to the north) of road frontage be a buffer zone . Maxton McDowell seconded the motion and the motion passed. D: GILBERT DAVIS, Randleman, North Carolina, is requesting that 7 acres located on Gilbert Davis Drive (off SR 1926) , New Market Township, be rezoned from Residential Agricultural to Residential Mixed/Conditional Use . Zoning Map #7747 . It is the desire of the applicant to develop a 7 space mobile home park (2 existing spaces and 5 new spaces) . Davis was present and explained his intentions for the mobile home park. Robert Riffle, 5952 Gilbert Davis Road, said that he and 13 other people use this drive as an access to their homes. Riffle questioned the maintenance of the road. Johnson said that the road would be brought up to 45 ' right of way with 18 ft of gravel road, and 4" base as required by the mobile home park regulations . Riffle said he would have no problem with the zoning if the road was built to handle the additional traffic . Lynden Craven made the motion, seconded by Maxton McDowell , to recommend to the Commissioners that this request be approved. The motion passed unanimously. �•.- E: HARRIS BROWN, Sophia, North Carolina, is requesting that 5 acres located on Hwy 311 (north of SR 1946) , New Market Township, be rezoned from Residential Agricultural to Light Industrial. Zoning Map #7736 . It is the desire of the applicant to use the property for industrial purposes . Brown said he would construct a building 16 , 000 to 20 , 000 sq. ft. for a masstransit seat business . Brown said his business is currently at 6825 US Hwy 311 but they need more room. Brown said the building would be used for manufacturing and warehousing. Brown said the entire business would relocate here with 7 employees. Dorsett asked about landscaping and building type. Brown said he plans to landscape the grounds , have a paved drive to the business , and the building would be metal with a brick front. There was no one present in opposition. Dorsett said he would be in favor of any development to upgrade Hwy 311 . Bill Dorsett made the motion, seconded by Aweilda Williams , to recommend to the Commissioners this request be approved. The motion passed unanimously. 5 . Swearing in of the Witnesses: "Do you swear or affirm that the information you are about to give is the truth, the whole truth, and nothing but the truth, so help you God. " There were 13 people to take the Oath. 6 . SPECIAL USE PERMIT REQUESTS: A: MARTY CRAVEN, Sophia, North Carolina, is requesting a Special Use Permit to operate a "turkey shoot" at his residence located at 2768 Old County Farm Road on 21 . 66 acres, Back Creek Township, Zoning Map #7743 , Zoning District RA. Hal Johnson stated that the Planning Board considered this request at their last meeting and postponed making a decision until this meeting. Craven showed the Board pictures of the shooting range and said there would be 4 people supervising the operation. Craven said he would only operate on Friday & Saturday nights from 6 : 30 p.m. to 10 : 30 p.m. from September through February. Bill Dorsett questioned if this permit would be for one year or from now on. Dorsett expressed his concerns if this area ' s density level changed. Johnson explained that if this did happen the Board could reconsider and withdraw the permit. Greg Robbins, Bonkemeyer Drive, said Craven runs a clean turkey shoot. Clifford Gilpin, 2130 Twinleaf Drive (Kivett Lakes Subdivision) , said Craven operates a nice place with no hassles . Gilpin said it is a family oriented business. Kay Medlin, owner of Mountain Road Market, said the Craven' s asked to leave a petition (in favor of the request) at her store for signatures . Medlin said that within one day the entire petition was filled. Medlin said her customers expressed good feelings about the operation and a huge majority of the neighborhood is in a favor of the business . David McCracken, Kivett Lakes Subdivision, spoken in opposition and presented a petition to the Board. McCracken said he spoke at the last meeting and he would not take up unnecessary time at this meeting. McCracken did add that the area did not need the added commercial traffic. Jerana Craven spoke and said there was not anything her or her husband could do about the roads (that was the job of DOT) , but that she had contacted DOT and was told the additional 10 to 20 cars would not affect the traffic flow of this road. Ralph Evans, Kivett Lakes Subdivision, said the Cravens shoot any time, not just 2 days a week and sometimes as late as 11 or 12 p.m. Chris McCracken said there is no way to have total control of this type of business . Bill Dorsett asked Craven the distance between the targets and the back property line. Craven answered around 800 feet. Dorsett asked Craven if he would be willing to post the back property line with no warning signs , Craven answered yes . Dorsett said he has worked at a "turkey shoot" before and stated that you do have control over these shooting ranges . Dorsett said he felt it was better to have a central place for people to shoot instead of people shooting anywhere. Tim Poole made the motion, seconded by Aweilda Williams , to approve the request for a Special Use Permit with the following restrictions : **6 : 30 p.m. - 10 : 30 p.m. **Friday & Saturday nights **September through February **only shotguns allowed The motion passed unanimously. B: DONALD & ALICE WOODS, Sophia, North Carolina, is requesting a Special Use Permit to develop 1 additional space in their existing 3 space mobile home park. Location: 1935 Groom Road, Back Creek Township, Zoning Map #7744 , Zoning District RM-CU. The Woods were present and explained their intentions to expand their park by one mobile home. Debbie Cecil, Greenwood Road, stated that when she bought her property in December 1990 she was told that there would be no more mobile homes allowed in this park. Cecil said that this is a private road maintained by only 4 out of the 7 residents on the road. Cecil said that the renters do not help with road maintenance and they abuse the road. Alice Woods said that she sees that all the lots are kept clean and a dumpster is provided for their garbage. Danny Cecil, Greenwood Road, said he picks up trash thrown out by the renters on the sides of the private road. Aweilda Williams made the motion, seconded by Maxton McDowell , to deny this request for an additional mobile home. Williams said that there are all ready 4 mobile homes on this 4 . 22 acres tract and an additional mobile home would be too much on this tract. The motion passed by a 5 to 1 vote . Bill Dorsett voted against the motion. 7 . AMENDMENT TO THE UNIFIED DEVELOPMENT ORDINANCE: Adoption of New Federal Flood Hazard Regulations Johnson explained that Randolph County regulates development in Flood Hazard Areas by not allowing any development. Johnson said that their have been revisions made, by the Federal Government, to the Flood Hazard Ordinances that Randolph County need to adopt. Johnson described these changes as only minor work changes to allow the ordinance to treat mobile homes the same as site built homes are treated. Lynden Craven made the motion, seconded by Maxton McDowell, to recommend to the Commissioners these amendments be adopted. The motion passed unanimously. 8 .
