November 15, 1994
1 . Chairman Jim Routh called to Order the Randolph County
Planning Board meeting at 7: 00 p.m.
2. Roll call of members: Jim Routh, Chairman, present;
Aweilda Williams, Vice Chairperson, present; Tim Poole,
absent; Lynden Craven, present; Charles Adams, present;
Bill Dorsett, present; Phil Brower, present; and Maxton
McDowell, Alternate, present (substituting for regular
member Tim Poole.
3. Phil Brower made the motion, seconded by Lynden Craven,
to approve the Minutes of the October 4, 1994, Randolph
County Planning Board meeting. The motion passed.
4. Swearing in of Witnesses:
"Do you swear or affirm that the information you are
about to give is the truth, the whole truth, and
nothing but the truth, so help you, God. "
43 citizens took this Oath.
5. REQUESTS FOR A SPECIAL USE PERMIT:
A: CLIFTON KINDLEY, Archdale, North Carolina, is
requesting a Special Use Permit to construct a
storage building (40 x 70) for classic cars at his
residence. Location: 1684 Greendale Road
Extension; 1 . 30 acres; Zoning Map #7747; Zoning
District RA.
Kindley was present and explained that he owned at
' 58 truck, ' 67 Camaro, and ' 55 Chevy. Kindley
said he collects these type classic vehicles for a
hobby and would be using the building to store
these vehicles. Kindley added that he has an
existing garage that he uses to restore the cars.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by Charles
Adams , to approve this request for a Special Use
Permit. The motion passed unanimously.
B: DIAL CALL INC. , Atlanta, Georgia, is requesting a
�.. Special Use Permit to located a cellular phone
tower. Location: corner of SR 1131/Hwy 64; 3 . 70
acres; Zoning Map #7702; Zoning District RA.
Jerry Martin, representative for Dial Call,
explained that this would be a part of a mobile
telephone project (one other location was approved
for a tower earlier this year) .
Johnson asked Martin if his company has preformed
any impact study to determine what effect it would.
have on the surrounding structures (church 400 '
away and nearby residences) . Martin said no but
that the 350 ' tower would be self supporting (with
no guide wires) .
Carlene Johnson, neighboring resident, expressed
concerns of electro-fields and quoted an article
from "Popular Science" magazine saying there was
no information to determine that these towers are
safe. Johnson also expressed concerns of the
tower being located so close to the church.
Bernice Myers, neighboring resident, expressed
concerns from the church of this tower being
located on this site .
Norm Zimmerman, neighboring resident, was opposed
on aesthetic grounds. Zimmerman said this is a
nice rural agricultural community and this tower
would be an eyesore.
7 citizens were present in opposition to this
request.
Martin said that all studies done recently have
produced no evidence to prove there are any
dangers with these towers . Martin said this tower
is only 100 watts per channel , which is less than
in most homes (through microwaves , etc . ) . Martin
added:
*no hazard to the church
*necessary to provide communication services
*will allow county/municipal agencies to locate
emergency radio services on the tower
Hal Johnson, Planning Director, said that there
are valid concerns of the tower being located so
closely to a "settled" area (residences and
church) . Johnson said it appears that a more
compatible location could be found in the area.
Aweilda Williams made the motion, seconded by Bill
Dorsett, to deny this location. The motion passed
unanimously.
C: DAVID HORN, Archdale, North Carolina, is
requesting a Special Use Permit to operate a frame
shop in an existing building 40 x 30 . Location:
6405 Canter Road; 1 . 50 acres; Zoning Map #7738;
Zoning District RA.
Hohn explained his intents to expand his part-time
business (which he has been operating for about a
year) at his residence to more full-time work.
There was no one present in opposition to this
request.
Lynden Craven made the motion, seconded by Charles
Adams, to approve this request for a Special Use
Permit. The motion passed unanimously.
D: RICHARD COMER, Asheboro, North Carolina, is
requesting a Special Use Permit to operate an
automotive repair shop from an existing building
at his residence located at 5522 US Hwy 220S, 3 . 30
acres; Richland Township; Zoning Map #7657; Zoning
District RA.
Comer explained his desire to operate a part-time
business , with no employees, to change oil and
some brake work. Comer' s operating hours would be
from 8 : 30 a.m. - 1 : 00 p.m. Comer added that Pugh
Oil Company would come by and pick-up excess oil.
There was no one present in opposition to this
request.
Charles Adams made the motion, seconded by Phil
Brower, to approve this request for a Special Use
Permit. The motion passed unanimously.
E: HOWARD BOLING, Archdale, North Carolina, is
requesting a Special Use Permit to operate a
"turkey shoot" on the property with a residence
and auto parts business . Location: 26 . 50 acres;
5555 NC Hwy 62; Zoning Map #6797; Zoning District
RA.
Boling was not present at the beginning of the
meeting.
There were 35 citizens present in opposition to
this request.
Mike Eckstrom, Colonial Circle, Trinity, expressed
concerns of the danger of guns being fired in such
a high density area and also the noise this would
create. Eckstrom stated that Boling' s past
performance with his neighbors has been poor and
feels this would not be the type of business he
should be allowed to operate.
Dustin Lankston, Collett Farm Road, Trinity,
questioned the Board of the large number of tires
stored on this property. Lankston added that
there are several drums labeled High Point
Chemical that have liquids stored inside.
Ralph Collett, Collett Farm Road, Trinity,
questioned why Boling has been allowed to have a
huge pile of household garbage on his property for
the last two years. Collett said this garbage has
created a rodent problem for the community.
Collett said there are enough problems (in the
community) without a "turkey shoot" .
Terry Reddick expressed concerns for the creek
that adjoins the property. Reddick said his cows
drink from this water source and with all the
garbage, chemicals, and junk stored on the
property this could be a problem.
Boling entered the meeting.
Boling explained that he has 60 acres that is
approximately 1200 ft. from this subdivision and
the closest house would be the Kennedy house
(400 ' ) and Hwy 62 is approximately 400 ' from the
site. Boling said the shooters would be in an
insulated building using #9 birdshot. Boling
discussed the fact that his home was burned in
1991 and this past Sunday his camper, carshed, and
building was set on fire. Boling said that the
tires were dumped on his property but were not
part of his operation. Boling added that the
garbage was also dumped by a Davidson County
resident without his permission.
Charles Adams said that considering the fact that
the whole community is residential in nature, this
would not be in-keeping with the area. For this
reason Adams made the motion, seconded by Lynden
Craven, to deny this request for a Special Use
Permit. The motion passed unanimously.
6 . REQUESTS FOR PROPERTY REZONING:
A: ARCHIE RICH, Asheboro, North Carolina, is
requesting that 2 . 40 acres located on Hwy 64 west
of Asheboro (just past Scenic Point Drive) ,
Tabernacle Township, be rezoned from Residential
Agricultural to Light Industrial/Conditional Use .
Zoning Map #7712 . It is the desire of the
applicant to operate a furniture manufacturing
business on the property.
Rich explained that when he purchased the land in
1973 he was told (at the auction sale of the
property) that he could operate a commercial
business on the property. Rich said he would
probably locate a warehouse there first and then
possibly use the building for manufacturing
purposes (15 employees) .
Brenda Perdue, adjoining property owner, said this
area has always been residential (she has lived
her for 20+ years) and added that the property
would allow a church or school (through private
deed restrictions) but not a business. Perdue
said that Rich has enough property at his existing
location to build another warehouse. Perdue added
that she is not against Rich but doesn't won' t to
see this residential area become commercial.
John Spangler, Scenic Point Drive, said he bought
land one lot down and was told it was a restricted
development. Spangler asked if he could locate a
mobile home on the lot temporarily until the house
construction was completed; they were told no.
Phyllis Haithcox, Scenic Point Drive, said she
thought the property was restricted (Haithcox has
owned her property since 1970) .
Betty Causy, neighboring property owner, said she
would like to see the area remain residential.
Kenneth Fields & Robert Chester, neighboring
residents, expressed concerns for road maintenance
(on Scenic Point Drive - a private road) and the
added traffic to the area.
Michelle Spangler said she felt this development
would devalue the adjoining properties.
Rich said the only traffic to this business would
use Hwy 64 not Scenic Point Drive.
Bill Dorsett said that he was sympathetic with
Rich but everyone (in Randolph County) had the
opportunity to see that their property was zoned
to their liking in the beginning (in 1987 when
zoning came into effect) .
Aweilda Williams made the motion, seconded by
Charles Adams , to recommend to the Commissioners
that this request be denied. The Board noted that
this would be incompatible to the area.
B: NEAL CRAVEN, Asheboro, North Carolina, is
requesting that 25. 90 acres located on Staley' s
Farm Road (SR 2839) , Grant Township, be rezoned
from Residential Agricultural to Residential
Mixed. Zoning Map #7668 . It is the desire of the
applicant to develop a 16 lot subdivision for
mobile homes (1984 or newer models) . Property
Owner: Honora Glover Brown.
Craven was present and explained that this area is
developed with several mobile home subdivisions.
James Auman was present and stated that this would
be consistent to the mobile home community.
Cain Jones, President Farlow Lake Homeowners
Association, expressed concerns of the added
traffic to Staley Farm Road.
Lynden Craven made the motion, seconded by Aweilda
Williams , to recommend to the Commissioners that
this request be approve as consistent with the
Land Development Plan. The motion passed
unanimously.
7. The meeting adjourned at 8 : 00 p.m. There were 78
citizens present for this meeting.
